All may not be over in the Rivers state governorship primary of the Peoples' Democratic party (PDP) EVEN as the PARTY INAUGURATE HER CAMPAIGN COUNCIL ON MONDAY. THIS IS DUE TO THE LEGAL BATTLE BETWEEN CHIEF MORGAN TOM WEST AND MR. SIMINALAYI FUBARA, AS THE duo engaged on validity of candidature for the party. MANY ARE NOT AWARE THAT
Chief Morgan Tom West has approached the Court through his Lawyer, Ibrahim Idaye, ESQ seeking for the disqualification of Mr Siminalayi Fubara on GROUNDS THAT THE PDP GOVERNORSHIP CANDIDATE IS NOT QUALIFIED TO CONTEST THE PDP GOVERNORSHIP PRIMARY OF 25TH MAY 2022 BECAUSE HE IS NOT A MEMBER OF PDP AND DID NOT HAVE A VALID PDP MEMBERSHIP CARD. CHIEF TOM WEST FURTHER alleged THAT SIMINALAYI FUBARA ALTERED A PDP membership card of ONE FUBARA JOSEPH WITH DELETED SIGNATURES OF NATIONAL SECRETARY AND THE NATIONAL ORGANISING SECRETARY, AND WRONGLY PRESENTED SAME TO THE Peoples'Democratic party AS HIS, IN breach of THE party constitution AS PROVIDED IN CHAPTER 2 PART 1 SECTION 8 (7). CHIEF TOM WEST ALSO ALLEGED IN THE ORIGINATING SUMMONS FILED ON THE 7TH JUNE 2022 THAT THE PDP CANDIDATE MR. SIMINIALAYI FUBARA LIED on oath about HIS retirement DATED 11TH APRIL 2022 AS THE ACCOUNTANT GENERAL OF RIVERS STATE. CHIEF MORGAN TOM WEST FURTHER ALLEGED THAT SIMINALAYI FUBARA LIED ON OATH THAT SIMINALAYI FUBARA ATTENDED COMPREHENSIVE SECONDARY SCHOOL PORT HARCOURT AND OPOBO PRIMARY SCHOOL OPOBO TOWN. MORE SO, CHIEF TOM WEST ALLEGED THAT THE PDP CANDIDATE NEVER PARTICIPATED IN THE GUBERNATORIAL PRIMARY IN THE 1ST PLACE HAVING NOT BOUGHT THE PDP GUBERNATORIAL NOMINATION AND EXPRESSION OF INTEREST FORMS TO CONTEST THE PRIMARY ELECTION OF 25TH MAY 2022.
In an originating summons in suit No: PHC/ABJ/CS/818/2022, filed by the plaintiff counsel, BARR. Ibrahim Idaye in the Federal High Court 5 Port Harcourt, pursuant to section 177c OF THE 1999 CONSTITUTION AS AMENDED, SECTION 84 (14) of the Electoral Act, 2022, Order 3 Rule 6 and 7 of the Federal High Court (civil Procedure Rules), 2019, Chief Morgan Tom West (plaintiff) is asking the court to determine whether Mr SIMINALAYI FUBARA, validly emerged as the winner of the governorship primary election held on 25th May, 2022, with regards to PDP Gubernatorial primary election guidelines as mandated by section 84 ( of the Electoral Act.
The plaintiff CHIEF MORGAN TOM WEST IS seeking the court to determine whether by the provisions of sections 177(c), 182 (1) (g) of the 1999 constitution as Amended, and section 84 (11) and (12) of the Electoral Act and Chapter 2 Part 1, section 8 (7) of the PDP constitution, the 1st Defendant MR. SIMINALAYI FUBARA can validly contest in the 25th May, 2022 Rivers state Gubernatorial primary election held at Obi Wali Cultural Centre, Port Harcourt, Rivers state.
CHIEF TOM WEST is ALSO praying the court for an Order to disqualify Mr Siminalayi Fubara as the RIVERS STATE governorship candidate for the Peoples Democratic Party for alleged alteration of the Party's membership card BELONGING TO ONE FUBARA JOSEPH
that WAS earlier SUBMITTED to PDP NATIONAL SECRETARIAT AND LATER SUBMITTED TO INEC by the 1st Defendant WITH ALTERED SIGNATURES OF THE National secretary and the Organising Secretary INCLUDING THE NAME "JOSEPH"
CHIEF TOM WEST CLAIMED THAT CHAPTER 2 PART 1 SECTION 8 (7) OF The PDP CONSTITUTION CLEARLY STATED THAT THE membership card OF THE PARTY shall be produced by the National Headquarters and authenticated by the National Chairman and the National Secretary. THAT SIMPLY MEANS ANY PDP MEMBERSHIP CARD WITHOUT THE SIGNATURES OF THE NATIONAL CHAIRMAN AND NATIONAL SECRETARY IS FORGED, INVALID, NULL AND VOID. AND THAT THE PDP GOVERNORSHIP CANDIDATE MR. SIMINALAYI FUBARA PDP MEMBERSHIP CARD PRESENTED TO BOTH PDP AND INEC IS FAKE AND INVALID.
Given THE ABOVE, the plaintiff is praying the court for an Order to disqualify the 1st Defendant for allegedly lying on Oath about his resignation or retirement from the STATE CIVIL SERVICE, adding that the Affidavit sworn by MR. SIMINIALAYI FUBARA THAT HE retired on 11th April, 2022 OFFENDED RELEVANT SECTIONS OF THE 1999 CONSTITUTION, THE ELECTORAL ACT 2022 AND THE PDP GUBERNATORIAL ELECTION GUIDELINES.
The Defendants in the matter are Siminalayi Fubara, PDP, INEC, PDP National Chairman, Senator Iyorchia Ayu and the Chairman of the Committee that conducted the guber primary in Rivers state, Prof. Walter Mboto.
While claiming to have retired from the state civil service on April 11, 2022, MR. SIMINALAYI FUBARA on September 5th and 20th signed an official documents as the Accountant- General of Rivers State, a move CHIEF TOM WEST CLAIMED VIOLATED THE 1999 CONSTITUTION AND THE ELECTORAL ACT.
MEANWHILE CHIEF TOM WEST is asking the court to declare him the validly elected RIVERS STATE Governorship candidate of the PDP.
However, the matter which was last heard on the 13th October, 2022, is slated for JUDGEMENT ON November 4th 2022.

1. Some iPhones are
* under contract which means it has not been fully paid off. (Debt)

* blacklisted which means the imei is dented and you will have to pass Tru some sort of grace to get tech to clean the imei or bypass it.

* in most cases they are generally tag BAD ESN/Financed

2. Some network are naturally expensive to unlock hence client go for chip. Sprint T-mobile etc

3. Some are generally not supported.mostly new devices

If iPhones fall into any of the above the best way to go around it bypass those hurdles with chip.
