In Criminal law, two elements must exist to make an accused guilty of a crime. The first is the actus reus (actual act), and the second is the mens rea(intention).

For any crime at all, once the victim or prosecution is able to prove the above two elements beyond reasonable doubt, the court will convict and sentence the accused.

For the offence of rape, I am aware that not all rape accusations end with a conviction for the accused, before a conviction is secured in a rape charge, the victim or prosecution must prove to the court that there was indeed penetration of the accused's male organ, into the female reproductive organ, without the consent of the victim.

Proving consent is subjective, depending on the peculiarity of the different rape circumstances or scenarios...
