I have a similar case but I'm the landlord. My tenant moved in Jan 2015,paid for a year's rent. this year,she promised to pay me by January ending. Jan 31st, she then told me that she might be transferred to Abuja by 2nd week in February. I told her to still pay and if she gets transferred, I will refund her money.
My agent then called her this Monday when she did not pay to ask about the money. she then told the agent that she does not have money and after all, she should be given 3 months quit notice by law.
Now,I don't even want her in the house again,want her to leave by February ending whether she pays or not and I have told her. what are my options pls? Can I evict her by month end? remember,I didn't have any issue with her till she made that statement.

Oga biko, still look at it from the tenants point of view. Her last rent expired on the 31st of January. Today is 11th of February. She explained that she might be transfered to Abuja and you want her to pay one year again first and if she is transfered you will refund?

Haba! Have some compassion. If she is transfered, she will need to settle down there too. How will she be discussing refund and looking for money to move at the same time? I am certain she replied that she is entitled to that notice because of your demand. It is better that both of you meet in the middle.

My suggestion:

1. We know you are entitled to your rent.

2. She will know if she will be transfered in about four (4) days time.

3. If she is transfered she can pay you rent for a month and use the remaining days of the month to pack out or even pay for two months to make her transition smooth while you open the house for another tenant.

Somehow I think she does not want to have to be asking you to refund. Tenants are human too biko.

Since she is owing rent for a year, she is only entitled to seven (7) days notice of owners intention to recover possession of premises. Once that notice is served, upon expiration or even before expiration, you need to file a process in court to evict her legally. The court will not take it lightly with her that she is in default of rent for that length of time

He has no entitlement to the 6 months notice. By paying 3 months notice, in the face of the law, he renegotiated his tenancy and brought it down from a yearly tenancy. His reasons are irrelevant so there is no issue or consideration for cogent reasons. A landlord is entitled to his rent and once a tenant pays rent dutifully, the tenant is entitled to peaceable possession.

1. If the one year rent your paid is subsisting and will expire by march ending, this means that she has missed the opportunity of giving you a VALID notice to quit which should have been for six (6) clear months terminating on the last day of your current term or rent except you entered into an agreement to determine the tenancy with a shorter notice.

2. If that is not the case, Since she has failed to do that the option she has now is to wait till you default in your payment and become a tenant at will then on the basis of your default she can now quit you with a shorter notice.

3. The law does not allow you stay over in her house without paying rent so even after she gives you notice you are still entitled to pay her rent for the months you stay over except that this time it is called the mesne profit but it is usually the same amount month as you paid before.

4. I understand that you want to pay her back for her bad conduct and seek a means to do so. For you, this is easy cos your last rent was a year and she has missed the opportunity to give you a valid notice so before she can correct the anomaly, you would have stayed over for the 3 months you want to stay. Cos briefing a lawyer and quitting you legally will take her at the very least that 3 months but eventually, you will still pay the rent.

5. My question though is, if she does all those bad things to you and you don't have peace in the house, why do you think you will enjoy the 3 months you want to stay? If she can torment you when your rent is subsisting, what will she do when your rent is now in arrears?

6. My advice - you are bigger than her. Look for an apartment where you can enjoy and appreciate your rent

It may be illegal in Nigeria but the woman may be powerless to stop her in-laws from carrying out the practice on her daughters if they insist on it.
So instead of saying it's illegal and leaving it at that, let's join in sensitization about the issue so that those who still believe in it will have a rethink.

I know she is lying because the said father in law is unnamed; the community is also unnamed. Despite what is may seem to the outside world, Nigeria is no longer in the stone ages. If she is emancipated enough to seek asylum in a country like Canada and seek the services of a lawyer then she is emancipated enough that the in laws cannot impose their will on her. However, I must say that I agree with you on the issue of sensitisation.

Male genital circumcision is practiced in Africa and indeed in Nigeria. We have not distanced ourselves from it nor made laws against it. This is likely because we know its benefits and found a basis for it in the bible.

Please do not give the impression that nairalanders are mindless simply because we have said no to fgm and you feel the reason is because that idea comes from the west. We as nairalanders and Nigerians have weighed the pros and cons in the light of knowledge and decided not to stand for it. We have examined the rationale for the practice and found it wanting. The clitoris enhances the pleasure derived during sex for women and we have seen no reason for clipping it merely because some men feel that sex should be enjoyed only by men while women just endure it. Or that women become promiscous simply because it is not clipped or chopped off.

While Fgm is indeed a form of gender based violence which is prominent in the African culture, the dynamic nature of culture and movement against it has ensured that it is no longer a problem in Nigeria. In the main, it is now done only by women who are steeped in their ways and take their female children to do it as of course as well as traditional health workers who do not want to let go of the practice as it is a means of income generation.

If this claim was not bogus the woman should have mentioned the community and the father in law's name. Heck we even have several laws against it , the latest of which I think is the Violence against Persons Prohibition Act of 2015. Madam just used that story to seek asylum and get the canadian govt to take car of her triplets

I'm sorry I can't give you even an estimated figure because I don't have your dimensioned/detailed drawings. Only with that, alongside your required specifications in terms of finishing can we determine what it will cost to complete your project or even tell you how much your roofing will cost.

I mentioned this recently on some other thread were the OP was asking for costs to construct a particular building. Determining costs of construction is scientific, not guesswork. It can only be accurately determined with details (drawings, etc). Anyone who will begin to list quantities of materials or costs for you here without seeing or working with your drawings (like is the case with some people on this forum) is only doing guesswork AND only trying to market himself/herself, get you into engaging & mobilizing him/her as a contractor and when they get to a stage where the erroneous figure they told you can no more complete the work, they come to you asking for more and if you refuse, they abandon you.

This is wisdom for you and all those who care to listen!
