Wike and his followers talk like rivers state is their personal enterprise..

In the light of the above provisions of the constitution, I think the supreme Court erred in its judgement.
LGA creation, composition, and administration is clearly spelt out in the constitution and if there should be any form of variation, the constitution should be a place to run to for such adjustment by the reason of amendment.
As part of the functions of the Judiciary, which is where the supreme Court falls into, it is primarily stated that its major function shall be to interprete the constitution and not amend nor repeal any part of it thereof.
The national assembly should be the principal body in charge with this duty of amendment.
All that is expected of the supreme Court was to have recommended to the national assembly and not to outrightly repeal the constitution outrightly.

(Sec. 1, Sub. S. 6), the entire Sec. 7 and the third schedule of the 1999 constitution which created the LGAs and it system of administration never gave the duty to alter its structure to any institution in Nigeria.

The only way out of this is to amend that part of the constitution by the national assembly that gave room to a joint account between the state and the LGAs and the powers of control and funding vested on the states over LGAs.

Even if the ruling is implemented it still amount to abuse of the Nigerian court process.

Without a constitutional amendment, the supreme court just succeeded in engaging in an academic exercise.

There must be a clear intention to abolish the joint account between the LGAs and State governments.

When the constitution has clearly stated the constitution to be 3yrs, the supreme court can't do otherwise.

These are matters that only a constitutional amendment can take care of and not a court ruling...

Look at order 3... it says all parties go back to status quo antebellum.. that is the state of affairs before the matter was instituted at the state high court.

Now Oko jumbo became speaker 8th May.... the order by Wali was given 10th May so what is status quo antebellum 😂

The appeal court was careful not to grant any of the prayers Martins requested that had to do with the meat of the matter like asking the court to remove oko jumbo as speaker and render his actions as null and void. That language was not used. The AC avoided granting amewhulee prayers as that would amount to deciding the main matter that should rightly start from the FHC.

The ruling of the court of appeal is very clear.

The court says Status Quo Ante Bellum should be maintained and that simply means parties should go back to the situation in existence before the ruling of the state high court. Thereby setting aside the ruling of the rivers state high court. Because the state court lacks the jurisdiction to try the matter brought before it.

The case the state high court ruled on is that the defected members of the rivers state house of assembly are still members of the
State house of assembly as well as those other three members of the house of assembly. And they can parade themselves as members of the house of assembly.

Both factions still exists. And as a matter of fact either of the parties can bring the matter to the appeal court to be tried....

Funny enough, the situation in the state house of assembly still lingers and has not been put to rest...

Most times, we fail to check the prompt on the screen of our POS (terminal) before giving out cash to customers.
After any transaction with POS machine, there is always a prompt or display on the screen suggesting the actually status of the transaction.
Due to haste, most times, we fail to check the status of transaction and blame it on others.
