News via freebuzz.com.ng Kim Kardashian West has won close to $2.8 million from the fast fashion company Missguided in a lawsuit claiming that the company used her “persona and trademarks” to sell replicas of her outfits, in part by continually tagging her on Instagram. The issue of whether Missguided’s Instagram behavior violated trademark law was never actually litigated, though: the company just didn’t respond to her lawsuit, leading to a loss. In a default judgment last night, a California judge ordered Missguided to pay Kardashian West $2.7 million in damages and $59,600 in attorney fees. She also ordered the company to cease using Kardashian West’s trademarks in connection with the “sale, marketing, or distribution of its products.”Kardashian West’s original lawsuit made the argument that Missguided profited off of her brand and likeness. The suit included images from Missguided’s website and Instagram that depicted Kardashian West and her outfits. In one example, customers could click on photos of her and be taken to a Missguided page selling a similar look. “Missguided’s use of Plaintiffs’ marks is likely to cause consumers to mistakenly believe that Plaintiffs are associated with Missguided, or that they sponsor or endorse Missguided and its websites,” the lawsuit states. “And in fact, consumers have already expressed such confusion, suggesting in social media posts and online articles that Plaintiffs must be in a ‘collaboration’ with Missguided.” It’s unclear why Missguided never responded to Kardashian West’s lawsuit, but it has since deleted an image of her from its Instagram. While it may not have name recognition, Vivo has been taking the smartphone world by storm over the past year. The technology hasn’t been announced for any commercial phones just yet, but Vivo says Super FlashCharge 120W can fully charge a 4,000 mAh battery in just 13 minutes, which is incredibly fast. Keep in mind, most phones have battery capacities smaller than 4,000 mAh. Even the massive iPhone XS Max has a 3,174mAh battery. As a reference point, Huawei earlier this year debuted its own fast-charging tech for the foldable Mate X smartphone, which can fully charge that phone’s 4,500 mAh battery within 30 to 40 minutes. Even Apple’s own fast-charging tech can only charge the iPhone XS, with its relatively small 2,658 mAh battery, to 50% in 30 minutes. Meanwhile, Vivo’s new tech takes about five minutes to charge a smartphone to 50%. Vivo’s Super FlashCharge tech uses a custom USB-C cable, paired with a 120-watt power charger, to achieve these incredible speeds. It’s unclear when we’ll see Vivo’s fast-charging solution in a commercially available product but be warned: fast charging is believed to expedite the deterioration of your phone’s battery. The long-term effects of fast-charging are still unclear, but some studies say that fast-charging your batteries make them die a lot faster. News via freebuzz.com.ng Chinese mobile maker Oppo today unveiled its solution to the ubiquitous smartphone display notch – the “word’s first” Under-Screen Camera (USC). The fullscreen display-enabling technology was demonstrated to the public at Shanghai’s Mobile World Congress, following a teaser earlier this month. According to Oppo, the selfie camera is embedded under a section of the display that’s made of a highly transparent custom material with a special pixel structure, which enables light to pass through to the lens. The selfie camera is also said to be larger than other front-facing cameras, featuring a wider aperture lens in front of the sensor. The company has already admitted that putting a camera under the screen will make it harder to match the quality of an unobstructed smartphone camera. To compensate, however, Oppo said it has developed software algorithms that address haze, glare, and color cast issues, resulting in pictures that are “on par with mainstream devices.” We won’t know how accurate that claim is until the tech hits the market, and it’s still not clear exactly when the under-screen camera will debut in a consumer product, but the company says it plans to launch a device featuring its USC “in the near future.” This isn’t the first time Oppo has tried to innovate in the mobile camera space. The company in February introduced a 10x optical zoom camera system for smartphones, and just last month unveiled its latest flagship OnePlus 7 Pro phone, which features a bezel-free display and pop-up selfie camera. Apple’s 2019 iPhones are widely expected to include a triple rear camera system featuring wide, telephoto, and ultra-wide lenses. The display notch, which houses Apple’s TrueDepth camera and Face ID tech, will almost certainly remain. 2019 seems to be the darkest year in mobile OS history, if you count the fact that both Android and iOS are getting official system-wide dark themes. Not only that, but Google and Apple are also busy working on adding dark themes to all of their mobile apps. The latest one to get the treatment is Gmail for Android, but don’t pop the champagne just yet. It’s still very much a work in progress, even though it is randomly showing up for people running the latest version of the app. You can also download the app I created specially for deleting email spams and junk so as to increase phone ram here For now, the dark theme is only there in the Gmail app’s Settings. You don’t get it in the main window or the sidebar, unfortunately. Also, it seems to come on and off when it wants to, and you have no control over it because there’s no toggle to enable or disable dark mode.Hopefully Google is hard at work turning this into an actual full dark theme for Gmail, and will release that soon – or, at the latest, when Android Q comes out in August. It would be sad for Pixel owners to enable the system-wide dark theme and find built-in apps such as Gmail still not supporting it. If you were planning to ship a Huawei phone to America, you might be in for a surprise. This week, writers at PC Magazine tried to ship a Huawei P30 from a UK office to a US one, and were surprised to find it sent back a few days later. Since the sender had identified the phone down to the IMEI number, it was clear from the beginning that box contained a Huawei phone, but the package was actually shipped all the way from London to Indianapolis — from the UK’s Parcelforce to its US partner FedEx — until a legal issue emerged and the shipment was returned to the UK. According to the attached notice, the problem was a “US government issue with Huawei and China government.” This is totally ridiculous. Our UK writer tried to send us his @HuaweiMobile P30 unit so I could check something - not a new phone, our existing phone, already held by our company, just being sent between offices - and THIS happened @FedEx Crucially, there wasn’t a specific law referenced; the company simply decided it would rather not take on the trouble of figuring out if this was kosher or not. Always thorough in the face of confusion, the PC Magazine folks checked with UPS, too, who said it would be happy to accept such a shipment. They checked with Huawei, too, who said it was a complete misinterpretation of the US orders. It’s easy to see how FedEx could get confused. The past few months have seen a flurry of overlapping restrictions on Huawei, often for conflicting reasons. The company has been quietly blacklisted by US carriers for some time, but is now explicitly banned from US networks and from partnering with US tech companies. None of that explicitly bars a UK national shipping a duly purchased phone to the US. But as often happens when corporations enforce law, FedEx seems to be using company policy to stay as far away from the issue as possible. The frustrating thing about this is that there isn’t any clear purpose to it. None of the executive orders against Huawei have been aimed at making it harder to ship phones into the US. With no US carrier supporting the company, it’s already hard to get a Huawei phone onto a US network, so an executive order closing that loophole wouldn’t be worth the trouble. And for most of the actions so far, the justification has either been avoiding network vulnerabilities (i.e. Huawei cell towers in US networks) or avoiding technology transfer (i.e. US technology in Huawei phones). But neither of those quite applies here. As a result, the logic of blocking the shipment of an individual phone is hard to follow. If you did want to start selling Huawei phones in the US, shipping individual units would be a pretty bad way to do it. A trickle of non-retail phones is hardly a threat to America’s network integrity, and cutting them off has real negative consequences. If you’re an Android or web developer trying to see your programs run on one of Europe’s most popular phones, you’re simply out of luck.
