What was in contention was the ward delegates list not the Primary. Section 84(14) of the Electoral Act 2022 made it clear who can challenge or have the locus standi to challenge the outcome of a Primary.


Ighodalo will appeal because it will have adverse effects, but ask yourself why INEC has not acted on this Court Order...

The plaintiffs came under section 82 not 84, that's why the preliminary objection of the respondent was overruled by ekwo. They're not challenging the results of the primary but their unlawful exclusion from the process. Can you build on a faulty foundation? Can you build something on nothing and expect it to stand? As long as the process is pronounced faulty by the court, the results have been invalidated indirectly. Don't forget that thus case was already in court even before the primary election held. The pdp that is running to the appeal court knows what's at stake here.

By the way , inec doesn't need to act now until when it's time for final publishing of candidates name for the election. Let them not stay the execution and proceed to appeal. I wan check something.
