GOVERNOR ADELEKE DID NOT FORGE HIS SCHOOL TESTIMONIAL AS FOUND BY JUSTICE KUME OF THE OSUN GOVERNORSHIP TRIBUNAL

2. The issuing school testified before Court of Appeal in 2018, that it was their error, which has nothing to do with Governor Adeleke,

Politics / Osun Buga Judgement And The Impending Doom For Nigeria's Democrary by DukeOfOsun(m): 4:23pm On Jan 30, 2023
Osun Buga judgement and the impending doom for Nigeria's democrary

By Sarafa Ibrahim

For some time now, a lot of Nigerians have expressed concerns about the growing incursion of the judiciary into the decision-making on who leads the people. As against the known practice in democrary making the people the ultimate decider on who rules over their affairs, the judiciary in Nigeria is taking up that role.

This distortion of democrary is causing a whole lot of worries, and one of such was expressed by a former President of Nigeria, Goodluck Jonathan, who had during a visit to TOSTV Network studios in Abuja said "I have already made a public statement on that to the effect that ballot paper and not the judiciary should determine who wins elections or select political leaders. The ballot paper should be the only basis for selecting political leaders."

And last Friday, the very disturbing trend that Jonathan canvassed against raised its ugly head in Osun state. Justice Tertse Kume who led the Osun election petition tribunal did the unthinkable as he went outside the dictate of his power in pronouncing a winner for the Osun election. The basis of the obscure and ridiculous judgement was that the elected Governor, Ademola Adeleke, did not score the majority of lawful votes after deducting votes in disputed polling units.

But that was not even what the law empowers him to do, assuming without conceding that his verdict on alleged over-voting was right. For the education of those who may not know, Section 51(3) of the Electoral Act 2022 stipulates that "Where the result of an election is cancelled in accordance with subsection (2), there shall be no return for the election untill another poll has taken place in the affected polling unit."

In other words, the judgement of Justice Kume runs foul of the provision of the law. What the judgement did, in essence, was to shut the door to nearly one-third of the state from having a say in who will administer the state. By any stretch, it smears the real intent of democrary, and worse, a mockery of the law.

In Osun, the impression that the majority judgement gave to most people is that Justice Kume simply awarded the state to Gboyega Oyetola of the All Progressives Congress (APC) despite having lost at the poll. And this can not be faulted considering the fact that the basis of the majority decision of the Tribunal was flawed and defied any sense of justice.

It should be unthinkable that a court would be a place to overturn the clear will of voters based on a controversial evidence. Apart from the fact that the BVAS report relied upon by Justice Kume to make a decision has been disputed by the maker, the Independent National Electoral Commission (INEC), it is inconceivable that the accreditation data on the BVAS machines used for the election was ignored by the jury.

The BVAS machines were the device used at the various polling units to accredit voters. It is also a fact that BVAS machines were the originator of the accreditation data, and as such, the primary source of evidence to determine the true number of accredited voters for the election. Yet, Justice Kume went for a secondary source of evidence that is housed in faraway Abuja, which is susceptible to hacking and manipulations.

In short, Justice Kume turned a blind eye to the accreditation data on BVAS machines which were physically present at the polling units he ordered, and went for the accreditation data on a server not known to many of the voters in the election. It is like throwing away a chicken and embracing the egg she laid. Does that not foul of logic and justice?

What the decision of Justice Kume portrayed is an extreme partisan fervour targeted at robbing the people of their power to choose their leader. The implication of this would mean that the people do not need to take part in an election since whatever they decided on the ballot may not matter but the partisan instincts of the jury.

This will most likely put the decision on who leads on the judiciary, and not the people, as democrary was structured to operate. What this would therefore mean is that a judge would have unrestrained power to upturn election, especially when the winner is not someone he likes, as Justice Kume plainly demonstrated in his judgement by mocking Governor Ademola Adeleke.

To be frank, the threat posed to Nigeria's democrary by the pronouncement of Justice Kume is far-reaching. The moment the judiciary becomes just another political tool, especially one used to hijack states by those who know how to manipulate it, it begins to lose any faith left in it by the people. No amount of legal fantasies can cover for an obvious plot to take away the power of the people in a democrary.

What just happened in Osun is a reminiscence of the 2018 mandate heist. While 'remote control' was the tool used to usurp the mandate of the people in 2018, now the least expected source, the judiciary is posing as the tool. It is time for the leadership of the judiciary to rise up and ensure the sustenance of the will of the people before compromised officers are used to steal away our democracy forever.

Illegally Employed Workers Remain Disengaged - Osun State Government

Those illegally employed by former Governor Gboyega Oyetola are no longer in the employment of the state government and no amount of blackmail can change that reality, the State Government has announced.

Reacting to the pocket of demonstration by members of the All Progressives Congress(APC) employed towards the tail end of the last government, the State Government in a statement by the Special Assistant, Community Communications to Governor Ademola Adeleke, Mr Tunde Busari, noted that Mr Oyetola deliberately padded the state payroll with APC members to create stage for deeper financial crisis, conflict and disharmony.

" Those engaging in demonstrations are APC members smuggled into the state payroll by former Governor Oyetola. By virtue of the Executive Order issued by Mr Governor, those illegally employed remain sacked and are no longer staff of the state government. No amount of demonstration and blackmail can change that reality.

" We have the details of plan by APC to deploy its disengaged members for demonstration. However, the people of Osun state are in the know of the whole situation especially the several warnings by the PDP while in opposition. We warned against colluding with Mr Oyetola during those last days when the former Governor was issuing employment letter despite the State's inability to pay staff salaries.

" Those APC members are now playing the script. They have failed from the beginning as this administration will not bow to unjustified demands from those who collaborated to deepen Osun financial woes", the statement noted.

100 Days Agenda: Osun PDP Applauds Governor Ademola Adeleke

The Osun State Chapter of the Peoples Democratic Party has applauded the state Governor, Senator Ademola Jackson Nurudeen Adeleke for his unflinching love for the people of the state as contained in his multiple intervention programs to better the lots of the citizenry in the state.

The PDP particularly eulogized the governor for riding through the odds to hit rhe ground running as the state helmsman and commit his administration to measured deliverables to the people within the first one hundred days in office.

The rural electrification and mass water projects embarked upon by the governor,, according to a statement from the office of the Osun State PDP Caretaker Committee Chairman, Dr Akindele Adekunle, are indicative of an administration that is prepared to affect lives without any form of segregation.

That the state government also allowed target beneficiaries to unanimously choose locations of these stopgap interventions, underscores the core value of democracy, with the people as the main focus, the PDP chairman noted.

Dr Akindele also assured the people of the state that Governor Ademola Jackson Nurudeen Adeleke will continue to address their needs compassionately as contained in his electoral promises, just as he enjoined them to continue to join hands with rhe PDP administration in ensuring that all projects embarked upon by the State Government are gaurded jealousy and protected from avowed saboteurs.

He however called on members of the public, to be wary of those he described as enemies of the state who are trying to reset agenda for the governor with a view to discrediting the noble steps mapped by the state government in measured time to frontally meet the good people of the state at the very points of their needs.

“PDP administration is not given to ego massaging and that is why leaders of communities and people alike, will continue to be pivotal in decision making mechanism of the state government, especially when it comes to citing of projects for the good of all in the state”

” We are therefore not surprised that some disgruntled elements of the defeated opposition, who are devastated by the massive approach of Governor Ademola Adeleke to governance, had begun to run helter skelter, deliberately reworking the Governor’s 100 days pledge outside of the open and well circulated agenda of water, rural electrification, primary health care, roads and and schools rehabilitation. This, we are confident will faill and fall on them as usual.

‘Our great party, the PDP is proud of our dear Governor for his people oriented disposition and we call on our people in other spheres of life in the state, to remain calm and be assured of the state government’s interventions as the case may demand either on immediate, medium or long term basis” Dr Akindele concluded.

TEXT OF AN ADDRESS DELIVERED BY HIS EXCELLENCY, SENATOR ADEMOLA ADELEKE AT THE LAUNCHING OF EMBLEM FOR THE YEAR 2023 ARMED FORCES REMEMBRANCE DAY

PROTOCOL

Today is another significant period to mark and remember the unquantifiable contributions of members of Nigeria's Armed Forces to the peace and stability of our great country, Nigeria. We are gathered here as in other capitals across the country to place our debt of gratitude on records to our fallen heroes who paid the supreme sacrifice.

The stability of the nation rests on the gallantry, patriotism and sacrifice of the security and military services. Service personnel of the armed forces in particular are in many volatile sectors of the society confronting and curtailing open and subtle threats to the territorial integrity of the country. That we must live, many offered their precious lives. We must therefore continue to acknowledge the contributions of the armed forces to the survival of the nation.

As we gathered here today, I reassure the military service of the commitment of our government to expand the present level of partnership. Our administration has a security sector reform which places welfare of service personnel at the centre stage.

Today, I recommit to the well being of our service personnel. Our veterans and their families will continue to receive our support in recognition of their service to the fatherland.

It is on this note that I launch the appeal fund for the 2023 Emblem for the Armed Forces Remembrance Day with a sum of Five Million Naira.

Thanks for listening.

HE, Senator Ademola Adeleke,
Executive Governor of Osun State.

Nairaland / General / Osun Is Set For Good Governance In 2023- Governor Ademola Adeleke by DukeOfOsun(m): 12:04am On Jan 01, 2023
OSUN IS SET FOR GOOD GOVERNANCE IN 2023- GOVERNOR ADEMOLA ADELEKE

My good people of Osun state, it is with high sense of gratitude, hope and commitment that I address you this morning.

The last one year has been very eventful in the life of our state. We have passed through many developments. We have concluded a major election that ushered in a new government under my leadership. Our state transited from one political party to a different political party and also from one government to a government by and for the people.

Despite the tension and anxiety, our state gallantly emerged stronger with your support and goodwill. I put on record my deep appreciation to you, our people, for your strong support for my political party and I during those struggling days. I promise to remain responsive and accountable to you all as we move to reposition our state for greater height.

In the last one month, our administration has laid a strong foundation for sustainable governance of our state. I opened up state finance to the public in the spirit of accountability. I am reforming several sectors to block revenue leakages and stop diversion of state assets. The repositioning of the civil service for professionalism is also ongoing. Urgent state matters are being attended to with a view to restore normalcy and bring our people together for good governance.

Our administration has created a strong working relationship among the three arms of government. We have forged a common understanding to put the interest of the state at the forefront of everything we do. Combined effort, mutual support and impactful governance are hallmarks that have been accepted by all as a path to progress, in the best interest of the state.

Within the same one month, our administration is focused on delivering on its first 100 days in office programme. I have visited several schools, health centres and other public infrastructures. These inspections have strengthened our pre-election data. We are poised to deliver on our first 100 days in office programme, which covers areas such as water provision, rehabilitation of schools and health centres, rehabilitation of roads and delivery of tech innovations for the digital economy.

My good people of Osun state, our administration has a rolling plan of 100 days, six months, one year followed by deliverables in subsequent years. I have also put in place a monitoring and evaluation team. By the end of the first 100 days in office, we will be hosting the maiden edition of our public accountability forum titled 'Ipade Imole'. We will meet you, the good people of Osun state, and keep you informed about the journey so far.

Permit me to use this occasion to seek the full support of Osun indigenes, home and abroad. Our administration is committed to ensure people based development. Our vision is to enthrone tech based agro-industrial growth in our state. We plan to address the infrastructure deficit with a cost effective, home based and labour intensive programme.

To our people in the diaspora, we are opening up the state for partnership in education, health, trade, investment and tech innovations. We are creating the enabling environment for multiple cooperation to put our state on the global map of development.

In our drive for a new Osun state, I assure you that we will be fair and inclusive in our actions. Like I noted in my inaugural address as governor, the election is over. Now is the time for us all to join hands to move the state forward. I am the Governor of all Osun people and I will serve the state in the spirit of brotherhood, equity, transparency, accountability and fear of God.

I welcome us all to the new year under the umbrella of Almighty God.

Illegal Mining: Governor Adeleke Disbands Mining JTF, Orders Reconstitution

In his drive to clean up the solid mineral sector, Governor Ademola Adeleke has ordered the immediate disbandment of the state's Mining Joint Taskforce (JTF).

The existing JTF is consequently directed to hand over all government vehicles and documents in their possession to the Solid Minerals Committee.

Governor Adeleke had also set up a Solid Mineral Committee to look into activities of stakeholders within the sector with a view to put an end to revenue leakages, unauthorised appropriation of solid minerals and tackling increasing criminal activities around the mining communities.

" I consequently direct the Chairman of the Solid Mineral Committee to take neccesary steps to ensure seamless transition from the old to the new JTF. The new team when constituted must operate with utmost professionalism with zero tolerance for misconduct", Governor Adeleke directed.

Politics / Osun Is Indebted To The Tune Of N407.32 Billion - Governor Adeleke by DukeOfOsun(m): 1:21pm On Dec 15, 2022
Osun is Indebted to the Tune of N407.32 Billion - Governor Adeleke

I am pleased to welcome our royal majesties and fathers to this all important event. I called this meeting first to meet our royal fathers and to present to you the official debt profile of Osun state as at November 30th, 2022 as submitted to me by the Accountant General of Osun State.

With high sense of responsibility, I am reporting to our people through our traditional rulers, the total debt profile inherited by my administration from Governor Oyetola's administration.

This event is in pursuance of my pledge to Osun people to be transparent and run an open government.

My administration inherited eight outstanding loan facilities, apart from salaries and pension debts, from Governor Oyetola's administration. The repayment period ranges from 16 months to about 28 years, as follows:

1. Budget Support Facility:
• Outstanding Balance: N51.8 Billion

• Monthly repayment: N154.9m

• Repayable Period Outstanding:
335 months = 27 years 9 months

2. Salary Bail Out Loan:

• Outstanding Balance: N38.8 Billion

• Monthly Repayment: N232.77m

• Repayable Period Outstanding:

•167 Months = 13 years 9months

3. Restructured Commercial Bank Loans:

• Outstanding Balance: N158.77 Billion

• Monthly Repayment: N1.14 Billion

• Repayable Period Outstanding:
139 Months = 11years 6 months.

4. Excess Crude Account (ECA) Loan:
• Outstanding Balance: N14.48 Billion

• Monthly Repayment: N89.97m

• Repayable Period Outstanding:
161 Months = 13 years 4 months

5.CBN Infrastructure Loan:
• Outstanding Balance: N9.2 Billion

• Monthly Repayment: N44.98m

• Repayable Period Outstanding:

205 months = 17 years 1 month

6. FGN Intervention Loan:
• Outstanding Balance:
N1.7Billion

• Monthly Repayment:
N100m

• Repayable Period Outstanding:
17 months

7. FGN Bridge Finance Facility: N18.04 Billion

A large portion of this particular loan was taken after July 16th, 2022 election which Governor Oyetola lost.

No information on the Repayment terms.

Not one kobo of this loan was left in Government Coffers, when the Deputy Governor and I resumed work on Monday 29th November 2022. And no explanation on how the loan was expended.

8. Foreign loans: $86.2m
No information on the Repayment Terms.

My good people of Osun state, the total loan stock as at today is N331.32 Billion.

If the N76 billion debt on salaries and pension are added, the state is indebted to the tune of N407.32 Billion . The amount owed contractors is yet to be determined.

The only Fund in government coffers, as at Monday 29th November, was for November 2022 Salary. Otherwise, the state treasury was empty.

As your Governor, I will ask questions on your behalf. And will demand for answers.

Governor Oyetola must explain how the N331 Billion borrowed in the name of Osun State was expended, with no obvious infrastructural development to justify this huge debt.

Governor Oyetola must explain how the N18 Billion Bridge Loan taken after he lost the election on July 16, 2022, was expended.

Governor Oyetola must also explain why Osun state is owing salaries & pension to the tune of N76 Billion after collecting a N50 Billion Salary Bail Out Loan from the Federal Government

The Creditors, especially the Commercial Banks must explain why various loans were given to an administration beyond its 4 year tenure. 28 years is equivalent to the tenure of at least four Governors. A child that is born today would have earned a PhD at 28 years of age. This is nothing but mortgaging the future of Osun State with nothing to show for it. This is definitely not acceptable.

I will update you accordingly, as we progress.

Governor Adeleke Unveils Revenue And Solid Mineral Sector Reforms

• After 25 Years, Segilola Gold Has Not Paid A Dime To Osun Govt

• Revenue Agents Earn More Than The State Government

• Mining Companies Not Paying For Environmental Damages– Gov

• 25 Years Derivation Payments Must Be Recovered From Segilola Company And Others

• Control Post Licences Suspended

• I Will Recover Every Penny Owed Osun–Governor Adeleke

The Osun State Governor, Senator Ademola Adeleke on Monday unveiled a comprehensive reforms of the revenue and solid mineral sector of the state government with far-reaching directives affecting mining companies and revenue generating agencies and stakeholders.

Inaugurating two separate committees, namely revenue and solid minerals, Governor Adeleke issued several directives to block revenue leakages; increase internally generated revenues; recover unpaid solid minerals payments from Segilola and other companies; halt illegal mining; review the operation of Osun State Internal Revenue Service; suspend control post licences; orders new terms of engagements for revenue collecting agents; orders review of licencing conditions for logging related permits; and vow to ensure mining companies pay for environmental pollution and degradation.

The Governor who decried the situation whereby revenue collectors are earning more than the state government, directed that henceforth all revenue generated must go into the coffers of the state after which decision will be taken on the percentage to be paid to collectors.

While further lamenting huge revenue loss, Governor Adeleke wondered why Segilola gold company has never paid a dime to the Osun State Government for the past 25 years that it has been mining gold in the state.

In the words of the Governor, "Osun state according to extant laws is entitled to 13 percent derivation from every ounce of gold extracted from our gold and other solid mineral fields. Segilola and other operating companies are expected by law to pay Osun state 13 percent derivation on the value of gold and other solid minerals produced in the last 25 years.

"Till date, we have no record of any payment made by Segilola and other mining companies to Osun state. My administration is determined to recover every penny owed Osun state by companies operating in Osun gold fields.

"Osun state has been subjected to intense environmental degradation arising from activities of mining companies. River Osun has been polluted and our people are dying as related sicknesses are spreading. These are sad realities which none of the mining companies has raised a finger to address. My administration will insist on the companies paying for the cleaning up of our rivers and environment. Segilola and other companies operating in our state should take note that cleaning up of our environment is going to be a continous exercise and the resulting expenditure is to be borne by the companies. I will not allow Osun people to continue to be exposed to polluted river water and the state to be so cheated.

"My administration is conducting an audit of Osun assets in the mining sector. All state mining licences already diverted to private possession must be fully recovered. All illegal mining activities must stop immediately. Henceforth, all illegal mining syndicates will be arrested and prosecuted", the Governor posited.

On the revenue side, Governor Adeleke vowed to stop huge leakages in revenue collection, which he blamed on corrupt practices, unfavourable revenue collection terms and outright inefficiencies in the revenue collection processes.

Speaking further, the Governor noted that "My administration will not condone a situation whereby revenue agents are earning more than the state. All revenue inflow must go to the Coffers of the state. We must then decide what will be the collection fees to be paid to the revenue agents. Consequently, all revenue agents operating on behalf of the state must report to the committee immediately for new terms of engagement.

"I have reports of extensive illegal logging of precious woods without permit from the state government. Consequently, all logging permits such as hammer and concession permits are hereby suspended pending review by the committee.

"My administration is in possession of report detailing low revenue returns and corrupt practices across the Control posts. Consequently, all consultants manning the control posts and collecting haulage revenue are hereby suspended pending review by the revenue committee.

"Furthermore, I direct this committee to review the following category of permits payments namely Control post/border checkpoints haulage; plantation or forest reserve concession allocation permit; sawmill permit and renewal; flinch sawn evacuation permit; timber and logs permit; hammering permit or release permit; motor-saw permit; forest reserve access permit and Tungya farming system allocation permit.

"My administration is directing a review of the Osun State Internal Revenue Service. The committee is therefore expected to review the operations of the agency and submit appropriate recommendations to increase internally generated revenue by substantial percentage", the Governor affirmed.

Responding on behalf of the Committee members, the Chairman of the Solid Minerals Committee, Mr. Samuel Oyedokun assured the Governor of their total commitments to the execution of the mandate given to the two committees.

"We totally share the passion and commitment of His Excellency for transparency and accountability in the management of Osun mineral assets and revenue inflows. We promise to commence operations immediately and ensure the fulfilment of His Excellency's various directives," he noted.

Each of the committee has 14 members. The Chairman of the Revenue Committee is Mr. Sola Adewumi while the Secretary is Mr. Hamsat Solanke. The Chairman of the Solid Minerals Committee is Mr. Samuel Oyedokun with Barrister Hashim Abioye as the Secretary.

The list of the Committee members are as follows:

Osun Deputy Governor's Lodge was Looted, State Govt Insists

Our attention has been drawn to a statement credited to the former Deputy Governor of Osun state where he claimed nothing was missing in the Deputy Governor's lodge. We want to insist that the lodge was not only looted but the pillaging was extensive.

We have a documentary proof of the state of the lodge as at the time of inauguration. From the main house to the service flats, the place was stripped of all fittings and other movable items. The video in our possession was detailed and physical inspection has confirmed the ransacking of the house.

The defence of the former Deputy Governor is spurious and against the reality on ground. We urge him to take responsibility as the Deputy Governor of Osun State, Prince Kola Adewusi spoke from factual reports which can be verified by a visit to the lodge.
