March 31, 2018 Press Statement FG List: My Reply To The Media Trial - Olisa Metuh My attention has been drawn to the recent release of names of 'looters' by the APC led Federal Government through the Minister of information, Lai Mohammed. By this publication the federal government has breached our constitution by seeking to burden me with two criminal trials on the same charge, one before Justice Okon Abang and the other before the media. In response to the scandalous publication, I wish to state as follows : 1) Since my arrest on the 5th day of January 2016 and subsequent arraignment, I have refrained from publicly discussing my persecution and travails by the government because as a lawyer, trained in the finest traditions of the Bar, I know that it is wrong to discuss a matter that is subjudice. However the present action of the government leaves me no option than to defend my name and integrity. I have therefore decided to avail the public of the true state of the contrived case against me. 2) The charge against me is that I received the sum of N400 million from the Office of the National Security Adviser to carry out duties assigned to me as the then National Publicity Secretary of the PDP by then President and Commander in Chief of the Armed Forces of the Federal Republic of Nigeria. The major crux of the prosecution argument is that I ought to have known that the money was a part of an alleged and yet to be proven unlawful activity of Col Sambo Dasuki(rtd), former NSA to President Jonathan. 3) The charge was brought regardless of the fact that neither President Jonthan who gave me the assignment and directed the release of the funds nor Col Dasuki(rtd), who effected the release of the funds have ever been interrogated nor even interviewed in this regard. As a matter of fact, officers of the office of the National Security Adviser have testified in court that the payment made to me followed all due process usually observed in the establishment. 4) It is of interest to note that the prosecution has not alleged any mens rea or collusion on my part other than the suggestion that I 'ought to have known' of the alleged unlawful activity. Also the alleged illegality of the funds has neither been established in law nor in fact. 5) I have NEVER held a government office and/or position and could not therefore have had any access to government funds. 6) In view of the weakness of the case against me, the APC led Federal Government resorted to all kinds of dirty tactics to dehumanise and intimidate me.They have done everything humanly possible to ensure complete persecution starting from bringing me to court in handcuffs( and parading the capture of Nigeria's most wanted) to media trials and constant interference with my case. 7) I have been reliably informed that the Federal Government has ordered a conviction at all cost to ensure that the PDP is tainted before the elections. The government 's determination to achieve this objective is clearly highlighted by the refusal to allow me attend to my deteriorating health notwithstanding several expert medical opinion on the matter. By going to the media to name me a looter(without cross-checking the definition and dictionary meaning of the word) the federal government has not only given a body language but has issued a direct intimidation and threat to the judiciary to get a compulsory conviction.9) It is now clear that the APC led government that thrives in impunity and intimidation of other arms of government will not allow justice to be done in my matter. It is incontrovertible that our country has descended into the worst form of draconian rule where the executive arm directly interferes and seeks to control and determine matters within the purview of the legislature and the judiciary. 10) In view of this unprecedented executive rascality and lawlessness, I have asked my lawyers to review the implications of this latest attack by the government and take appropriate steps for redress 11) In all, my faith is firm in God that this tyranny will not last forever and that no mortal is omnipotent in my matter. March 30, 2018 Press Statement The Peoples Democratic Party (PDP) has accused the Presidency and the All Progressives Congress (APC) of having the spirit of bitterness and vengeance, adding that such is responsible for the economic dryness, divisiveness and hostility in the nation under their watch. This is just as the party has advised the Presidency to direct its demand for refund of stolen funds to President Muhammadu Buhari and the APC, as those responsible for looting are now in the APC where they enjoy the protection of the President. PDP National Publicity Secretary, Kola Ologbondiyan, in a statement on Friday, said the APC and the Presidency have been trying to transfer their vile spirit of vengeance to Nigerians, as manifested in their refusal to let go, even after the citizens have accepted PDP’s apology, which were made in the overall interest of national healing, renewal and reconciliation. The Presidency and the APC do not have the spirit of forgiveness. They believe that they must take revenge on everything. This is why they are going about hounding everybody perceived to hold opinions that are contrary to their interest. This explains why they have continued to keep people like the former National Security Adviser, Col. Sambo Dasuki (rtd) in detention, even after he has been granted bail by the courts. That is why they are after figures like Senate President Bukola Saraki, Deputy Senate President Ike Ekweremadu as well as politicians perceived to be interested in the 2019 Presidential elections. The fact however is that Nigerians have seen through their vile tendencies and have abandoned them in their vengeance seeking ventures. Moreover, it is incongruous and shameful that the Presidency and APC are still engaging in their hypocritical media trial of asking the PDP to refund alleged looted funds, when the world is aware that those who looted the economy are all in the APC where they have become the poster faces of President Buhari and his discredited party. While we restate our challenge to the Presidency to name any individual in the repositioned PDP indicted for looting public fund, we make bold to state that in President Buhari’s cabinet are former APC governors indicted by their states for looting funds belonging to the people, bulk of which were used to finance the President’s 2015 campaign. We also have the list of prominent individuals, who were indicted of looting but have since crossed over to the APC where they are now provided cover by the Buhari administration. We assert boldly that the PDP has never been convicted or indicted for corruption and that there is no individual in the rebranded PDP who is indicted of looting public funds. We challenged the APC and the Presidency to make similar claim or keep quiet and hide their faces in shame. If not, we will no longer hesitate to go public with the list of indicted individuals in their fold who looted their state resources and deployed such funds to Buhari 2015 Campaign. The National leader of the All Progressives Congress (APC) and the reconciliation committee chairman of the APC, Chief Asiwaju Bola Tinubu, admitted that the ruling party has failed to meet the expectations of Nigerians after almost three years in office. He also admitted that the goodwill which it enjoyed during the 2015 general elections and the inauguration of the Muhammadu Buhari’s administration had been squandered. Tinubu therefore concluded that the APC has a lot of work to do to regain public confidence and solidarity before the 2019 general elections. The former Governor of Lagos State bared his mind on the state of the party on Wednesday in Abuja when he held a closed-door meeting with the National Working Committee (NWC) of the party at its secretariat. The meeting was Tinubu’s first since Buhari appointed him to reconcile all the feuding leaders of the APC in various states of the federation. In his down to earth assessment of the APC, Tinubu said that the party had faced several challenges since it took over power in 2015, stressing that it needs serious consultations and reconciliation moves to regain the goodwill of Nigerians. He listed some of the challenges confronting the APC as the disorder in the North Central and North East zones, killings and agitations, as well as intra-party squabbles. Tinubu said that the expectations of Nigerians had been high since the party won the presidential election in 2015, but regretted that the expectations had not been met. In a brief chat with journalists before he went for a close-door meeting with the NWC, the APC leader said that his visit was to consult with the party’s leadership, in line with the mandate given to him by the President, stressing that consultations and reconciliation were required since APC is still the hope of Nigerians for a better future. In his words; “I am here to consult, since you are already aware of the directive and announcement of the President who is the leader of our party and the President of this country. “First, let me sympathise with our National Vice Chairman for North Central for the various incidents that are happening around that corridor, and may God bring peace to Benue, Taraba, Plateau, Nasarawa, and the country as a whole, and all other places being affected by the age-old system that we are now facing. “After the last convention of the party, congresses were held from various wards to elect representatives from the ward, local government and states levels as well as the national level. We worked hard for victory. We have never governed before, but we won the confidence of Nigerians to govern. “We have a creed to really serve the country; change and reform the country. It is not easy to have those changes implemented like instant curfew. We have to grow and face challenges. “I sympathise with us and we should equally look at ourselves. Since we won the election, the expectations were very high and the goodwill was extremely high. But where are we today? “The solution is to seek opinion and advise on the various complexities around some states or if there is any national one, to reconcile, move the party in a cohesive manner and reposition and build the confidence among ourselves”. “we have to push that. I won’t touch those areas yet,” he said. Earlier, the APC National Chairman, Chief John Odigie-Oyegun, who described Tinubu as a “Peace Ambassador”, said that his visit was significant as the President moves to heal wounds where the party has any, as well as to bring every member of the APC together under a single objective, which is to give the party a runaway victory in 2019. #Innoson group Vs GTBank : 30 Key Points you need to know about their dispute 1 - At all Material time , Innoson Nigeria Ltd operates a Current Account with GTBank . 2 - Innoson obtained , and had repaid same , a loan of N1.3billion from GTB Which was secured with a legal mortgage of its properties valued at more than N1.4billion . 3 - Innoson discovered that GTBank imposed excess and unlawful charges in its Current account . 4 Innoson Group Complained to GTBank on his discovery of access charges on his account . 5 - Both parties ( Innoson and GTBank ) agreed to invite an independent auditing firm that will be agreed by both parties . *6*- At the end , MULTI-WINGS Consulting Firm of Auditors was invited to properly audit Innoson Nigeria Ltd Current account No 0043753636 domiciled with Nnewi Branch of GTBank . The audit covers a period from March 2004 to Dec 2011 . 7 - After the account was audited , it was discovered that GTBank has been illegally deducting excess bank charges on its overdraft facility to the Innoson to the tune of seven hundred and Eighty-Six Million, Two Hundred and Five Thousand , Nine Hundred and Fifty-Five Naira , Ninety Nine kobo ( N786,205,955.99). 8 - GTBank was shocked at the audit report when the report was forwarded to it .They replied in their letter to Innoson on 20th January , 2012 that it will investigate the issue raised and will get back to Innoson on the Conclusion of its investigation . 9 - In the month of September 2012 , GTBank wrote to Innoson that from their personal audit report , the excess bank charges was Five Hundred and Fifty-Nine Million , three Hundred and Seventy-Two naira ,Nine kobo ( N 559.3Million). 10 - Innoson agreed to their version and decided to accept payment from it in the spirit of amicable resolution. *11*- Innoson also requested that the said agreed amount of N559.3million be paid with a 22% interest rate because Innoson had been repaying all his loan with GTBank at 22% interest rate. 12 - GTBank refused and said that the best they can repay excess and illegal deduction is at 7% interest rate . This led to another disagreement between Innoson and GTBank . 13 - As a result , in 2012 , Innoson sued GTBank at Federal High Court Awka with Suit No : FHC/Awk/Cs/2012 . 14 - Federal High Court, Awka delivered Judgement in favour of Innoson in excess of N4.7billion against GTBank. Delivering Judgement in suit no : FHC /Awk/ CS / 139/2012 , the FHC awarded N4.7billion to Innoson Motors against GTBank . The court also ordered GTBank to pay 22 % (percent ) interest on the Judgement debt until all the payment had been made to Innoson . 15 - In 2013 , GTBank appealed against the judgement to the Court of Appeal, Enugu Division, appoxite appeal No: CA/E/288/2013 . 16 - The Court of Appeal , Enugu in a Considered ruling ordered GTBank to pay the Judgement debt of N6billion Inclusive of the accrued interest and any interest that would subsequently accrue thereon into an interest yielding account in the Name of the Chief Registrar of the Court . 17 - In its various affidavits, particularly at the Court of Appeal in suit no : CA/E/288/2013 , GTBank deposed that if it pays the outstanding Judgement debt of N6billion , much less the N8.5billion , it could go bankrupt and be out of business . 18 - GTBank went to the Supreme Court .The case is still in the Supreme Court , while the Judgement debt is about N8billion now to be paid to Innoson by GTBank . #Another Cases: IBADAN Cases : Innoson /GTBank/Nigerian Custom Service : 19 - Nigerian Customs Service Auctioned Innoson goods . 20 - Innoson challenged the action Nigerian Custom Service for auctioning its goods at Federal High Court , Ibadan . 21 - On July 29 ,2011, In a Garnishee Order Absolute , the Federal High Court sitting in Ibadan ordered GTBank to Pay Innoson #2,048,737,443,67 (#2billion) from Nigerian Customs account in GTBank . 22 - Rather than Comply with the Garnishee Order Absolute of the Court , GTBank on February 6, 2015 appealed the Judgement , but the Court of Appeal in Appeal no. CA/1/258/2011 affirmed the Judgement of the Federal High Court and ordered GTBank to pay the Judgement debt of #2,048,737,443.67 (#2.048billion) to Innoson . 23 - GTBank , instead , appealed to the Supreme Court against the Court of Appeal's decision where GTBank claimed through a motion in suit no : Sc /694/2014, that the Court of Appeal Judgement in Ibadan (CA/I/258/2011) was procured by suspicious means . 24 - On May 12, 2017 , Supreme Court in its wisdom and rightly , dismissed that unfounded and exasperating claim of GTB against Innoson . 25 - As a result , Innoson commenced a N400 billion suit against GTBank , in the suit No: FCT /HC/CV/2448/2017 at the High Court of the Federal Capital Territory, Abuja . #Another issues 26 - Consequently , in order to save itself from paying the outstanding Judgement debts to Innoson , the GTBbank filed a petition against Innoson alleging forgery which led to the suit No : FHC /L/565C/2015 by Police . 27 - On February 17, 2016 , Police properly and Competently withdraw the charges against Innoson , saying they needed to properly investigate the bank's complaints first and see if they had merits . 28 - On September 1 , 2014 , GTBank secured an ex parte order on Innoson Nigeria Limited, dated September 1, 2014 with suit no FHC/L/CS/1119/2014 , filed before a Federal High Court in Lagos , between GTBank and Innoson Nigeria Limited , issued by *Justice Okon Abang* , ordering that , pending the hearing and the determination of the substantive suit , all Commercial Banks in Nigeria were restrained from accepting in any manner whatsoever to any mandate or instruction presented to them by Innoson Companies or any of its agents or nominees for withdrawal of any sum of money standing to the credit of any account maintained by the company in all the banks. 29 - However , on June 10, 2015 , *Justice Saliu Saidu* of the Federal High Court , Lagos , in a Considered ruling set aside the ex parte order of September 1, 2014 , by Justice Okon Abang and the writ of summon as well . 30 - Innoson then slammed a N30 billion suit on Guaranty Trust Bank for what it had suffered in monetary terms and reputational terms during the months when the accounts of its companies in all Nigerian banks were frozen. With Innoson winning both cases at the High Court and both cases at the Appeal Court, and GTB appealing, both cases are awaiting the verdict of the Supreme Court. Meanwhile the fresh N30 billion naira suit has just gone to the High Court to start its legal journey. .... In all , Innoson has won two High Court cases and two Appeal Court cases all against GTBank . Innoson as at today has Judgement debt over about N10billion based on 22% interest rate against GTBank . #Questions for EFCC : (i) Now where is the EFCC coming from in all these ? (ii) Does EFCC actually understand their duties here ? (iii) Is EFCC by their action not sabotaging Nigerian economy ? (iv) If EFCC should to arrest any of the parties , shouldn't GTBank who dubiously deducted Innoson money from his account and have debt of about N8billion to pay Innoson that they should arrest ?
