There are indications that the National Judicial Commission (NJC) may have recommended the retirement of suspended Chief Justice of Nigeria (CJN), Justice Walter Onnoghen and the retention of Justice Ibrahim Tanko Muhammed as substantive CJN.

This is coming at a time the leadership of the All Progressives Congress (APC) has allegedly renewed fresh pressure on the judiciary and the Independent National Electoral Commission (INEC)to find political solution to the disqualification of the party from participating in elections in Rivers and Zamfara states.

Daily Sun gathered that the retirement of Onnoghen and retention of Muhammed as CJN are the NJC’s last-ditch effort to bring to an end the impasse in the judiciary following President Muhammadu Buhari’s hammer on the CJN.

The NJC, which had given Onnoghen and Justice Muhammed seven days ultimatum to answer to petitions against them, will today meet to ratify its recommendation on the CJN suspension saga.

A competent source revealed that the NJC resolved that the suspended CJN should retire, in the face of the allegations against him, even though yet unproven in the law courts.

On the reason for wanting Justice Muhammad to continue in substantive status as the CJN, the source said the NJC took the decision based on its view that he had not committed any offence or breached any rule.

“He presented himself for swearing in based on a court order (CCT). He couldn’t have disobeyed a court order, which the president also relied on,” the source said.

The retention of Justice Muhammed will dash the hopes of some powerful forces in the South West, which had anticipated that the next most senior justice of the Supreme Court from the zone will be a beneficiary of the impasse, in the event of the retirement of Onnoghen and Muhammed.

Recommendation for Onnoghen’s retirement and retention of Muhammed are contrary to expectations of some lawyers who had canvassed that both justices ought to go to ensure clean slate in the impasse.

They cite the case of Abia State Chief Judge, where the NJC ordered the retirement of acting Chief Judge of Abia, Obisike Orji, for accepting the appointment when the State Chief judge, Justice Theresa Uzokwe, was suspended by the state government without its approval.

Senior lawyers, like former President, Nigeria Bar Association (NBA), Olisa Agbakoba (SAN) had petitioned the NJC over Muhammed’s appointment as Acting CJN. He had insisted that Tanko was wrong in presenting himself to be sworn in.

Also human rights activists, Chief Mike Ozekhome (SAN) and Mr. Femi Falana, faulted the suspension of Onnoghen for being procedurally wrong.

Falana said: “I have had cause to call on the Attorney-General of the Federation, Mr. Abubakar Malami (SAN) to withdraw the charge of false declaration of assets filed against the Chief Justice of Nigeria, Justice Walter Onnoghen, at the Code of Conduct Tribunal. The call was without prejudice to the merit of the serious allegations levelled against the Chief Justice. In line with decided judicial authorities I had wanted the National Judicial Council to investigate the allegations.”

Ozekhome argued that the removal of the CJN was a ploy to emasculate the judiciary by the government so as to get political advantage ahead of the general election.

The United States government and the European Union equally condemned Onnoghen’s suspension saying the move was in violation of the constitutional requirement for the removal of CJN

The US authorities said the development was a mockery of President Buhari and other Nigerian politicians’ commitment to free elections.

A US statement said: “We note widespread Nigerian criticism that this decision is unconstitutional and that it undermines the independence of the judicial branch.

“That undercuts the stated determination of government, candidates, and political party leaders to ensure that the elections proceed in a way that is free, fair, transparent, and peaceful – leading to a credible result.”

In the sane vein, the Commonwealth Lawyers Association also flayed the move claiming that the constitutional procedures and due process stipulated for investigating a judicial officer in Nigeria were not followed.

The body contended that the government was entitled to charge members of the judiciary accused of criminal conduct, but that this should be done in a way that was “consistent with the rule of law and constitutional safeguards.

“The judiciary, like other members of society, may not be subjected to violations of their fundamental human rights no matter what the charges are against them,” the lawyers said.

Meanwhile, there is apprehension over Onnoghen’s appeal against his trial at the Code of Conduct Tribunal (CCT) at the Court of Appeal, which come up Wednesday.

Close associates of the suspended CJN are worried about the fate of the case, if the NJC announces the retirement of Onnoghen ahead of the case at the Appeal Court.

In its reaction to the Onnoghen case, the CUPP alleged that the Presidency has arm-twisted the judiciary for a deal.

CUPP alleged the NJC’s deal with the Presidency is to forcefully retire Onnoghen.

The deal, the group further alleged, was struck with the acting Chairman of the Council, Justice Umaru Abdullahi (retd).

CUPP said this in a statement issued in Abuja, yesterday, through its first national spokesperson, Ikenga-Imo Ugochinyere.

In another development, the APC leadership has reportedly intensified pressure to get a reprieve at the Supreme Court, which will enable the party field candidates in the forthcoming elections in Rivers State.

The APC had told its supporters not to panic after last Friday’s Supreme Court’s ruling, saying the determination of the substantive case, which comes up today, may be favourable to it. The apex court, by the ruling dismissed the appeal filed by the Rivers State APC chairman, Flag Ojukaye, challenging the judgments cancelling the conduct of the party’s primaries.

A stalwart of the party, who pleaded anonymity revealed that the APC was hoping to get a ruling today that will enable it field candidates in governorship, National Assembly and state Houses of Assembly elections in Rivers State.

“We are hoping to get a ruling that will allow us participate in elections in Rivers. Supreme Court is ruling on one of the appeals tomorrow (today),” the party chieftain said.

However, a legal luminary, Dr. Ehiogie West-Idahosa, had argued, in line with the ruling of the Supreme Court of February 8, that the matter of fielding candidates in the Rivers elections by the APC was “dead and deserved a decent burial.”

He said: “I do not see how Rivers APC can be restored to the ballot. I cannot find by what means. Like I had earlier submitted, it is the end of the road for Rivers APC candidates as far as 2019 general elections are concerned.”

The INEC had foreclosed the possibility of APC fielding candidates in the coming elections. The electoral body said follwing on the expiration of the deadline for APC to submit names if its candidates, the party will not participate in the elections

Bayo Ojo (SAN), former Attorney-General and Minister of Justice, on Thursday admitted receiving a "compensation" of $10million from former Petroleum Minister Dan Etete for his work as a legal adviser in the sale of OPL 245.

Ojo made the admission in a passage of his examination in Milan in the ongoing trial of former top officials of Royal Dutch Shell and Italian Agip-Eni over the payment of $1.092billion to Etete, the former Minister who awarded himself the lucrative OPL 245 by willing it to Malabu Oil and Gas, a company he had earlier set up using a false identity. He was also convicted of money laundering in an unrelated case in France in 2007.

Among the defendants in the matter are the CEO of the 'Dog six-legged', Claudio Descalzi; his predecessor, Paolo Scaroni; their accuser and former Manager of the Sahara area, Vincenzo Armanna; and also the same company and Shell.

Ojo admitted, in fact, that the worth of his compensation was $50million but he only received a part.

"I received only part, $10million, "and I hope to be able to regain possession of others. I'm not going to sue," he said.

The $50 million, according to the investigation documents, is a tranche of the maxi bribe of which a part was also paid to him, and was nothing more than — as it was written in an agreement — 5percent of the $92billion paid by the Italian oil company.

Ojo's admission, heard by videoconference, does not match that recorded by the former number one of the 'six-legged dog' for the Sahara area in April 2016, as he had claimed in front of investigators and investigators that the money "recovered by Bayo Ojo" has never been returned because not only in Italy at that time the price of gold was very high and "the margin would have been extremely modest", but also for its "economic difficulties.

Ojo, Descalzi had said, actually wanted to have this money back "but I involved him in some business and I found him some customers in Nigeria and then, in the end, he was satisfied".

The former Manager of the oil group would have 'coordinated' with Gianfranco Falcioni, former Italian consul in Nigeria, and Ojo the transfer of the alleged maxi bribe paid by Eni to the account of the Nigerian government at Jp Morgan Chase in London and subsequently received from the former Minister the sum of €917,952 with causal "Armanna inheritance" and that for the prosecutor's Office would be a share of the alleged bribes for the operation.

In his reconstruction, Ojo did not deny that he had collected $10 million. Instead, he said part of the compensation for his "legal advice" should actually have been $50 million, a figure equal to 5 percent of the amount paid to Malabu and Etete for the acquisition of the field.



Pressed by the questions of the prosecutor Sergio Spadaro about the work he had done since 2009 — after he had left the public office during which he had taken part in the proceedings to reassign Malabu to Etete — Ojo, who is referred to in the indictment as one of the recipients of the bribes, explained that his task would be to seek "one or more buyers of the Block but I was not lucky enough to find them".

He didn't talk about the details of his assignment, however, claiming professional secrecy, but he specified that during his work he didn't know about the lawsuit initiated by Shell nor that the Dutch and Italian oil companies "could be buyers" of Opl 245.

He then said that the $10 million was transferred from Rocky Top Resources "to his personal account because his firm did not have a foreign account". Of these, then, a million and $200,000 would be paid in 2012 to Armanna to start an activity in the gold sector

At an event which held at the NAPTIN Event Centre in Lagos, Comrade Shola Omolola, the Coalition’s Secretary, explained that the group “is convinced that the President and Vice deserved a second term in office to consolidate and put Nigeria on a sound footing and pride in the comity of nations.”

Omolola also stated: “Beyond the border of our political parties, politics and politicking, it is our utmost desire to Lagos State to continue to be great and enjoy the landmark achievements started by Asiwaju Bola Ahmed Tinubu since 1999.

“As we have now joined mainstream politics since 2015, and with all the goodies, national attention and developmental strides that has brought to Lagos State, we as Lagosians want to continue to be part and parcel of national politics.

Omolola, the Lagos State chairman of the New Nigeria Peoples Party (NNPP), added: “It is in this wise that we of the different political parties, have joined hands together to assist the APC to achieve resounding victory for PMB/PYO come February 16, 2019 in Lagos State.

Speaking at the event that was also witnessed by APC governorship candidate in the state, Mr. Babajide Sanwo-Olu, Minister of Works, Power and Housing, Mr. Babatunde Fashola, commended the foresight of the group, saying it was a genuine commitment that will take the country to the next level.

He described the spate of endorsements by opposition parties as the convergence of people who cannot deliver their constituencies.

According to him, the APC would continue to deliver on its promises to Nigerians and the people of Lagos State, especially in opening up the Apapa corridors, Amuwo-Odofin, Matori, and Ilupeju industrial layouts to enhance production.

He urged the electorates in Lagos and in other parts of the country not to fall into the deceit of restructuring rejected by the main opposition party 16 years ago.

The minister, who commissioned the Illashe 132/33KV Sub Station, said Lagos and other parts of Nigeria would witness unparallel improvement in all aspects of development by voting for the PBM/PYO ticket on February 16.

The Ohaneze Ndigbo has apologised to President Muhammadu Buhari over the endorsement of Atiku Abubakar, presidential candidate of the Peoples Democratic Party (PDP), by Nnia Nwodo, its president-general.

The group led by Uche Okwukwu, its secretary-general, told Buhari that Nwodo is on an indefinite suspension pending the outcome of a nine-man panel to investigate “acts of misconduct and abuse of office as well as bringing Ohaneze to public disgrace”, submits its report.

Ohaneze Ndigbo, Association of Eze Ndigbo in 19 northern states, the World Igbo Congress and the World Igbo Union, paid a courtesy call on Buhari at the presidential villa on Friday.

According to Okwukwu, the indefinite suspension of Nwodo bordered on the endorsement of Atiku.

At a summit of Nigerian elders, Ohaneze Ndigbo joined the socio-political groups which endorsed Atiku.

Okwukwu said the Igbo identify with Buhari’s achievements of improving ease of doing business in the south-east, assuring him that they will vote massively for him and resist any attempt to manipulate or rig the elections.


Responding, Buhari said he was impressed by the show of support from the regional body, which demonstrates unity in diversity.

Some Peoples Democratic Party (PDP) lawmakers in the Ekiti State House of Assembly have started their defection to the All Progressives Congress (APC), as leadership crisis rocks the state’s chapter of the PDP.

This is just as the party has inaugurated a seven-member committee to look into the allegation of anti-party activities levelled against some members of the House of Assembly.

The State Chairman, Mr Gboyega Oguntuase, who inaugurated the committee with a charge to do the assignment without fear of favour, said the constitution of the party must guide the panel in its decisions.



However, as the panel listed Honourables Posi Omodara, Segun Adewumi, Fajana Ojo Ade, Badejo Anifowose, Olayode Omotoso, Cecelia Dada and Olanrewaju Olayanju to appear before it on Tuesday, the affected lawmakers have perfected plans to start defecting to the APC.

Dada, one of the two female lawmakers and a former staunch supporter of former Governor Ayodele Fayose, on Monday announced her defection from the PDP.

It was gathered that other lawmakers who have been sitting on the fence would follow suit.


The crisis in the party is due to the fight for supremacy between Fayose and Senator Abiodun Olujimi.

Both are claiming to be the authentic leader of the party in the state.

The situation is affecting the preparations of the party for the coming general elections.

Fayose has even taken to the social media to campaign against the re-election of Olujimi to the Senate.

Incidentally, Olujimi served as a deputy to Fayose during his first term in office

Former Minister of Trade and Industry under President Goodluck Jonathan, Mrs Josephine Tapgun, has defected from the People’s Democratic Party (PDP) to the All Progressives Congress (APC) to support the re-election of President Muhammadu Buhari, Governor Simon Lalong and candidates of the party during the next elections.

Tapgun defected on Monday during the APC campaign rally for Plateau southern senatorial district, in Shendam Local Government Area of Plateau State.

She noted that she was endeared to the APC following the achievements of President Buhari and Governor Lalong in the fight against insecurity, corruption, and poverty.

“I have come to join APC to work for the re-election of President Muhammadu Buhari and Governor Simon Lalong. We will move from ward-to-ward and polling-unit-to polling-unit to ensure that APC wins the next election.

Governor Simon Lalong welcomed Tapgun to the party and vowed to provide a level-playing ground to all members of the party without any bias.



He said that PDP is deceiving people; that they have a credible candidate who is a retired general and that he will end insecurity and pay the salary of civil servants promptly.

Lalong said PDP left the state in hunger, insecurity, lack of payment of salaries and religious war and said APC had resolved all those conflicts and wouldn’t want to go back to the dark days.

He noted that President Buhari has Plateau people at heart and has worked to redeem the image of the people who have suffered attacks due to insecurity.

State Chairman of APC, Mr Latep Dabang, who represented former Governor Joshua Dariye now serving a jail term due to fraud, urged Plateau people to vote President Muhammadu Buhari and APC during the next election.

Dariye said Buhari and Lalong had worked to bring sanity to Plateau where crisis and herdsmen/farmers have left the state more divided.

He said the APC government had brought more development to Plateau and said a vote for Buhari and Lalong in the next election means development and peace

The senator representing Delta Central senatorial district in the National Assembly, Senator Ovie Omo-Agege, yesterday received a litany of Peoples Democratic Party, PDP members including a unit chairman, Ologe Oghenevwede, a PDP chieftain, Chief Abednego Agofure, and Chief Sunny Egbuyama to the All Progressives Congress, APC.

The defectors were received at the Agbarho town hall during the ward to ward campaign of the lawmaker who is seeking reelection in the forthcoming general elections.

Receiving them on behalf of the leadership of the party, Omo-Agege urged them to ensure that they go out and work for the victory of all APC candidates in the area in the forthcoming elections.

He said: “With the likes of Agofure and Ologe joining us as progressives, our coast has swollen politically here in Agbarho. I expect that they will add value to APC in Agharho, Ughelli North local government area and Delta State as a whole.

“On behalf of the leadership of the party, I will like to welcome you to the progressives’ family and I want you to know that unlike other political parties, you are entitled to all rites of the party as all APC members are equal irrespective of when they joined the party.”

Speaking at the event, the Executive Director, Business Development, NEXIM Bank, and a leader of APC from the community, Hon. Stella Okotete urged the people of Agbarho to support the reelection of President Muhammadu Buhari, Chief Great Ogboru, Senator Omo-Agege and other APC candidates in the area.

“The PDP claimed to have constructed roads here in Agbarho for us, but we didn’t see the roads until the coming of President Buhari who has done a lot for us.”, Okotete said, adding Agbarho people will vote support Omo-Agege at the polls.

“Seating here before you are indigenes, residents, and leaders of the 14 communities that comprises Agbarho kingdom and I want to assure you that they would be queuing behind you at the polls.”, she said.

Hon. Moses Anaughe, also an indigene of Agbarho and a House of Assembly hopeful who is in court to reclaim the APC Ughelli North Constituency II ticket described Senator Omo-Agege as a son of Agbarho kingdom noting that he has given the Urhobo nation adequate representation in the Senate and have, in turn, made the Urhobo people proud.

At Ofuoma, Agbarha-Otor and Oteri communities, Senator Omo-Agege while speaking on the benefits of a Buhari administration to the Urhobo people, said: “In such a short span, President Buhari has done a lot for us, it is only wise for us to reelect him to benefit more dividends of democracy from him as a president that has the interest of Urhobos at heart.”

A spokesman of the Middle Belt Forum has denied endorsing the presidential ambition of Atiku Abubakar, the candidate of the Peoples Democratic Party in the 16 February election.

“There was no time when we came together as a people to endorse Atiku Abubakar as our candidate in the 4th coming elections. Atiku Abubakar is not our candidate and will never be”, said Middle Belt Forum spokesman, Gowon Egbunu.

“Beloved Middle Beltans, take that as fake news and go about your normal business. If there’s a need to endorse any candidate, you will be communicated accordingly”, Egbunu, who is director of media and publications for the forum said.

“This is to clear the air and put the records straight, that, Middle Belt people are honest and highly principled people, who will not sell their conscience for a loaf of bread.

“I watched and listened with regret, one Dr. Bitrus Pogu, the Chairman of Chibok community in Abuja, on Channels Television a while ago, claiming to be speaking for the Middle Belt Forum”.

In a statement on Sunday, Atiku Abubakar claimed to have the endorsement of some regional groups such as Afenifere, Ohanaeze Ndigbo, Northern Elders Forum, Pan-Niger Delta Forum and the Middle Belt Forum.

He said the endorsement “is a loud statement that there is hope for our country as we go to the polls in a few days”.

Today we put aside all our prejudices to elect a President with religion and ethnicity playing no role in our elections.

“I profusely thank our Leaders across the country who have created this wonderful moment for us to come to the table of brotherhood. Once again, and in the words of our old National Anthem, we can proudly sing: “Though tribes and tongues may differ, in brotherhood we stand”.

In another reaction, Festus Keyamo described the whole politics of endorsement as Voodoo.

Festus Keyamo said on Channels TV that those who endorsed Atiku are persons who the masses do not listen to anymore.

He spoke as a guest on Channels Television’s Sunday Politics.

He dismissed the endorsement of Atiku Abubakar by the Leaders of the Ohaneze Ndigbo, Northern Elders Forum, Pan-Niger Delta forum, the Middle Belt Forum, and a faction of Afenifere, as inconsequential.

“There is nothing that is as fraudulent as known PDP members and sympathisers putting on the apparel of social-political groups and endorsing their own political parties”.

He further noted that “President Buhari is an unusual leader, he has managed to navigate his way through these middlemen and he has reached the people directly in this country”.

The Senior Advocate went on to challenge the socio-political groups to a popularity contest in states where President Muhammadu Buhari is yet to hold his presidential campaign.

“I want to challenge the so-called groups now, we are still on our campaign rally. Let them call a rally the same day we arrive their region, I am challenging them openly, I am challenging the faction of Afenifere: we have not gone to Lagos, we have not gone to Ekiti, the day we are arriving Lagos, I am challenging Afenifere to call a rally of Yoruba people at another venue in Lagos and let us see the turn out”.

The challenge was also thrown to the other socio-political groups including the Middle Belt Forum.

“I am challenging the middle belt forum, we have not gone to Benue, we have not gone to other places; to know how connected you are with your people, I challenge you to call a rally the same day we are arriving the middle belt and let us see the turn out at your rally and our rally” Keyamo challenged.

The lawyer argued that the leaders of these regions do not have the ears of the people again.

“The people don’t listen to them again. These are people who have over time represented their own interest and of course they are in tune with the philosophy of Atiku Abubakar who says that he will enrich his own friends. So like bees are attracted to honey, these people are attracted to Atiku Abubakar who wants to enrich his friends”.

Petroleum marketers under the auspices of the Independent Petroleum Marketers Association of Nigeria, IPMAN, on Friday threw their weight behind President Muhammadu Buhari in his re-election bid.

The body adopted Buhari as its candidate during a courtesy visit of its National Executive Committee to the State House, Abuja.



Speaking on behalf of the group, the National President, Chinedu Okoronkwo, thanked the President for his support to the industry.

Noting that the country was faced with frequent problem of petroleum products supply before Buhari’s administration, he said that there is free flow of petroleum products under Buhari.

He also said that the industry was enmeshed in deep corruption before Buhari’s administration, which is now a thing of the past.

He said “We are solidly behind your reelection bid. In our meetings, we have adopted you as our candidate.”



“Your success in the election will be a success for Nigeria,” he added.

He also assured that there will be no fuel scarcity in the country throughout the period of the general elections.

Stressing that the association is ready to continue to work with the Buhari administration to surmount remaining problems in the industry, he disclosed that the association is planning to set up refineries in the country.
