1. As per the contacts- call logs and chats; Do I start from when I was refused November 2015 till date? or May 2015 when I applied then?
2. Each chat; Facebook, Skype, What's app has nothing less than 162 pages each from January 2016 till date how do I do this?

No. I haven't personally. However, if you look at the financial requirement guidelines for this type of visa all you need will be there.

Whatever you do, make sure you enclose HMRC documents/paperwork. Tax returns, Bank statements.

I thought I replied. That's good you better not. I've been reading some pages back and some people have gone and got on with their lives... I will keep everyone updated regarding the appeal...I just can't believe the fee has gone up and there is probably no change in the timescale as to how things happen! Oh well. undecided

Good stuff, well done. I can't talk about the Naric stuff cuz i've got no clue on that... As i did both, my degree and masters in the Uk so i just sent in my certificates and transcripts........ But if you told to get it, then by all means do. Hit them with all you've got.....Not long b4 we hear you celebrating.... cool

Yes I sent it off yesterday. Had a few people read over my statement. I highlighted relevant sections on my payslips, employment letters, bank statement. Also added tenancy agreement and letter to back up the utility bills and council tax bill they claimed not to have seen.

The only thing I'm concerned about is the English requirement as we didn't have a Naric letter or assessment done at time of application but processing it now and wrote on the appeal form that the statement from Naric is pending and once available we will send it through. I'm worried that based on that alone they may not overturn their decision, though hubby submitted original and copy of degree cert and official letter from the University. undecided

The child was born here and hold a British passport just as me. Am just applying for my spouse which is the dad. The child is here with me but the dad stays in Nigeria which am now putting his application in now. That why am asking that question.
Ok! Well when you apply you will have to declare that you both have a child and would need your child's passport number and d.o.b etc. I believe this information is requested on one of the appendix that must be completed in the addition to the application.

Even if the child is coming from Nigeria, if he has a British passport, it's still £18,600. Go to uk.gov website and read up.
I know this. But I was under the assumption the person meant a child with a Nigeria passport not a British child who is residing in Nigeria and returning to UK. The child wouldn't even need to be a part of the application if they have a British passport. wink

Hubby received an email today at 1:57pm I saw it at 2pm that his passport is ready to collect. I called him and said babes they close at 4 please go there now I cant wait any longer.

He collected his passport today and his visa was issued!!

Time to book his return flight!!

Have been following this naira land for over 3 months now and am planning to put my application in for spouse visa sometime next year but am just trying to clarify something before then. This is about the £18,600 for spouse application and £22,400 when you have a dependant child does this apply to a British dependant as well or just a dependant in Nigeria only. Can someone pls help.
A dependant child coming from Nigeria who the UK spouse will be a sponsor for too.

So I have been gathering documents to attach to my appeal. They are:


- Payslips provided by employer from payroll system January - October 2016 (3 more since original application);

- P60 for 2016 (originally submitted);

- Letter from finance department confirming my employment, position, length of service and that payslips were issued from their payroll system and a break down of gross monthly earnings (submitted 1 originally so sending another) ;

- Employment contract ;

- Bank statements January - October 2016 (3 more statements since original application);

- quarterly gas bill July and October  (1 more since original application);

- quarterly electric bill July and October  (1 more since original application);

- Council tax bill (originally sent, sending again);

- Rent account statement x 2 (new info);

- Annual Student loan statement (new info);

- Gas safety record for rented accommodation  (new info);

- Tenancy  agreement + letter from tenancy  manager (new info);

- Maternity certificate  (new info, could not be submitted at time of application because they are only issued after a certain amount of weeks of pregnancy);

- Hospital detailed scan assessment letter confirming multpile pregnancy (originally sent);

- Mum's terminal illness diagnosis confirmation from GP;

- Applicant's degree certificate and letter from university confirming degree studied and examined in English  (originally submitted );

- Email correspondence from UK Naric regarding application for Degree comparability statement  (new info).

Do you think this is all OK?

I have highlighted my name, address, employee number, date, gross earnings on payslips, employer letter and P60.

I have also highlighted my name, date and address on all bills, statements. I have highlighted on my bank statements where my salary is paid into my account as well as the date, name and address.

We had the same issue with council about the letter. They ended up giving us a letter containing what you stated above. We then quoted the section of the tenancy agreement that stated he could "take in a lodger" in our sponsorship letter. We got the visa

No..The HO claim my husbands case was not straightforward. Then the lawyer provided an incorrect email and the mobile number for my hubby missing a digit. So we were not getting any correspondences.

Thanks to myself being proactive and not waiting on the lawyer who I paid in full upfront, I managed to update the contact details and pay the IHS charge that the lawyer said he had paid. Long story with back to back DRAMA! Just awaiting the decision now... So fingers crossed its good news...
Wow. Sounds like you have been through alot. Why did you hire a Lawyer if you don't mind me asking?

One other thing, put your name as his rep in the appeal and get him to email the tribunal giving you authority to receive all correspondence. If not, they send it through the Naija postal system, it took almost three months for my wife to get the first letter!
You mean in these sections? And it's OK for me to be both his rep and sponsor?

Hey, just a query. Hubby cannot apply for a visiting visa whilst we apply for an appeal can he? So he can be here to witness the delivery? or that is not a good idea?

I will see if I still have a copy of my appeal. It wasn't actually technical at all, I didn't quote any cases. I just addressed the issues the ECO with supporting documents and added the ones I missed out earlier (letter from employer and extra payslips)

I just stated that I have more documents which I believe will address his concerns and said I believe some documents were mistakenly overlooked, that's all.

The good thing is that you just have to address ONLY the missing criteria, that's it, nothing extra. I got out a highlighter and marked every relevant thing on the documents, labelled everything clearly and sent it off. Once they reviewed it, they overturned the refusal without having to go further
Yes I intend to do same. However, how am I supposed to address the income part as I submitted all I possibly could (7 payslips, Letter from employer, P60 and bank statements with salary going in). I did get ANOTHER Letter and 3 new payslips (since last application) today from my employer that I want to submit with the appeal. Perhaps I highlight the gross salary showing on my payslips, because I did this on the bank statements I provided.

Yes I want to send off the appeal by this week. If I wait for Naric and Hubby's University I believe the 28 days would have lapsed, so I am intending to submit the degree cert and letter again and will mention that I am waiting for the NARIC Letter/Certificate and once it becomes available I will forward it on.

Would you mind forwarding on your appeal statement please?

Exceptional circumstances - In your case is that, you believe your documentations were not properly scrutinized. All documentations requested your submitted and were all in date.
You can appeal on your husband's behalf.
NB: They haven't doubted the genuineness of your union (thats a good thing). The issues they had are more technical.
No they didn't doubt this, we met this requirement as well as the suitability requirement.
I can mention that in my appeal, about me not believing the documents were properly scrutinized and the ECO's issues were that of a technical nature?

Send all details you can and state whichever is pending. They might even waive the appeal and grant you your visa, due to weight of evidence produced.

Employer has just emailed me the stuff over.

What do you believe they (Visa people) can consider to be exceptional circumstances?

Also, I, as my husband's sponsor can write the appeal? as though it's coming from me? or I will have to word it as though he is writing it? On the appeals form there are a few signature spaces for the appellant.

Yes I will be doing that. I also took a look at Wallg's case that he posted. Yes it was quite complicated and from my calculation it was almost a year. WOW.

They haven't refunded my healthcare surcharge yet....

I do believe my case is straight forward but they don't care so it could still take time. My employer is writing another letter today confirming the true representative of the previous documents. she will also print off, stamp and sign in addition payslips from the payroll/finance system since we submitted the initial application (which will make another 3 payslips confirming gross annual salary)

I contacted NARIC, they said it would take 10 working days to process statement/certificate, however, they need the transcript to do this and hubby's University are saying to get the transcript will take 10 working days too. Which will be about 20 days in total.. Am I able to explain this in the appeal form and send the statement/certificate once received?
