"ABUJA Embattled former Speaker of the House of Representatives, Dimeji Bankole, yesterday, moved to avert his possible re-arraignment by the Economic and Financial Crimes Commission, EFCC, over an amended 16-count criminal charge bordering on contract inflation and abuse of office.

It would be recalled that the anti-graft agency had on June 7, 2011, docked the ex-speaker before the Abuja Division of the Federal High Court on allegation that he connived with some persons at large to defraud the Federal Government to the tune of N894million.

EFCC, through its prosecuting counsel, Mr Festus Keyamo, alleged that Bankole rigged bid for the purchase of three units of Mercedes Benz S-600 cars, two units of Range Rover vehicles (without bullet proofs) and 400 units of DSTV systems, by refusing to follow procedures prescribed for public procurements in Sections 17 to 56 of the Public Procurement Act No.14 of 2007.

It insisted that the action constituted an offence contrary to Section 58(4) (e) of the Public Procurement Act, No.14 of 2007 and punishable under Section 58(5) of the same Act.

EFCC further told the trial court that some of the illicit contracts through which monies were pilfered by the accused person, included the purchase of 400 units of 40-inch Samsung (LNS. 341) television sets, 800 units of Desktop Computers (HP Compaq dc 5700), 100 units of Sharp Digital Copier 5316, 400 units of HP LaserJet 2600N, among others.

Nevertheless, though hearing had already commenced in the matter with so many evidences adduced and witnesses called to testify before the trial court, however, the criminal proceeding is set to commence de-novo (afresh) following the sudden transfer of the judge presiding over the case.

Investigations by Vanguard revealed that the trial judge, Justice Donatus Okorowo, has been ordered to proceed on transfer to Taraba State, though no reason was given for his ouster from the Abuja Division.

Basically, whenever a trial judge hands-off a criminal case, such matter is re-assigned to a new judge who must commence the trial afresh by taking a fresh plea from the accused person.

Meanwhile, perturbed by the development, Bankole wrote to the Chief Judge of the Federal High Court, Justice Ibrahim Auta, yesterday, begging him to allow the transferred judge to continue presiding over his trial, saying it would ensure that his trial does not suffer undue delay.

Bankole, through his lead counsel, Chief Wale Akonni, SAN, forwarded the letter to the High Court CJ, following the refusal of the transferred trial Judge to sit over the case.

The matter was originally adjourned for continuation of trial yesterday with the court billed to record the oral testimony of the 3rd prosecution witness.

One of the court clerks who spoke to Vanguard on grounds of anonymity, noted that though the entire week was ab-initio dedicated to the trial, owing to the transfer of presiding Justice Okorowo, the case would be put on hold pending the response of the CJ to the former Speakers request.

The court had on the last adjourned date, concluded the cross examination of the 2nd prosecution witness, Mr. Adeboye Adeniyi, an investigative officer with the EFCC who tendered letters of agreements that the House of Representatives under Bankoles leadership, entered with some companies that allegedly took part in the alleged illicit contract deal.

It would be recalled that a lead investigator with the agency, Mr Ibrahim Ahmed who earlier testified before the court, narrated how fake companies were allegedly awarded contracts during the period Bankole held sway at the House of Reps.

The witness said spirited efforts by the agency to trace the benefiting companies proved abortive as they were non-existent.

He said the investigation was prompted by a petition that was lodged before the anti-graft agency by Bankoles colleagues in the House of Reps, led by Mr Dino Melaye.

My Lord, after our thorough investigations with the C.A.C, and close perusal of the documents used by the then leadership of the House of Representatives under the accused person in the award of the said contracts, we found out that the contact details of the beneficiary companies were non-existent, letters sent to the purported addresses on the contract papers, were returned two weeks later for reason of non existence of the addresses, he added.

Meantime, Bankole had earlier queried the legal propriety of the charge against him, contending that the facts as disclosed in the proof of evidence did not contain the basic elements of the offences charged.

He argued that there is no evidence that the accused performed the functions of any named officers under the Public Procurement Act. The court is not to strain itself in holding or connecting the accused person willy-nilly. The evidence before the court shows nothing to connect the accused with the commission of any crime under the Public Procurement Act. The absence of the combination of mensrea with the actus reus is very important he insisted.

He further begged that court to disqualify the prosecuting counsel, Mr. Keyamo, from the matter, describing him as an agent of witch-hunt, a request that was turned down by the court.

According to him, The prosecution has urged the court to connect the accused person with commission of offence under the Procurement Act by reason of inference and Section 443 of the Criminal Code Act, Sections 2 (4) and 7 of the Schedule to the Criminal Code Act. The law does not permit the court to assume irregularity in the absence of any shown fact of irregularity.

The prosecution also urged the court to stretch the law to its utmost limit under Section 57 (2), (3), (4) and 7 of the Public Procurement Act and find commission of crime against the accused person.

We submit, respectfully, that the act or conduct of the accused which amounted to crime must be shown by clear evidence in the proof of evidence. Respondent submitted that any person howsoever remotely connected with or who had anything to do with a step taken under the Act is liable for a criminal act whether or not there is the intention to commit crime which the law demands. The applicant is not connected to any act in violation with processing of bids or procurement of all the items particularly those alleged in the charges.

The Public Procurement Act in Section 58 is specific as to who can and must initiate prosecution of offences under the Act. The provision of this Act is specific and any person charged for offence under the Act has the right to know who is prosecuting him and insist on the law being complied with. Indeed neither the court nor parties can confer jurisdiction or compromise illegality.

It is an issue which the court has authority and power to satisfy itself, so it is a vital issue of law and validity of the proceedings. We submit the decision in the case of FRN V. BODE GEORGE is not relevant here, he contended.

“It is absurd, malicious and ultimately laughable” – Aviation Minister reacts to Arik’s allegation


24 hours after Arik Air, announced that they were suspending local flights, they came out to point accusing fingers in the direction of the Aviation Minister. The allegation, was that Mrs Stella Oduah, had demanded 5% equity from the airline. And when they refused to grant her the request, she set in motion the scheme to run them down.

But in a press release received by DailyPost this evening, the Minister has come out to deny all the allegations categorically, stating that there is no atom of truth in them.

ARIK AIRLINES’ CONFLICT OF INTEREST ALLEGATION LAUGHABLE, DIVERSIONARY

The attention of the Honourable Minister of Aviation, Princess Stella Adaeze Oduah, OON, has been drawn to a fabrication credited to the Management of Arik Airlines, to the effect that the Minister demanded a 5 percent equity holding in the airline. The story alleged a Ministry of Aviation hostility against Arik on account of the so-called equity demand that it claimed to have turned down!

The first impulse is to totally ignore this groundless falsehood. Except that it will send the wrong signals to the general public. Therefore, the sole intent of this release is to put the records straight.

The 5 percent equity story is without any foundation whatsoever. It is absurd, malicious and ultimately laughable. The Honorable Minister of Aviation could not have contemplated acquiring a stake in any airline, let alone Arik Air that is groaning from a crippling N85.4 billion debt overhang.

The time is ripe for Arik Air to change its business module that ‘thrives’ on unprecedented accumulation of debts and liabilities. The futile attempt to impugn the integrity of the Aviation Minister by inferring a conflict of interest against her is at best diversionary. It should be obvious to the management of Arik Air that blackmail is not a panacea for a floundering enterprise.

Nobel Laureate, Prof. Wole Soyinka, has said President Goodluck Jonathan is suffering from a bad conscience.

This was contained in a statement made available to SATURDAY PUNCH on Friday.

Soyinka was reacting to the President’s comment in Lagos on Wednesday that the Jan. 2012 fuel subsidy removal protests were sponsored.

He said, “The most generous response that can be given to President Jonathan’s recent statement on the people’s fuel subsidy protest is that he is suffering from a bad conscience.

“The worst – which I fear is closer to the truth – is that he is lamentably alienated from the true pulse of the nation, thanks perhaps to the poor, eager-to-please quality of his analysts.

“Since I have had the opportunity to contest this perception of the protest with him directly, it is clear what kind of interpretative diet he prefers. The nation needs all the luck it can get.”

Condemning the President’s use of force to quell the protests, Soyinka described the action as a violation of the people’s constitutional rights and dismissed Jonathan’s allegation that the protests were sponsored.

He said, “This should be seen as a grave danger to democracy, and a warning. Both the participants and those who, like myself, were unavoidably absent, that lent both vocal and moral support to the demonstration, have been maligned and insulted by such reductionist reasoning.

“The culture of public protest appears to be an alien territory to Jonathan, which is somewhat surprising, considering the fact that he has not only lived in this nation as a citizen, but served in various political offices.

“He has lived through the terror reign of the late Gen. Sani Abacha, whose ruthless misuse of the military and the secret service did not prevent demonstrations against perceived injustice and truncation of people’s rights.

“Jonathan’s pronouncements truly boggle the mind. What is this obsession with bottled water, comedians and musical artists? Must demonstrators drink water from the gutter? Is protest no longer viable when sympathisers cater to their needs, supply decent water and food rations?

RETIRED Justice of the Supreme Court, Justice Andrew Otutu Obaseki, yesterday denied newspaper reports that he rejected the national honour bestowed on him recently by the Federal Government.

Obaseki also made available a copy of a letter he sent to President Goodluck Jonathan through the Secretary to the Government of the Federation, Anyim Pius Anyim, thanking the President for approving the award.

Titled: “Re-2012 National Honours Award,” and dated September 4, 2012, the acceptance letter was made available to The Guardian on Wednesday by his son, Ikpomwonsa Obaseki.

The letter signed by the retired justice of the Supreme Court reads: “Reference your letter No. SGF.50/S.27/11 dated August 27th, 2012 informing me of the approval of Mr. President for the honour of the rank of CFR. Kindly convey to Mr. President my gratitude for the approval.”

He added: “Due to the condition of my health, it is not possible for me to travel to Abuja to receive personally the award/investiture.

“I therefore crave your indulgence to permit one of my children to appear personally and receive the award on my behalf, in the person of Mr. Ikpomwonsa Obaseki, who will appear and receive the award on my behalf. Once again, I thank My President for the honour.”

In an email forwarded to The Guardian yesterday, Ikpomwonsa Obaseki explained in details how he travelled to Abuja but was prevented from receiving the award on behalf of his father.

Ikpomwonsa, who is also the Head/ Market Operations Department, Nigerian Stock Exchange (NSE), said: “My dad said I should represent him at the award ceremony as he would not be attending due to health reasons. I arrived Abuja Sunday morning with my wife and headed straight for the accreditation venue, Agura Hotel.

“On getting there, I gave the staff doing the accreditation a copy of the letter from the Secretary to the Federal Government informing my dad of the award and a letter from my dad to the government accepting the award and also informing them that due to ill health he would not be attending the ceremony and that his son, Ikponmwosa Obaseki, would be receiving the award on his behalf.

“I met one Mr. Suleiman who collected my letters and asked me to register my name in a note book. He then called his boss, one Mr. Charles to have a look at my letters.

“Charles said I cannot collect the award on behalf of my father since I was not the recipient of the award. I am not allowed to shake hands with the President since I am not the recipient. I can come on Tuesday, 18th September after the award to collect the award at their office.

“I then asked why they did not reply my dad’s letter he had sent two weeks ago accepting the award. They should have replied and indicated that I would not be allowed to collect the award on behalf of my dad. He said if they had replied I might not have gotten it before the ceremony.

“He said the only thing they could do for me, after I said I had come all the way from Lagos, was to allow my wife and I attend the ceremony as guests and that we would not take part in any of the events.

“I was given two invitation cards and then I left the accreditation Centre for Transcorp Hilton, where I stayed.

“I was told to call their boss, the SFG later and that he would be at the accreditation venue. When we called later, they said he had come and left and he still maintained that I could not receive the award on behalf of the recipient.

“At the ceremony, the MC announced, when it got to my dad and his former colleague, Justice Esho’s turn to be presented with the award, that both were unavoidably absent and that the chairman of the award ceremony Justice Belgore had offered to get the awards sent to both retired Supreme Court Justices, Justice A.O. Obaseki and Justice Kayode Esho.”

Daily Independent broke the story on Thursday that the President had bowed to pressure to suspend introduction of the N5000 note.

According to Presidential spokesman, Reuben Abati; “the introduction is being suspended for now to enable the CBN do more enlightenment on the issue. Yes, President Jonathan has directed that the implementation of the new N5,000 note be suspended for now.

“This is to enablenable apex bank to do more in terms of enabling Nigerians understand why it proposed it in the first place. So, for now, the full implementation is on hold.”

Neighbours to Usman Inuwa who was caught with the corpse of a child in a suitcase in Maitama, Abuja have identified the dead child as Goodluck, his son. The shocked neighbours described the boy as very smart and wondered what came over Inuwa that made him to kill his child.

Inuwa, a welder, arrested with the corpse of the child in a suitcase last Saturday, is currently in police custody.

Our correspondent who visited Bwari where the suspect lived on Tuesday learnt that Inuwa’s wife left him about a month ago, following incessant quarrels between them.

The nursing mother was said to have packed out of their one- room apartment, whose veranda was fenced off with zinc. The building was located behind Zenith Bank, Bwari, about 45 km from Abuja city centre.

The room which was firmly locked with a padlock did not betray the nature of the heinous crime that was allegedly perpetrated inside it.

A fashion designer and immediate neighbour to the suspect said he was shocked to see Inuwa’s picture and the dead child on the Internet, noting that he saw Goodluck last Friday night around his shop.

“I was shocked to see Inuwa’s picture and the dead child; this was a boy I saw last Friday playing with other children in the afternoon and later in the night. Before now, Inuwa didn’t betray any suspicious behaviour except that he becomes aggressive anytime he is drunk and whenever he is high on Igbo (Indian hemp),” the neighbour who declined to give his name stated.

Another neighbour, Sam, described his pains when he heard that the welder murdered his son, describing the incident as appalling. He said for the few years he had known the suspect, he was always friendly.

“I can describe him as a friendly person, but he is antagonistic and hostile anytime he is drunk and everyone around here (neighbours) knew this and we don’t interact with him once we observe his change of mood. He also quarrels with his wife and the woman who is nursing a baby girl, left him about a month ago,” Sam said.

Daniel Okogie who claimed to have known Inuwa for about nine years stated that the suspect must have been under a spell to have killed his child, whom he said Inuwa took good care of.

He said, “We all know Inuwa and Goodluck and we are surprised that he would kill the boy. He took care of that boy and bought things for him; the child was to start school soon and now this tragedy happened.”

Asked if the police had visited the crime scene, Okogie and other respondents said they had yet to see them, pointing out that investigators would get clues that would assist them inside the apartment where he was believed to have murdered the child.

The FCT Police Public Relations Officer, Doris England, had said that investigations had commenced into the incident.
