Saraki is officially Finished |
The Attorney General of the Federation (AGF), Abubakar Malami, the Economic and Financial Crimes Commission (EFCC), the Inspector General of Police (IGP), Solomon Arase and others have asked Senate President, Bukola Saraki not to politicize his trial before the Code of Conduct Tribunal. They advised him to direct his energy at defending the charge against him rather than imputing political motive to his trail. They faulted Saraki’s claim that his trial was politically motivated. In a counter affidavit they filed at the Federal High Court, Abuja in response to a fresh suit by Saraki, they denied being influenced by any political consideration to initiate the 13-count false asset declaration charge against him (Saraki) before the CCT. The AGF, EFCC, IGP, the Director of Public Prosecution of the Federation (DPPF), Mohammed Diri and Muslim Hassan (a Deputy Director in the Federal Ministry of Justice) said Saraki’s trial was informed by the outcome of a joint investigation conducted by the EFCC, Department of State Services (DSS), the Code of Conduct Bureau (CCB) and the Independent Corrupt Practices and other related offences Commission (ICPC) between 2003 and 2015. They said the investigation revealed among others, that Saraki lied in the information he presented in the CCB Forms he completed between 2003 and 2011 in Ikoyi and Ikeja, Lagos, using third party companies, in which he had interest, with the intension of concealing his interests in such property. They gave the name of the companies as: Tiny Tee Limited, Vitti Oil Limited, Skyview Properties Limited and Carlisle properties. The AGF, EFCC, IGP, Diri and Hassan added that the Senate President lied in his claim that an official of the Federal Ministry of Justice, Bulus Micheal informed him that his trial was politically motivated. They said no official of the ministry bears such name. “The charges preferred against him before the CCT were based on the conviction that a prima facie case was disclosed after investigation and not on any political consideration. The 1st, 2nd, 4th, 10th and 11th respondents (AGF, EFCC, IGP, Diri and Hassan) are not politicians and they have no interest in who becomes the Senate President. “The 1st, 2nd, 4th, 10th and 11th respondents do not take instructions from any politician, but are public officers and public offices, who are only interested in the performance of their statutory and constitutional duties. “No one has made or is making any effort to trump up allegations against the applicant, but the charges that were preferred against him were preferred upon being satisfied that a prima facie case was disclosed against him.” They denied Saraki’s allegation that his rights were being violated with his trial before the CCT, arguing that aside that the charges were validly preferred, the Court of Appeal, Abuja has, in its judgment of October 30, 2015 upheld the CCT’s position that it possessed the jurisdiction to try Saraki based on the charge. In their notice of objection, they challenged the court’s jurisdiction to hear Saraki’s fresh suit, noting that the reliefs he was seeking in the new suit are contained in a similar suit marked: FHC/ABJ/CS/775/2015, which he earlier filed before the court, and which has now been assigned to Justice Evoh Chukwu of Court 8 for hearing. Saraki is, by the new suit, seeking to stop all the respondents, including the CCT, CCB from proceeding with his trial. He accused them of violating his rights. Last Monday, Justice Abdukadir Abadulkafarati heard an ex-parte motion for interim restraining order filed along with the new fundamental rights enforcement suit by Saraki. The judge declined to grant the applicant’s prayer, but instead, directed that the respondents be served with the motion and other processes in the case for them to show cause Friday (November 20) why the order sought by Saraki should not be granted. Justice Abdulkafarati found that not all the defendants were served by the applicant as ordered by the court. He refused argument by Saraki’s lawyer, Ajibola Oluyede that he take further steps in the case. The judge insisted that every respondent in the case must be served before any further steps could be taken in the case. He consolidated the originating summons and preliminary objection, in view of his decision to hear all the processes simultaneously, and adjourned to December 2for hearing. The judge ordered that hearing notices be issued on the 3rd, 5th, 6th, 7th, 8th and 9th respondents (ICPC, CCB, CCT, CCT Chairman, Danladi Umar, Atadaeze Agu Azda –CCT member, and Sam Saba – Director General, CCB), who are yet to be served as earlier ordered by the court. The Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Mr. Ibrahim Magu, has ordered the arrest of a director and five officers for the alleged leakage of information and corrupt practices. The agency is investigating some of its top operatives, who are believed to be living above their earnings. The massive clean-up has caused tension in the commission because of the likely sack of bad eggs. A source said: “The no-nonsense acting chairman of the Economic and Financial Crime Commission, Ibrahim Magu, has commenced a massive clean-up of the agency with the arrest of some officers. “Those affected are a director and five officers who are causing disaffection and engaging in corrupt practices. “We will not release their names until the investigation is completed.” The source also gave details on the allegations against the six suspects. “They were allegedly involved in unauthorised leakages of official information and causing damaging reports based on false information to be published against the commission by bloggers. “The action of the officers is prejudicial to discipline and violates their oath of allegiance. “Those in custody include a director, some senior and lower cadre officers, including a former senior operative, who was dismissed for corruption and involvement in cult activities. “In recent times, the EFCC has been at the receiving end of negative reports by bloggers and the mainstream media, targeting its leadership. The malicious reports have done untold damage to the reputation of the commission. “Available facts showed that the staff, who operated as a syndicate, were desperately projecting the management staff to take over the leadership of the commission while attacking the integrity, professionalism and reputation of the EFCC. “The investigation is still o, with the possibility of more arrests in the coming days.” Meanwhile, the EFCC has started probing workers and operatives living above their means. It was also learnt that some workers, who used to collect bribes to influence investigation, were being sorted out. Another source said: “We have some workers using exotic cars above their income or family inheritance. We are looking into the activities of these workers in order to rid this commission of bad eggs. “Also in focus of the discreet investigators are workers against which allegations of corruption have been made by the public. “This clean-up has created tension in the anti-graft agency. Magu has vowed to ginger up the anti-graft campaign and he will leave no stone unturned.” EFCC chair Magu orders arrest of agency’s director, others - The Nation Nigeria http://thenationonlineng.net/efcc-chair-magu-orders-arrest-of-agencys-director-others/ |

Former Minister for Petroleum Resources, Diezani Alison-Madueke has denied allegations that she blocked a move by former Central Bank Governor, Sanusi Lamido Sanusi to contest for the presidency of the African Development Bank, stating that it was some un-named aides under then President Goodluck Jonathan that scuttled Sanusi’s dream. She disclosed this in an interview with Dele Momodu, having promised back in the United Kingdom in October that she would speak about her stewardship as Nigeria’s first petroleum minister. Sanusi, who is now the Emir of Kano, had a run-in with the Jonathan administration close to the end of his tenure as head of the nation’s apex bank, one of which involved an allegation that $20 billion was not remitted into the nation’s coffers by the Nigerian National Petroleum Corporation. Alison-Madueke said of Sanusi’s relationship with the president’s aides: “There were those who said the then Governor of Central Bank must have been angry at me because of the way the Presidency treated him. “In all honesty, he was being blocked from seeing the President by some of Oga’s people (presidential aides) but it had nothing to do with me. “I was the one who even told Oga about the development and Oga said he would meet him in London on one of his trips. “Unfortunately, my boss fell ill and was rushed to King Edward Hospital and the meeting was aborted.” “Sanusi and I had been friends. There was no way I would have done anything bad to him. He even came to my house to inform me about his interest in heading the African Development Bank and we discussed for about two hours. “I promised to support him and I spoke to Oga about it. We were together on the Reconciliation Committee that looked into the accounts of NNPC. Femi Adesina, Nigeria’s immediate-past substantive agriculture minister, was elected to the exalted office of President of the AfDB in May 2015. Opinion 2 hours ago Editor’s note: Without fail, every article on Ibrahim Magu, the deputy commissioner of police and the newly-appointed acting chairman of the Economic and Financial Crimes Commission (EFCC), contains a few words on how brilliant, unrelenting and tough Magu is. Alkasim Abdulkadir, the Naij.com columnist, helps us to make a more accurate portrait of the new EFCC boss. Ibrahim Magu One puzzle bothered Nigerians on the evening of 9th November, 2015: the identity of Nigeria’s new anti-corruption boss. Who is Ibrahim Magu? Many questions rang across the social media platforms that evening. Then, slowly, sketchy profiles and grainy pictures started appearing. Before nightfall, a narrative had been in place. Ibrahim Magu was one of Nuhu Ribadu’s henchmen before he was transferred. He is very strict and fashioned in the like-minded image of Ribadu. For some, the latter description was good enough to start regarding Ribadu (not the politician) as the most successful anti-corruption fighter to ever grace this land. Let Ibrahim Magu’s service record speak for him Magu is on a familiar terrain here. His prosecution list reads like a guest list to a very important political fund raiser rather than an allegation sheet. He prosecuted and charged to court Ayodele Fayose, the current governor of Ekiti state, he led the investigation of Sen. Joshua Dariye, the former governor of Plateau state. He also investigated former Nasarawa state Governor Abdullahi Adamu and Korean Yo Jim for the Farin Ruwa Hydro Electric Dam which became a white elephant project. He charged to court the former Sokoto state governor, Alh. Attahiru Baffarawa on the alleged diversion of public funds, and similarly spearheaded the case against Boni Haruna, the former governor of Adamawa state. He was also at the forefront of building the case against Steph Edward Jason, Jim Bob Brown at then members of the Wilbros Group alleged to have given government officials gratification to win the Eastern Gas Gathering System. This investigation was conducted in collaboration with the US Justice Department and the FBI. One of his most famous cases has been the prosecution of and securing a subsequent jail term for his boss, Inspector General of Police Tafa Balogun. Another equally high-profile case was that of Prince Abubakar Audu, the then-governor of Kogi state, and, coincidentally, the current gubernatorial candidate, who was charged to court on allegations of diverting ten billion naira to purchase real estate assets abroad. Alfred Omoerah is still serving his 10-year prison term after forging customs duty clearance and defrauding the federal government of 214 million naira with the help of a staff in the then-accountant general’s office. The long-term heist ensured they had no option of fine. All these cases and Magu’s famed no-nonsense mien earned him the appellation “the General” from his colleagues and subordinates at the anti-graft agency. A new chapter in the anti-corruption book? In 1980, Ibrahim Magu graduated from the Government Secondary School in Waka-Biu. He attended Ahmadu Bello University, Zaria, from 1983 to 1986, graduating with honours and obtained a degree in accounting. In 2005, to understand the ramifications and far-reaching impact of the effect of corruption, he enrolled at the University of Hong Kong and obtained a graduate certificate in corruption studies. Between 2010 and 2011, he earned a masters degree in law enforcement and criminal justice from his alma mater, ABU Zaria. One of the hardest trails currently beclouded in Nigeria is that of tracing the terrorism financing flow. Ibrahim Magu attended anti money-laundering courses with the FBI, and anti-terrorism, combating the financing of terrorism courses with the US Department of Justice and the Department of Homeland Security. This background will allow him to create a pathway in tracing the financial transactions meant for sponsoring terrorism-related activities. In his inaugural address, Magu did not mince words in pointing an accusing finger inwards and made it clear that this will no longer be the business as usual in house. He delivered the punchline when he said no EFCC official had a place in the fight against corruption if they were corrupt themselves. Without gainsaying, Magu comes to the job with the requisite credentials and stem reputation to get the job done and decrease Nigeria’s perception as the bastion of financial crimes and mismanagement of resources. As it is with corruption, it will eventually fight back. But first, the “general” has to lead the war against it. The Nigerian National Petroleum Corporation (NNPC) says its mega stations across the country will begin a 24-hour sale of petroleum products to quell scarcity. In a statement on Friday, Ohi Alegbe, group general manager public affairs division of NNPC, said the corporation had enough volume of petrol in stock to satisfy the nation’s domestic consumption requirement. He noted that the prevailing fuel queues in some major cities across the country had nothing to do with the lack of supply of petroleum products. Justine Ezeala, executive director (commercial) of the Pipeline and Products Marketing Company (PPMC), stated that a projected volume of N1.4bn litres of petrol was available for distribution to fuel stations across the country for November alone. As part of the extra measure in place to tackle the artificially induced queues, PPMC has increased the volume of petrol being trucked out to fuel stations across major cities in the country, Ezeala added. He also revealed that most of the 37 NNPC retail mega stations across the country had been directed to commence 24-hour service. “NNPC Retail has 513 retail outlets all over the country and the strategy is that every one of these stations is designed to have products at all times,” he said. “In addition we have decided that most of the mega stations will adopt 24 hours operation model and where, for security reasons, that cannot be met, we are going to have extended hours of operation in such location starting from 5am till about 10pm daily.” Oladipo Fagbola, a managing director, said in addition to the commencement of the 24-hour service, the state-owned oil firm had opened up some hotlines to enable members of the public provide useful feedback and intelligence on the operations of mega and affiliate filling stations across the country. The hotlines are 08057008021, 08052195801 and 08100941174. He urged members of the public to provide useful information to assist the corporation achieve its mandate and responsibility to the fuel consumers. • Fear grips civil servants over restructuring • Presidency unfair to Culture, says Soyinka NEW ministers, new style. Barely 48 hours after President Muhammadu Buhari inaugurated his 37-member ‘round- pegs-in-round-holes’ cabinet to man the 25 restructured ministries, some of them are already raring to go. They have been reeling out statements that indicate the direction of the present government. Among such ministers is Power, Works and Housing’s Babatunde Raji Fashola, who has commenced inquiry into the problems of the power sector and why it allegedly failed to deliver the desired promises to the country. Fashola, who met with directors at the ministry shortly after he resumed Wednesday wanted to know if some of the problems of the sector were systematic or man made. He urged the management of the ministry to be open with information, as he was determined to find a solution to the lingering power issue. “We are here to work with you, in solving problems on ground as quickly as possible. We want to know if some of those problems are man-made or systemic,” he noted. A meeting that took place on the day of inauguration was attended by the Minister of State, Alhaji Mustapha Baba Shehuri, the Permanent Secretary, Mr. Louis Edozien and directors. The minister said his thoughts are on how to bring together processes and activities of all the ministries now under his supervision for effective service delivery. He assured the ministry’s leadership of his willingness to learn from them as career people who had been on the job for a long time. “We want information on what has been done, what remained to be done, and what are the future plans; we want to continue from there.” Also speaking, Shehuri requested a detailed Ministerial Briefing Document to serve as guide for proper takeoff. Director, Human Resources, Mrs. Grace Papka, gave copies of the requested documents to the two ministers, in addition to a timetable for proposed briefings by departments and agencies in the power sector. Already concerned Nigerians have hailed President Buhari’s choice of Fashola as ‘placing square peg in square hole. Speaking under the aegis of Gateway for Empowerment and Justice for Peace Initiative (GEJPI), the group at a media briefing yesterday in Abuja said that considering the requisite experience and records of performance in maintaining sustained economic growth and unprecedented infrastructure development in the last eight years in Lagos State, it is only appropriate that Fashola be given a heavy portfolio to handle. Leader of the group, Jide Cole, an engineer said: “Yes, we are aware that the All Progressives Congress (APC) and Buhari were determined to bring on board the best technocrats and administrators into the new government. Our expectations have been met and even surpassed as the President gave Nigerians a pleasant surprise. “Therefore, we want to lend our voice, joining other well-meaning citizens of this great nation in thanking Buhari for such great show of wisdom and administrative finesse by putting square pegs in square holes. We also congratulate Fashola for being best suited as minister for the combined portfolios he got because he is a hard working, unassuming and transparently so. He is a person who never gets tired of whatever he sets his eyes to achieve. He came in as governor of Lagos State in 2007, and after eight years turned Lagos into the state to beat in Nigeria. “We also believe that President Buhari saw Fashola as a disciplined man just like himself who was ready to work assiduously. He ensured that he implemented his predecessor’s idea for a Bus Rapid Transport System which eased the transportation problems of Lagosians. And of course, this trait is one of the things Fashola will bring to bear in his new assignment.” Meanwhile, there is anxiety among directors and other senior level workers in ministries affected by the restructuring like Aviation, Police Affairs, Housing, Urban Development, Power and Works, Youths and Sports even as Nobel laureate, Professor Wole Soyinka, yesterday decried the fact the Culture Ministry was a victim of the exercise. To him, the Culture Ministry is ‘missing in action.’ “We all know that culture is, at best regarded as an orphan, but does General Buhari have to make it so obvious? Even orphans are entitled to a foster home,” he lamented. Culture is now subsumed by the Ministry of Information, while Special Duties was scrapped and the Department of Budget and National Planning excised from the Ministry of Finance and now a substantive ministry headed by Senator Udo Udoma. However, the workers in the affected ministries, yesterday gathered in groups discussing the development as many expressed the concern that they could soon be rendered redundant. But, it was a blend of joy and sadness in many of the merged ministries, while some workers wore long faces, others were happy that their arrears of salary had been paid. The Federal Government had compulsorily retired 17 permanent secretaries from the Federal Civil Service, sending mixed signals to directors, deputy directors and other junior officers, especially cleaners. In a related development, Minister of Science and Technology Dr. Ogbonnaya Onu had said that Nigeria could “not do it without science and technology.” He spoke at a reception organised in his honour by Concerned Ebonyi State natives in Abuja, where he pledged to revive the Technology Village Project in Abia. His words: “Science and technology will take Nigeria to a height unimagined today; we will do our best to be the instruments that Nigeria will use to get to that height. And I need your prayers; I need your support,” he said. He noted: “One assurance that I will always give you and I have said it repeatedly, is that as your son, I will never do something that you will be ashamed of. It is better for me to leave politics than for me to do something for my own selfish interest that will make you to be ashamed of your son. I will continue to act in a way that Nigerians will know that Ebonyi State is truly the Salt of the Nation.” Defence Minister expected to resume today The newly appointed Minister of Defence, Brigadier General Mansur Mohammed Dan-Ali, will formally resume today. A message from the office of the Department of Information and Public Affairs in the ministry to Defence correspondents yesterday evening said the minister would be resuming today at 8 a.m. local time. It is expected that, like in all other ministries, Dan-Ali, on resumption, set the ball rolling as issues relating to the ministry form some of the major concerns of the present administration.
