Brig-Gen Maude Aminu-Kano, who was eased out of the Army as the commander of the Nigerian Army School of Finance and Administration (NASFA). In September 2005, a court martial was set up to try him for charges on circulation of false information on Col. N.E. Ekwale and Col. P.A. Toun.

Eight witnesses were called by the Army but Brig-Gen. Aminu-Kano pleaded not guilty to the charges and objected to the sitting of the court martial on the ground that the offence for which he was being tried in Abuja was committed under 81 Division in Lagos. He also argued that he had been pardoned for the offences he was being tried for.

The court martial saw no sense in his arguments and went ahead to sit on the matter. He was subsequently found guilty of all charges, convicted and sentenced to imprisonment. He was also sentenced to a reduction in rank for each count of the seven charges against him.

A displeased Brig-Gen. Aminu-Kano approached the Court of Appeal, which set aside the decisions of the court martial. The Army was dissatisfied and went to the Supreme Court. It was defeated. Justices George Oguntade, Francis Tabai, Ibrahim Muhammad, John Fabiyi and Olufunlola Adekeye, on February 29, 2010, relied on Section 171 of the Armed Forces Act. Cap. A20, Laws of the Federation of Nigeria, 1990 to defeat the Army.

The section states: “Where a person subject to service law under this Act (a) has been tried for an offence by a competent civil or court martial under service law; or (b) has been charged with an offence under service law and has had the charges dismissed, or has been found guilty on the charge on summary trial under this Act; or (c) has had an offence condoned by his commanding officer, he shall not be liable in respect of that offence to be tried by a court martial or to have the case dealt with summarily under this Act.”


The justices ruled that what the Army did to Brig-Gen. Aminu-Kano amounted to double jeopardy. He was reinstated and thereafter retired from the Army with his entitlements.

I want to thank everyone for your concerns over my present predicament. I have gotten a loan with stringent payback conditions to refund my client, which I did yesterday and he has withdrawn the case from the police. On 20th of January, I was able to locate the address attached to the vehicle plate number details but unfortunately, I was told he moved out of the house few weeks ago and all efforts to retrieve helpful information from neighbours fell on their deaf ears after multiple trials and visitations.
On 22nd of January, late in the evening, i got a credit alert of 500,000NGN from him with the transaction receipt sent to me via WhatsApp and he said he has started refunding my 2,220,000NGN I sent for the purchase of the vehicle that he never acknowledged to have seen.
Having banked on the information made available here, I was able to get the contact of his associate whom I called and swiftly accused me of vilifying my friend on social media immediately i introduced myself, he said he had discussed with him that he said we are friends that he borrowed the sum of 2,220,000NGN from me to clear some goods that he has even returned 500,000NGN out of the money, that was when I realized what prompted him to send the 500,000NGN in the first place.
I explained how everything went and made him understand that I haven’t met Kolade before in my life until the day of our transaction, he asked me to affirm if I got the 500,000NGN and I said yes then we agreed to discuss with me on WhatsApp, after proving beyond reasonable doubt with all the evidences I have, he sympathised with me and told me to give him time to talk to him.
He got back to me with Kolade brother’s number and also told me that he has spoken to Kolade himself, I tried reaching Kolade’s brother but his number wasn’t available throughout that day, on the 27th of January, Kolade sent another 300,000NGN as part of the refund which i believe was prompted by his associate's pressure and it annoys me further that he wasn't refunding me as the money was sent from me.
On the 28th of January, I finally got through to Kolade’s brother and he told me that Kolade said he has not seen the alert of the money I sent that when he does he will hand over the car, also said he can assure me that the car is still in Ibadan and said he was going to call me back, when he did, he asked if I have gotten 800,000NGN and i said yes then I asked him why Kolade sent 800,000NGN if truly he hasn’t seen the 2,220,000NGN I sent to him? then he made excuses for him and said there big brother will call me.
Lo and behold, their big brother finally did and he also made excuses for him as well, then brokered another round of negotiations on his behalf saying I should add 80,000NGN to the initial mutually agreed price (2,220,000NGN) and send 880k to him then he will make arrangements on how I will get the vehicle, I declined that I will not make any additional payment until the vehicle is in sight, he tried convincing me but I held my position so he then said someone is coming to buy the car for 2.5m on the 31st January that they will send my balance but I have not since heard from them neither have they picked my calls. I have recorded conversation of myself and his brothers and also a picture of his international passport.
