TRUTH OF DR DAWARI GEORGE'S CASE AND FATE OF THE PETITIONS OF APC CANDIDATES BEFORE THE TRIBUNAL Good afternoon ladies and gentlemen. 1. This afternoon, I seek to specially communicate to the members of our great party, the All Progressives Congress ( APC) in Rivers State, members of the PDP in Rivers State, and indeed members of the general public who respect the place of truth in information dissemination. 2. Late last night, a distressing story filtered in to the effect that the tribunal hearing the petition of Dr. Dawari 1. George, House Of Representatives candidate of the APC against the purported victory of Ms Boma Goodhead of the PDP in Akuku-toru/Asari-toru Federal Constituency struck out the petition of the APC candidate. The reason the tribunal gave for its decision was that Dawari's petition was not qualified, INEC having not been mandatorily notified by his party the APC 21 days before the primaries that returned him as a candidate for the election in accordance with section 85(1) of the Electoral Act. 3. As soon as that verdict was reached, PDP overzealous vuvuzelas gleefully went to market with the toxic propaganda that the same fate awaits all the Rivers APC petitions before the various election tribunals. They claimed that the petition of our Governorship Candidate, Dr. Dakuku Peterside, those of of our other National Assembly candidates and our House of Assembly candidates would be similarly struck out. Like Philistines who don't have the fear of God, there was great rejoicing in their camp. But this piece will show that their claim was an outright concoction and toxic propaganda churned out to bamboozle members of the public, weaken the moral of APC members in Rivers State and give themselves a false sense of security. They know that their days are numbered, hence, resort to cheap propaganda, egregious report and blatant falsehood has become their stock in trade. Here are things you need to know. (a) The judgement of the tribunal against Dr Dawari George CANNOT survive the rigors of appeal. The reasons for my assertion are twofold: (i) It is not true that the APC did not notify INEC 21 days before the conduct of its primaries as mandatorily demanded by section 85(1) of the Electoral Act. As a matter of fact, through a letter dated 19th of September, 2014, and titled NOTICE OF SPECIAL CONGRESSES FOR THE NOMINATION OF CANDIDATES- 2015 GENERAL ELECTIONS written and signed by Mai Mala Buni, National Secretary of the APC, and received and acknowledged by Ibrahim K. Bawa Esq, Director Legal, INEC, the party duly notified INEC. It should be noted that there was yet another letter written on the 18th of November, 2014, in reference to the first, and titled REVISED DATE FOR THE CONDUCT OF PRIMARIES in which the party communicated to INEC revised dates for the conduct of primaries in the various positions. It was that second, which ought to reference the first letter that the tribunal acted upon, without knowing the existence of the first letter. The two letters are attached to this post. It is submitted that when the existence of the first letter is made known in the Appeal Court, the decision of the tribunal will be rightly upturned, hence, PDP's claim of victory is only pyrrhic hallucination. (ii) The Supreme Court has severally ruled that election tribunals should not concern themselves with technicalities. It is also interesting to note that the issue of period of notification is a pre-election matter that didn't concern the tribunal. It is hereby submitted that the Appeal court will have no difficulty setting aside the decision of an Election Tribunal based on the technicality of pre-election issue, and having nothing to do with the substance of the petition before it. 4. The Rivers PDP vuvuzelas also went to the market with the very toxic, irresponsible, spurious, godless, reprehensible, disgusting, annoying and crazy propaganda that Dakuku Peterside, our amiable Governorship candidate and soon-to-be Governor of Rivers State, annoyed by the ruling of the tribunal, has accused the Chairman of APC in Rivers State, Dr Davies Ikanya, of collecting bribe from the PDP and delaying the notification of dates of primaries from reaching INEC within the stipulated time. 5. It should be clearly understood that the letter of notification to INEC was written by the appropriate National organ of the APC. It did not emanate from the state chapter of our great party as the attachments to this post show. Davies Ikanya, therefore, could not, and did not write the notification. It follows that Dakuku Peterside could not have accused Davies of bribery over an act that was not performed by the state chapter of the party. 6. The said propaganda was carried out through the following dedicated PDP propaganda machinery in Rivers State: (a) SCAN NEWS - it is hereby stated that Scan News is a PDP propaganda outfit oiled to dish out concoctions, distort and fabricate stories and feed unsuspecting members of the public with falsehood. Scan News is a SCAM. Nothing from this medium should be taken seriously by those who love and cherish the truth. (b) RISING TIDE NIGERIA- this is another Wike-financed propaganda outfit created to dish falsehood about Rivers APC and faked performance of the loan-taking Governor of Rivers State. (c) RIVERS AMACHREE- the third propaganda outfit of Rivers PDP is the faceless page called Rivers AMACHREE. The operator of this page is paid to malign the character of opposition figures in Rivers State and insult BUHARI. Members of the public are hereby alerted to be wary of any news emanating from those platforms. Don't allow yourselves to be hit bellow the belt and fed on the toxic diet of propaganda cooked on those platforms. 7. Finally, let me urge members of APC in Rivers State to be strong in the face of unrelenting bestial intimidation from the Wike-led Government. The truth, crushed to the ground, would rise again. Let there be no doubt that our great party is poised to pursue, overtake and recover all that the PDP stole from us in a ruthlessly orchestrated electoral armed robbery that notoriously took place in Rivers State on 28th of March and 11th of April 2015. Continue to support the BUHARI government and always remember that our party SHALL pursue, overtake and recover all that lovers of violence and impunity stole from us. God bless you all. High Court restrains Wike from sacking 23 LG Councils in R/S The National Industrial Court of Nigeria presided over by Hon. Justice J.T. Agbadu-Fishim, holden at Yenagoa, Bayelsa State has granted an Order of Interim Injunction against the Governor of Rivers State, the Rivers State House of Assembly and the Attorney-General of Rivers State and their agents from dissolving, suspending, sacking terminating or in any manner whatsoever interfering with the tenure of office of the 23 Local Government Councils of Rivers State. The Order, in Suit No: NICN/YEN/26/2015, which was granted on Monday, 22nd June, 2015 followed a motion ex-parte and affidavit of extreme urgency filed by the 23 Local Government Council Chairmen on behalf of themselves and the 23 Local Government Councils of Rivers State. The Order also restrained the Inspector-general of Police or his agents and privies from enforcing any purported action detrimental to the existence of the 23 Chairmen and Councils in Rivers State. The Order will remain in force until the hearing and determination of the motion on notice for Interlocutory Injunction. The APC would like to recall that the Governor of Rivers State, Nyesom Wike, the Rivers State House of Assembly and the Hon. Attorney-General of the State have been hatching all manner of schemes to do away with the elected 23 local Government Councils in Rivers State. We believe that, despite the presence of a few bad eggs, the judiciary remains the last hope of the oppressed. Therefore, we hail this decision by the Yenagoa High Court as specified in the attached Order.

The Archbishop of Enugu Anglican Province, Most Rev. (Dr) Emmanuel Chukwuma, has criticised President Goodluck Jonathan for visiting some Pentecostal churches and watching Chief Femi Fani-Kayode abuse prominent Nigerians in the name of running his campaign. Chukwuma, who is also the Bishop of Enugu, told Daily Sun at the weekend that Jonathan’s sectional visits to churches could be counter-productive as the orthodox churches would pay him back for his nonchalance and continuous neglect. On the Director of Media and Publicity of the PDP Presidential Campaign Organisation, Chief Fani-Kayode, the bishop said it was shameful that Jonathan allowed him to drive his campaign even when the President knew he has a case in court. He frowned at the way Fani-Kayode was insulting prominent and elderly people, saying if he was not called to order, may affect the President adversely. He also noted that the Independent National Electoral Commission (INEC) did not do well by shifting the elections, noting that the electoral umpire should have known the security situation before fixing the dates for the elections in the beginning. Chukwuma called on INEC to follow rigidly the new dates fixed for the elections, saying the electoral body would derail the country’s democracy if it fails to abide by the new dates. “The report we got is that most Southerners have already fled from the crisis zones in the North, so INEC should allow them to vote wherever they are now. INEC should find a way of people using their PVCs anywhere they are, just like we use the ATM cards and as practised in the advanced world,” he said. |
