Ebeano49 & Mrs F congrats to the both of you, even with all the rhetoric going on right now, God touched our appeals to ensure our decisions were over turned without the need for court. This forum has been a Godsend and hope that we can all continue to help each other. We are just waiting now for the passport to get back to Nigeria. I’m a naturally inpatient person so this final wait is so frustrating (but exciting at the same time ) smiley

Thanks all for the well Wishes – my husband’s passport has been sent to Sheffield via DHL today (we don’t waste time) should be there by next Tuesday they advised. So now how long will it take for him to get the visa issued and sent back to him in Nigeria, do they send it to Lagos even thou he applied at the Abuja office.

I also want my refund as advised on the UKBA website (of the appeal fee) – with Christmas coming up the extra £140 will come in handy with buying gifts.

I thank everyone again and know that without the help of this forum I doubt I would have been able to go through this process properly – and I’m glad I did not listen to my MP’s office who asked me to reapply, this government is just hungry.

To everyone who has helped me on this forum, I want to say a big thank you. Justwise – for all your help when I prepared the appeals bundle, and most especially girlfio – your help this past month has been tremendous.
My husband has just received an email from the UKBA informing him that the initial decision has been over turned and he should send his passport to Sheffield.

Can he send it to me and I forward it or should he send it directly.

I am so happy that i'm speechless and shaking

Hi all,

I emailed the UKBA last week and have not received a response from them. Their automated reply claims that they respond within 2 working days. This timeframe has passed and I am wondering where I go from here as the email I sent required someone actually doing some work so was wondering if this is the reason or if this is a usual thing.

girlfio: Got some great news today people, they've sent us the email notifying that my husbands refusal has been overturned!! smiley We've just got to arrange for his passport to be sent to Sheffield now for the visa. I'm so lost for words, this has been such a difficult process and even though there reasons for our refusal were flimsy, its still so easy to doubt that you'll get a positive result. We were refused because my bank statements were printed from my online account so I had to get them stamped by the bank. My payslips were not on headed paper so I also had to supply them with a letter on headed paper determining the validity of my payslips. Then finally I didn't supply them with enough information proving that the address where we were going to live was suitable. I just give thanks to God that He has fought this fight on our behalf. My greatest encouragement to everyone is that you find your faith in God, He will guide your footsteps and lead you to that place of victory. Thanks to everyone for your support, love you guys like family. smiley

Please justwise and others I think I’m just recovering from a heart attack right now – just called the tribunal who gave me a worse case situation of next summer for a hearing date if the UKBA do not overturn their decision – please what can I do to find out what is going on – my husband’s appeal bundle is in Sheffield (that’s what they just told me). I don’t think my sanity and mental health can take anymore of this – sorry if I sound dramatic but it has reached that point. I now don’t even have leave left due to taking time off to go to nigeria due to visiting lawyers, MP office prepare appeal pack and other issues this year.

If anyone can help then it would be appreciated as I am trying hard not to cry while typing this in an open plan office

Please I need urgent advice about this – so after speaking to my MP’s office last week who advised that reapplying would be the best option, I have decided that we will not reapply, due to a serious illness in Husband’s family and some other issues we just don’t have the money spare to hire a lawyer and reapply.

My question is this – I will wait for the appeal, but now that I have been given a date 26/11/13 for the Home Office to respond – what happens after this date? and do I really need to employ the services of a lawyer as a representative (I have put my name down but was advised that as I am not legally trained I should use a professional lawyer)

The reasons for refusal were very weak, and my appeals bundle addressed all their points. Do the UKBA fight very hard to uphold their refusal decision.

I have an appointment with my MP’s office on Tuesday who have suggested on the phone they can possibly help me. So I will get my paper work together this weekend, my main points will be my health (don’t want to disclose a lot here) and the financially strain this is putting on us.
I will also ensure that I read up on the right to family right section in the human rights act to see if I can add that on Tuesday. This is only to see if they can speed up the appeals process, as I addressed all the issues they raised in the decision notice.
I honestly try not to get upset about this, but at times I cannot believe that some uneducated frustrated ECO can LIE about certain things and literally make a bad decision that has such upsetting consequences on a person’s life.
Yes – I’m not myself this morning after looking at ticket prices online this morning to go to Nigeria in august I’m annoyed.

MP can inquire on your behalf but not expedite your case. You will need a valid reason which must be stamped by AIT to expedite your case. You can choose to send this through your MP which is long winded (MP - UKBA - AIT - then UKBA if accepted) or do this yourself (Applicant - AIT - UKBA if accepted).

UKBA will only honor expedite agreement stamped by AIT

Hi john I will send you an email later this afternoon as I believe I have a few valid reasons to expedite the process. I personally don’t think considering many things going on right now that my circumstances can wait until end of November. Considering that November date doesn’t guarantee the visa will even be issued.

Congrats to those who have been granted their visa’s – its given me renewed hope that I will soon have my own good news.
Please I received a letter from the court saying that they have until 26/11/13 to respond, so is there any way to speed this up, I’m hoping to go to my MP’s office this week or next who may be able to help me – will this speed this up, plus if they find the ECO made a mistake will I still have to wait for the November date.

I'd suggest you book an appointment to see your MP in person. They have surgeries locally about one or two days a week and any constituent can book an appointment. There's nothing like a face to face conversation. Search for your MP here using your post code http://findyourmp.parliament.uk/

I'm booked in to see mine this Friday. I'd advise you do the same. Good luck

thats what i have been trying to do all day, called - nothing, emailed - nothing. so next line of action is writing to her london parliment address. u have to call or email my MP to go to her surgery - yet you can't even get to arrange that!

it is easier and better to write your MP than calling them. There is a dedicated department within the home office (based in Manchester) who deals with MP requests and they will only give you definitive response if you write.

As for the Appeal, IAT's job for now is only to process your appeal bundle and send it off to Sheffield VS. For now, AIT can only tell you when your appeal was processed and how long the HO has to respond. The next time they will have information will be in cases where ECO upholds their original decision. This is when the actual appeal starts. Right now your appeal is going through a review process.


does it mean that even with all the documents I submitted they can still stand by their wrong decision.

Just found out today that these wicked tories wanted to make th income limit £40k b4 the Libreral democrats got them to reduce it to £18K

if the tories win the next election - i can only imagine what this country will be like

I have just tried to call my MP, only getting her voice mail (yet they want £75k), hopefully I will get a phonecall back.
Is there anyway of finding out whats going on with my appeal, I called last week and they refused to discuss anything with me as they are only dealing with cases submitted before 11/6/2013.
I hate the way an ECO can lie to make a decision and then make u wait or reapply only for them to either waste your time or refuse again.

I sent my pack today and filled in the representative and sponsor details with the same details. i plan to call the 0300 number from next week to start the chasing up process.

been feeling very low over this issue - I can't believe this visa was refused - think the reality has only just hit me.

and there was a topic here (i believe the cost of USA birth topic) where some people where saying that giving birth in UK is free, its not just Nigerians that annoy me with this leeching off the NHS. Americans are known for abusing the NHS, after all if you don't have health insurance buying a ticket for $800 is nothing when you might have to bankrupt yourself to get treated over there.

A lot of oyinbo ex pats also fall foul of the rules - think of all the english people in France and Spain

hi guys this is an urgent request as i am sending my appeal bundle in the post today (well in the next 2 hours)

in the pack sent back to my husband with the refusal letter they sent back the originals and copies of the bank statements, payslips and phone records (i thought they kept the copies for their own records) since these are the main issues they used in refusing my husband his visa i think they sent it back to claim we never submitted it with the original application

do i include these docs with the new/missing documents i put together for the appeal?

so i have started getting my docs together - please how long does the appeal process last.

I have all the missing bank statements ready (do i need to date or just up to the date of application - April 2013?)

also i have now printed out all my O2 phone bills for the past 18 months and had the fun and joy of highlighting all the lyca calls, have reprinted and cross referenced the lyca pages and instructions - u know just in case thier brain needs some help, explaining how lyca talk operates, have printed the page from O2 explaining that calling nigeria is £1 a minute hence why i don't call from my mobile directly. I have also written a 3 page letter to clairfy and adddress and expand on each point and provide detailed explainations to them for all points (yes i'm thorough)

since these are the issues they are claiming (oh yeah also not enough pictures) will this take the estimated 6 months i keep ready about cos this sepeartion is no longer funny for me.

just had 2 lawyers tell me that appeal cost between £1500 - £2000 between the both of them

abeg do i have to use a lawayer, cos the reasons the ECO gave are extremely weak and i intend to go thru all my bills over the past 2 years and hightlight every single text and phone call made on evey single page and also submit those bank statements - must i pay £2k for someone to help me do this.

also do i have to get my local MP involved

they claimed i only called him a couple of time last year (even thou i submitted 18 months of O2 phone bills with the bloody lyca access number highlighted for them and the pirnt out of the linked lyca talk account)
and that i only used my lyca mobile a few times - um duh i have an o2/lyca account as well

also payslips up to march bank statement only up to december.

i have to go now - have a meeting

still waiting for my husband to scan the refusal letter

can i appeal on his behalf or does it have to be done in nigeria?

i can't stand dumb ass incompetent admin staff who make decsions that affect people's lives

It means that your passport is ready to be picked up, only when you collect your passport that you will know whether you have been given a visa or not
