Supreme Court to hear appeals on Rivers’ APC’s
dispute Thursday

A seven-man panel of the Supreme Court has
scheduled hearing for Thursday (April 4) in four
appeals relating to the lingering intra-party dispute
among members of the All Progressives Congress
(APC) in Rivers State.
The four appeals, The Nation learnt, are in relation
to the some interlocutory decisions of the lower
courts on the dispute that has polarised the party
and affected the outcome of the primaries it
conducted preparatory to the 2019 general
elections.
The Justice Ibrahim Muhammad-led seven-man
panel adjourned to April 4 after addressing some
preliminary issues on the appeals on Monday.
The first of the appeals, marked: SC/ 1972019 was
filed by Magnus Abe and some others, with APC
and the Independent National Electoral
Commission (INEC) listed among the respondents.
The court granted the motion by the APC,
represented by Jibrin Okutepa (SAN) for permission
to merge the different respondents’ briefs, earlier
filed by the 2nd to the 35th respondents, into a
single brief.
It rejected a similar motion filed by the appellants’
lawyer, Henry Bello for leave (permission) to
amend the notice of appeal.
The court noted that the motion was defective
because Bello failed to attach the old notice of
appeal to the motion, as required. It noted that the
lawyer only attached his proposed amended notice
of appeal.
It adjourned to April 4 for hearing, before which the
appellants are to, within 48 hours, filed their reply
to the respondents’ brief of argument.
The other appeals are: SC 295/ 20019, filed by
APC, with PDP listed among respondents; SC266,
filed by APC, with Magnus Abe and others as
respondents and SC/267/2019 filed by Tonye
Patrick Cole, with Magnus Abe and 48 others as
respondents.
The three appeals were adjourned to April 4 to
allow the formal service of hearing notices and all
other processes on INEC, which was not
represented on Monday.
Other members of the seven-man panel of the
Supreme Court are: Justices Olukayode Ariwoola,
Olabode Rhodes-Vivour, Amiru Sanusi, Paul Galinje,
Amina Augie, and Uwani Musa Abba Aji. |

A Federal High Court in Abuja Tuesday ordered the
Independent National Electoral Commission to stop
the collation and announcement of the result of
the governorship and House of assembly elections
in Rivers State held on March 9, 2019.
The Commission had moved to resume the
collation of the result that had been previously
suspended after it was alleged that the AAC
Candidate was leading in the results so far
declared at the various collations centers by the
INEC returning .
There was a disruption of the collation process at
some collation centers which led to the suspension
of results for the elections. The commission on
had announced the resumption of the result
collation process after considering a report from
its fact-finding –committee put in place to
ascertain remote causes of violence that led to the
suspension of the process.
However, Justice Iyang Ewa, ordered the
Commission to halt its proceedings based on an ex
parte application filed by AAC Candidates.
The applicant prayed the court for an order of
Interim Injunction restraining INEC from resuming,
collating or announcing the result of the
suspended elections in Rivers State in respect of
the election to the office of Governor and the
Houses of Assembly
Inyang Ewa ordered INEC to appear before the
court on Friday for hearing of the suit filed against
it by the AAC and its candidate in the election.
Inyang affirmed that the court will give its final
order after it concludes the suits brought before it
by the plaintiffs.
Although INEC represented, by a Senior Advocate
of Nigeria (SAN), Ransome uwa, approached the
court with a motion challenging its jurisdiction.
But the Counsel to the plaintiffs, mohammed Abali,
however, objected to the application of INEC,
informing the court that the order issued on
Monday asking the electoral body to show cause
why the requests of the plaintiffs should not be
granted had not been obeyed.
The judge, however, ordered electoral umpire to
halt the proceedings till the court give the final
order. |

Last weekend, precisely on Friday, gunmen went on rampage in Obrikom in Onelga Ogba Egbema Ndoni Local Government Area of Rivers State, killing "Chief Adube, a traditional ruler and APC chieftain in the area, along with his two sons and seven others. We learnt that these PDP miscreants have moved to Oboh, a neighboring community and destroyed the house of Vincent Ogbuagu, an APC House of Assembly aspirant and also to continue their killing spree before they will hit other areas of the State,” reported Rivers State APC Chairman, Dr. Davies Ibiamu Ikanya in the following press release. |
