zik4ever: SENATORS are angry over the refusal of the presidency to subject nominees into appointive offices to screening and confirmation processes before they are asked to assume office, with many of them declaring that what is fast becoming a fad under the Muhammadu Buhari-led administration is an affront on the legislature. The lawmakers, who spoke under strict condition of anonymity, insisted that the decision by President Muhammadu Buhari to name some appointees without a recourse to the Senate was not only a violation of the laws, but also a way of tying the hands of the Senate in confirming such appointments. President Buhari had named the chairman of the Independent National Electoral Commission (INEC) in acting capacity, besides the appointment of the board of the Asset Management Company of Nigeria (AMCON) and the chairman of the Federal Inland Revenue Service (FIRS) before referring them to Senate for confirmation. The president also named appointees to the National Communications Commission (NCC) without confirmation by the Senate. Presidential Adviser on Media and Publicity, Femi Adesina, two weeks ago, said the letter requesting the confirmation of AMCON appointees had been prepared in readiness for dispatch to the Senate. Sources in the Senate, however, said the lawmakers were angry that their powers to dispassionately assess the nominees were being eroded, as the appointees had already assumed office, started drawing salaries and allowances and had also started implementing policies. “It is wrong for an appointee, who is supposed to be confirmed by the Senate before appointment, to assume office and then come for confirmation. In such situation, the man is already enjoying the pecks of office and the confirmation is being made to look like a fiat accomplished,” one of the senators said. The lawmaker said the general opinion among his colleagues was to lay ambush for those who had assumed duties before their confirmation by the Senate. “Notwithstanding the argument being held on to by the Presidency, the fact is that the Senate was not set up as a rubberstamp institution. “The Senate should be in a position to confirm or reject a nominee and it is absurd for the nominee to appear before the Senate for confirmation with all the paraphernalia of the office he is seeking,” another senator said. “You don’t see this in the United States of America from where we borrow our democracy. Appointees are grilled by the Senate and the chamber reserves the right to reject anyone without ruffling feathers. “In our case, however, once any of these nominees is rejected, the media would shout it that Senate removes Buhari’s nominee. It’s unprecedented and uncalled for,” another senator said on Tuesday. A senator further said the appointments by Buhari amounted to a violation of the constitution, since the appointees had resumed office and started acting before their appointments were confirmed by the Senate. According to him, the constitution provided that the appointments shall be subject to Senate confirmation, adding that it was absurd that some of the appointees had started spending money from the office before their confirmation. “What we are seeing concerning these appointments amount to an offence and gross breach of the constitution. I am aware that senators are peeved by this conduct and there is the thinking that some of those who have assumed office might have disqualified themselves. “The lawmakers consider the development as an abuse of their respect for Buhari and that the act is undermining the Senate,” a senator in the know said. Fayose, who’s unimpressed with the public assets declaration of the President, described the move as as a ploy to get “the applause of the gullible”.
The governor also warned the All Progressives Congress not to provoke him to reveal the hidden assets of their members.
Fayose released a statement on Wednesday, through Lere Olayinka, his spokesman.
“We know where everybody, including President Buhari’s wealth are hidden, and the APC should not provoke the governor to such an extent that he will begin to reveal their hidden assets,” he said.
“Nigerians demanded that President Buhari must declare his assets publicly because that was what the President promised when he was seeking the people’s votes. “It was part of President Buhari’s electoral promises that his assets will be declared publicly and up till today, he has not done that.
We have only been told that the President, whom they said was poor to the extent that he had to take bank loan to buy his party’s nomination, is now the owner of a mini estate in Asokoro, Abuja that is worth over N3 billion.
“The APC should rather explain to Nigerians how a man they said had no houses anywhere apart from Daura and Kaduna suddenly became owner of houses and landed properties in Kano, Abuja and Port Harcourt.
“They should also tell Nigerians what happened when President Buhari headed Petroleum Trust Fund (PTF) and why they lied to Nigerians that the president was poor, thereby obtaining Nigerians’ votes by trick.”

Yhunoos: There were indications on Saturday that President Muhammadu Buhari and the All Progressives Congress had begun moves to compensate the South-East for not getting any appointments so far in the current administration.
SUNDAY PUNCH reliably gathered that some states in the geopolitical zone might get more than one ministerial slot.
The Presidency and the APC sources, who spoke to SUNDAY PUNCH on condition of anonymity, also justified the appointments made by Buhari on Thursday.
A top member of the party said the President was not unmindful of criticisms that greeted the alleged lopsided appointments.
He said, “The President has assured us that all zones that have not been represented in the appointments he has made so far will be compensated.
“For example, some states in the South-East may get more than one ministerial slots. The President is going to make board and ambassadorial appointments. All zones, including the South-East, will be represented in this government.”
Prominent Nigerians and socio-political groups, have criticised the appointments made by Buhari so far.
Out of 31 appointments made so far, 24 of the appointees are from the North and seven are from the South. The South-East has no representation in the Buhari-led government.
SUNDAY PUNCH however gathered that the emergence of the new Secretary to the Government of the Federation, Pastor David Lawal, and the Chief of Staff, Abba Kyari, was the result of the politics among power blocks in the APC.
It was learnt that the two appointees belonged to the Congress for Progressive defunct Change, which Buhari led, before it merged with other parties to form the APC
A Presidency source told one of our correspondents that Lawal and Kyari were picked because of their closeness and loyalty to the President.
The source said, “Although the President is a loyal member of the party, the levels of trust he has in the members differ. There are various blocks in the APC.
“You don’t give appointments such as chief of staff and the SGF to your rival or his loyalists; you give them to those you can vouch for. Those posts are ears and eyes of the President and they are not subjected to the party’s ratification.”
It was also gathered that the latest appointments confirmed the existence of various power blocks in the APC.
It will be recalled that the CPC, led by Buhari, merged with the Action Congress of Nigeria, the All Nigerians Peoples Party and a faction of the All Progressive Grand Alliance, led by the Imo State Governor, Rochas Okorocha, to form the APC.
They were later joined by five governors, who defected from the Peoples Democratic Party.
Former Vice President Atiku Abubakar also defected from the PDP to the APC.
Meanwhile, the Presidency, on Saturday, assured Nigerians that by the end of the series of appointments being made by Buhari, no part of Nigeria would feel alienated.
The Special Assistant to the President on Media Affairs, Mr. Garba Shehu, said this in a telephone interview with one of our correspondents.
When asked if the South- East and other parts of the country, who are complaining of being marginalised by Buhari would be compensated, Shehu said appointments so far made by the President were just a few out of so many that would be made by the President.
He said, “There will be ministers, heads of government departments, federal boards and ambassadors. At the end of the exercise, no part of the country will be left feeling left out.”

While enjoining those already crying wolf over Buhari’s early appointments to first take cognizance of “the personal merit of each person that has been appointed,” he stressed that: “You cannot run away from the fact that each person appointed merits the position. They are qualified!”
Adesina, who made this known Friday while speaking on RayPower’s flagship programme monitored by DAILY POST in Abuja, said: “But then in terms of the spread, the thing I will also like to say is that the President has the prerogative to make appointments and he knows that there is federal character in our constitution. I’m sure he bears that in mind as he makes the appointments that will come in the future.
“I believe that at the end of it all, there is going to be a balance.
“These are still early days in the appointments he is going to make. At the end of it all, I believe we are going to have a balance,” he stated.
Responding to the need for Buhari to make appointments bearing in mind that Nigerians of northern extraction are already leading the legislature and the judiciary, Adesina said: “Let’s not forget that some of those were by elections, some were statutorily the next person in rank. There is nothing the president can do about that. If it’s by election, what will he do about it? Because he doesn’t control the election; the National Assembly came by election.”
“For the ones he can control, there are still so many ahead,” he said stressing that any position can be key depending on the way the person appointed into the position “applies himself to that position.”
On whether Nigerians can begin to expect ministerial list, the Presidential spokesman assured that Buhari will keep to the September dateline given by him. He added that, “September is just next month and it has 30 days. I believe that within those thirty days, the job will be done.”

midolian: Presidency has again stated that the administration of president Mohammadu Buhari will not shelve the probing of the past government of former President Goodluck Jonathan in the face of monumental fraud and corruption.
It however revealed that no one is under probe at the moment, saying that the government is only taking briefings and gathering evidences to prosecute corrupt officials of the past government.
The presidency’s reiteration followed an accusation of selective probe by a prominent Northern leader, Tanko Yakassai.
Speaking exclusively to Vanguard on Sunday in reaction to the accusation, the Senior Special Adviser to president Buhari on media and publicity, Mallam Garba Shehu said that there are sensitive matters arising from briefings and officials engagements which the president cannot overlook.
[b]Shehu described as laughable the allegation that Buhari has excluded other former presidents like chief Olusegun Obasanjo due to his affinity with him.
“Let me say that officially, nobody is under probe even Dr. Jonathan. People should not make mistakes about the fact that what is going on are routine investigations. These are matters that the president has found on the table.
“So, there is nothing like a probe. If Jonathan will be probed, you would have heard of, may be, an administrative panel of enquiry or Judicial Panel of Enquiry. But it hasn’t come to that. These are matters of routine engagements of due process of law and order.
“I am talking about probe now. As I said, President Buhari in his campaign said this government is not going to probe into the past. We are not probing but as a responsible government, you cannot bring to the table matters such as we are dealing with and then, the president will wave them off.
“The office of the president may be powerful but it is controlled, regulated by due process and the constitution of the country. The president cannot wave away the matters that are arising from either handing over or the routine briefings that he is into.
“How can anybody say he was part of the Obasanjo military regime. That’s why he’s not probing them? Speaking further, the presidential spokesman queried why the allied of former president Jonathan would wait until now to Champoin the cause of probing past government before Jonathan. He stated that it was Jonathan’s responsibility to probe the governments of Obasanjo and Umoru Musa Yar’Adua.
“Let me tell you, if Obsanjo and Yar”Adua and all of the past governments before Jonathan needed to have been probed, why did Mr. Jonathan shy away from his responsibility? Why didn’t he probe him why he was in office? Why didn’t Mr. Tanko Yakkassai ask Jonathan to probe Yar’Adua, Babangida, Obasanjo? Why do they have to wait for Buhari to come to do what he should have done then?
“It is common sense. So, if he didn’t probe them, why should his people ask some other person to come and probe them? If they felt it was desirable, as a party, PDP, if it was desirable to probe the past administration, why didn’t they do it themselves? Why do they have to wait for President Buhari to come?
“No, this is not a government of probes. It is a government of due process and law and order. President Buhari is dealing with the matters he has found on the table and he has no power under the constitution to wave them. If someobody had stolen Nigeria’s one billion dollars of oil, President Buhari is not authorized to wave it off under the law. He should ask questions. There is no probe going on now. People who are creating the spectre of probes in the country just want to create unnecessary fear”, he said.[/b]
Asked to say assuredly when the probes would actually begin, Shehu said it was the prerogative of President Buhari to say.
“I don’t know if there will be probe eventually. The president will determine that. I am not permitted to say that now. But as it is now, matters are rising from the briefings the president is getting, from handing over, matters he met on the table. The president has the right to ask questions and that is what he is doing”, he said.
On the issue of running a unilateral government having not appointed Ministers, Shehu said that the allegation was unfounded.
According to him, the government is running well and it’s Ministries and Agencies were competently manned by the Permanent Secretaries. Shehu however assured that president Buhari would form his cabinet soon.
“It is not correct. The constitution is very clear about the powers of the State. Legislatives powers are there under the parliament. The President has not interfered with the powers of the parliament even when the clamoir for him was there to save the parliament from the crisis of leadership, he stayed out of it.
“The power of the Judiciary resides in that arm of government. President Buhari is not interfering and the Executive powers of the government are there and the Executive Arm of government is the first arm which he had under him, there is no vacancy now as we speak now. All the Ministries of the government are been competently run under the supervision of the Permanent Secretaries.
“They consult the President and the President consults them. He consults the party and the party consults him. So, if anybody is not in the room when these matters are being discussed, don’t go out there telling people that there is no consultation going on. You cannot be an adviser to PDP president and also be an Adviser to the APC government at the same time.
“I hope so. He didn’t say September 1 though. The president will appoint Ministers. There is no question about that. I don’t know. The president will decide when he will appoint his Ministers. If it is auspicious for him to appoint them in September, he will”, he said.
