By Francis Ighata ENUGU—The sleepy town of Imilike-Agu in Udenu Local Government Area of Enugu State was, weekend, thrown into mourning following the killing of a 60-year-old Paulinus Ugwuoke, during a heated altercation with his son, Anselem Ugwuoke. This came as no fewer than four person, including a bus driver, a passenger and two children were confirmed dead while scores also sustained varying degrees of injuries in a head-on collision involving two commuter buses which took place on Christmas Day at about 3pm along Enugu-Onitsha expressway by Water Works, Umumba, Ezeagu, Enugu State. It was gathered that Anselm, the suspected killer of Paulinus had engaged the father in the company of his friends in a hot exchange of words over a yet-to-be established issue when as Anselem allegedly hit the father with a heavy object which left him unconscious. Paulinus was later confirmed dead at a nearby hospital. The Nigerian Government would on January 1, 2016 reduce the pump price of the petrol to N85 per litre. The product officially sells for N87 per litre, although it sells for higher prices in some states of the federation. The Minister of State for Petroleum, Emmanuel Kachikwu, disclosed this to journalists at the Port Harcourt Refinery Company (PHRC), where he spent Christmas inspecting the plant. Asked when the Federal Government would release the new price template of the Petroleum Product Pricing Regulation Agency (PPPRA), Mr. Kachikwu said he approved the new price for the agency on Thursday. “Like I said, we have done a modulation calculation and it is showing us below N87,” Mr. Kachikwu said. “I imagine that if PPPRA publishes it today, it will become effective immediately. But the 1st of January that is when we are looking at.” According to him, the new price is below the current N87 per litre and it would now convince Nigerians that the pricing modulation that the Federal Government promised to embark on a few days ago was not a trick. A British Judge on Tuesday refused to release $85 million (N17 billion) to Malabu, a fraudulent company controlled by Nigeria’s former petroleum minister, Dan Etete. In refusing to release the money to Malabu, Justice Edis of the Southwark Crown Court declared that he was not sure the administration of President Goodluck Jonathan acted in Nigeria’s interest when it approved the transfer of the money to Malabu. “I cannot simply assume that the FGN which was in power in 2011 and subsequently until 2015 rigorously defended the public interest of the people of Nigeria in all respects,” the judge ruled. PREMIUM TIMES had reported how the Jonathan administration controversially approved the transfer of $1.092 billion from Nigeria’s JP Morgan account in London to Nigerian accounts controlled by Malabu. The money was paid by global oil giants, Shell and ENi, for Africa’s richest oil bloc, OPL 245. The former Attorney General of the Federation, Mohammed Adoke, and the former Minister of State for Finance, Yerima Ngama, signed the documents approving the transfer to Malabu. The fraudulent deal, shaded in various layers of corruption, has been condemned by Nigerians and international transparency advocates and is being investigated by authorities in four different countries. THE SEIZED $85 MILLION The $85 million was seized at the request of Italian prosecutors who are also investigating the deal. The money was the last part of the OPL 245 largesse not yet distributed. Sensing that the Muhammadu Buhari administration was yet to find its feet on international legal matters, Mr. Etete approached the British court and asked that the money be returned to him. At a two-day hearing that started on November 23, Mr. Etete’s lawyers argued that there was no fraud in the deal and asked that the money be released to him. While Mr. Etete argued that the money be released to him, the Italian prosecutor argued that “their investigation could lead to a potential forfeiture of the money down the road.” a source who has followed the case and was present at the proceedings told PREMIUM TIMES. Malabu’s lawyers told the court that freezing the money was an assault on Nigeria and questioned how the court could imagine that Messrs. Adoke and Ngama would be a party to a corrupt deal. THE RULING While giving his ruling on Tuesday, Justice Edis said while he could not say for certain if the deal was fraudulent pending conclusions of investigations, it would be inappropriate to release the money to Malabu. “I am not making any findings of fact about misconduct by anyone. I am simply assessing the evidence before me to determine whether a restraint order should be discharged which was granted by way of MLA (Mutual Legal Assistance between the UK and Italy) to support an investigation by the Italian authorities,” the judge said. The judge also made reference to evidence provided by the Italian authorities that ex-President Jonathan was directly involved in the fraudulent deal. “The suggestion from the wiretaps is that “Fortunato” was implicated and I am told that this was a reference in code (not subtle) to the former President of Nigeria, President Goodluck Jonathan,” the judge said. “Aliyu (Abubakar) is said to be associated with him and Aliyu received, in a way which was not transparent, $523m of the money paid for the OPL 245 licence in August 2011.” PREMIUM TIMES had reported how fictitious companies owned by Abubakar Aliyu, a man referred to as ‘Mr. Corruption’ by anti-graft officials, received over half ($532 million) of the total $1.092 billion. Mr. Aliyu, a close ally of Mr. Jonathan was recently quizzed by EFCC operatives for the first time despite being a central character in the deal whose investigation was virtually stalled during the Jonathan presidency. ACTIVISTS REACT Reacting to the ruling, Simon Taylor of Global Witness stated that “Given the gathering pace of the EFCC investigation in Nigeria under new leadership and a call by the Nigerian House of Representatives to cancel the deal in 2014, investors in Shell and Eni should demand to know why they were exposed to such risk.” The UK based Global Witness has been at the forefront of the demand for transparency in the deal and other similar deals across the world. President Muhammadu Buhari on Friday explained why his administration was yet to release names of corrupt former officials of the past administration who voluntarily surrendered their loot. Speaking in Abuja at this year’s edition of the annual Osigwe Anyiam-Osigwe Foundation Lecture, President Buhari said “any disclosure now may jeopardize the possibility of bigger recoveries”. Mr. Buhari said, “As I stated recently, a good number of people who abused their positions are voluntarily returning the illicit funds. I have heard it said that we should disclose the names of the people, and the amount returned. “Yes, in due course, the Central Bank of Nigeria will make information available to the public on the surrendered funds, but I must remark that it is yet early days, and any disclosure now may jeopardize the possibility of bigger recoveries. “But we owe Nigerians adequate information, and it shall come in due course. The deputy governorship candidate of the All Progressives Congress in the recently concluded governorship election in Kogi State, James Faleke, has said he would not present himself for swearing-in with Yahaya Bello, the governorship candidate who was drafted in after the death of Abubakar Audu. Mr. Faleke is billed to be sworn in on January 27, 2016, alongside Mr. Bello. Mr. Faleke made his position known on Monday at Kabba at a meeting of APC stakeholders from Kogi West senatorial district. He said his stance is in furtherance of his earlier letter to the national leadership of the party not to work with Mr. Bello, the governor-elect. The politician, who was reacting to a resolution reached at the meeting that he should pursue the legal option to a logical conclusion, said the Audu/Faleke ticket remained intact and unchanged. “I will not disappoint Prince Abubakar Audu. I, James Abiodun Faleke will not be there for the swearing in if we don’t finish the case before the January 27, 2016. “Nobody consulted me before making me a deputy to Bello. Bello too did not consult me. I have made my position known to the party leadership on this. I am not ready to betray and disappoint Prince Abubakar Audu,” he said. The tenure of the present administration ends on January 27, 2016 . He also exonerated President Mohammadu Buahri from the crisis, saying Mr. Buhari he knew ‘cannot be a party to injustice and outright violation of the rule of law.’ Mr. Faleke warned the leadership of the APC against setting the party on a path of destruction through impunity and injustice, saying that they should learn from what happened to the Peoples Democratic Party. He said that the present struggle was a complex one and beyond him, saying it was about emancipation of the people and the future of the state. While asking the people not to fight or castigate anybody over the development, Mr. Faleke said those fighting in 2015 for positions in 2019 were trying God. “People are fighting for 2019 in 2015. Are they God? What is happening is beyond human imagination,” he said. He warned members and supporters of the party against fighting or castigating anybody, saying those behind the plot were only working to actualize God’s plan and the ultimate liberation of the state from the flaws of poverty and underdevelopment . “I am a marathoner, no matter how bumpy and rough the road is, we shall get there, “ he said. According to him, the constitutional crisis created by the sudden death of Mr. Audu, when finally resolved, will enrich the country’s democracy . The Peoples Democratic Party, PDP, has said it is “a waste of time, scarce national resources and ridiculous shadow-chasing”, the action of the Independent National Electoral Commission, INEC, in declaring Yahaya Bello, the candidate of the All Progressives Congress, APC, who, it said, did not participate in the overall election, as Kogi State Governor-elect. INEC announced Mr. Bello as the governor elect of Kogi after he won the supplementary election held Saturday in 19 polling units. The PDP said INEC, in a “bid to satisfy the President Muhammadu Buhari-led APC Federal Government”, succeeded only in making a mockery of itself and the entire electoral process, by trying to illegally install an individual who, apart from not being a valid candidate, scored, under his name, a paltry 6885 vote in the so-called supplementary election as against the 204,877 votes polled by the PDP candidate, Governor Idris Wada, in the overall election. The PDP National Publicity Secretary, Olisa Metuh, in a statement on Sunday said “the action of INEC in trying to transfer the votes earlier garnered by the dead APC candidate, Audu Abubakar, to another individual is completely impractical and alien to the nation’s Constitution and the Electoral Act.” “The declaration by INEC that one Yahaya Bello polled the highest number of votes is an embarrassing travesty of the nation’s democracy and electoral process. Not only that this individual is not in any way a valid candidate in the election, he also did not score the overall votes declared against his name by INEC and cannot be declared winner under any circumstance within the provisions of our laws. “The provisions of the constitution and the electoral act are clear to the effect that with the unfortunate death of Prince Abubakar Audu before the conclusion of the election, and the fact that the laws do not permit the replacement of candidates once the balloting has commenced, the APC crashed out of the race, leaving the PDP candidate, Governor Idris Wada as the clear winner, having garnered 204,877 votes to top all other contestants since, Prince Abubakar, the hitherto leading contestant died with his votes. “It is therefore unfortunate that INEC disregarded the provisions of the Constitution and the Electoral Act, which left it with no other legitimate option than to declare Governor Idris Wada the governor-elect. Instead, it went ahead to preside over a charade, for which it is now attempting to illicitly handover the vote cast for a dead man to another person, who did not participate in the overall election. “We all, including INEC and the APC know that nothing other than declaring Governor Idris Wada winner of the election fulfils the requirements of the law under the circumstance. APC cannot have two candidates in one election and the bitter in-fighting within their fold shows the absurdity of INEC’s decision in that regard.
