The Op did not say if the phone was given to him by his employer in his primary post. To answer your question, if the mobile phone was provided by the employer, YES. Usually when employers give employees mobile phones for the purpose of work, the employees are made to sign some documents. Most employees sign without reading thoroughly and these documents contain clauses that give the employers the right to listen in and record phone conversations. Employees private messages in an employer's owned phone are NOT private (by law) and the employer has the right to view these messages.

EVen when you sign an Agreement, it is not in anyway right to track an Employee's phone. If the case is reported, there is a possibility of the company being sued which may include all the director for subjecting their workers to being monitored without the employee being a suspect to a crime or offense or the employee is not a certified citizen of Nigeria.

It's a violation of a citizens fundamental human rights. A company registered under the law must also consider these rights before entrenching it in their legal document.

Well, in this case, the person in question didn't state whether it's a company phone. He quoted, "My boss is Tracking my phone" It's is to some extent justifiable if it's a company phone, but if it isn't the boss is overstepping his boundaries.

He has the right track his company issued phones if he suspects theft or sabotage.

His boss has no right to track to the person in question's movement. No matter what the bye-laws of the company says, the constitution supersedes any other law if it's inconsistent with it's provision. And as long as the person in question is not convicted as a criminal he has a right to privacy.

It is justifiable to accuse his boss of violating his privacy, and even if his boss has duly informed the person in question earlier and it has not being more than 3years. If the knowledge of is more than 3years it could be considered "acquiescence" But on rare occasion can his boss attitude be justifiable.

37: The privacy of citizens, their homes, correspondence, telephone conversations and telegraphic communications is hereby guaranteed and protected.


But if you feel the need to keep accepting that kind of treatment, You can ideally stay in one place during work hours sha..But if you want to proceed with a lawsuit, I can guarantee you can make a lot of money from the case. Just find a lawyer and tell him/her your situation. I'm sure they can represent you Pro bono.

I believe considering your threats in any business is most important. i.e Immediately you plan the business, you plan the work of a qualified (Appropriate College degree) Avian Vet.
