In the process of building or acquiring a property, one of the most important decisions you can make is to use professionals. The primary reason is because professionals help you avoid unnecessary mistakes. There are many things professionals in the built/real estate industry will do for you but let’s look at a few. If you use a professional land surveyor, he will help you avoid buying land that is under government acquisition. He will help you avoid building your property within the required setback area for major roads. This is very important because if there’s a road expansion in the near future and your property is within the required setback, it will be demolished and you will not be compensated. He will ensure that the land that the seller told you is 6 plots is not actually 4 plots. If you use a professional engineer, he will ensure that you build a good drainage system throughout your entire property that facilitates easy movement of water from your property to the road drainage system. He will ensure that the ground upon which you are building can withstand whatever structure you intend to build on it thereby avoiding building collapse. He will ensure that the level(height) of your foundation is much higher than that of the road thereby ensuring that your property is not flooded when it rains. If you use a professional architect, he will ensure he designs your property in such a way that it uses the available space you have effectively. If you use a professional town planner, he will ensure that whatever you intend to build complies with the local town planning rules. If you use a professional lawyer, he will easily smell trouble where you suspect nothing. He will ensure he investigates the root of title and ownership of any property you intend to purchase. He will ensure that a proper deed is prepared that effectively transfers the property from the seller to you. Professionals will save you time and money in the long run. |
In recent times we have been contacted by some of our clients who are in the process of purchasing land from real estate companies to help them verify the excision file number of the land they intend to buy. Most times these real estate companies in Lagos – especially those which have lands in Ibeju-lekki- don’t have an approved excision for their land yet so what they have is an Excision File Number NOT a Gazette Number. An Excision File Number is the identification number(ID) of the file that contains the documents that are being used to process the excision. An example of an excision file number is KL 9408. A Gazette Number is the number of the published notice(gazette) which shows details of the lands that have been excised. A gazette is published by the government AFTER a land has been excised. For example , the gazette number of a parcel of land in Ogogoro Village in Ibeju-Lekki is :Ogogoro Village Gazette no. 29 Vol. 42 18th June 2009. In other words, if the land you want to buy has an excision file number, it means it has NOT been excised by the government yet and DOES NOT have a gazette.

hisgrace090:Most of them are. They have no office. You can't trace them when there is a problem. They are not registered with any professional body. Doing business with them is very risky. When you give them a job, they still have to give it to a Registered Surveyor to register the land so why go to them in the first place? Why don't you go directly to the Registered Surveyor? The ones without integrity will not even bother giving it to a Registered Surveyor to register the land. In the end, its your money so you are always free to decide who you patronize. |

If you want to buy a land and the land owner (Omonile) is insisting on you using their own family surveyor to survey the land, please be wary. It is becoming a trend with Omoniles in Lagos State –especially those lands owned by families. This is different from housing estates which already have a registered survey layout and insist on using their in-house surveyor for uniformity sake. This is wrong. Why do some omoniles insist that a land buyer use their own surveyor? Why can’t the buyer use his own surveyor to survey land he bought with his own money? These omoniles don’t force clients to use their own engineer, architect, builder etc. but they make it mandatory to use their own land surveyor. They insist on using their own surveyor because they are hiding something and they know part of a professional land surveyor’s work is land investigation. They don’t want the client’s surveyor to do any investigation on the land. They know a professional surveyor will find out the status of the land and will inform the client. They know a professional surveyor will ask for the survey plan of the entire family land and he will be able to find out if the land they are selling to his client falls within their boundary or not. Many land owning families are guilty of this. Please let YOUR OWN selected professionals do your work for you. Don’t let omoniles impose anyone on you. So many lands in Lagos state are under government acquisition or committed. Now and again we read reports about the housing deficit in Lagos state. Some reports claim we need about 1 -3 million housing units to solve the housing shortage problem. In spite of this, the government keeps holding on to a lot of lands. For example, a large chunk of Ibeju-Lekki is either under government acquisition or committed. If you buy a committed land, you can’t perfect your title which means the land still practically belongs to the government and you will receive no compensation whenever it decides to use the land. If you buy a land under government acquisition and you are lucky, you will be able to do Ratification and get a good title. However, in most cases, you cannot. How are we ever going to solve the housing deficit problem when people can’t buy land and build freely? Buyer confidence is low in the land market. The government has to release these lands so people can buy and build freely. Finding genuine lands to buy in Lagos is becoming too stressful and frustrating. |
When buying land from a family(Omonile), please ensure you request for the layout survey of their land. A layout survey is a survey that shows the division of a parcel of land into plots, roads, amenities etc. This is very important. Let them show you the exact plot they are allocating to you on the layout survey. Then make sure it corresponds to the plot they show you on the ground. Make a photocopy of the layout and keep it. Ideally, every plot on the layout should have a plot number. If the plot has a number, make sure it is written on the agreement you sign with them. A lot of Omoniles dance to the tune of the highest bidder. If someone who has more money than you loves the location of your land, they will sell it to the person at a very good price and give you flimsy reasons why they have to relocate your plot. One of the most commonly used excuses is that a road is supposed to pass beside your land and they need to relocate or shift it to make way for the road. A friend of mine told me he just rented an apartment somewhere in Maryland and I remembered a list I created for myself when I was looking for an apartment some years ago. Let me share. 1) Is there running water in the compound? You don't want to be buying water from "aboki" or fetching water from another compound everyday. 2) What is the power situation? Some areas are notorious for not having power. Do your research. 3) Is the area flooded when it rains? You don't want water entering your house anytime there's a heavy rain. Look for signs on the walls, drainages etc. and ask questions. 4) Does the landlord live there? Living in the same compound with a landlord can be stressful. They monitor everything you do and want you to do things their way all the time. You don't want to be seeing your landlord everyday especially when your rent is due and you don't have the money yet. 5) What is cost of renovations? If the cost of renovating the apartment to your taste is too high, it may be better to leave it and look for another one. 6) How close is the house to my place of work? In most cases, the closer the better. Less stress, less time commuting and you spend less on fuel / transportation. 7) Are the people living there making any visible progress? Sometimes you want to verify that a land has no pending court case before purchase so you don’t have avoidable issues later. This is very important but It has always been an arduous process carried out by lawyers. However, a company – Legal Metrics Solution Limited - in partnership with the Lagos State Ministry of Justice have put up an online solution that makes it possible to verify a property is not the subject of a lawsuit. The solution is called Lagos State Lis Pendens Electronic System. Lis pendens simply means “pending suit”. It is a written notice that a lawsuit has been filed concerning real estate property. To do an online verification, navigate to the website: https:///ewRtUvc Click on “Search” on the main menu bar. You can search by property description, suit number, judge/court or parties. I personally think searching with “parties” or “suit number” gives the most relevant results. I am not sure the records at https:///ewRtUvc is exhaustive but it is a very good place to start your search and you can do it from the convenience of your home or office. I attended a real estate event (Property Ownership Workshop-POW) last Saturday and it was awesome. During one of the plenary sessions, someone asked a question which had to do with obtaining a Deed of Rectification and I quickly noticed most people there didn’t know anything about it. Simply put, a Deed of Rectification is a deed used to correct mistakes on a title document. During preparation of title documents, sometimes mistakes are made such as wrong distances, area or coordinate on the survey plan, wrong description of the location of the land, wrong spelling of the names of the parties etc. If you want to buy a property that already has a title e.g. C of O, Governors consent etc., it is important for you to obtain a copy from the seller and ask your lawyer to help you study it and ensure all the important details are correct. In the event that there is a mistake, you must notify the seller and ask him to apply for a Deed of Rectification at the land registry to correct the mistake(s) before it is transferred to you. If you find a mistake in your own title document, you can apply for a Deed of Rectification as well. It costs N18,750 (Eighteen Thousand Seven Hundred and Fifty Naira only) at the lands registry. The Office of the Surveyor General of Lagos State has stopped issuing Consent to Survey on agric aquisition lands in Lagos until further notice.This is due to the complaint by Agric Holdings citing their inabiility to identify their lands due to massive enchroachment in agric acqusition areas. This means that if you purchase any land that falls under agric acquisition now you wont be able to carry out a registered survey. It is best to avoid agric acquisition lands for now -especially in Ikorodu. Please chart any land you want to buy before purchase. |

Easter is coming soon and some real estate companies are selling "cheap" lands with incentives like free bags of rice, ram, oil etc. Don't be cajoled by these companies. A bag of rice is NOT your problem. What you want is a sure investment. Most cheap lands don't have any Title. If you are going to buy cheap land, do some investigation and be sure the land is FREE FROM GOVERNMENT ACQUISITION and is not the subject of any COURT CASE. Ensure you are buying from the REAL OWNERS. If you are buying several plots, confirm the size of the land before full payment. If you are in the Diaspora and you plan to build a property here in Lagos, here are a few tips that will help you. 1 - Form a core project team. This team should consist of ONLY professionals – land surveyor, architect, lawyer, engineer etc. 2- Try as much as possible to know how much things cost before sending money but don’t be too tight-fisted. 3 - Make video calls when speaking with any member of your project team working on site. This allows you to see things for yourself. 4 - Have someone outside your core project team monitor your project. This is VERY IMPORTANT. Be willing to pay this person. This person’s duty is to visit your site often, verify the cost of building materials (if necessary) and give you a report on what is happening. This person can also help you verify some of the land documents you receive from your core project team.
