The SCOTUS has had the same makeup since Trump's first term and is a 6-3 Conservative majority. Fox News could have went to court and could have appealed it to the conservative Supreme Court then. But they chose to settle for ~700 Million US Dollars. That in itself would tell anyone with a properly working brain how bad their case was.

But just like the Durham prosecutions, don't see anything close to a conviction.
Conspiracy theories aren't facts and Juries deal with facts.

Usually, vindictive prosecution cases rarely win.
I think we can see a high profile one here where Comey wins. Especially since Trump can't stop tweeting and fired the DA, hired a new one for this express purpose and days later he gets charged.
