Two presidential aspirants on the platform of the Peoples Democratic Party, PDP, are ready to lock horns with the ruling party for saying they would not get the forms after payments. It was gathered that the national leadership of the party refused to sell its presidential nomination and expression of interest forms to the aspirants after paying for the forms. Two of the aspirants, Dr. Abdul-Jhalil Tafawa- Balewa and Prof. Akasoba Duke-Abiola, were at the national secretariat of the party in Abuja on Tuesday to purchase the forms, but they were turned back. Punch reports that first to arrive was Tafawa- Balewa, who hails from Bauchi State. He is also the son of Nigeria’s First Republic Prime Minister, the late Abubakar Tafawa-Balewa. It will be recalled that all the levels of the party, including the National Executive Council had endorsed President Jonathan as its sole presidential candidate. Tafawa-Balewa had on September 21 frowned at the action, saying nothing would stop him from running for the presidential race. He had asked, “What type of democracy do we have? Is the PDP a communist party? Where is the place of internal democracy?” Report said a visibly angry Tafawa-Balewa stormed the party’s national secretariat with his supporters and bank tellers, with which he had hoped to purchase the presidential nomination and expression of interest forms. The bank tellers indicated that he deposited N22m into the account of the party with Zenith Bank. The breakdown of the fees showed that he paid N20m as nomination fee and another N2m for the expression of interest form. He paid the money into the party’s account Number 1012436478 with the Zenith Bank. Rather than being issued his forms, the aspirant claimed that he was told by officials of the party that the forms were not ready. Tafawa-Balewa said he was told that all other forms were on sale except the presidential nomination and expression of interest forms. He said, “I have paid for my forms. I was, however, told that they don’t have the forms ready. I am still here. I will send some of my people here on Thursday to come and pick the forms.” He said he went to the office of the Secretary of the party, Prof. Wale Oladipo, and the National Organising Secretary, Alhaji Abubakar Mustapha, but was denied the forms. Also speaking on the refusal of the party to present her with her forms, Duke-Abiola, who is one of the widows of the late Chief MKO Abiola, described the action of the party as questionable. Abiola, who displayed the Diamond Bank Teller with which she paid her N2m to the party’s bank account, wondered why the party would issue her receipts and refused to sell the forms to her. Female aspirants, like her, are expected to pay just N2m for the expression of interest form while the nomination form is free for them. The presidential aspirant said she was told by the National Chairman of the party, Alhaji Adamu Mu’azu that the party printed only one form. She said, “I have the receipt from the party after paying my money. But they said they printed only one presidential nomination form, even though the guidelines do not say that. “The National Organizing Secretary and the National Chairman said the party printed only one form. I asked that they should give me the one they printed to me since I was there. They laughed and said whether I didn’t know who they printed it for. This is a fraud.” She said that she would not ask for a refund of her money, but that the party must sell the forms to her. In his reaction, the National Publicity Secretary of the party, Chief Olisa Metuh, said he was not aware that the aspirants came. “I will have to find out from the national Organising secretary, because I’m not directly involved in the selling of that forms. I’m only involved in the management of the image of the party”, he said. |
The long-anticipated defection of Hon. Aminu Tambuwal from PDP to APC has robbed the ruling party of its claim to the number four position in the country. PDP is expected to push back through various means to challenge Tambuwal’s right to hold on to both his legislative seat (which he won on the platform of PDP) and the officeof the Speaker. Essentially, there are four options available to PDP in the wake of this recent development. Instigate Impeachment One of the options is to instigate Tambuwal’s impeachment.But how realistic is this option? As a start, there are constitutional requirementsto be met before an impeachmentprocess can sail through. According to Section 50 (2) (c) of the 1999 Constitution, the Senate President or the Speaker ceases to occupy that position:“if he is removed from officeby a resolution of the Senate or of the House of Representatives,as the case may be, by the votes of not less than two-thirds majority of the members of that House.” The implication is that a minimum of 240 members (two-third) of the 360 members have to vote in favour of his removal as the Speaker. At the moment,PDP has 188 members and APC has 160 members, while other minority parties combined have 12 members. Evenif the PDP gets the 12 members of the minority parties to join forces with it, it would only make it 200 votes. And the Speaker needs only 121 votes to remain as Speaker. This is clearly not option that PDP can pull through as it is inconceivable that APC members will not vote to save their new man. Challenge His Right to Speakership The PDP can decide to go to court for interpretation on Tambuwal’s eligibility to continue to preside as Speaker of the House being a member of the opposition. But the Constitution is not specific on the party of the presiding officer as the only condition given is to be a member of the House. The House Rules is also silent on the party of the Speaker. In Section 50 (1) (b), the Constitution states that:“There shall be:a Speaker and a Deputy Speaker of the House of Representatives,who shall be elected by the members of that House from among themselves.” While the PDP may ask the court to interpretthe intentionof the framers of that Section (since it might not be conceivable that an opposition member would be elected Speaker in the first instanceexcept by mutual consent), it is however doubtful if this option can be pushed through because the constitutional provision is non- ambiguous. The PDP might also appeal to morality by saying it is immoral for someone to be elected Speaker on the platform of a party and keep the position after crossing to another party. It is doubtful if Tambuwal will be swayed by this argument. If he would, he would have stepped aside in the first instance. Declare His Seat Vacant Another option is to declare his seat vacant, which will allow the PDP to kill two birds with one stone: get him out of the House (at least temporarily) and remove him as Speaker (as he needs to be a member of the House to be the Speaker). But this move will call for clear interpretation of the Constitution. In Section 68 (1) (g), the 1999 Constitution says “A member of the Senate or of the House of Representativesshall vacate his seat in the House of which he is a member if- – Being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected; provided that his membershipof the latter political party is not as a result of a division in the political party of which he was previously member or of a merger of two or more political parties or factions by one of which he was previously sponsored”. While the PDP can ask that Tambuwal should vacate his seat for defecting, Tambuwal can argue that he defected because of crisis and division in the PDP in Sokoto, his home state. He can claim that this was responsible for the reconciliatory meeting held by ChiefTony Anenih only last week in an attempt to broker peace. The two parties will be expected to test this in court. Make the House Ungovernable The last option is for the PDP to empower its foot-soldiers to make the House ungovernable for the Speaker by instigating one form of crisis or the other. There could be drama around the mace, parallel sessions and accusations. Given that most members are now more interested in securing their return tickets, this could work either way. The members could either be ready to do anything to get return tickets or they could be distracted by local politics in their constituencies. In any case, Tambuwal seems to have bought himselfa breather by adjourning seating till December 3. Whichever of these options the ruling parties decides to pursue,one thing is certain: there are interesting days ahead. MetropoleMag |

It was an atmosphere of jubilation as well as mourning on the floor of the House of Representatives today as the Speaker, Aminu Tambuwal declared for the All Progressives party, APC. At exactly 12:24pm Tambuwal In a short speech at the end of plenary, said he was defecting to the APC for political reasons adding that the yearning of his people in Sokoto State necessitates the decision. This puts to rest the avalanche of speculations on if or when he would defect. Some members of the PDP were in tears yesterday as Tambuwal declared. However, the APC Caucus in the House led by Femi Gbajabiamila said they would be stimulated into doing more by Tambuwal’s defection, adding that nothing has changed in the House as all members would work together for the advancement of the Parliament and greater good if the Nigerian people.
