The court presided over by Justice A. T Badamasi, also ordered the seven-man investigative committee set up by the assembly to maintain the status quo ante. A group of constitutional lawyers, “Lawyers for the Sustainable Democracy of Nigeria”, had dragged Kano State House of Assembly to court and sought for an order to stop its committee from further investigation into the matter. The National President of the group, Barrister Muhammad Zubair, who read the court order to newsmen today, said the investigation contradicted the law that separates powers among the three tiers of governments on how to operate. He said, the case was criminal, hence only a competent court of law could entertain it. “Though the house relied on Sections 128-129 of the Assembly in conducting its investigation, however, the assembly can only do so if there is any petition to that effect from someone,” he said. The order of interim injunction reads, “Upon carefully running through the ex-parte application dated 5th day of November 2018 filed by the Counsel for the plaintiff accompanied by a 23-paragraph affidavit duly deposed by Muhammad Zubair, the Court granted the order”. The court said the respondents, Kano Assembly, Chairman of the Committee Baffa Babba Danagundi and the Attorney General should be served before closing hours of Monday, November 5, 2018. “And that accelerated hearing is hereby ordered and the respondents are given 4 days to respond to this application after serving,” it said. The court also ordered that parties should maintain status quo ante pending the hearing of the motion on notice, and adjourned the case to November 12, 2018 for hearing. When contacted, the chairman of the Kano Assembly seven-man Committee, Hon. Baffa Babba Danagundi, said the committee had not been served with the order, hence nothing could stop them from discharging their responsibility. He, however, said when they were served, they would respect the rule of law as lawmakers. “We have promised to do justice to the case and we will do justice to whoever deserves it. November 5, 2018 Press Statement PDP To Buhari: Speak Out On N378 bn NLNG Scandal The Peoples Democratic Party (PDP) challenges President Muhammadu Buhari and the All Progressives Congress (APC) to speak out on revelations of how N378 billion proceed from the Nigerian Liquefied Natural Gas dividends was allegedly siphoned by the Buhari Presidency cabal, under sleazy oil subsidy deals. The party said Nigerians were startled by revelations of how the funds from the NLNG, an agency under President Buhari’s direct supervision as Minister of petroleum, was secretly lifted and spent without the appropriation of the National Assembly. Available intelligence shows that the Presidency cabal cornered the money under the guise of subsidy payments but allegedly diverted a huge part of it to members of the cabal and some key APC leaders, which they used to finance their wasteful lifestyle, including acquiring posh property within and outside the country. If there was no ulterior agenda; if the money was actually meant for payment of subsidy, why was it drawn and purportedly spent without recourse to the constitutionally required approval of the National Assembly and other due process procedures under our laws? The PDP notes that such humongous corruption and stealing of trillions of naira in the oil and gas sector, which is under President Buhari’s purview, as Minister of Petroleum, is directly responsible for the biting economic recession and its attendant high cost of living, acute hunger and starvation, poor living standard, dilapidated infrastructure, escalated violence and high mortality rate in the country in the last three and half years. If the Buhari-led APC administration had curtailed its greed and allowed for a little transparency in governance, our nation would not be in the dire strait in which we have found ourselves today. In any case, what else does one expect from a government replete with avaricious individuals, certificate forgers and liars. The PDP challenges President Buhari, as Mr. Integrity, to speak out on the monstrous corruption in his Presidency, which has also failed to offer explanations for the alleged siphoning of over N10 trillion from various sleazes, particularly in the oil and gas sector. Finally, the PDP urges the National Assembly to immediately open an inquest into the N378 billion NLNG scandal and unravel who actually authorized the withdrawal, the beneficiaries, as well as what each APC leader got from this huge scam, with a view to exposing them and recovering the fund in the national interest. FG’s Failure to Pay Service Providers May Ground TSA There are strong indications that the federal government’s Single Treasury Account (TSA) policy may be grounded, following the government’s failure to pay the technology service providers and participating banks their commission in the past 22 months. A reliable source in the Federal Ministry of Finance, who spoke with THISDAY yesterday, said the major reason the federal government approved a new TSA tariff model which mandated that the service charge on payment to its ministries, departments and agencies (MDAs) from last Thursday, would be borne by the individuals or corporate organisations making the payment, was to ensure that the debts no longer accumulate. Attempts to speak with the Accountant-General of the Federation, Mr. Ahmed Idris, on the matter proved abortive as he did not respond to phone calls yesterday, neither did he respond to text messages by THISDAY. An indigenous firm, SystemSpecs, was engaged to provide the Remita platform on which the Central Bank of Nigeria (CBN) coordinates all accounts linked to the TSA. Under the terms of the service which was agreed after some controversies, SystemSpecs is entitled to one per cent of each in-bound transaction and up to N5, 000 for each out-bound transaction. The firm was last paid in 2016, while as of December 2017 the total outstanding against SystemSpecs was in excess of N10bn for out-bound services. The payment app is a single online platform that manages financial payments tags and has blocked all financial leakages in the government circle. Responding to enquiries on why the federal government decided to shift the charges to payers, the source explained, “Remember the service provider used to get one per cent on each transaction on that platform, which was re-negotiated to one per cent, but a maximum amount of N5, 000. Then there was a disagreement on the effective date of the difference. “But they eventually agreed with the date proposed by the federal government and for 22 months after that agreement was reached, they have not been paid and the debt has been accumulating. November 4, 2018 Press Statement PDP: Buhari’s Certificate Saga, Worst National Embarrassment The Peoples Democratic Party (PDP) says public demonstrations that the Presidency may have procured a forged West African Examination Council (WAEC) Certificate Attestation and Confirmation for President Muhammadu Buhari is a huge smear on our nation’s integrity and the Office of the President. The party laments that the development has turned our nation into a laughing stock in the West African sub-region and the entire global community, as our President is now being mentioned as beneficiary of a duplicitous act. Most appalling is that Mr. President’s handlers have succeeded in dragging a reputable institution as WAEC into public disrepute and opprobrium, as Nigerians are quick to demonstrate marks of forgery in the attestation issued by the examination body. A check on the attestation clearly shows that it does not have the “Original Certificate Number”, the key authentication feature in all genuine attestations by WAEC. Instead, a “non-applicable” is entered, indicating that the beneficiary does not have a certificate to be attested to, thus rendering the said attestation unauthenticated, fake and of no effect. Also, the attestation is for West African Senior School Certificate, which President Buhari couldn’t have sat for, given that the Senior School Certificate Examination was established only in the late 1980s. Does it not smack of high level scam that the same WAEC, which, in 2015, confirmed that it does not have records of President Buhari’s certificate, now had to send officials to present Mr. President with an attestation, that has no original certificate number? Moreover, by WAEC rules, attestations are only issued in the case of missing or destroyed certificate. Why then should the exam body issue an attestation to President Buhari, whose certificate, he claimed are with the military and not missing or destroyed? If not intended to circumvent the system and deceive Nigerians, why did President Buhari’s handlers chose to write to WAEC to issue an attestation when he, as the Commander-in-Chief, has the powers to direct the military to make available his credentials for all to see. What the unauthenticated attestation has shown is that Mr. President does not have a WAEC certificate; we urge his handlers to humbly so admit and apologize to the nation, having exhausted all gimmicks to mislead Nigerians. The Buhari Presidency should know that there is no way the truth can be suppressed. In fact, the current disagreement between the Presidency and WAEC over who initiated the attestation deal is also very revealing. Finally, while the PDP urges WAEC to redeem its image by handing over all its officials involved in the deal to the INTERPOL for investigation and prosecution, it also calls on the Nigeria Police to immediately invite Mr. President’s handlers for questioning over this huge national embarrassment. Security agents ‘ll henceforth arrest hate speech makers- Buhari. President Muhammadu Buhari has warned Nigerian elites to stop misleading the people through their unguarded utterances. Buhari, who is the visitor to the University of Uyo, according to the News Agency of Nigeria, gave the warning at the 24th convocation ceremony of the institution on Saturday. The President, who was represented by the Director of Corporate Communications, National Universities Commission, Mr. Ibrahim Yakasai, said development and progress could not thrive in a hate-filled and divisive society. He said universities as home of great thinkers, should give guidance to the communities to enable the people to make informed decisions as the nation approached the 2019 general elections. He said that the Federal Government would not condone or tolerate incendiary remarks capable of causing fear and spread hatred among the people, from any person or group of persons. Buhari said that the Federal Government would continue to do its best to ensure security of lives and property in the country. The President said, “At this point, I want to be very clear and equivocal, that the Federal Government will never condone or tolerate incendiary remarks from any person or group of persons, which are meant to harass, intimidate, cause fear and spread hate, no matter how highly placed such a person is. “Law enforcement agencies should fish out people who make inciting statements, instigate civil disobedience, broadcast hate speeches or stir strife, riot and rebellion and bring them to book. “We should continue to live together as brothers and sisters.” The President called on the new graduates to look beyond leaders who had failed themselves and the nation but should choose their heroes from among those who believe in the progress of Nigeria and emulate those honest and hardworking in their professions. Buhari said there was a need for the curriculum of Nigerian universities to be diversified to include entrepreneurial skills to help graduates to employ themselves and others after graduation. The Vice-Chancellor, University of Uyo, Prof. Enefiok Essien, said 32 students from the institution graduated with first class honours in the 24th convocation. EXCLUSIVE: How Buhari Campaign Organization fraudulently used Pseudo Companies to bid for contracts from Ministry of Power, Works and Housing The Buhari Campaign Organisation has collected over N60bn from different ministries and agencies of Government through Pseudo Companies to fund the campaign of the President’s re-election in 2019, LeadersNG learned. In a document made available to LeadersNG, it was gathered that Good Governance Awareness Campaigner Group under the auspices of the Buhari Campaign Organization used the following Private companies, Heridam Worldwide Limited, Maysu Construction LTD, Honeygate Engineering Company LTD, Extended Global Services Limited, Ajibako Multi Links Nigeria Limited, Maizamam Multi Resource Limited, Authentic Consulting Firm Limited, Teamdek Ventures Nigeria Limited to illegally obtain contracts from the Ministry Of Power, Works and Housing to fund the re-election campaign of President Muhammadu Buhari. In a letter addressed to the Permanent Secretary of Ministry of Power, Works and Housing, the Campaign proposed for the Supply and Installation of Road Signs along Federal Highways. The Organization requested the Ministry to give some slots to cushion the Financial Pressure on them as they intend to move the campaign train to the grassroot in the Six Geo Political Zones in the country. The source further told LeadersNG that the Campaign Organization has been using the re-election of the President to get contracts from different Ministries, Agencies and Parastatals of Government without following due process. You would recall that LeadersNG had Exclusively reported that the Spokesperson of the Buhari Campaign Organization, Mr. Festus Keyamo collected N450M from the NNPC for the President’s re-election. The Public Procurement Act as enacted in 2007, prescribes principles by which public procurement entities within the various Federal Ministries, Departments and Agencies should conduct their affairs. The principles, which include honesty, integrity, transparency, accountability, fair competition, economy and efficiency and value for money, apply to all transactions, large or small, and describe the behaviour expected of every public officer in the conduct of public procurement. The spirit of the Act is to offer all interested contractors, suppliers and consultants a level-playing field on which to compete and thereby, directly expand the purchaser’s options and opportunities. The Law also frowns at procurement officials betraying and abusing public trust for personal gain. Procurement Act stipulates that bids shall be invited only from qualified/approved contractors/suppliers competent to do the work or provide the services to the nominated standards, the process that was never followed in the award of Contracts to some of the above mentioned companies. The law also says that contracts shall be awarded to the lowest evaluated responsive bidder, and shall meet all technical requirements and standards on the basis of competitive tendering unless overriding technical grounds exist to justify any other course of action. of every major contractor to the Federal government in the country with no exception are funding the President’s re-election. This includes oil companies, construction companies and other private companies. Mr Kelechi Anayo, A Lagos based Public Affairs analyst our correspondent spoke with says the Buhari led administration has reneged on its campaign promises and opaque system of awarding and approving major contracts is a testament that the administration’s war against corruption is just a mere charades. Ministers and other appointees of the Septuagenarian Leader who promised to kill corruption, have continued to award contracts without the National Council on Public Procurement (NCPP) – a regulatory body, created by law, to set thresholds to values of contracts that an awarding ministry or agency can approve.
