saintokwuluora: PDP is not petitioning based on whether he restrained Obaseki or not but on the fact that the court does not have jurisdiction to entertain the matter in the first place, based on which the judge would have returned it to the chief judge of the federal high court for it to be reassigned to either the federal high court Abuja or Benin which have jurisdiction to hear the matter. The matter will either struck out or reassigned on Thursday on grounds of jurisdiction. This is despite the fact he did not restrain Obaseki from contesting. Federal High Court has jurisdiction everywhere. |

Driven by his desperation, and banking on a corrupt deal with ‘godfathers’ to force other aspirants into submission, Godwin Obaseki, without any sense of shame, and removing all doubts on his politics of no principles, chanted ‘Power to the People’ in a room packed to the brim at the Secretariat of the PDP. No one is deceived, this is a marriage of convenience made possible by circumstances. It is the union of a party willing to dip its tongue into a bowl of its own vomit and open its doors to a man it accused and dragged before a court for forging academic certificates and declared unworthy for public office – and a man so blinded by desperation and love for public funds, he is willing to sacrifice what is left of his battered integrity. His shamelessness aside, also evident from the event was the open disregard of social distancing principles and the violation of the gazette signed by the Governor banning the gathering of more than 20 persons in a single location. From the grounds of the secretariat, down to the office where Obaseki, voice hoarse and shaky, announced his defection, hundreds of people gathered in tight spaces revealing the hypocrisy of the man who has reduced COVID-19 to a political tool wielded when he intends to target and punish his opponents, or is his desirous of more funds from the treasury. There are better ways the Governor could have staged his defection. He could travel, discreetly, to the secretariat of the party as he has done for days with bags of cash lodged in his trunk. But he chose a rancorous process, he mobilized and staged a mass gathering because, in his order of importance, vain display of support and popularity ranks higher than public health and well-being of the people. Any better way to illustrate other than the fact that while he remained protected, to a large degree, with a face shield, the crowd he summoned, paid, and instructed to scream his name was left exposed and possibly returning home with strains of the viral disease? Obaseki doesn’t care, has never cared, and will never do. But that is already a known fact. And he will be defeated. The remnants of his allies know, but they pretend otherwise. He is a cash-cow, led to the slaughter. For today, in front of cameras, they raise their fist in a fake display of joy. But in their hearts, they know too well that they have veered into unchartered territory, unprepared and exposed. To borrow from the popular parlance, their masquerade, deserted by its guide, has run into the expressway. They still do not know how to face the people and explain their flip-flop; neither do they have a solution to the problem that is Kenneth Imasuagbon and Ogbeide Ihama, two bonafide and cleared aspirants of the PDP who have threatened legal action. In the end, they will save themselves and abandon Obaseki to his fate. After all, only a foolish fly follows a corpse into the grave. |

The Court of Appeal in Benin has set aside the order of the Federal High Court from conducting the June 22 Governorship primary using direct mode.
The appellate court also ordered the continuation of the trial at FHC, which will hold on Friday morning brought by the suspended chairman of APC, Comrade Adams Oshiomhole on jurisdiction of the court.
On June 8, the Federal High Court presided by Justice Mohammed Umar had restrained the All Progressives Congress from conducting the June 22 governorship primary election in Edo State using direct mode.
But Justice Morenike Ogunwomiju who headed the three-man Justices set aside the order by the lower court, saying the trial judge gave a problematic order that was not sought by the parties.
In the lead judgment in the suit by APC, delivered by Justice Ogunwomiju and backed by Justice Oseji, she said: “The trial judge (Justice Umar) gave a problematic order that was not sought by the parties to the suit. As at the date (June the order was given, the political party (APC in Edo State) had 14 days to organise its governorship primary election. Every judge must be a democrat.
“The appellant (APC) was not given an opportunity to be heard by the trial court. The injunctive order of the trial court of June 8 is hereby set aside. The administrative orders subsist and the issue of jurisdiction should be determined by the trial court.”
In his dissenting judgment in the APC’s suit however, Justice Adumein declared that the injunctive order of FHC ought not to have been set aside, insisting that the appeal was interlocutory, incompetent and should be struck out.
Adumein noted that the trial court did not make any mistake in the matter, in line with Section 285, Sub-section 8 of the 1999 Constitution of the Federal Republic of Nigeria, as amended, adding that court should not decide cases based on sentiments
