ABUJA—SPOKESMAN for the House of Representatives, Abdulrazaq Namdas, yesterday, said the 2017 Budget won’t be passed until after the Easter break. Namdas made the disclosure while briefing newsmen at the National Assembly Complex, yesterday. The lawmaker who declined comment on Federal Government’s delay in the submission of details of the 2017-2019 Borrowing Plan to the House, insisted that the budget will be passed before the end of April 2017. He said: “I have been inundated with calls about the position of the budget and I feel I should tell you that we are working very seriously on it and hopefully we will pass this budget when we are back from Easter break. Ilorin – There was an uneasy calm in some parts of Ilorin, the Kwara State capital Thursday as gunmen, suspected to be cultists, struck and killed one person. The victim, simply identified as ‘Abbey’ was shot dead around Ikokoro area, off Niger road, in Ilorin. The unidentified gunmen, believed to be of a rival cult group, stormed the area at about 2.45pm and allegedly went straight to the apartment of the victim and murdered him. The victim was said to have been a member of another notorious cult syndicate. It was learnt that while some residents stayed indoors during a fierce gunfight that ended Abbey’s life, shop owners hurriedly locked up their shops to avoid being caught in the crossfire. A resident, who pleaded anonymity, said the area and its immediate environ, became deserted immediately the fracas began. When NAN visited the scene, the remains of the victim were said to have been evacuated. NAN recalls that a similar incidence occurred around the same Ikokoro Area in 2016, where a suspected cult member, Wasiu Adanri, was murdered. DSP Ajayi Okasanmi, the Public Relations Officer of the Kwara Police Command, confirmed that a life was lost in the cult clash. The Enugu State Police Command, on Wednesday, announced the arrest of a man, Daniel Ekemezie, for allegedly killing his uncle, Pa Patrick Odoh (83), over land dispute. The command’s spokesman, Mr Ebere Amaraizu, disclosed this in a statement on Wednesday, adding that the suspect blamed the devil for his action. Amaraizu said that the killing happened at Ukpata community in Uzo-Uwani Local Government Area of the state. He said that police acting on intelligence promptly nabbed the suspect who confessed what transpired between him and his late uncle. The suspect also said that he and his uncle had been locked in a protracted land dispute. According to the suspect, on March 4, 2017 at 8 p.m. he, Ekemezie alias Bakassi and a father of two, left his house in Ukpata community and headed to his uncle’s place, Pa Odoh place, who was believed to be about 83 years. “On getting to the place, I woke my uncle up and tied his mouth with cloth to avoid him shouting, while I whisked him quietly that evening to Iyimkpafu/Ofiakputu forest in our community. “I tied him on the tree with rope and left him till March 8, 2017. “When I discovered after five days that he was dead, I buried him in a shallow grave,’’ Amaraizu quoted the suspect as confessing to the police investigation team. Amaraizu said that the suspect has been helping the police in their investigation. Whenever you enter a lease or tenant agreement you should know there as certain obligations you must carry out as a tenant and also there certain obligations your landlord must oblige to. In most cases landlords tend to push their obligations to their tenants whereby trying to indemnify themselves of their lawful responsibilities. Well, most tenants are only aware of external and internal repairs agreement but there are most obligations to the landlord to fulfil and more obligations to fulfil as a tenant. These obligations are either implied by law while others are expressly negotiated and entered into by the landlord and tenant. Implied Covenant These are rights and obligations belonging to the parties whether they are expressly agreed or not. The rights and obligations are provision of the law and they are binding on one as landlord or tenant. Express Covenant Those rights and obligations which are expressly discussed and agreed upon by the landlord and the tenant. Therefore, they are rights and obligations negotiated by the landlord and tenant. Implied Covenants of the Landlord These are rights of the tenant and must be carried out by the land. These rights are binding on the landlord by law and they are not expressly discussed and agreed. Rights of the Tenants Quiet Enjoyment of the Property This simply means that the tenant should be allowed to use the property for the purpose(s) it was leased or let to him. On expiration of tenancy due to effluxion of time and the tenant is not ready to leave the house for some reasons, the landlord has to follow due legal process to recover his property from the tenant and if he decides to use forceful means he can be sued for breach of quiet enjoyment. Exclusive Possession This means that only the tenant excluding the landlord shall be in control of the property let to him. Even if the landlord wants to carry out repairs he should the tenant advance notice to allow him come in and carry out the repairs. Not to Derogate from Grant The landlord should not frustrate the tenant in the use of the leased property. If the house or shop is leased or let to tenant for business, the landlord is not allowed to hinder the tenant directly or indirectly from using it for the business. For instance if a property is let for music business the landlord shall not complain about noise from the property. The Property Should be fit for Human Habitation The property should be fit for human habitation and not for animals, depending on the parties’ agreement. Therefore the landlord has to make the property comfortable for habitation, where the landlord refuses to do so the tenant can carry out such repairs and subtract the money from his rent. Tenant’s Rights under Express Covenants Covenant to Repair It is the right of the tenant that the landlord should bear the burden of carrying out repairs of property in case of any damages which depreciates the quality of the property. Where a landlord neglects or refuses to repair, the tenant can carry out the repairs and later ask for reimbursement from the landlord. Covenant to Insure the Property Against Fire Here, the liability to insure the property leased against fire is subject to express agreement. If it is expressly agreed that the property should be insured by the landlord, it becomes the landlord’s obligation and not the tenant. Covenant not to Assign or Sublet the Property Generally, a tenant is at liberty to transfer his interest in the leased property to a third-party either by mortgaging, subleasing it or any manner he so wishes. However, this right can be curtailed by an express agreement between the landlord and the tenant. But where the lease is silent on the issue of subletting then the tenant can sublet. Length of Notice to Quit Although there are laws, which govern the length of notice to be given to quit the property, the landlord and tenant notwithstanding the laws, can go on to agree on different length of notice to determine the lease/tenancy. And when it is agreed, it supersedes the legislative one. Review of the Rent Clause The tenant has the right just as the landlord to review the rent payable over the property. It can be reviewed upwards by the landlord and downward by the tenant. To avoid misunderstanding it is always advisable to include such a clause in the tenancy agreement. The Recovery of Premises or the Rent Control and Recovery of Residential Premises Laws all over Nigeria, is to ensure that if a tenant should be ejected from the Landlord's property, it must be according to the law. 1. Any landlord or Agent who demolishes, alters or modifies a building in order to force a tenant out of his rented accommodation, without an order of court, can be punished with imprisonment or fine or both. 2. A tenant can claim damages against the landlord who throws away his belongings or goods, with false affidavit that the tenant has abandoned his flat or shop. 3. Abatement notice from government to landlord to repair or demolish his building is not enough to force a tenant out of his rented accommodation. Notwithstanding the government abatement notice, the landlord is required to serve the tenant with necessary notice and to obtain court order for the ejectment of the tenant. 4. Even where a tenant's rented accommodation is an illegal structure, the landlord should not use self-help or thugs to force the tenant out of his building, otherwise tenant can claim damages against him. 5. Whether you are president, governor, commissioner, local government chairman or any government official, you should not use thugs or area boys to throw away a lawful tenant and his properties out of government building or land, otherwise the tenant can claim a lot of money for damages suffered. Unfortunately, it is the government that pays the damages. 6. A landlord should not use police or soldiers to force a tenant to pay rent or pack out. Whether the tenants are in arrears of rent for 3years or is a "bad tenant" the landlord is required by law to serve the tenant with the required notices. If he proves stubborn or refuses to pack out, the landlord should take the matter to court and obtain an order to ejectment or pack out order against the tenant. 7. A landlord with his hired thugs breaking into tenant's rented accommodation in his absence or presence and throwing away his belongings or properties is wrong. It is trespass to the land and chattel. 8. It is not permitted by any of our laws in Nigeria, to remove tenant's door, window or roof because he refuses to pack out or because he fails to pay his rent. 9. Mum-of-four Khalida Begum, 35, has given in to her instincts and begun to breastfeed her baby boy, despite calling him an ‘alien’ for his deformities. The unusual looking baby, from India, was born with a tiny head, bulging eyes and a hard, shell-like body. He has been swarmed by local visitors who believe he is a reincarnation of a Hindu God. Begum gave birth to the little boy on Monday and said she was “shocked” when she saw his appearance. She initially refused to breastfeed the baby. Doctors in India have diagnosed the boy with an extremely rare genetic condition called harlequin ichthyosis, locals said. Villagers in Kadamgachi in Kathihar, are now flocking to the family home, believing he is an incarnation of Hindu monkey God Hanuman, it has been reported. . His mother said: “Several body parts of the baby is not completely developed. When I saw the baby after delivery for the first time, I was completely shocked to see the alien-looking boy. I couldn’t believe that I had a delivered an alien-like boy. I was so shocked and saddened by this that I asked the midwife to take the baby out of my sight. My other children were born healthy without any deformity. As the Joint Admission and Matriculation Board, JAMB commenced the 2017 Unified Tertiary and Matriculation Examination, UTME registration on Monday, its spokesperson Dr Fabian Benjamin yesterday said the Board has within two days registered 20,000 candidates. JAMB is expecting about two million candidates to register for this years UTME across the country within the allowed period of March 20 to April 19. Meanwhile, many accredited centres in Lagos were yet to commence registration of candidates as at yesterday due to lack of JAMB code. Vanguard investigation revealed that most candidates who visited the centres in Lagos said their hope of registration were dashed as accredited CBT owners told them they were yet to access the code of operation from JAMB. In his reaction, the spokesperson of JAMB, Dr Benjamin said the information that candidates were finding it difficult to register in the accredited centres in Lagos was strange. ‘’I am not aware that UTME centres in Lagos are finding it difficult to register,’’ he said.
