Civil liberties campaigners are preparing to legally fight San Francisco's ban on public nudity. Does the US Constitution guarantee the right to walk the streets naked? No sooner had San Francisco's lawmakers voted to ban unclothedness in public places than a lawsuit was filed. It argued that the free speech of nudists was being restricted. It's a dispute that typifies the famously liberal city, but it also reveals much about the importance of freedom of expression to Americans. Opponents of the move say that, by limiting the ability to express themselves, the law violates their rights. They cite the First Amendment to the US Constitution, which forbids the government from "abridging the freedom of speech". But legal experts say previous court rulings suggest that being nude does not, in itself, constitute an act of expression. "It's taken as a given by the Supreme Court that a general restriction on public nudity is constitutional," says Frederick Schauer, professor of law at the University of Virginia. Continue reading the main story The answer * The US Supreme Court does not regard public unclothedness as a right under the First Amendment * Nudity in the form of artistic expression is protected * But authorities can ban nude performances for "secondary" reasons San Francisco's Board of Supervisors voted 6-5 in favour of banning anyone over five from exposing "his or her genitals, perineum or anal region" in most public locations. It came after a growing number of naked men gathered regularly in a plaza in in the city's Castro district, an area well known for its large gay community. Ken Paulson, president of the First Amendment Center, which promotes the study of free-speech issues, says he does not believe the legal bid on behalf of the Castro nudes is likely to succeed. Nude backpacker A nude backpacker walks the street of San Francisco last year. Such an act is now illegal. "There's no First Amendment right to be naked in a public place because you are not saying anything," he adds. But while the Supreme Court has been consistent that nudity is not in itself a form of expression, that does not mean that nudity cannot be expressive. "Being naked in the Castro could be seen as expressing a point of view about LGBT rights," says Amy Adler, professor of law at New York University. "I'm not sure a court would buy it but that's the argument I would expect them to make." It's possible that the nudists could argue their unclothedness was a political act. Continue reading the main story “Start Quote Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble.” End Quote From the First Amendment to the United States Consitution The Supreme Court has, in fact, held that nude dancing, as practiced in strip clubs, is a form of free speech, Schauer says. However, it ruled that establishments which offer displays of erotic dancing can be regulated. As long as the regulations are intended to deal with the side effects of such establishments - if they are causing a rise in crime, for instance - it is legal to impose a public nudity ban. It was a principle established in law in the 2000 case Erie v Pap's AM, which set a Pennsylvania city council against a nude dancing establishment. Of course, strip bars operate indoors, on private property, while San Francisco's nudists express themselves in full view of the public. San Francisco supervisor Scott Wiener, one of the lawmakers who passed the nudity ban, said it was "appropriate to have some minimal standards of behaviour" in the city and "our public spaces are for everyone". According to law professor Adler, case law suggests the city was acting within its rights. "Even if the nudists could prove they were engaging in nudity for expressive purposes, the state has the right to regulate it," she says, as long as the regulation is not about what's being expressed, but the side effects that expression has on the rest of the city - for instance, heavy traffic or lowered property values. But all may not be lost for the naked men of the Castro. One option open to them would be to move somewhere such as Oregon, where public nudity is legal so long as there is no "intent to arouse". "There's nothing in the constitution that requires a state to regulate against nudity," says Schauer. Source http://www.bbc.co.uk/news/magazine-20404710

Two British women say they are "absolutely convinced" the man accused of raping them in Barbados is innocent after meeting him at a court hearing. Researcher Dr Rachel Turner, from Hertfordshire, and Diane Davies, of Anglesey, north Wales, were attacked within days of each other in 2010. Barbadian Derick Crawford, 47, has been charged with the attacks, but the pair are certain he was not the rapist. Police in Barbados said the "evidence strongly supports" the charge. Dr Turner and Mrs Davies said they are concerned that while the Royal Barbados Police (RBP) continue to support the prosecution of Mr Crawford, the real rapist is free to attack again. The two women, who have waived their right to anonymity, say Mr Crawford looks and sounds nothing like the man who attacked them in Holetown St James. 'Incensed' Dr Turner, 30, who grew up near Letchworth, Hertfordshire, and holds a research post at the University of the West Indies, was attacked as she walked along a path to the beach in October 2010. Two days later Mrs Davies, who was on holiday, was assaulted in the same area. Dr Turner said: "The person who attacked me was in their early 30s. This person (Mr Crawford) was 47 and has a scar on his face, features that are completely different." Mrs Davies said: "The attacker was at least 10 years younger than this man. He was taller, chubbier and had a round face. He (Mr Crawford) is nothing like him." Dr Rachel Turner Dr Rachel Turner says she is "convinced" of the innocence of her alleged attacker Dr Turner believes the Barbados police are not concerned about who they convict for the crime as long as the case appears to have been solved. "I think that the Barbados police are ignoring a problem until it goes away. I'm not prepared to watch them sweep it under the carpet. I don't want them to get away with it and the person who committed these crimes is still free and, of course, he might rape again," she said. Mrs Davies added: "The man who did do it is still out there and they (the police) are not attempting to find him. We are convinced they have arrested this man to protect the tourism industry. We are incensed by it all." Mrs Davies flew out to Barbados to attend a committal hearing due to take place on Tuesday. Although the hearing was adjourned until Friday, both Dr Turner and Mrs Davies met Mr Crawford for the first time. "Diane... and I spoke to him and I am absolutely convinced that he is not the man who raped me, as is Diane," said Dr Turner. President of the Barbados Bar Association Andrew Pilgrim, who is representing Mr Crawford, said he was concerned that after 18 months the police had not provided him with forensic evidence. 'Highly regarded' "I would have had full disclosure on the DNA evidence whether they favour him (Mr Crawford) or don't favour him," he said. The prosecution case against Mr Crawford appears to be relying on a confession from Mr Crawford which has since been retracted. RBP Police Commissioner Darwin Dottin said in a statement: "The team of investigators who were tasked with investigating these assaults are firmly of the view that the evidence strongly supports the decision to arrest and charge Mr Crawford. "The Royal Barbados Police Force has an excellent reputation in the law enforcement community and is highly regarded. This is not to say that we never make mistakes. On the contrary, on such occasions, it is our policy to admit our failings. "To suggest that we put the reputation of our country before the welfare and comfort of our visitors is utterly wrong. Almost one million visitors come to Barbados each year. The overwhelming number of these visits are incident free." Source http://www.bbc.co.uk/news/uk-england-beds-bucks-herts-20432825

The controversy trailing embattled for governor of Delta State, James Ibori has taken a new twist as a Lagos based refrigerator repairer, Olalekan Bayode has applied to the Federal High Court sitting in Abuja to appoint him as a manager of the disputed $15 million (N2.6 billion) James Ibori alleged bribery money and to also make him intervener in the dispute on the ownership of the money. The refrigerator repairer through his United Kingdom based lawyer, John Olufemi Aina, sought the order of Justice Gabriel Kolawole to make him an intervener in the dispute and to appoint him as a sole agent to be in custody of the money till undisclosed period of time. He asked Justice Kolawole to make an order compelling the Central Bank of Nigeria, CBN, to release the money to him for proper management following the dispute on the ownership of the huge funds by the federal government and Delta State. |
A building located in Low Cost Housing Estate, otherwise called Jakande estate, in Oke-Ake-Afa, Isolo area of Lagos, collapsed, yesterday, killing two graduate sisters. The mother of the dead girls, identified as Mrs Coker, a widow, who was brought out of the debris alive was, however, in coma yesterday. Affected were flats 2, 4 and 6 of the six flat low-cost houses built over 30 years ago. The building, Block M20, according to eye witnesses started showing cracks and sinking over a year ago. The tragic incident as gathered, occurred at about midnight causing a deafening sound. Vanguard gathered that while occupants in flats 2 and 4 managed to escape, those in flat 6 – Mrs Coker and her two children: Toyin, a graduate of the University of Lagos and her younger sister, Bukola, did not. It was learnt that occupants of the collapsed building apparently ignored the warning signs of imminent danger which was evident since the past year. Tenants in flats two and six reportedly moved out some months ago, only for owner of flat two to lease the flat out to new occupants. After the incident, youths in the area reportedly began a rescue mission. The body of Mrs Coker in her unconscious state was said to be the first to be brought out from the debris at about 3am and was immediately rushed to the estate health centre. Bukola’s body, in her night gown was reportedly brought out at about 5am, while that of Toyin was brought out an hour later, stone dead. When Vanguard arrived the scene at about 8am, officials of NEMA and neighbourhood watch were sighted. Fire fighting vehicles arrived later. Source: Vanguard

"Henry Pender is a graduate of Political Science from the University of Ibadan. Pender graduated in 2000 and has worked as a banker, yet he is among the about 100 graduates undergoing training to become truck drivers; or rather logistics assistants. Pender is also the class governor of this first batch of trainees. After my service, I had the privilege of being retained at the Rivers State Primary Education Board where I did my primary assignment. I was with them for about a year before I joined the All States Trust Bank, which is now defunct. I worked with them for three years before I joined the Ecobank, from there I moved to the Oceanic Bank before joining Ecobank again after the acquisition of Oceanic Bank by Ecobank. I had to leave the banking industry when I married my colleague, because the human resource policy then did not allow spouses to work in the same office. I felt that my wife should stay behind while I as a man would look around for something to do. It wasnt easy, because the job was not forthcoming as I thought. I attended a couple of interviews at different places, but I didnt get what I was looking for. When this opportunity of becoming truck driver with Dangote presented itself, I applied with open mind. I felt that this is an opportunity for a new beginning to move into a new paradigm that is not explored. We have just begun the journey in the Nigerian Institute of Transport Technology (NITT). I was pleasantly surprised when I came here to see people from different backgrounds and professions. We are all getting along very well. I am looking forward for an experience that would improve our larger society. Dangote has put something in place that would turn out to be a revolution in the transport industry in this country. I think this programme would eventually become a model that all organisations of international standard would adopt in no distance future. From personal point of view, I like driving. I have driven a lot since when I became a professional driver and I like travelling. But by coming here, I have been exposed to the academic side of driving. I feel that whatever I do as a graduate, there should be a level of expected difference from what a layman would do. I think the objective of employing graduates as drivers is for sanity to be restored on our highways. Most of us are victims of the recklessness of heavy truck drivers and this is what this initiative wants to address. We are being trained here to become complete gentlemen as drivers, Pender said. He explained that he has, essentially, decided to join the truck driving profession out of interest not for material reward. As at the time we had our interview, there was no mention of any material reward. It is now that we are hearing that after a successful driving for a certain period, or covering of certain mileage that one would own a truck or things like that. No such thing was mentioned; there was no mention of special incentives rather than we would be employed and paid salaries. What I would say lured me into joining the truck driving profession is the name Dangote that is known locally and internationally. I bet you that if it were some other companies that came up with this initiative, some of us may not be here but the mention of the name Dangote, one would know that there is quality; there is a personality behind it; there is international recognition; that is what lured most of us here beyond any other material gain. We only discovered the entrepreneurial incentive of this programme when we came here; when most of us have completed their registration. Being somebody who had the experience of the banking sector, I would quickly join Dangote, because I know I would have job security and we are enjoying ourselves here in the NITT as the pioneer batch of this training programme. I never knew there is an institute like the NITT in Nigeria. We are grateful to them for the knowledge they are impacting in us. I want to also use this medium to urge the youth of Nigeria to work hard. We have to make names for ourselves by working hard as it is not all of us who are children of the privileged, therefore we are here as part of our dignity of labour. I would rather stay here and do this work than apply for visa to go abroad and face all kinds of humiliation by washing toilets or driving taxi while I have a similar option here, which I would do with dignity and leave a good example for the upcoming ones, Pender explained. source: www.247nigerianewsupdate.com/dangote-tr ... -d-holder/ |

IBARA ROUNDABOUT BRIDGE;OGUN PAYS OVER N4M COMPENSATION The Ogun State Government today make good its promise to adequately compensate owners of properties demolished in the course of erecting structures as it pays the sum of four million, two hundred and eighty nine thousand, three hundred and twenty seven naira (N4,289,327.00) to nine individuals whose properties were affected by the construction of the Ibara roundabout overhead bridge. Handing over cheques to the claimants, the Deputy Director, Acquisition in the Bureau of Lands, Mr. Isaac Akogun, observed that the Senator Ibikunle Amosun led-administration was the first government that made such instant payment to property owners whose land or properties were affected by infrastructural developments. He remarked that physical development is part of beautification and urban renewal, adding that after the initial discomfort, residents benefit in the long run as they stand to enjoy the comfort provided by such infrastructures. Mr. Akogun enjoined residents to always cooperate with government, urging that where necessary, owners of properties that could disturb infrastructural growth should surrender them for overall public good, particularly now that government is paying compensations promptly. Speaking shortly after collecting his cheque, one of the claimants, Mr. Safiani Egbeyemi lauded the government for matching its words with action as it has displayed that it is committed to the welfare of the people. “The present administration in Ogun State is a government with human face whose passion for the people cannot be overemphasized. Let me say that I was not optimistic initially because governments in the past have not been fulfilling promises, however, I was pleasantly surprised when I was called up for this” he remarked. Speaking in the same vein, another claimant, Mrs. Iyabo Tagoe said she was overwhelmed with government’s gesture, pointing out that the money will help her and others to embark on projects that would ensure their wellbeing and reduce their loss owing to the demolition. Guys Whats Your Intake On This? Is Road The Major Thing Neccessary In Ogun? |
The Ogun State government is putting up a proper design and layout plan for the Lagos/Ibadan Expressway to address uneven development along the axis. The Special Adviser to the Governor on land matters, Mrs. Ronke Sokefun who made this known today in Abeokuta while speaking during a media chat, affirmed that the present administration would not relent in its efforts to stem further uncontrolled development along the axis. Mrs. Sokefun, who is also the Director-General of the Bureau of Lands noted that as a proactive and responsive government, the Senator Ibikunle Amosun led-administration had decided to address once and for all, the issue of non-conformity with the State’s regional plan of the axis, insisting that all development must conform with the regional plan in order to have an even development. She added that to implement the design and planned layout appropriately, a cadastral mapping and zoning of the expressway would be embarked upon. Speaking on the decision of the State Government to reinvigorate its Geographic Information System (GIS), Mrs. Sokefun disclosed that the need to meet the demands of modern day data gathering, storage and processing on land management was responsible for this to ensure accurate mapping, obtain concise pictures and depict land marks necessary for socio-economic development. She explained further that the GIS will also facilitate up-to-date land administration and ease the processing of Certificate of Occupancy by eliminating the existing manual system and makes documentation an easy process. She reiterated that the ultimate aim of the GIS project was to provide customized services which include data collection and digitalization of existing surveys, conversion of controls into digital format among others to facilitate easy transfer and exchange of geo-spatial data. |

A mail I got from the victim's colleague. See it below... On October 24, at about 10am, Gbolahan Olayinka and his office driver had gone to the Mobil filling station along Agege Motor Road, adjacent FRSC office, Mushin, where they usually buy fuel. On arrival, they observed that some men of the Federal Road Safety Commission where stationed there. Gbolahan and his office driver parked at a place that obviously didn’t obstruct traffic, by the gate of the filling station. Before they could turn an eyelid, one of the officers was by their car and was about to release the tube of their tyre. Please continue... Gbolahan challenged him for his action. That was when a slap landed on his face, then another slap from another officer. Before he could say anything in self defense, the officers – three of them – had pounced on him. He was bundled into their vehicle and taken to their office where he was handcuffed to a mast behind their office, his phone was ceased – he was held incommunicado – and beaten mercilessly. He was forced to write a letter of apology (under duress). They made it clear to him that he had no way out; he got threats that he would simply be said to have attacked an officer of the law or that he used charms on someone. When his brother, who is a lawyer, and other family members got there, the FRSC officials threatened to beat them too. Gbolahan and his people have lugged complaints at the FRSC office in Ojodu and the Commissioner of Police. This inhuman treatment must not be allowed to stand. You know why I share stories like this? Tomorrow, it could be me or you! The brutalization of people by officers, which we hear about everyday, has got to stop!
