Na you dey turn law upside down .... issues of parental right i.e. ownership of a child, can be properly handled by the family court wihich is part of every state high court in Nigeria, courts have hierarchy and a high court is more superior to a customary court or magistrate court.

The judge was not bn emotional, his pronouncements are in line with the dictates of the court he presides over which is a magistrate court.

And even if a customary court is approached, nothing says that only the custom of one partner should apply over their kids, the man too has his own customs which state that he is a father over every child he fathers, once proven , regardless of his status with the mother

In a logical world, customary courts should only handle cases wher both partners are adherents of the custom in which they want to use to settle the matter, it is similar to muslim taking a christian to a sharia court to decide issus whn they have one.
