It is no longer news that the cost of survey has increased in Lagos. The Lagos State Cadastral Policy was reviewed earlier in the year and became effective April 2017. Before the review, the least cost of survey of a plot of land in Lagos was N120,000 (One hundred and twenty thousand naira) but now it is N350,000(Three hundred and fifty thousand naira). This means that there was an increment of about 300%. The increment was sharp and drastic, however the NIS(Nigeria Institution of Surveyors) has done a good job of enlightening the public on the new survey fee in Lagos and the necessity of the review. The indices for costing include: 1) Job content 2) Personnel 3) Instrumentation 4) Transportation and Logistics 5) Materials 6) Value of land 7) Type of vegetation Professional development and administration charges9) Contingency There are two things to note 1 As stated earlier, the least cost of a registered survey of a plot of land is N350,000(Three hundred and fifty thousand naira). 2 In Lagos, the cost of survey varies according to location. There are three zones in Lagos. They are Zone A, B and C. The minimum cost of survey in each zone is N350,000, N500,000 and N1,000,000 respectively. Local government areas(LGAs) under Zone A are Eti-Osa, Lagos Island, Ikeja, and Apapa . LGAs under Zone B are Agege, Alimosho, Amuwo-Odofin, Ibeju-Lekki, Ifako-Ijaiye, Kosofe, Lagos Mainland, Mushin, Oshodi/Isolo, Ojo, Shomolu and Surulere. Those under Zone C are Ajeromi-Ifelodun, Badagry, Epe and Ikorodu. |

PLEASE AVOID THIS LAND INVESTMENT MISTAKE A real estate surveyor friend of mine called me concerning a client of his who has about 2 hectares of land in Ogun state. This man bought the land, obtained a C of O (Certificate of Occupancy), and didn’t bother visiting the land for more than 10 years. His plan was to buy, keep it for some years and sell it later at a good price. Now he needs money and wants to sell but he does not know how to locate the land because the whole area is now built-up. The area has undergone massive development. Due to the man’s situation, we decided to help him locate his land free of charge. We were able to locate the land using the coordinates on the Survey Plan. Unfortunately, sitting on the man’s land now is a boarding school that has been operational for years! Please learn from this man’s mistake. If you want to buy land, keep it for some years and sell at a good profit, find a way to keep an eye on it. Visit the land often, lease it to a mechanic, have someone in the area watch over it for you or use it for farming. Keep an eye on your investment. |
You must ask one very important question before you conclude a land transaction and the question is: Is there any dispute or court case on this land? Failure to ask this question can have dire consequences. During the week, I received a phone call from a lawyer who wanted to carry out a survey of a plot of land on behalf of his client. As our conversion progressed, I found out that his client – an elderly couple – had paid for the same land twice! Yes, two times! They purchased the land from a man who did not tell them that there was a court case on the land. When the man lost the case, the real owner showed up and tried to take possession of the land. I cannot imagine how this elderly couple felt when they found out they bought the land from the wrong person. In the end, they had to negotiate with the real owner and pay for the land again. Please avoid this kind of mistake. Ask questions before paying for land. It is your HARD EARNED MONEY so don't be in a hurry to part with it. A Certificate of Occupancy(C of O) is a legal document that shows ownership and purpose of land. It is a very important document. By law, the government owns all land. It will issue a C of O when an applicant has met all the necessary requirements. The C of O is a solid root of title and gives the owner sole right to the land thereby eliminating multiple ownership, which is a common land fraud in Lagos. Requirements for C of O: 1. Application form 2. 4 copies of survey plan (2 clothes and 2 papers) 3. Land information certificate 4. Purchase receipt 5. 4 copies of deed of assignment 6. Picture of the site showing time, date, and street name where the property is located 7. Site location sketch 8. Tax Clarence certificate 9. Current development levy 10. Four passport photographs (5 by 5 on white background) 11. Application letter 12. ID card 13. Publication/Inspection fees Benefits of having a C of O -It shows ownership of land and will serve as a strong defense in case of a land dispute. -Higher property value. -It eliminates the problem of multiple ownership. This happens a lot because sometimes unscrupulous land owners sell the same land to different people. -If the government needs to acquire your land for public purposes, you will be compensated because of your C of O. -It can be used for obtaining loans. -It can be used when securing mortgage. -It a solid root of title and it makes it easy for you to sell your property. A Record Copy (also referred to as Red Copy) is a copy of the original survey carried out by a Registered Surveyor which is lodged in the Cadastral Records department of the Office of the Surveyor General of the State. The Record Copy is very important because it is required during the processing of any land title. In fact, a survey is not complete until the record copy is lodged. An evidence of lodgment is usually given to the surveyor after successful lodgment of the record copy. The time required to lodge a Record Copy depends on the state where the survey was carried out. For a survey carried out by a Registered Surveyor in Lagos state, lodgment of record copy should not take more than 2 months after submission. It is very important for clients to demand for the evidence from the surveyor so that they don’t have issues during the processing of title because it was not lodged. The Lagos State Lands Bureau, through the Directorate of Land Services, has harmonized its demand notice/assessment letter to encompass all fees payable for Governor’s Consent in the State. A statement released by the Special Adviser on Urban Development, Mrs. Yetunde Onabule said the harmonization is part of the ongoing efforts to improve the Ease of Doing Business relating to land matters in Lagos. According to the release, the demand notice now outlines the harmonized fees to include Consent fee, Capital Gain Tax, Stamp Duty, Registration Fee, Neighborhood Improvement Charge, Charting Fee as well as Endorsement and Form 1c charges. Onabule stated that the new payment schedule affords applicants the opportunity to pay all fees related to the issuance of Governor’s Consent in a single transaction. She said in addition to the newly introduced payment regime, automated searches at the Land Registry are conducted within one hour of submission of any request, emphasizing that it is no longer a pre-requisite for applicants to conduct a title search prior to registration of title documents. The statement affirmed that the newly introduced process has reduced the timeframe for obtaining Certified True Copies(CTC) of land title documents to a maximum period of two hours. There has been a proliferation of real estate companies claiming to have lands for sale all over Lagos especially in Ibeju Lekki axis. Some of the lands they are selling have genuine titles but most of them don’t especially those on which they claim to be “processing excision”. They tell prospective buyers they have started processing excision and they have “file number” already. An excised land is a land that has been released by the government to the indigenes of the area who originally owned the land before the government acquired it. This means that the land is no longer under government acquisition and processing of C of O (Certificate of Occupancy) is possible. Two things you have to know about excisions: 1 The fact that a file number has been given at the ministry does NOT mean that the excision will be granted. This means that if the government does NOT grant the excision, you get no land. 2 In an excision application, the total area of land applied for is NOT always granted. This means that if a real estate company applied for 50 hectares of land to be excised, the government may grant 30 hectares. The implication is that those who bought land from the 20 hectares that was not granted will lose their lands. If they are lucky, the real estate company may compensate them by giving them land in another location but it won’t be the location they paid for. I'm getting conflicting figures How conflicting are the figures you are getting? At this point I have to ask if the state bureau of lands has surveyors working for them Yes they do. But they carry out survey of government lands only e.g excisions, government estates, revocations etc. They DON'T carry out survey for individuals/corporate bodies. PS. If you are looking for the cheapest price, you may be swindled. Surveyors have standard fees for different areas. |
