By the provisions of Section 140 of the Electoral Act 2010 (as amended), where an Election Tribunal or Court determines that a candidate who obtained the highest votes was not qualified to contest the election, it shall not declare the candidate with the second highest votes as elected, but it shall order for a fresh election.

On the other hand, where the Tribunal or Court determines that the candidate who was returned as elected did not score majority of valid votes at the election, it shall declare the candidate with the highest valid votes as elected.
Firefire, are you aware that in a case of Re-Run, PDP will not participate? Their candidate is invalid and the time of Primaries is long past.

Meaning PDP are just being Emotional and not Reasonable about this!

The fact is that the law requires the the Primaries hold in Taraba State capital. But PDP moved theirs to Abuja (against the laws of the land) in order to sell it to the highest bidder.

Even if you order a re-run, PDP will not participate because their candidate was illegally selected and the time for Primaries (selection of candidates) is long gone. Also for holding the Primary in Abuja, all the aspirants in PDP are automatically disqualified.

No matter how you mix this, PDP are losers on this one. It is Mama Taraba all the way. No one can stop a destiny whose time has come.

It is very shameful reading post after post as known supporter of PDP on this platform downplays and badmouth the victory of the Nigerian's Eaglets and the fact President Buhari is the only leader in the world to receive the Champions as a Military Head of State and a Civilian President. This unpatriotic show of shame is very appalling at the very least.

Well meaning Nigerians will continually celebrate good development in the country and support the administration of President Buhari as we all work towards greater victories. While some unscrupulous elements can even go to even to the extent of working for the destruction of Nigeria just to display their hatred for the President.

There is no way PDP can win Taraba - because even in the case of a re-run, PDP will not be allowed to participate. The process of choosing their candidate was flawed and the time of primaries is long gone.

This is what happens when some greedy politicians hijacks the electoral process to foist their own candidate on the people. I hope PDP will now learn the hard way.

The tribunal has legal backing to seat anywhere for security reasons. The question is, does PDP have legal right to hold the state's primary outside Taraba?
Answering that question will be the determining factor of the case
