fergie001: This is also not true.
The Appeal Court nullified the jurisdiction of the Rivers State High Court but DID NOT order for a status quo ante bellum.
The lead judgement by Justice Bada did not seek status quo, the 2nd concurrent judgement by Justice Balkisu Bello did also not order for status quo.
It was only Hamma Barka who ordered for status quo and that's why vanitybwanti posted the screenshots of Barka alone but that is an orbiter.
Again, the Gov started acting on budget on 13/12/23 and the FHC gave that judgement on 22/1/24, so if the Amaewhule-led House decide to say No way, the Gov will refund or what?
The Gov has used his red biro already, dave. Let them start the fight from today, not yesterday. The court of appeal doesn't even need to make any pronouncements on statusquo. What was the situation before the state high court gave the exparte order? Right hon Martin was speaker of the house. The only legal stand oko jumbo had was the pronouncements of justice wali of the state high court. Once that order was nullified by the appeal court over lack of jurisdiction, right hon Martin and his colleagues automatically resume their functions. There's nothing that needs to be added. I'm shocked that people like you will still be supporting an obvious illegality in this manner. As of today, there's nothing that gives oko jumbo any power to still be sitting as Speaker and carrying out legislative functions, because the only thing that gave them power has been nullified by the appeal court. No stay of execution or notice of appeal to the Supreme Court. So where does he get the power to still be carrying out legislative business? And you as a custodian of the law is supporting this? There's no hope for Nigeria! By the way ,neither oko jumbo nor Edison even had the quorum to sit in the first place. The judiciary is messed up. The bench and the bar are grossly corrupt and filty. Indeed there was a country! |

fergie001: I am been as objective as possible. I am not pro-anybody I wasn't there when they were negotiatin.
A Rivers High Court on Dec 12 confirmed Edison as Speaker despite an FHC order for injunction. Acting on the orders of that Court, the Gov presented a budget and signed the following day.
His pen on that document has initiated the process of acting on it. In Dec 29, Ehie resigned as both speaker and member of the house and so informed the Court.
I may be wrong but I do not think any Court has said Ehie Edison is not Speaker. Notwithstanding, on Jan 22, the FHC ruled that the Gov's presentation to that house was not legal.
The Gov has signed already nah and it has been overtaken by events. The more u explain, the more u show ur bias. Go back to omotosho judgement and read it very well. Then come back and apologize for supporting illegality. U nor just different from the average Nigerian politician. |

fergie001: This is very funny. Is this new to you? This is what every I mean every Gov does. Even in 2023, the one that got to the Supreme Court, it was also written and signed at Osadebey Avenue.
All indirect primary elections follow same.pattern, irrespective of political parties, that's why the party is Supreme in its own affairs. This is one of the reasons the APC ran away from indirect primaries but this is how the PDP conducts her own.
Let me ask you, how do you think Ward delegates elections are conducted? You think it's by election or standing in the queue? Hell No. This is the pattern, lobby the NWC to send you a friendly Gov or Chairman who will do what you want.... This is how it happens with every I mean every political party.... Seyi Makinde was sent ofc everybody knows it won't work, he decided to resign. Ask senatordave1, he knows better.
Once the NWC endorses, that's all because INEC is only to monitor and not the umpire here.
You see the problem? Putting the cart before the horse. Ward delegates election held on 4th Feb Seriake Dickson submitted his findings to the NWC on 9th Feb
Not waiting for the NWC to make a decison, these persons went to Court on 8th Feb A day before the report was submitted. I believe this have answered the question, they had absolutely no interest in that committee's resolution.
But the primary wasn't nullified right? Ighodalo remains on the ballot right?
Leave what happens thereafter, that's the crux of the whole thread. You already answered all the questions in your initial response to my submission. Na wetin nwc agree with obaseki dem carry out. Every other thing na just story jooor. And that's the reason they can't win this election. Let me tell you something, after that fraudulent ward delegates congress, there was a gentleman agreement amongst all the gladiators to put on hold the primary and proceed for a political solution. That was part of the seriake dickson recommendation, but the nwc said the should continue with the process on the 9th of February, knowing fully well that with the doctored list, the other aspirants stood no chance. So they had no option but to proceed to the court. The original plan was to get an exparte injunction against the pdp on the 8th but it didn't work b'cos of the new electoral act. Anyways some judges would've granted it and heaven nor go fall. After all justice wali did one in rivers against jurisdiction. They would have looked for a more pliable judge for the job. Before appeal go vacate am, many things go done go wrong. Justice ekwo told them to put the defendants on notice. Dem get luck. Well this primary have completely destroyed pdp in edo and the result of the election will show it. Fergie001 don finally join Nigerian politicians in the rigging game. LolHaha |

You can't proof overvoting without the pu results. Bvas alone can't do it for u. Bvas is to capture accredited voters. You need to compare the numbers against the results at each polling unit. As for uzodinma it was never an issue of overvoting. That's the point here. |

senatordave1: Dino lost before the polls started.all sdp was suppose to do was to bring the pu results of the 4 lgas(minus ogori magongo) and highlight the over voting using bvas reports and with an inec and expert witness affirming it.they had two months to do it and could have done it.dont forget uzodinma did similar thing in imo and obi did same in 2006.fayemi and aregbe too... Uzodima case different na. He only brought results that were signed and certified by inec returning officers and added to what was on ground. The results were initially rejected by the SRO. I think they just have 21days to file. It's not as easy as you describe it on nairaland bro. Proving overvoting now and in the days of aregbesola ,fayemi etc are different. There have been changes in the electoral act that changed the definition of overvoting. And besides just getting pu results, you need ur pu agents to speak to those results in court. I think the time is not really there. |

fergie001: That means we both agreed that the PDP Primary was neither nullified nor invalidated.
Unlawful exclusion is a strange term in our EA and CFRN, because it is not found there.
What do you mean by they were excluded. The Party obtained names from a process conducted by her Representatives and worked on it. It is not unusual that they will get many other lists but they will depend on those they sent to give them results.
The protagonists of this suit rightly said there was an election but it did not follow due process. They also claimed that the National HQs of the Party sent different persons under the RO, Ndubuisi Mbah whose results forecloses finality.
Again, like I have said many times, this case is non-justicable.
The first question that comes to mind is: 1. Who announced the winners? 2. Who is the RO of the election? 3. Who appoints persons to oversee the election. 4. On whose platform, logo and motto are the supposed winners expected to represent.
If these questions are to be answered ... It is clear that one. 1. Mbah submits the list of winners to the party. 2. Mbah is the RO 3. The PDP 4. PDP
Again, what should aggrieved persons do, firstly file appeals at the Disciplinary Committee raised by the party to hear their grievances but what do they do.... They went to the court on a matger that should otherwise be within its own voluntary organisation they willingly joined.
PDP have said Mr A and Mr B from our results won ... It is not the responsibility of the Court to begin an inquisition on the matters that are otherwise domestic affairs of the Party.
Don't forget in this case, INEC didn't file any process. They opted to stay completely neutral.
See examples are too numerous:.Jimi Lawal v Adebutu last year Olabode v PDP
Kekere-Ekun was emphatic that she sympathises with the ward delegates but they weren't aspirants, and had no legal rights to file same.
You will see how the higher Courts will lash on Ekwo. He knows what he is doing ..... From your submission in the latter part, it's clear you didn't follow this matter from the beginning otherwise I would have said you're supporting electoral malpractice and crass illegality. The plaintiffs were the rightfully elected delegates and they tendered all the results signed and certified by the pdp officials that conducted the elections in the field. Governor Peter mbah and the secretary of the congress sat in government house and signed all the already prepared results given to them by obaseki while collation was still ongoing in the field. The 378 elected delegates took the matter to the nwc of the pdp and a committee was set up to look into the matter. The committee was headed by seriake dickson former Bayelsa governor. The committee submitted their findings to the nwc. They found out that all the results were signed by only mba and the secretary for all 192 wards in the state. The committee having confirmed the true status of the issues raised, thereafter proposed a political solution amongst the gladiators since there was no time to conduct a fresh congress. But the nwc refused to implement the report of the seriake dickson led committee. At that point they had no option but head for the courts. Justice Ekwo during the judgement also confirmed the findings of the seriake dickson led committee. So all internal dispute resolution mechanism was exhausted by the plaintiffs. Back to the first part of your submission, eventhough Justice Ekwo didn't expressly say the primary was nullified but that is the implied decision of the judgement because the process that culminated into the primary has been pronounced faulty by the court. |

Politics › Re: Court Did Not Void Edo PDP Guber Primary: See Certified True Copy Of Judgement by Indispensable85(m): 3:58pm On Jul 06, 2024 |
fergie001: Again, let me stress that the Courts have no business to adjudicate on the selection or nomination of candidates for political parties, however, the Court has limited Jurisdiction when it comes to Parties obeying its own rules.
The Ward delegateship election is a process culminating in the choosing of a candidate in a primary election. Hence, you cannot divorce Sections 82 from 84 of the EA 2022.
The Courts have stressed many times that only an aspirant has the locus standi to challenge such a suit, it is non-justicable because it falls within the domestic affairs of a political party.
See these: Dalhatu v Turaki, Ayogu Eze v PDP and most recently in the same Edo in Enoghama v PDP. (see link): https://www.nairaland.com/7359275/edo-pdp-supreme-court-affirms#117134104
I have repeated this many times that the Court has no business in imposing an adhoc delegate on a Party. I also repeat you CANNOT DIVORCE THE WARD DELEGATES ELECTION FROM THE PRIMARY PF THAT PARTY.
I also re-emphasise that the intervention of the Courts in the process of selecting or nominating a candidate is very narrow and can only confidently come under Section 84(14), that is to filed by an aspirant.
https://www.thecable.ng/edo-pdp-congress-scourt-dismisses-suit-by-orbihs-faction-says-its-a-party-affair/amp/ (Please check whether this suit is different from the particular one discussed).
for indispensable85
1. INEC has published her final list for Edo. https://inecnigeria.org/?page_id=13150
2. Let him fight it on 21/Sept but I am looking at the suit proper proper for now.
3. Section 82 talks about duly elected delegates participating in the process.
4. I never said Ighodalo wasn't affected. I have carefully confined myself on whether the PDP Primary was nullified or not. The topic is clear that the primary was not nullified in the sense that it never came up in the suit ab initio.
For Tareq1105 1. If Ighodalo doesn't appeal, his name will still be on the ballot because the judge never made any pronouncement on any consequential order that touches on his validity.
However, if nothing happens as Kelvin Mohammed and others want it to be, they will approach another Court for enforcement which will be granted, and that can be latched on at the tribunal because either the Candidate or the Party refused to appeal.
For Christistruth00 1. How were the "delegates" prevented from participating in the Congress? Were they restrained? Was there any police report or court order that ensured they did not attend?
They didn't participate in the Congress, they have to show why! In your number 4 submission you agreed that the issue in contest wasn't the primary, that's the reason the court agreed that they have locus. It's about participation and that's section 82. The primary results couldn't have been an issue before the court because it wasn't even conducted as at the time the case was filed, so it wasn't an issue of section 84 which is more of challenging the outcome of a primary. Their names were unlawfully removed and substituted on the delegates for the primary at Samuel Ogbemudia stadium. How do you want them to have participated when their names have been removed from the list of delegates? I want to see this case get to the Supreme Court. It will help us clarify certain things further. |
