$150m Abacha Loot Return: CISLAC, TI France Urge Nigeria, France to Uphold Asset Recovery Laws The Civil Society Legislative Advocacy Centre, CISLAC, and Transparency International, TI-France chapter,have jointly called on Nigeria and France to uphold asset recovery laws ahead of the return of $150 million looted by former Nigerian head of State, Sani Abacha. In a statement co-signed by the CISLAC Executive Director, Auwal Musa Rafsanjani, and Sara Brimbeuf, TI’s Head of Illicit Financial Flows Program in France, the CSOs urged Nigerian government to be vigilant about misappropriation of funds. The upcoming return of $150 million from France to Nigeria was announced during the launch of the Global Forum on Asset Recovery, GFAR, Action Series. The anti-corruption watchdogs, in the statement titled: ‘$150M Abacha Loot: Time for France and Nigeria to Uphold Asset Recovery Laws’, posed questions about the commencement of negotiations between France and Nigeria, the criteria for selecting projects or programs funded by the returned funds, and the inclusion of civil society organizations in the return process. "France, despite not having returned confiscated assets previously, has recently established a legal framework for asset restitution, emphasizing transparency and accountability principles. “The statement emphasized that the impending restitution presents an opportunity for both France and Nigeria to implement their respective legal frameworks, ensuring transparency and accountability in the return process, with active involvement from civil society organizations," the statement noted. The CSOs noted that Nigeria's extensive experience in asset return, having recovered over $4 billion from different jurisdictions over the past three decades. “While commendable for efforts in repatriation, Nigeria faces challenges in the transparent and accountable management of these assets. “The recent adoption of the Proceeds of Crime (Recovery and Management) Act 2022 is seen as a positive step, assigning roles and responsibilities to relevant institutions and providing a provision for civil society to monitor implementation. “The return process is part of proceedings initiated in the United States in 2014, where a court entered judgment forfeiting approximately $500 million linked to money laundering involving Abacha's corruption. “As part of the same proceedings, an agreement was secured in February 2020 for the return of $311.7 million, proposed for financing road infrastructure projects,” the statement noted. In conclusion, the statement stressed the significance of the upcoming restitution, portraying it as an excellent chance for both France and Nigeria to demonstrate commitment to transparency and accountability in asset recovery, setting a model for other destination countries.

10th convocation: 20-year-old emerges overall best student at Baze University At the 10th Convocation Ceremony of Baze University, 20-year-old Morenikeji Adebanjo, hailing from Ogun State, emerged as the overall best student. The ceremony, held on Saturday in Abuja, showcased Adebanjo's exceptional achievement, attributing her success to the collective efforts of her lecturers, family, and the institution. Adebanjo, a Law graduate, claimed the top position with a Cumulative Grade Point Average (CGPA) of 3.81 on a scale of 4.0, surpassing 388 undergraduate candidates. Additionally, Oseloka Zikora, a Mass Communication student, secured the overall best spot in the Master's program with a perfect 5.0 CGPA on a scale of 5.0, outshining 225 candidates. Akpabio Must Ensure Transparency, Public Participation in Legislative Works - CISLAC The Civil Society Legislative Advocacy Centre (CISLAC) is urging the leadership of the National Assembly to prioritize transparency, openness, legislative participation, and fairness in conducting their legislative activities and advancing their agenda. In a statement signed by Comrade Auwal Musa Rafsanjani, the Executive Director of CISLAC, the call is a response to concerns expressed by Senators about the Senate's leadership, under Godswill Akpabio, fast-tracking the passage of bills without adequate public hearings and debates, despite the requirement for two-thirds of legislators to be present before a bill is passed. Senator Ali Ndume of Borno South remarked on this issue, stating, "You are passing bills without prior notification, even money bills, without anyone's contribution and within 2 hours. This is not good for Nigeria, and history will judge you." Rafsanjani emphasized, "While expediting the legislative process is essential, it's equally important to ensure meaningful input from legislators and Nigerians. A bill passed without sufficient involvement of the people can result in a significant deficit for Nigerians." "Senators and House of Representatives members must ensure that the NASS leadership considers popular views before passing legislation to uphold transparency and accountability. The general public should be invited to participate in public hearings, as they are stakeholders whose views should be heard and respected. If the Senate leadership, under Akpabio, undermines this, it implies a limitation on the functions of the Senate." He continued, "The relationship between the legislature and the executive should not merely be a rubber stamp. The legislature should play a critical role and scrutinize every legal framework presented to them. Speedy passage of bills does not define legislative activism; other responsibilities, such as oversight and public hearings, must also be prioritized to enhance the quality of life for Nigerians." "Legislative bills should not be pursued based on personal and selfish interests, but they should reflect the aspirations of Nigerians," he added. CISLAC calls on NASS to adhere to its legislative activities with a focus on openness and transparency, aiming to boost Nigerians' trust and confidence in the legislative process and the legislature's ability to effectively carry out their duties in line with NASS rules. Additionally, CISLAC urges the executive not to intimidate the legislature but to engage them in meaningful debates and discussions, allowing them to fulfill their functions in participatory democracy. The legislature should welcome meaningful stakeholder engagement and set aside personal and private interests that may undermine their work. CISLAC Urges Immediate Government Action to Address Disturbing Findings in NEITI Audit Report The Civil Society Legislative Advocacy Centre (CISLAC) is urgently calling for immediate government action in response to the troubling revelations brought to light by the NEITI 2021 Oil and Gas Industry Audit Report. In a press statement signed by Auwal Musa Rafsanjani, Executive Director of CISLAC, the organization stated that the report has uncovered critical issues within Nigeria's oil and gas sector that demand prompt attention to ensure transparency, accountability, and optimal national development. Rafsanjani, who heads Transparency International Nigeria Chapter, emphasized that the report highlighted a decline in Nigeria's ranking and score in the Transparency International (TI) 2021 Corruption Perceptions Index, underscoring recurring concerns regarding the Nigerian National Petroleum Corporation's oversight of the nation's shared assets. "The audit findings reveal alarming losses in crude oil due to theft, sabotage, and measurement errors, along with significant expenditures on PMS subsidies and quasi-fiscal items. Moreover, the report sheds light on unremitted or under-remitted federation revenues, misapplication of the 13% derivation principle, issues related to the Petroleum Industry Act (PIA), sector governance, and concerns regarding crude oil and gas barter arrangements. "CISLAC is calling for immediate action, utilizing the legal and regulatory framework provided by the PIA to mobilize civil society for advocacy, public debates, and vigilant monitoring of sector reforms. The organization advocates for the simplification and widespread dissemination of the report's key findings to enhance public awareness and drive demand for transparency and accountability. "Furthermore, the non-profit legislative advocacy is urging the strengthening of the capacity of extractive-focused civic actors concerning essential strategies and sector-specific issues within the PIA, encompassing beneficial ownership, contract transparency, audit remediation, and metering. The organization emphasizes the critical importance of tracking and following up on remediations and host community development. "In alignment with the PIA, CISLAC advocates for improved data management processes within government agencies reporting and conducting transactions in the sector. The organization also calls for a thorough investigation and audit into subsidy payments, Project Eagle loans, and other loan arrangements in exchange for the nation's crude oil and gas. "CISLAC, the Nigerian chapter of Transparency International (TI), is urging the National Assembly to provide effective oversight of the implementation of the extractive sector legal framework and take serious action on NEITI audit report recommendations," the statement added. The statement further urges the Nigerian government to investigate and hold public officials accountable for accepting nearly $80 million in bribes from Glencore, a multinational mining and commodity trading company. Despite Glencore facing repercussions for bribery, public officials on the receiving end have not faced any consequences. Likewise, CISLAC points to the over US$1 billion paid in bribes by Eni and Royal Dutch Shell for the rights to the OPL 245 offshore oilfield to members of President Goodluck Jonathan’s administration. This questionable deal could cost Nigeria as much as US$5 billion due to poorly negotiated fiscal terms, in addition to the US$1.1 billion already lost due to corrupt payments, as outlined by Italian prosecutors. CISLAC remains steadfast in its commitment to fostering positive change and upholding the principles of transparency, accountability, and good governance within Nigeria's oil and gas sector. Lastly, CISLAC commends the NEITI Secretariat for its ongoing efforts in expanding transparency and accountability within the extractive sector.

Rafsanjani Criticizes Buhari Administration for Spending N81 Billion on Tree Planting Comrade Auwal Musa Rafsanjani, the Executive Director of the Civil Society Legislative Advocacy Centre (CISLAC) and Head of Transparency International Nigeria, has raised concerns about the Nigerian government's expenditure of N81.2 billion on planting 21 million trees through the National Agency for the Great Green Wall (NAGGW). The House of Representatives ad-hoc committee, responsible for investigating the utilization of Ecological Funds and other intervention funds of the Great Green Wall Project, recently questioned the National Agency for Great Green Wall (NAGGW) regarding its claim of spending N81 billion to plant 21 million trees in several northern states, including Kebbi, Sokoto, Zamfara, Katsina, Kano, Jigawa, Bauchi, Gombe, Adamawa, Yobe, and Borno. Comrade Rafsanjani, in an interview with Radio France Internationale - RFI, expressed skepticism about the government's reported spending. He argued that it's impossible for the government to plant 21 million trees at a cost of N81 billion, which would mean each tree costs 4 million Naira. He described this as absurd and suggested that it points to corruption within the country. Furthermore, Rafsanjani criticized the President Muhammadu Buhari administration for what he perceives as wasteful spending at a time when Nigerians are grappling with hunger, insecurity, and unemployment. He stressed that the funds allocated for tree planting could have been better invested in critical sectors like health, education, and security. Rafsanjani called on the legislature to continue probing government projects and urged them to hold corrupt public officials accountable. He also highlighted the need for transparency and accountability in the management of public funds, particularly in the context of security expenditures. Rafsanjani, who also heads Transparency International in Nigeria, emphasized that appointing individuals facing corruption charges to political roles could undermine the morale of anti-graft agencies and have detrimental consequences for the nation. He further criticized President Tinubu for demonstrating a lack of integrity in governance by appointing individuals with corruption allegations. He said, “A scenario where an individual who has very substantial corruption allegation against him is made to lead the ruling political party is worrisome. These are happening despite ongoing investigation by anti-graft agency both at the state and federal level against some of these individuals. “We find it appalling that some of the names sent by the president to the National Assembly to be screened for ministerial positions have corruption related cases to answer with the anti-graft agencies. Going by this list, the president would correctly be perceived as shown lack of care about integrity in governance and turn a deafening hears to public outcry on key issues especially the fight against corruption. “The ministerial list sent to the senate proves that we are reversing the gains made in our anti-corruption efforts since our return to democracy in 1999. For example, the list has an ex-governor internationally accused of aiding a former military ruler to launder Nigeria’s wealth abroad. “It is also disturbing that a politician who has a case to answer with the Economics and Financial Crimes Commission (EFCC) is at the leadership of the National Assembly and will be conducting oversight duties on anti-graft agencies, including the EFCC.” Rafsanjani also decried the number of ex-governors and ex-ministers nominated by the president to serve as ministers in his cabinet, as they failed during their previous assignment. He further said that the president's appointment has also shown that he is not ready to listen to the demands of Nigerians to have a corrupt free government. “We equally frown at the recycling of some ex-governors and ex-minsters who glaringly failed to perform in their previous assignments. “With the assemblage of these alleged corrupt individuals with integrity deficit, it is clear therefore that the President has no regard or concern for the public demand to have a sane and responsible government. “Nigeria’s reputation in the global community is going to suffer negative consequences with the incredible damage the acts like money laundering, drugs trafficking, merchant of violence and illegal proliferation of arms have done to our country which has contributed and will continue widening insecurity, poverty, collapse of education, health care infrastructural development and ethnics and value system,” he said “We find it very sad that young Nigerians will have no positive lesson to learn from these corrupt leaders. “Citizens and well-meaning Nigerians must continue to demand that transparency, accountability and responsible leadership be institutionalized in our public offices,” the statement concluded.

Rafsanjani Calls for Prosecution of Officials Who Accepted Bribes from Glencore Auwal Musa Rafsanjani, the executive director of the Civil Society Legislative Advocacy Centre (CISLAC), is calling on the relevant Nigerian authorities to investigate and hold public officials accountable for accepting nearly $80 million in bribes from Glencore, a multinational mining and commodity trading company. "Glencore has admitted that it paid bribes to Nigerian officials in connection with deals involving the purchase of oil and petroleum products from Nigeria’s state-owned company," said Rafsanjani in a message in TI’s Newsletter in Berlin. "It is time for Nigerian authorities to investigate these allegations and hold those responsible to account." Despite Glencore facing repercussions for bribery, public officials on the receiving end have not faced any consequences. “The same can be said for over US$1billion paid in bribes by Eni and Royal Dutch Shell for the rights to the OPL 245 offshore oilfield, to members of President Goodluck Jonathan’s administration. Nigeria could lose as much as US$5 billion because of the questionably negotiated fiscal terms under the deal, in addition to the US$1.1bn that it already lost due to corrupt payments, according to Italian prosecutors.” To ensure that government officials who demand for bribes are punished by the US, Transparency International's Nigeria chapter and 10 other chapters of Transparency International are urging US lawmakers to adopt the Foreign Extortion Prevention Act (FEPA) to support anti-corruption efforts in their countries. "FEPA would provide a valuable tool to help countries like Nigeria combat corruption and hold their officials accountable for accepting bribes. "We urge US lawmakers to pass this important legislation," Rafsanjani said.

Auwal Ibrahim Musa Rafsanjani, Executive Director of the Civil Society Legislative Advocacy Centre (CISLAC), has called on the Nigerian government to take advantage of private and modular refineries in the country to end dependence on imported oil products. Rafsanjani believes that the private and modular refineries have the capacity to strengthen the country's refining sector, reduce the price of fuel, and boost the country's earnings. In response to the NNPC's recent fuel price increase, Rafsanjani stated that petrol consumption had witnessed a significant fall due to the increase in price. This increase in fuel prices has not only caused difficulties for individuals but also for micro, small, and medium-sized enterprises, which account for a significant percentage of the country's businesses, employment, and national GDP. He said, "This has huge implications for businesses that rely on refined crude products like diesel and petrol, respectively. Petrol and diesel prices negatively and significantly affect manufacturing output in Nigeria." “In January this year, daily petrol consumption was 62 million litres; February, 62 million litres; March, 71.4 million litres; April, 67.7 million litres; May, 66.6 million litre; June, 49. 5 million litre; and now 46.3 million litres, a 35% reduction. While this suggests reduced demand, it does not suggest a reduced dependence on it. Less people can afford petrol to meet their transportation, home-powering and other needs, and Small and Medium-sized Enterprises (SMEs) are facing difficulties in accessing affordable power. “This has huge implications for businesses which rely on refined crude products like diesel and petrol, respectively. Petrol and Diesel prices negatively and significantly affect manufacturing output in Nigeria. There are at least 39.6 million micro, small and medium enterprises (MSMEs) operated in Nigeria as of December 2020, accounting for 96.7 percent of businesses, 87.9 percent of employment, and 49.7 percent of national GDP. Totaling about 17.4 million enterprises, they account for about 50% of industrial jobs and nearly 90% of activities in the manufacturing sector, in terms of number of enterprises. “The trade deficit of $20 million recorded in November 2022 from the low crude oil export receipts signalled the urgency to jettison petrol subsidy, develop local production capacity and end fuel import dependency for a favourable balance of trade. While it is true that no nation has control over the price of crude oil, several measures can be put in place to mitigate the effect of oil price volatility on the country's domestic economic productivity. “The current underutilization of Nigeria’s refineries impedes the country’s ability to meet local demand and its economic potential. Nigerians are yet to receive firm commitments, actions and timelines on the delivery of our four moribund refineries to optimal operations. Furthermore, the private and modular refineries have a refining capacity that will strengthen Nigeria’s refining sector, eradicate dependency on imported oil products and lead to improved crude export earnings.” Rafsanjani also knocked the government for being insensitive to the plight of Nigerians who are becoming poorer by the day due to harsh economic policies, adding that the government must cushion the effect of its decision on fuel subsidy. “A major effect of the subsidy removal is its knock-on effect on prices of goods and services. Increased transportation costs due to the high fuel prices, directly impact agricultural production and have implications for food security. The government must show real concern and take urgent actions to cushion the effect of its decision which is perpetuating poverty and inequality. This is widening the country’s already-existing income inequality with low-income citizens and vulnerable segments of society facing greater financial strain to meet their basic food needs. “The government is clearly insensitive to the plight of the growing number of Nigerians slipping into poverty daily as a result of its harsh policy directions. It has so far demonstrated a lack of interest in people centered programs that could help reduce poverty, economic inequality and economic suffering. “At the same time this government is inconsistent in the application of its “austerity measures” as it is pursuing outrageous, unsustainable, unjustifiable and reckless spendings at the expense of the welfare of its citizenry. Nigerians do not know the economic blueprint of this government and this is the repercussion of the absence of political accountability under President Bola Tinubu right from his campaigns when he refused to participate in the political debates to enable the citizens to track his commitments towards socioeconomic and political reforms that can reduce corruption, poverty, unemployment and improved well-being of Nigerians.”

CISLAC urges NGF to create anti-corruption agencies in states The Civil Society Legislative Advocacy Centre, CISLAC, has called on the Nigerian Governors Forum, NGF, to push for the creation of anti-corruption agencies across the 36 states of the federation. Speaking during a two-day workshop for representatives of state-led anti-corruption agencies, the CISLAC Executive Director, Auwal Musa Rafsanjani, said creating anti-corruption agencies in states would help fight corruption effectively. He said: "Corruption affects us all. It threatens sustainable economic development and ethical values and justice; it destabilizes our society and endangers the rule of law. “It is, therefore, imperative that anti-corruption efforts are replicated and implemented at the state level and beyond. Nigerians need to own the process.” Speaking at the workshop, Mr Rafsanjani who heads Transparency International in Nigeria, said the program was an opportunity to better understand the legal frameworks of existing state-level anti-corruption agencies which could serve as a guide to other states. According to him, the existing state-level anti-corruption agencies will have an opportunity to pick out efforts to replicate, achievements and challenges that will be shared here by the federal anti-graft agencies. He said: "We believe that it is therefore imperative for anti-corruption agencies as well as relevant stakeholders not to work in isolation but develop partnerships and collaborations aimed at providing synergy in our work which will make it more impactful and yield better results in the interest of Nigerians and Nigeria." Also speaking, Bathsheba Tagwai, the CISLAC’s Senior Legal Officer, stated that the workshop would explore the legal frameworks of existing agencies with a view to strengthen their capacity for institutionalizing the anti-corruption efforts at the sub-national level. The CISLAC legal officer also said the workshop was also an advocacy for replication of existing state-level anti-corruption agencies in other states in Nigeria. According to her, following the example of Kano and Oyo states, more states are putting effort towards constituting independent anti-corruption commissions or their equivalent. Also speaking during the workshop, Jonathan Ogunsanya, the Deputy Director Public Prosecution at the Lagos State Ministry of Justice, said the state had enacted laws to establish its state anti-corruption agencies, adding that the process towards putting proper structure in place is in motion. He, however, lamented that too much emphasis is given to the legal framework for anti-corruption saying that what was necessary at the moment was more of ethics and value re-orientation. Olayanju Efo-Abasi, Chief Legal Officer of the Oyo Anti-Corruption Agency, stressed the need for states to develop their independent anti-corruption agencies, saying that doing so would strengthen the fight against corruption. She, however, said that efforts must be put towards synergy and collaboration between agencies that tackle corruption issues. On his part, a representative of the Economic and Financial Crimes Commission (EFCC), Iheanacho Ekele, noted that the need for more synergy in corruption fighting is key towards the total eradication of the menace in the country. A member of the Borno State House of Assembly, Babakura Maina, said his state would be pushing for the creation of its anti-corruption agency. According to him, the campaign for the creation of the agency should not only be limited to state governors, adding that state legislators too should be empowered and trained to see the importance of such legislation. A representative of the Independent Corrupt Practices and Other Related Offences Commission (ICPC), Ude Nma Chioma, stated that the commission has created the Proceeds of Crimes Directorate to fight corruption in compliance with the POCA law. She added that the commission has always been committed to working with relevant agencies to tackle corruption in the country. On the other hand, Habibat Pat Eluameh, an Assistant Director from the Federal Ministry of Justice, stated that Nigeria, as a State party to the United Nations Convention against Corruption (UNCAC), formed the National Strategy Plan 2017-2021. However, due to the discovery of gaps - as some states were not carried along, the strategy plan was extended to 2022-2026 to involve all states. She expressed her eagerness to work with state-level anti-corruption agencies to implement the provisions of the National Strategy Plan 2022-2026.

NILDS bags Westminster Foundation innovation award The National Institute for Legislative and Democratic Studies (NILDS), has bagged an impact and Innovation award, from the Westminster Foundation for Democracy (WFD). The award was bestowed on NILDS for its outstanding endeavors to promote inclusivity within political parties in Nigeria. The WFD in a letter by its Regional Director of Africa, Michael Nevin, explained that under the leadership of the Director General Prof. Abubakar O. Sulaiman, it has partnered with NILDS on inclusive political parties programme which according to them was a commendable initiative aimed at empowering underrepresented groups such as women, young people, individuals with disabilities, and marginalized communities. TMG criticizes INEC, FG for dismissing EU’s electoral report The Transition Monitoring Group has expressed their concern over the dismissal of the European Union Electoral Report by the Independent National Electoral Commission (INEC) and the Federal Government. In a statement by the Chairman of the election monitoring group, Comrade Auwal Musa Rasfanjani, said local observers and civil society groups working on election observation and democracy monitoring had also raised similar concerns about gaps in the electoral process in Nigeria. "The recommendations by the European Union align with the views of many civil society groups and local observers. It is imperative that the government and INEC review those recommendations and work towards addressing the gaps in the electoral processes in order to make our electoral system more transparent, accountable and participatory to restore confidence in the process," he said. Comrade Rafsanjani also emphasized that it is only when our government genuinely ensures that transparent and accountable, free and fair elections hold that our democracy and good governance can be consolidated and achieved in Nigeria. "We urge President Bola Tinubu to take courage and admit to the shortcomings with the electoral process which is evident by the violence and several election petitions going on in the country and the reduction of Nigerian's participation in the elections, he should emulate late President Umar Musa Yar’Adua who admitted that there were gaps in his election and committed to reform the electoral system. Therefore, TMG urges president Tinubu to ensure effective reform. "The EU witnessed the election process and their report should not be ignored. It is disheartening to see that the government and INEC are disregarding the recommendations from the European Union who they invited to observe the elections.” He also noted that the government and INEC may be sending the wrong message by disregarding both local election observers and the EU Election Report. He stated that TMG insisted that electoral misconduct should not be normalized, and the government and INEC should work towards addressing electoral corruption and impunity, saying that this will greatly improve our electoral process and bring integrity. “The EU Electoral Report and local elections observers report should not be dismissed, but rather, it should be looked into, and the necessary action should be taken to ensure free, fair, transparent and credible elections in Nigeria,” Mr Rafsanjani added.

CSOs task Tinubu on reviving anti-corruption fight A group of 30 Civil Society Organizations, CSOs, with a focus on combating corruption in Nigeria has called on President Bola Tinubu to rejuvenate the fight against corruption in the country. Speaking on behalf of the group during a press conference in Abuja, the Executive Director of the Civil Society Legislative Advocacy Centre, CISLAC, Comrade Auwal Musa Rafsanjani, rated the performance of the previous administration on anti-corruption very low. According to him, corruption is believed to have worsened during the administration of former President Muhammadu Buhari. Mr Rafsanjani added that challenges such as lack of political will, weak governance, and low public engagement hinder the effectiveness of existing anti-corruption initiatives like the National Anti-Corruption Strategy. Rafsanjani highlighted the mixed opinions on the success of the Buhari administration's anti-corruption efforts, despite the implementation of legal frameworks and initiatives. Corruption is believed to have worsened, and the new administration led by President Tinubu lacks a clear focus on anti-corruption. Rafsanjani pointed out various factors contributing to corruption, including the low reporting of corrupt practices due to citizen mistrust, the absence of whistleblower and witness protection laws, underfunding of anti-graft agencies, and non-compliance with laws. The group made recommendations to address these issues, such as passing the Whistle-blower and Witness Protection Bill into law and fully implementing the National Strategy on Anti-Corruption and the Freedom of Information Act across all states. They also called for capacity building for public institution staff, effective monitoring of beneficial ownership registers, and the implementation of relevant acts like the Proceeds of Crime Act and the Money Laundering and Prohibition Act. Rafsanjani urged for improved funding for the Independent Corrupt Practices and Other Related Offenses Commission (ICPC) and the Code of Conduct Bureau, as well as a review of the appointment provisions for the ICPC, Economic and Financial Crimes Commission (EFCC), and Code of Conduct Bureau. He emphasized that these actions would increase the number of convictions of politically exposed persons (PEPs) by the EFCC and ICPC. Additionally, the group called for the investigation of public officers implicated in various international scandals. Rafsanjani highlighted the need to reform financial institutions prone to money laundering, including the Central Bank of Nigeria (CBN), commercial banks, the Federal Inland Revenue Service (FIRS), the Nigerian Ports Authority, and the maritime sector. He emphasized the importance of ensuring judicial independence by providing real financial autonomy to the judiciary, which currently depends on delayed disbursements by the executive. The group demanded greater transparency in the budgeting and expenditures of anti-corruption and security agencies and urged the government to prioritize the provision of information and data in the oil and gas sector. Furthermore, Rafsanjani called for the alignment of state governments with federal-level anti-corruption strategies and initiatives. He stressed the need to strengthen the autonomy, independence, and institutional capacity of state-level anti-corruption agencies while fostering better synergy with their federal counterparts. TINUBU, THE PILOT YOU & I, THE PASSENGERS TO NEW NIGERIA, THE DESTINATION Last week Monday, which was the 29th day of May 2023, ushered in a new dawn for Nigeria. It was the Day 1 of Asiwaju Bola Ahmed Tinubu's 1st tenure as President and C-in-C of the armed forces of the federal Republic of Nigeria. In that capacity, he shall remain until 2027 --God willing, when his 1st tenure will elapse. May 29 also, was the day that the whole world is witnessing another democratic change of power in Africa's economic giant and most populous nation. At the Eagle square ground of the ceremony in Abuja, the change of baton from BUHARI to BOLA which is B2B or APC-2-APC is carefully arranged to be an SSS event, i.e. Special, Smooth & Spectacular. PILOT Tinubu, the brand new president of Nigeria has about 1,454 days to 'fly' us, his PASSENGERS to the land of Renewed Hope -NIGERIA as promised in his campaign speeches. In the eyes of the electorates, the Tinubu expedition is typical of a journey that is both FAR and NEAR. Far, because it is 4 years away and Near, because like many years gone bye, year 2027 will (day after day) soon become history. As a mechanism for smooth take-off of his regime "shuttle" towards year 2031 end of his 2nd term, I wish to advise the president who is now "Jagaban-General" to carry on board the weaponry that will QUIETLY but QUICKLY target Insecurity, Corruption, Wastefulness, Youths restiveness/fraternity, Electricity supply, Public health care, Enforcement of road traffic rules and checkmating the (would-be) cabals that loiter around every government. In a turn around manner, the President should invigorate National orientation agency NOA by detailing it to create templates for government's recognition & reward for patriotic citizens, while metting social and moral exclusion to persons with questionable characters. Going forward, I call on Mr president to also consider the re-establishment of Presidential Liaison Bureau in the 36 states of the federation to be headed by bureau chiefs. The Presidential Bureau concept was debuted by late president Shehu Shagari in 1979 and indeed, it engendered wider political outreach for NPN -the ruling party and it brought 'federal might' closer to the people. The initiative offered the president a lighter work schedule and it gave him the leverage for swift action (through the PBC) on matters that require presidential attention from the states. Nigerians will be glad if the points mentioned above are put in place within the first 90 days instead of the usual 100 days threshold by past regimes. The advantage of the 90 days "report card" is another way of meeting set targets for completing yearly goverment projects ahead of schedule by (atleast) 40 days. In fact, now that Tinubu's yearning for EMI LOKAN has been achieved, the next is ISE LOKAN i.e. hitting the ground running and making haste by calculative progression. Upon swearing-in, president Tinubu learnt his FIRST lesson after official briefing on the current state of Nigeria and its global status in the committee of nations. Mr president will be further fascinated as it will dawn on him that every ESSENTIAL matter in the country, begins and ends with him (Tinubu) as the person on whose table the buck stops. At this point, may I passionately remind and advise the president (even though he knows) that: 1) POWER is a double-edged sword - So, handle it with care & caution 2) POWER is a sweet and sower lozenge - Enjoy the flavour but swallow the Gel with apprehension 3) POWER is the master-key to the doors of Hell to your left, and Heaven to your right - Always give way to the traffic on your left (TEMPTATION!!!) Mr president, may I seek your permission to ask other Nigerians to join me in urging you to use the power/key "in your hands" to open the door to Heaven vide a RADICAL/DYNAMIC/EQUTIBLE/PRAGMATIC rule that will go down history lane. This means carrying everybody that is GOOD along, managing those that are BAD and keeping vigil on the ones that are UGLY. The opportunity to sanitize Nigeria is lying on your door-step and begging for action. Proverbially, it is said that opportunity knocks only once and the wise also say that there is no SECOND chance for first FIRST impression. The capital projects that were executed when you were Governor of Lagos State "with an ordinary key" can be replicated on a larger scale across the country NOW that you hold the master-key as the PC-in-C. If the master key ideology is imbibed at the federal level, state governors and LG chairmen will emulate for want of being on the same page with the Tinubu phenomenon. Public & private sector operators that are yearning for good governance will as well tag-on to the new regime values. However, in order to attain a Sustainable Good Governance SGG, the 3-Fs of management studies namely; FRIENDLINESS, FAIRNESS, FIRMNESS should be upheld at all times. Tinubu must not fail his country men & women who have been following him from pre-NADECO days in his long walk to the presidency and now he has arrived. By the arrival, Tinubu has redefined patience -a vital ingredient of life thus; "PATIENCE IS NOT ABOUT HOW LONG YOU WAIT BUT HOW WELL YOU BEHAVE WHILE WAITING"... May I then draw Asiwaju's attention to again to another fact that the 4-year mandate that he obtained from the March 25th election is a kind of "sentence" that goes with HARD LABOUR because, the job is tideous, tireless and often thankless. However, I know for certain that president Tinubu's quest for a new Nigeria is NOT negotiable. As a profound member of All Progressives Congress Party -APC, I pray that God Almighty should Guard & Guide the president as he prepares to go through the politically WINDY WEATHER of the nation's "airspace". On the ground, his mastery of land & Sea projects like Eko Atlantic city, Lagos blue railway, uncommon IGR initiative, Lekki housing estate - phase 1, 2 & 3, Local Council Area development approach, mentorship across region & religion, first-ever Treasury single account, Independent Power Project, Review of Lagos Judicial officers emoluments (to stem corruption) etc, are all worthy of note & mention. It is on record that Bola Tinubu's political prowess & sagacity are factors behind APC's victory in 2015, 2019 and 2023 general elections. Judging from the view in the horizon, Nigerians may within 50 days begin to appreciate the fact that there is a new Sheriff in town. Honestly, Asiwaju deserves empathy, co-operation, encouragement and prayers from you & I, --the PASSENGERS. Nevertheless, we urge and demand of him --the PILOT too, to reflect on the welfare of his country men and women on 24/7 basis while in office. Fuel Subsidy and the Plight of Common Man in Nigeria, by Gidado Shuaib While I was in Kano for a friend’s wedding, I overheard a conversation that Uber drivers in Abuja have increased the cost of commuting from the airport to the city center to N15,000. Given the new price, I knew any time I returned to Abuja, I would have to trek home. As a university lecturer, there is no way I could afford such a price. The abrupt removal of the fuel subsidy by our brand new President, Ahmed Bola Tinubu, on the floor of his inauguration, has exacerbated the economic difficulties Nigerians have been battling for years. The president has made the announcement and it is already being implemented religiously. However, as Nigerians continue to groan, we need to realize that sustaining the subsidy will not only cripple the economy but will also continue to keep us deeply indebted. Nonetheless, I wanted to frown at the fact that the removal was carried out in the absence of an economic team which ought to help in recommending strategies that will cushion its effects, But because Tinubu is an acclaimed strategist, I have the belief that a lot of thoughts and strategies would have been considered or are currently being considered. It was after the announcement that the President met with the Nigerian Labour Congress (NLC). This meeting should have happened before the announcement. But how would the ordinary Nigerians survive the pangs the removal is coming with? They have been appealing for the implementation of the minimum wage, but the state governors have been reluctant about it. The reality is that some states can’t pay. But even if the minimum wage is implemented, it won’t take a man who has a family anywhere. According to the new price template, Lagos State has the lowest pump price at N488 per liter, while Maiduguri and Damaturu have the highest at N577 per liter. Following a meeting with the president, Mele Kyari, Group Chief Executive Officer (GCEO) of the Nigerian National Petroleum Company (NNPC) Limited said the subsidy payment was no longer sustainable as it hinders the company from funding its core businesses. “Today, we are waiting for them to settle up to N2.8 trillion of NNPC’s cash flow from the subsidy regime and we can’t continue to build this,” Kyari said. The GCEO said since the provision of the “N6 trillion in 2022, and N3.7 trillion in 2023, we have not received any payment whatsoever from the federation”. Kyari said the NNPC made the petrol subsidy payments from its cash flow, noting that the government has been unable to pay back the N2.8 trillion spent so far. “That means they (the federal government) are unable to pay and we have continued to support this subsidy from the cash flow of the NNPC,” the GCEO concluded. Many experts and agencies have been pushing for the removal of the fuel subsidy for years, one of which is the Nigeria Extractive Industries Transparency Initiative, NEITI. It has been consistent with her call since 2006, saying it was concerned about the huge financial burden it places on the growth of the Nigerian economy. An estimated $74.39 billion which translates to N13.69 trillion was spent on subsidies between 2005 and 2021. This figure is outrageous. Nevertheless, for the fuel subsidy removal to be impactful to Nigeria, there is an urgent need to strengthen the implementation of the Petroleum Industry Act (PIA). Currently, the implementation isn’t total but halfway. There is also a need to kick-start people-oriented welfare programmes to cushion the pangs. In doing it, attention must be given to the poor and vulnerable. The government should also prioritize the rehabilitation of the nation’s four refineries. Nigerians do not know the amount of PMS they consume daily. We ought to know. Additionally, the government should enforce stringent sanctions for criminal activities in the sector and conduct appropriate stakeholder consultations, engagements, and enlightenment. Finally, before Tiwa Savage confuses us about relocating out of Nigeria over the current challenges, I am advising my fellow compatriots that we must all come together and fix our country as this is the only way we can all beat our chest and be proud of what we have. Subsidy removal: Tackle fraudulent regime in the fuel pricing, CISLAC insists Despite being a crude oil-producing State, Nigeria does not – mainly due to maladministration of her refineries – refine the crude oil she produces into its component products, like the petrol she consumes. Instead, Nigeria exports its crude oil and imports the refined products for most of her domestic use. For decades, the Nigerian government has subsidized and fixed retail prices of petroleum products. When President Muhammadu Buhari assumed office in May 2015, he vowed to put an end to petrol subsidy from the fuel pricing templates of the Petroleum Products Pricing Regulatory Agency (PPPRA) and allow market forces to determine retail prices at the filling stations. On May 11, 2016, he announced a nation-wide removal of petrol subsidy. With this, petrol price initially reduced from N87 to N86.50 per litre before adjusting upwards to N141. Later, the price was adjusted further upwards to N145 per litre. The government, however, quietly restored subsidy in the pricing template of petrol without any formal announcement. The then NNPC, classifies its subsidy spending as “under-recovery” (operational cost), repeatedly arguing that only the National Assembly could approve a subsidy. Under-recovery is the additional cost that the NNPC is incurring in subsidizing the price of petrol in order to ensure that it is sold at the regulated price, even when the real market price is above this regulated rate. With the NNPC being the sole importer of petrol into Nigeria, it was essentially subsidizing the product for users. The price remained at N145 per litre despite variations in the international price of crude. Arguments for the removal of fuel subsidy have always bordered on a need to free resources and take needed measures towards long-needed reform, as the cost has become unsustainable, especially as the economy hovers in and out of recession. The present deregulation (subsidy removal) agenda is part of what is contained in the Petroleum Industry Act (PIA). What has Nigeria lost? A report by the House of Representatives committee, revealed that Nigeria's fuel subsidy scheme cost the country $6.8bn over a three-year period (2009-2011). The NNPC was single-handedly responsible for almost half of the siphoned subsidy funds and was "found not to be accountable to anybody or authority". Seventy-two (72) fuel importers, some of whom had allegedly close links to senior government officials, were also singled out. In one case, payments totaling exactly $6.4m flowed from the state treasury 128 times within 24 hours to "unknown entities". Investigators discovered that importers were paid for 59 million liters a day, while the country only consumes 35 million. In 2012, the pump price of fuel was N65 ($0.40) per litre, against a landing cost of N139. The government thus contributed a N73 subsidy per litre, for an annual total of N1.2trillion ($7.6billion), or 2.6 per cent of the country’s GDP. According to the Nigeria Extractive Industry and Transparency Initiative, Nigeria spent about N722.3 billion on fuel subsidy in 2018. The NNPC’s financial and operations report for 2019 showed that Nigeria spent N326.43 billion in four months (N104.35 billion, N102.24 billion, N30.64 billion and N89.19 billion in January, February, March and April, respectively) in 2019. The PPPRA disclosed that the NNPC spent an average of N36.59 subsidizing every litre of petrol imported into the country in November 2019. The NNPC currently the sole importer of petrol in the country reported that Nigeria consumes between 55 million and 60 million litres of petrol every day. Going by a daily consumption of 55 million litres and an average of N36.59 spent on subsidy per litre, the federal government of Nigeria spent N60.37 billion on subsidizing fuel in November 2019, increasing by over 2000% when compared with the amount spent on subsidy in the same period 2018. According to Bloomberg, Nigeria averagely spends $7billion on fuel subsidy annually. These fiscal burdens are often financed by a combination of higher public debt, higher tax burdens, and disruption of potentially productive public spending (for example, on health, education, and infrastructure), all of which can be a setback on economic growth. What are the gaps The fuel subsidy regime in Nigeria has been rife with elite manipulations and intrigues. It is worthy of note that no administration has been able to give Nigerians the true picture of what happens in NNPC. Likely causes for the perpetuation of the 2009-2011 travesty according to the forensic reports from the last administration included: • The conflict of interest in having the then Oil Minister being both on the board of NNPC - a fuel importer - and the supervisor of the subsidy regulator, the PPPRA. • The discrepancies between the PPPRA Regulations, the Act and the other petroleum industry related laws. • The fraudulent listing of “ghost” fuel importers by the PPPRA which rose from 5 in 2006 to 10 in 2007, 19 in 2008 and 140 in 2011. • Unchecked and fraudulent payment transactions made by the accountant-general’s office including 128 subsidy payment transactions of 999 million naira each in the space of 24 hours between January 12-13 2009 — equal to about $6.36 million almost every 10 minutes. The real issue is that there been an erosion of trust from the people who need the assurance of a credible plan and the challenge that will arise when oil prices rebound amidst call for the government to quickly implement post-subsidy programs. Some form of social protection should have been launched immediately to protect the most vulnerable. • Public trust: There must be clarity and opacity in disclosing information on the scale of subsidies, their costs and impacts, who pays and who benefits, access to foreign exchange for petroleum marketers to import petroleum products, plans for reform, and complementary measures that will be taken. Our position is clear on the fuel subsidy removal. We have been calling on the Nigerian Government to end subsidy fraud by fixing the local refineries and by extension prevent avoidable corruption ,wastage and oil theft that have continued to stymie the nation’s economy. Without doubt, the solution to the problem of subsidy is local refining of products, which will drive down cost of products and end the corruption associated with the present subsidy regime. More importantly, the recently commissioned multi-billion dollar Dangote Refinery and Petrochemical Company in Lagos; as the largest single-refinery train in the world with the estimated capability of meeting 100 percent of the nation’s domestic demand for fuel is another anticipated development to ameliorate the impact of the removal. However, giving the purchasing capacity of common Nigerians and the rising inflation level that has rendered majority of households incapacitated to afford basic goods and services, adequate and sustainable measures must be instituted by the Federal Government to mitigate the impact of the removal. It is at this point that the Presidency has the fundamental mandate to with immediate effect address Nigerians on her proposed measures and plans for the removal. This includes mainstreaming the concerns of civil servants and other Nigerians who earn minimum wage. The Presidency must take this as a matter of priority. We have been engaging the Nigerian Government on macro-economic issues including the fuel subsidy fraud removal and will continue to engage because so far there is no transparency on the actual consumption and cost of landing of fuel in Nigeria and the consequent pump price as been manipulated by NNPCL. CISLAC calls for critical dialogue that stimulates transparency and accountability in the extractive sector as the new administration emerges. The Petroleum Industry Law is clear NNPC has no absolute power to be fixing prices without dialogue and having the interests of the poor Nigerians therefore Petroleum Industry Act must be implemented and complied with as a way of stamping out corruption in extractive sector in Nigeria. CISLAC calls for reversal of Abuja, Kano airports’ concession The Civil Society Legislative Advocacy Centre (CISLAC) has called for the immediate reversal of the concessioning of the Nnamdi Azikiwe International Airport, Abuja and the Mallam Aminu Kano International Airport, Kano. The Executive Director of CISLAC, Comrade Auwal Musa Rafsanjani, in a statement on Wednesday, noted that signing of the concession agreement by President Muhammadu Buhari was not done in public interest. Mr Rafsanjani, therefore, called on the President-elect, Bola Tinubu, to cancel the agreement on his first day in office. He said: "It is worrisome that the Federal Government led by Minister of Aviation, Hadi Sirika has concession two of our critical airports to Messrs Corporación America Airports Consortium. And, in the consortium, they have Messrs Mota-Engil Africa and MSSRS Mota-Engil Nigeria. The PPP is for 20 years for Abuja and 30 years for Kano. “Why borrow and spend public money to upgrade the airports only to hand them over to private concerns in the name of a concession?,” the centre quizzed. "It is not only alarming to see that these airports would be kept in the hands of foreign businesses in a cumulative period of 50 years, it is also disheartening to understand that the total amount of money that this airport is accruing to government is $700m for Abuja and then $97.4m for Kano. “Put together, it is about $800m and Nigeria is receiving a concession fees or upfront of less than $10m, that is, only $7m for Abuja and $1.5m to be given for Kano. "This concession is clearly dubious and raises a lot of questions on the process and what the actors stand to gain. "It will be recalled that unions in the aviation industry embarked on a strike to question the integrity of the concession exercise. “Thus, the concession by this government at this time raises fundamental questions of injustice and an elephant project against the public interest and also concerns of why the concessions at all at end of the administration.” Mr Rafsanjani lamented that the country’s legislature was sound asleep when the concession took place, stressing that legislative oversight remains an important mechanism for accountability and transparency. “Should the National Assembly oversight finds fault in this concession one day, the Federal Government will be in trouble, especially the array of lawsuits that would be slapped on the face of the government,” Mr Rafsanjani warned.

Baze University Holds Main Conference on Sustainable Entrepreneurship and Leadership Development An international Conference and Exhibition on Sustainable Entrepreneurship and Leadership Development will be held next month, June 12th to 16th at the reputable Baze University, Abuja.
