A CALL TO INVESTIGATE THE ROLE OF THE OBA OF BENIN IN THE CRISIS ROCKING ITSEKIRI ANCESTRAL HOMELANDS IN EDO STATE WITH A VIEW OF ASCERTAINING WHERE HE DERIVED THE POWERS TO CREATE AND OPERATE AN ILLEGAL OLOGBO DUKEDOM IN CONTRAVENTION OF CONSTITUTIONAL PROVISIONS AND SANCTIONING HIS PROMOTION OF INTER COMMUNAL WAR WHICH HAS CLAIMED THE LIVES OF SO MANY ITSEKIRIS , SENT OTHERS TO JAIL AND DESTROYED THEIR PROPERTIES WORTH MILLIONS OF NAIRA.
1. The Movement for the Protection of Iwere Homeland Development and History (MPIHDH), wishes to use this open petition to draw your immediate attention to the unconscionable and illegal activities of the Oba of Benin, Oba Ewuare 11 since ascending the throne on 20th October, 2016 which has resulted in the several unprovoked attacks unleashed on innocent Itsekiri aboriginal indigenes residing peacefully in their God given ancestral homelands of Ologbo, Kolokolo, Ajoki, Ajamogha, Ajatiton and other Itsekiri communities in Okpoba Oha Local government council of Edo State.
2. Permit us to reiterate that the above named communities which all bears Itsekiri names as an undeniable proof of its historical connection to the Itsekiri people of the ancient Warri kingdom, their founders, (with no single linguistic or historical connection to Bini) were previously part of the old Midwestern Region and then Bendel State before the creation of Edo and Delta state.
3. Suffice to point out here that when the various tribes that make up Bendel state before it was divided into Edo and Delta state for easy administrative purposes, the Binis, the Etsakos, the Esans, the Itsekiris, the Aniomas, the Urohbos, the Isokos , the Okpes, the Ikas, Aniomas, etc had their autonomous and well spelt out territories which were independently controlled and presided over by the respective traditional rulers in their own domain. This can also be said of several other states and regions in Nigeria today without any rebuttal.
4. Whereas the Oba ruled over his territories marked out as ancestral homelands of the Binis, the Obi of Agbor rule over his marked territories and his people. The Otaru of Auchi, did same in his marked territories, The Ovie of Ughelli did same in his marked territories. The Olu of Warri who was the vice chairman of the traditional council of the state, ruled over his marked territories which are exclusively referred to as Warri Kingdom.

This kingdom comprises of various aboriginal Itsekiri communities and it is an open secret that during this period, as you must be aware of considering your vast experiences in the Nigerian polity since independence, the Oba of Benin never for once had a say in anything Itsekiri or purported to own any piece of land that belongs to the Itsekiri people. The Itsekiri people too never asserted such claims on any Bini community. We lived together with mutual trust, love and oneness despite being two distinct tribes. But this Oba has decided to destroy the bond and peace our forefathers have built due to greed.
6. These communities we are talking about, includes Ologbo community and the rest Itsekiri communities then in Bendel state which the current Oba in a desperate bid to eat oil money has turned to a war zone. It is also interesting to emphasize that during that era, the Olu of Warri had his own separate palace with all his traditional council of chiefs, one of which is the ITYASERE OF WARRI KINGDOM, a title exclusively reserved for the Ityasere and Ikaye descendants of Ologbo community. This practice has not changed till date. No Benin traditional head or representative of the Oba has EVER occupied the position or title of Ityssere of Warri kingdom. That will never happen too.

Mr President, around 1988, the late Oba Erediawa the father of the current Oba against constitutional provisions and the advise of noble Bini indigenes and Itsekiri prominent indigenes allegedly claimed to have created what he called a OLOGBO DUKEDOME without any legislative enactment or pronouncements. According to this plan, the late Oba was to have one of his brothers as his representative in Ologbo community, a land which from the creation of mankind and since over 800 years of the Binis and their Obas has never seen such an illegality. This broad daylight illegality and affront on the territorial integrity of the Itsekiri people was vehemently and ferociously resisted.
9. The reasons why the Itsekiri aboriginal indigenes of the community fought against the illegality was that amongst several other reasons, their forefather, Ityasere Egharegbemi the number three traditional chief in Warri kingdom, was the first to deforest the land and settle in the area at a time which is now far out of human memories with a very strong and large family before he died.
10. More so, it is on record that one of the grandson of the original founder of Ologbo community, the Ityasere, the mystical Itsekiri warrior called IKAYE was gifted EXTRA LANDS as compensation and for his war exploits and service in helping Oba Osewende, in 1818 to defeat the great Oba Arakele, the Deji of Akure who hitherto that period, had almost ruined the Bini people through wars and famine that threatened their existence. The tales and woes of the Binis and their Obas in the hands of the Akure warriors and their powerful Dejis, is available on different history libraries across Nigeria for inquisitive minds
11. On returning from that war, the Oba asked IKAYE to start his journey from Ologbo community which was far far into existence towards Benin city while he would do the same from Benin. The two parties met at a community called IYANOMO along the Benin-Sapele road as one travels to Warri from Benin by the right. They both ate and drank and took an oath after carrying out blood sacrifices promising to keep the covenant and never to cross that boundary to attack each other. This true historical account which has stood the test of time from generations in the past till date, is dishonorably denied by the current Oba with an empty wave of the hands without adducing any concrete evidence or facts.
12. On the above premise, the Itsekiri people resisted that ignoble action of the late Oba Erediawa. But to keep the blood relationship and historical connection between the two tribes, it was amicably resolved that since we are all one, the Oba should be giving some part of the proceeds from whatever accrues from the land. This was the greatest mistake the Itsekiri aboriginal indigenes of Ologbo community and the rest Itsekiri communities have done which the current Oba is capitalizing on unsuccessfully however to lay false claims to our homelands in Edo state. But he will fail.
PRESENTLY
13. The Oba of Benin, Oba Ewuare 11 is promoting inter communal war by his several illegal activities in our ancestral homelands in Edo state which is an offence proscribed in the Criminal Code under section 42 that is punishable with life imprisonment. As can be seen conspicuously on the signpost shown below, he has caused a signpost with his picture and that of his stooge one Owen Akenzua who is illegally parading himself as ENOGIE of Ologbo Dukedom to be placed on Itsekiri aboriginal homeland of Kolokolo. This singular act and other provocative incursions into our territories, is enough evidence that the Oba is working against the Federal government efforts to keep the peace and order in every parts of this country. To allow him to continue unchecked will spell doom because, no reasonable man will sit down and allow a traditional ruler who has never ruled over him to come and lay claim to his inheritance. The Itsekiris are not a conquered tribe.
The signpost was put there immediately after the Ityasere of Warri kingdom Chief Johnson Amatserueleghe who the Oba see as his Achilles in his attempts to annex the Itsekiri aboriginal homeland in Edo state was sent to prison after being paraded as a suspect in the alleged murder case of one of our own, Mr Sunny Etchie against acceptable constitutional provisions that a suspect is presumed innocent until proven guilty as stipulated under section 36(5) of the Constitution. The erection of this provocative signpost and other illegal activities of the Oba with the active support and connivance of some notable Bini Chiefs and some members of the Nigerian security agencies especially the Nigerian police and some vested interests in the Edo state judiciary, has put the innocent Itsekiris under intense fear and intimidation. The people cannot sleep with their two eyes closed. Since the current governor of the state governor Godwin Obaseki, another Bini man seems too weak or willing to act and stop the Oba illegality, hence the MPIHDH is writing you this open petition to come immediately to aid of our oppressed people in the hands of the Oba.
Our argument against the illegality of creating an Ologbo Dukedom
14. We are aware that Nigeria is practicing a Democratic system of government in which the private and public conducts and actions of ALL citizens are regulated within the ambit of the Constitution and other relevant statutes. Since were are not practicing a monarchical system of government, the purported creation of a so called OLOGBO DUKEDOM in Itsekiri aboriginal homeland in Edo state, an integral part of the sovereign state of Nigeria is a nullity, ultra vires, null and void. Our position on this this aberration is hinged on the provisions of the 1999 Constitution which is the fonts est origo of all our laws.
15. Section 1(1) &1(3) of the 1999 Constitution (As Amended) is unambiguous. The Constitution is supreme and its provisions shall have a binding force on ALL authorities and persons throughout the federal Republic of Nigeria and that includes the Oba of Benin, Oba Ewuare 11, his Enogie and sponsors of the crisis in Ologbo community and other Itsekiri aboriginal homeland in Edo state.
16. Since the powers through which he purports to create the illegal Ologbo dukedom is unknown to and in conflict with the extant provisions of the Constitution under section 1(3), the provision of the Constitution shall prevail and that other law (which purports to create an Ologbo Dukedom) is null and void abi-nitio. The Oba or any of his assignee cannot use any unconstitutional instrument oral or written to perpetrate violence and criminality in our ancestral homelands without facing the consequences.
17. The creation of states or local government councils in any part of Nigeria, is well spelt out under section (s) 8 and 9 of the Constitution. They are are part of the legislative functions of Parliament under section 4 of the 1999 Constitution. The question we want Mr President to ask the Oba of Benin and his cohorts is that, where did he derived the powers and authority to create a dukedom? Which power grants him the powers to continue to act in such a manner that makes a mockery of our democracy, rule of law, supremacy of the Constitution and justice.

The Oba has through his divide and rule tactics which is predicated on his illegal quest to annex Itsekiri aboriginal homeland in Edo state given wrong advice and support to some aggrieved Itsekiri sons and daughters who ran to him for reconciliation with their kith and kin in Ologbo community and other Itsekiri aboriginal homeland in Edo state which is partly responsible for the alleged gruesome murder of the young Itsekiri man whose picture can be seen as attached below.
19. When Mr Sunny Etchie and other Itsekiri went to meet the Oba to resolve or complain about their grievances, they went to the Oba thinking they were going to an Oba who they saw as part of the Itsekiri people. But instead of the Oba to use his fatherly role as a traditional ruler to mediate and call the Olu of Warri to see how the issue can be amicably resolved, he played on their nativity and began to confer on them Bini traditional titles never known in Itsekiri aboriginal homeland on the late Sunny Etchie and other Itsekiri indigenes. This he did to make sure he successfully corner them from their people so that he can effectively gain access to the Itsekiri aboriginal homeland to cause confusion and trouble.
20 Through different sponsored protests in Benin, including media trials and propaganda, the brothers became estranged and before you know it, there was violence in Ologbo community and then Mr Sunny Etchie was alleged to have been murdered in cold blood an action we still condemn.
21. The role of the Oba in the whole saga is that of a conspirator. He failed to use his exalted position as a well recognised traditional ruler who owe a duty of care to give the young Itsekiri men useful advice and guidance which has led to the unfortunate death of others. As we speak, the Oba is still plotting how to cause more troubles in our ancestral homelands in Edo state.
22. We call on you to look into the excesses of this Oba and use your good office to cause an investigation into this issue to forestall further lose of lives of innocent Itsekiris and the wanton destruction of their properties by the Enogie the Oba brother who we understand now go about freely in Ologbo community and other Itsekiri aboriginal homeland in Edo state with cult members and some unscrupulous members of the security agencies causing mayhem.
23. Thank you your Excellency for your prompt action on this SOS to save our people in Edo state from the pangs of this Oba. Your swift action on this matter will restore the confidence of our oppressed people that the Constitution which you swore to uphold will continue to be the basis upon which every actions of all Nigerians shall be regulated no matter how powerful they may think they are. The Oba illegality must stop as Edo state is not Bini state. He was on live television calling on the two governorship candidates in the upcoming Edo election for peace to reign whereas he failed to do the same when the aggrieved Itsekiris which painfully included the alleged late Mr Sunny Etchie came to him for reconciliation of their disputes back home which he took advantage of to cause so much blood and tears in our homelands. The Oba cannot create a dukedom in anywhere because he lacks such powers constitutionally.
