In a development with significant political implications, Nigeria’s First Lady Aisha Buhari on Wednesday evening arrived in Washington DC on a weeklong visit. She is billed to attend a number of events in the area.

Sources at the Nigerian Embassy in Washington DC said Mrs. Buhari arrived on a British Airways flight from London.

Her visit is of tremendous interest in Nigeria where Ekiti State governor Ayodele Fayose alleged in June that Mrs. Buhari was involved in the infamous Halliburton scandal, and is the “Aisha Buhari” mentioned in related court documents.

Our investigations show that there is no “Aisha Buhari” mentioned in the Halliburton scandal. However, there is one mentioned in the case of former United States congressman William Jefferson, who was convicted on corruption charges in 2009, and to whom “Aisha Buhari” wired the sum of $170,000. It is to that matter the governor mistakenly appears to allude.

On several occasions, Governor Fayose asserted that Mrs. Buhari could not enter the US, suggesting she would be arrested, a bluff she has now called. Investigations by SaharaReporters and the New York Times have categorically stated that the Aisha Buhari mentioned in the court document in reference is not President Buhari's wife. Nonetheless, Mrs. Buhari has sued Governor Fayose concerning his allegations.

According to an official invitation letter to her, obtained by SaharaReporters, Mrs. Buhari was expected to have arrived in the United Stastes two days ago, but was held back by official delays in Nigeria.

Among others, she is expected during her visit to attend meetings at the George Mason University in Fairfax, Virginia. She will also be hosted by the United States Institute of Peace, in collaboration with Voice of America, and attend the 25th Anniversary celebration of Zumunta Association USA Inc.

BREAKING: PDP Crisis: Ali Modu Sheriff wins as Court nullifies Port Harcourt convention

A Federal High Court siting in Abuja has nullified the national convention held by the Peoples Democratic Party on May 21 in Port Harcourt, the Rivers State capital.
It was at that convention that the National Working Committee of the party led by former Governor Ali Modu Sheriff was dissolved and a caretaker committee led by former Governor Ahmed Markarfi was constituted.
Mr. Sheriff, a former governor of Borno State, has since then been challenging his removal and has insisted that he remained the legitimate leader of Nigeria’s leading opposition party.
But ruling in a fresh case brought before his court on Thursday, Justice Okon Abang said the May 21 convention was illegal and that Mr. Makarfi’s committee was unlawfully constituted.
Justice Abang gave the ruling while determining the rightful counsel to represent the PDP in the new case.
Mr. Sheriff is asking the court to determine whether his replacement by Mr. Makarfi was lawful or an abuse of court orders.
The Lagos division of the Federal High Court had issued a court order restraining the PDP from conducting election into the offices of its national chairman, national secretary and national auditor.
The ruling by Justice Ibrahim Buba was made sequel to an application brought by Mr. Sheriff and his colleagues who occupied those positions.


The application had intended to prevent elections of new party leaders at the May 21 convention.
But on May 21, the PDP held its convention in Port Harcourt where Mr. Makarfi was appointed to lead a caretaker committee, a development that sparked a fresh round of crisis in the party, with Mr. Sheriff insisting that he remained the legitimate chairman of the fold.
The two contenders sent two different lawyers to Justice Abang’s court on Thursday, both claiming to represent the national chairman of the party.
The court listened to the two lawyers – Ferdinand Obi and Adeniyi Akintola — to enable it to determine who should be the legal representative of the PDP in the matter.
Giving his ruling, Mr. Abang ruled that in determining who should be the rightful counsel to the PDP, it was necessary to decide whether the caretaker committee led by Mr. Makarfi was rightly constituted or not.
“The convention was unlawfully held and the caretaker committee was unlawfully constituted,” the judge ruled.
“If the Markarfi-led faction, as an apostle of impunity, missed its way to the Port Harcourt division of the FHC, the court cannot be said to have acted within its legal jurisdiction in entertaining the matter,” Mr. Abang said.
He urged politicians to desist from creating confusion for judges.
Prior to his ruling, the counsel argued for over seven hours.
Mr. Obi, who represented the Makarfi faction, argued that it was illegal for the Deputy National Legal Adviser of the Sheriff faction , Bashir Maidugu, to file the suit and then also receive court processes on behalf of his faction.
“The plaintiff has no authority to receive documents for PDP, whom he has sued as the second defendant,” he said
He further cited a previous ruling by the Port Harcourt division of the Federal High Court, which ruled that the decisions taken at the May 21 convention were completely legal.
He added that the court held in that judgment that nothing in the decision of the convention amounted to an abuse of the law.
But responding, Mr. Akintola, who represented the Sheriff faction, said his client received the processes for the matter as part of his official responsibility as a legal officer representing the PDP.


“I submit that the plaintiff has power to act in plural capacity. He is a lawyer and the legal officer for the PDP,” Mr. Akintola said.
He added that the previous case cited by Mr. Obi did not make categorical statement as to who should represent the PDP, adding that the decision of his client to act in his statutory position should not amount to an abuse of law.
“We urge the court to hold that we are counsel for the PDP and that my learned brother should cease to appear for the PDP,” he said.
In his ruling, Justice Abang noted that there was an order restraining the party from conducting election into the offices of national chairman, national secretary and auditor pending the hearing and determination of a substantive suit at the Lagos decision of the Federal High Court.
“Where the court in Port Harcourt had no jurisdiction for entertaining such matters, a court of coordinate jurisdiction has legal prerogative to nullify the decision reached at the Port Harcourt division of the court,” he said.
Responding, Mr. Obi prayed the court for an adjournment, saying the issues raised were weighty and important for the determination of the matter.
“They should therefore not be resolved hastily,” he said.
Responding, Justice Abang said the May 21 convention was held despite the decision of the court, and that the Port Harcourt division wrongly assumed jurisdiction which led to the July 4 judgement that nullified the decision of the Lagos Division of the court.
He therefore ruled that the decision of Mr. Obi to ask for adjournment rather than respond to the question posed to him was not meritorious and therefore his prayer for adjournment refused.

Senate President Bukola Saraki, factional Chairman of the Peoples Democratic Party, Ali Modu Sheriff; and Senate Minority Leader, Godswill Akpabio, are among 31 former governors whose alleged corruption cases investigated by the anti-graft agencies are likely to be reopened soon.

The Attorney General of the Federation and Minister of Justice, Abubakar Malami, had written to the Chairman of the Independent Corrupt Practices and other related offences Commission, ICPC directing the reopening of the cases of the ex-governors.

It was learnt on Wednesday that the AGF had called for the case files of the former state governors.

The list contains the names of Saraki, a former Governor of Kwara State; Akpabio (a former Governor of Akwa Ibom State, and Sheriff (an ex-Governor of Borno State).

Other former governors include Orji Uzor Kalu (Abia); Chimaroke Nnamani (Enugu); Saminu Turaki (Jigawa); Sule Lamido (Jigawa); Joshua Dariye (Plateau); Ahmed Yerima (Zamfara); Gabriel Suswam (Benue); Martin Elechi (Ebonyi); Danjuma Goje (Gombe) and Murtala Nyako (Adamawa).

They also include Ikedi Ohakim (Imo); Obong Victor Attah (Akwa Ibom); Achike Udenwa (Imo); Abdullahi Adamu (Nasarawa); Gbenga Daniel (Ogun); Jolly Nyame (Taraba); Boni Haruna (Adamawa); George Akume (Benue); Rashidi Ladoja (Oyo); Attahiru Bafarawa (Sokoto) and Adebayo Alao-Akala.

Others are Usman Dakingari (Kebbi); Adamu Mu’azu (Bauchi); Peter Odili (Rivers), and Lucky Igbindedion (Edo).

Part of the AGF’s letter to the ICPC indicated that the cases against some of the former governors were investigated some years ago but charges were never filed against them.

The letter partly read, “It is clear that some of these governors and other politically-exposed persons have not been charged to court despite the fact that the ICPC has concluded their investigations, concerning allegations levelled against them, for one reason or the other.

“It is the position of the present administration that all ex-governors, who the ICPC had long concluded investigations into the various allegations levelled against them, should be immediately prosecuted.”

The letter also gave the Chairman of the ICPC a 14-day ultimatum to “remit the duplicate case files concerning the politically-exposed persons investigated by the ICPC over the years” to the office of the AGF.

The AGF had sent a similar request to the Economic and Financial Crimes Commission, EFCC with the same list of former governors annexed to his letter.

Some of the ex-governors, according to one of the sources, include some, who had been convicted for charges preferred against them by the EFCC, while some of them also had their cases terminated before full blown trial could begin.

Others are currently undergoing trial on charges initiated against them by the EFCC at either the various divisions of the Federal High Court or the High Courts of their home states.

There are about five of the former governors, who are now said to be serving senators.

The affected personalities, it was learnt, served as governors for either one or two terms between 1999 and 2015, and are from all the six geopolitical zones of the country.

It was also confirmed that the majority of those on the list belonged to the two dominant political parties, the All Progressives Congress and the Peoples Democratic Party.

Another source also confirmed that a former Governor of Delta State, James Ibori, who was convicted in the United Kingdom for fraud-related charges and still serving his prison terms, was on the list.

Apart from Ibori, two former governors from the South-South, are said to be on the list.

Five of the former governors are from the South-East, and three from the South-West.

The AGF letter defines high-profile cases as cases “involving alleged misconduct amounting to economic sabotage; involving complex financial transactions or property movement; involving any of the suspects, who is a politician, a public officer or judicial officer; and where the subject matter involves government or corruption of its official or involves the abuse of office.”

Such judiciary officers, it was learnt, would include judges allegedly involved in economic sabotage, including financial transactions.

The AGF’s letter to both the ICPC and EFCC indicated that AGF’s request for the case files was in the exercise of his powers vested in the AGF by Section 174(1) of the Constitution as well as sections 105 (3) and 106 (a) of the Administration of Criminal Justice Act.
