PoliticsCourt Nullifies Benue Rep-elect’s Certificate Of Return, Orders Prosecution by emaculate99(op): 12:18pm On May 20, 2015
A Federal High Court in Abuja has ordered the Independent National Electoral Commission to nullify the certificate of return issued to Christian Abah  for the Ado/Okpokwu/Ogbadibo Federal ‎Constituency seat in the House of Representatives‎ of the forthcoming 8th National Assembly.

Justice Adeniyi Ademola, delivering judgment in the suit challenging Abah’s eligibility to stand for the election, held that the allegation of certificate forgery levelled against him, by the plaintiff, Mr. Hassan Saleh, was established to be true.

Abah was said to have forged an Ordinary National Diploma certificate in Accountancy purportedly obtained from the Federal Polytechnic, Mubi, in 1985.

Justice Ademola said his findings revealed that an earlier judgment of the  National/State Assembly Election Petition Tribunal ‎sitting in Makurdi delivered on September 6, 2011, and a letter by the Registrar of the polytechnic, Mr. Suleiman Buba, affirmed that the certificate presented by by Abah to INEC was forged.

The court ordered the Inspector-General of Police, Mr. Solomon Arase, to immediately commence prosecution of Abah for forgery and perjury.

Abah, who is a member of the Peoples Democratic Party, had earlier been declared unopposed and elected being the only candidate presented for the March 28, 2015 election.

The court  in his judgment declared all the votes that accrued to him in the PDP’s primary held on December 6, 2014, as wasted and also declared Saleh, who came second as the winner of the primary.

He ordered INEC to issue a fresh certificate of return to Saleh.

The court also ordered the incoming Speaker of the ‎8th National Assembly to swear in Saleh as the member representing Ado/Okpokwu/Ogbadibo Federal ‎Constituency.

The court also berated the conduct of the counsel for PDP and Abah in the suit, Mr. S.I Ameh (SAN), for the frivolous applications and tactics to delay the hearing of the case.

Justice Ademola therefore ordered that the processes filed in the suit and his judgment be served on the Nigerian Bar Association, the Legal Practitioners Disciplinary Committee, the Legal Practitioners Privileges Committee with a view of taking appropriate sanction against Ameh.

The judge also imposed a N450,000 fine on the three defendants – the PDP, INEC and Abah in favour of the plaintiff.

The court berated both the INEC and PDP for promoting “the culture of impunity” by their failure to disqualify Abah from participating in the election in view of the court judgement that had since 2011 affirmed that he (Abah) presented a forged certificate for the purpose of standing for an election.

EHITZ:
You are clearly looking for relevance and wants to be noticed as the good guy.
Truth is, a lawyer, like every other professional is entitled to his professional fees. It lies on the bargaining power of the clients.
Do you have an idea of the energy, finances invested into becoming a lawyer? I bet you may not.
On the issue of ethics, its a different ball game. I may agree with you.
I understand how you feel. you thought am destroying the trade of law but am not destroying it. I am just telling things to know in order to escape being cheated by those who parade themselves as lawyers and those lawyers who are ready to cheat the people with their knowledge of law. The legal profession has etiquette and this article is written based on the etiquette.
lastly, am a law student and I know the stress and money that legal profession requires. is the stress and money invested in the study of law a justifiable factor in cheating the masses who might have little or no livelihood? Most Nigerians are living under $2 a day and with this should some lawyers still cheat the masses?

CareerEscape Being Cheated By Lawyers. by emaculate99(op): 3:37am On May 16, 2015
Over the years, lawyers had been notorious in cheating the masses with their mischievous acts and thinking. I think it's high time to drop some codes in preventing yourself from being cheated by them. Always remember that lawyers are not trained to be cheating the masses but the Judas Iscariots among the lawyers are the one cheating the masses. Being caught in cheating the masses is an act that can attract an attractive punishment but many Judas Iscariots do it freely without being caught. Not to fall into their traps, I think you should know these:

Tips on how to escape from the Judas Iscariot of law

To escape from these people, you have to know that the lawyer you are hiring possesses the following qualities:

1. Communication
A lawyer must communicate with you in a way that keeps you updated about your case.
Communication problems can cause you to think that you have a bad lawyer when you don't, or that your lawyer is doing a bad job when he might not.
Your lawyer should give you a basic description of your legal matter and let you know what problems to expect, how they will be handled, and when things will happen.
And of course, your lawyer should promptly return
phone calls and answer your questions -basic
courtesies that many lawyers commonly ignore because they are so busy.
If the communication between you and your lawyer still remain bad after some talk with him (yet he didn't give a genuine reason for that) the best thing to do is to be smart and find another lawyer who can communicate well with you because without communication, the case is bound to fail.

2. Competency
A lawyer can be brilliant and might not be competent. Competency does not need your brilliance but your intelligence. Some of the incompetent lawyers do look for avenues to cheat on their clients (magas).
Competence is the core knowledge and expertise of the legal profession. Lawyers aren't machine and you cannot expect them to be always right every time. Moreover, people can claim that they are always right due to the fact that they passed the bar examination but it should be noted that since the bar examination had been passed, they might not have any test after that and also some lawyers only cram to pass and don't know the core knowledge and expertise of law.
However, some lawyers are so judasical in their action and act in an incompetent way either procedurally (not filing a case on time) or ethically (representing both side in a divorce case at the same time without notifying the either sides).
The good news is that you can sue the lawyer for any loss incurred by his action and the bad news is that such lawsuits are almost impossible to win and are always expensive.

3. Ethics:
Each state (country) has its own ethical rules and agency to discipline any erring lawyers.
Ethics of all the states in the world have common grounds and which include:
1. Representation of clients with total loyalty
2. prioritising the interest of the client ahead of his.
3. keep client's confidences
4. Indulge not in criminal activities
5. Maintenance of a separate bank account for the client
Any erring lawyer can be fined, suspended, told to return the stolen money, derobed (revocation of law license).

4. Fee:
This is where the Judas Iscariots show their true colour. As clients, you must be sharp whenever you are dealing with lawyers in this regard. Disputes do abound between the client and the lawyer on fee. commonly, the disputes are related to:
1. High fee of the lawyer
2. Itemised bills
3. Billing a lawyer rate for the work done by a paralegal.
4. Overcharge due to time spent on a case
5. Bill reduction due if bed job done by a lawyer.
The good news is that we can avoid this dispute by entering a fee agreement with the lawyer. you should ensure that this agreement is clear and easy to understand and has a mandatory arbitration clause in case there is dispute. you don't need to go to court to contest your fee whenever there's dispute if you include the arbitration clause in the agreement.

Note: there are many Judas Iscariots spoiling legal professions by trying to scam the masses. The above clues will help you to escape from the Judas Iscariots.

Nairaland GeneralBeliefs About The Trekkers; check out if your belief is there. by emaculate99(op): 8:50am On May 15, 2015
Nigeria has recently become the hub of trekkers. I will like to make a list of the beliefs that people have about the trekkers. I know that some of us will be guilty of one or two of these. These include:
1. The trekkers are jobless: we believe that it's only a person that has nothing to do will embark on such journey for days. A person can not just leave his job for days without incurring any loss.
2. The trekkers are mad: To some people, only a mad person will trek such distance. They then conclude that these trekkers are mad.
3. The trekkers are heroes: some take these trekkers to be extraordinary people doing extraordinary things to appreciate or make a complaint on behalf of a group of people and therefore, they should be praised for their courage.
4. The trekkers are poor: some people take these trekkers to be poor and cannot afford the transport fare to there destinations. They take them to be trekking under the pretense of appreciating or making a complaint but in the real sense, they can't afford the transport fare to their destinations and that what is making them to trek.
5. The trekkers are attention seekers: most people believe that the trekkers are just trekking just to gain cheap attentions, especially from the social media and the leader they are going to "appreciate."
6. The trekkers are liars: some of us still hold the fact that there is nothing like trek because no man can ever trek such distance. Many people are still doubting if these people are really trekking.

What is (are) ur own belief about this trekking fever? Mine is no 5 and what is urs?

people had been criticising the fact that the reporter wrote that 4 people were arrested in 5 states. this is my own view about it. I guess the police men arrested the thieves at Lagos(State of the crime) but they escaped from the policemen and they were later arrested in the other four states after reports had reached other stations. the policemen didnt report the fact that some escape from them because of Nigerians' comments. this is just a guess work oooo but I must say that, that part is too obscure.

Four suspected members of the gang that robbed a new generation bank in Lekki, Lagos State, in March have been arrested by operatives of the Special Anti-Robbery Squad of the Lagos Command.

An eyewitness told Channels Television that the gang members were arrested in Lagos, Osun, Ondo, Ogun and Delta State, after series of investigations that led them within and outside the country.

The Armed Robbers had attacked a bank along Admiralty Way, Lekki, killing three policemen and a teenage fish hawker in a deadly shoot-out.

Channels Television gathered that the robbers, in their bid to escape through the link bridge to Ikoyi after robbing the bank, encountered the policemen.

After the robbery, the police said investigations had started, promising to arrest those behind the attack that left four persons dead.

It was also gathered that two Iphones stolen from the scene of robbery were recovered.

Meanwhile, efforts are still on to arrest other members of the gang that killed three police men and a female trader during their operation.

Nairaland GeneralA Nairalander Vow To Trek If Buhari Can Regulate MTN by emaculate99(op):
Chai! I think it had become a norm now for people to be
trekking a long distance just to respect their "master"
for doing something "great." At first, it was a guy who
vowed to trek from Lagos to Abuja if Buhari won the
election. lo and behold, he fulfilled his vow! The next
person on the list is one Abubakar who made up his mind
to trek from Yola to Abuja. He is on his way, I am not
sure maybe he could fulfill it but let's keep watching sha.
A guy also promised to ride a bicycle (though it's a
rickety bicycle) from Katsina to Lagos to thank the
Yoruba for voting Buhari. A guy, Oladele(if my memory
is still functioning), promised to trek from Abuja to
Otueke to thank Goodluck for being democratic. I think
this guy is the one enjoying most ooo, in the course of his
journey, a lady (who will probably be his wife, if he is still
a bachelor) joined him and he got a monetary assistance
from UK. Charlie boy had also vowed to ride a bike to
China if Buhari equate naira to dollar. To top it up,
basket mouth said that he will trek from his room to his
garage to take his car and travel to Abuja to
congratulate Buhari.
And I am now saying that I, Emaculate Emmanuel
Ernest, will trek from the sitting room to the kitchen if
and only if Buhari can regulate the legal thieves which
include DSTV, MTN, Shoprite, and some people that I
can't mention here cos they are many in Nigeria.

Nairaland GeneralMayweather to be Fought by Amir Khan by emaculate99(op): 1:28pm On May 05, 2015
Britain’s former two-time light-welterweight world
champion Amir Khan has said he wants to be the next
opponent for Floyd Mayweather after watching ringside
as the American outpointed Manny Pacquiao in the Las
Vegas superfight on Saturday.
Mayweather kept his unbeaten record with a unanimous
points victory over Pacquiao in a welterweight unification
showdown that failed to live up to all the pre-match
hype, but fully highlighted the winner’s superb defensive
skills.
Mayweather said after the fight that he would only get
in the ring once more – in September – and Khan, 10
years younger at 28, believes he is ideally placed to be
the American’s final opponent.
“I think the fight is there,” Khan told the BBC .
“I spoke to Len Ellerbe, his manager, I saw him in the
media room and he came over to say ‘hi…he’s ready
when you are’.
“I think Mayweather’s team want the fight. But then –
on the other hand – I’ve even spoken to Manny’s team
and they said the same thing. (They said), ‘Look Amir, I
think it’d be good to have the fight between you and
Manny next’.
“So, I’m in a position where I could fight either guy but I
think Mayweather’s the one I want, because I really
believe I have his number.”
The Bolton boxer, with 30 wins and three losses to date
in his career, is in action later this month in New York
taking on Chris Algieri, but he hopes to get in the ring
with Mayweather later this year or early in 2016.
“I think it would be an amazing fight, one that boxing
fans all around are talking about because I really believe
size is a big factor between me and him and the speed
and the power as well. I really believe I have his
number.”
Early reactions to the richest fight in boxing history were
mixed with Oscar de la Hoya, a former rival of both
Mayweather and Pacquiao saying on Twitter : “Sorry
boxing fans” and “call me old school but I like the fans
getting their money’s worth by watching an action
packed fight.”
Former Irish champion Barry McGuigan agreed saying
on his Twitter site “boringly one-sided”
Others though praised the boxing skills of Mayweather as
he took his unbeaten streak to 48 wins over 19 years.
Former world heavyweight champion Mike Tyson, who
had picked Pacquiao to win told Sky Sports, “It’s him.
It’s who he is. It’s just his time at the moment.”
Britain’s Lennox Lewis on Twitter said, “If U can’t catch
it you can’t hit it #Maypac that pretty much sums up
the fight.”
