The introduction of BVAS have really revolutionised our electoral process given it spectacular feats in Ekiti, Osun and Anambra states. This is why a Tinubu that said Voter's card has an "expiry date" is attempting with shameless futility to discredit the same BVAS by doubting it proficiency and reliability.

I am not in APC nor in PDP.I however follow the Tribunal sittings.1 Oyrtola claimed results of the774 units were fabricated. 2 He presented the results he got from the INEC with differences in the results.3 INECclaimed the differences affected only six units .Other units with differences were where the BVAS machines have not been shchrominised. 3. Tribunal accepted the resukts given to APC by INEC after the elcty with major differences and irregularities. 4 INEC yesterday presented. results given to the public which is different from the resukts given to Oyetola after the election. 5 A lot of people report the orocedings daily : APC and PDP reporters write always in favour of their parties. I am interested in this case because it is the first time Tribunal will adjudge BVAS matters. The Independent National Electoral Commission (INEC) has admitted that there was over-voting in the July 16 governorship election that brought in Ademola Adeleke as Governor of Osun State.

A Deputy Director in the ICT department of the INEC, Mrs Abimbola Oladunjoye disclosed this while giving evidence before the Election Petition Tribunal hearing the petition filed by Mr. Adegboyega Oyetola and the All Progressives Congress (APC) against the declaration of Adeleke as the winner of the election.

Being cross-examined by the Petitioners' counsel, Chief Akin Olujinmi SAN, Oladunjoye who was referred to as a star witness of INEC admitted that in Ward 4 unit 7, Ede South Local Government, there is an over-voting of 75, as the figure of accreditation on the BVAS report presented by INEC is 313, while the result on form EC8A is 383.

Oladunjoye's attention was also drawn to paragraph 21.36 of his witness statement where she stated that the accreditation figure was 830, but in the BVAS report presented by INEC, the figure of accreditation is 793, admitting that there was an over voting of 37.

The witness also admitted that in paragraph 26.7 of his witness statement, there is an accreditation figure of 402, while the accreditation figure on the INEC BVAS report was 263, admitting that there is an over voting of 139.

Also in paragraph 23.24 of his witness statement, Oladunjoye agreed that the accreditation figure she mentioned was 448, while the accreditation figure on BVAS was 224, admitting that there is an over voting of 224.

The witness who said under cross examination that she was not a Presiding Officer on the election day said, it is only the Presiding Officers that have explanation on what transpired at the polling units on the election day.

The INEC representative who admitted that she signed and certified a BVAS report for the Petitioners, further said that the copy of the report was different from the one issued to the respondents, adding that she never indicated that the report issued to the Petitioners was an interim document which would be subjected to synchronisation.

She testified that the synchronisation was done after election result had been declared on July 17, 2022 and BVAS report had been issued to the Petitioners on July 27, 2022.

Done with the cross examination of the witness, Chief Olujinmi hinted that the irregularities identified in the BVAS report presented by INEC was just a tip of an iceberg, saying, there are loads of over-voting during the election.

Earlier, the tribunal had admitted as exhibits the load of BVAS machines and CTC of Form EC8 series brought to the tribunal by the INEC counsel.

After the Cross examination of the witness, the INEC counsel, Professor Ananaba informed the court that he would no longer be calling any other witness, as he applied to close his case.

Counsel for Adeleke, Onyeachi Ikpeazu subsequently opened his defence by tendering form EC8 series used for the election.

However, the tribunal raised issue as to the safe custody of the BVAS machine tendered and admitted in evidence, as the panel ordered that the machines should be kept in the Central Bank Vault in Osogbo.
The tribunal then adjourned till tomorrow, Thursday.

Guber Tribunal: INEC defends Governor Adeleke’s victory, says there was no over-voting



The Independent National Electoral Commission(INEC) has launched its defence of the July 16th victory of Governor Ademola Adeleke, positing that over-voting can only be proven through comparison of server secondary data with primary data in the BVAS machines.



In a very revealing disclosure for the the second straight day of defence, the electoral body faulted claims of voting as emanating from lack of understanding or deliberate oversight on the part of the petitioners on the working of the voting machines.



In a presentation by the witness from INEC, Abimbola Oladunjoye, the Tribunal was told that after the election, the electoral body had to embark on a synchronization process after which data will be transmitted to the backend server.



According to the witness, if there is no network on a BVAS machine, the information will not be transmitted to the back-end server. This makes the back-end server an unreliable source to determine over voting.



On the previous data provided a team of lawyers from the All Progressives Congress(APC) , the INEC witness said it was to fulfil the spirit of the freedom of Information law which mandates the commission to provide information sought within a stipulated number of days.



While explaining that the commission deployed 976 BVAS devices to cater for some large voting centers during the election, the commission affirmed that over voting cannot be proven except through diligent comparison between form EC8A and the physical BVAS Machine.



“The earlier report as at 22nd of July was in fulfilment of the FOI law mandating inec to provide response to information sought. As at this time, sychronization of data was still ongoing at the inec server backend”, the witness noted.



The sitting at tribunal was punctuated by intermittent adjournments even as the the BVAS machines used at the challenged polling units by APC counsels were brought to court today.



It will be recalled that the total sum of 976 polling units were falsely alleged for over voting.



However, Mrs Oladunjoye who is a deputy director of ICT department cleared the mess by thorough explanation before the tribunal today.



She further established that a BVAS machine was deployed to where the total registration of voters were more than 750, stressing that the primary source of overall result was form EC8A, BVAS machines and the registered voters.



The details were given on how failure of network can cause awkwardness for transmission of the result to the headquarters. She thereby said the result will remain on the BVAS storage.



According to OSBC Judicial Reporter, the sitting continues on Thursday.

Xmas Rice: How Adeleke Introduced Transparency in

Purchase and Distribution- Osun PDP

Governor Ademola Adeleke of Osun State is receiving accolades for the transparency he introduced in the purchase and planned distribution of rice for the Christmas celebrations in Osun state.

The State Chapter of the Peoples Democratic Party (PDP) in a statement by its State Caretaker Chairman, Dr Adekunle Akindele commended the Governor for securing the purchase at a lower rate compared to what obtained under the former government and for ensuring purchase from factory and market women sources.

"We applaud the Governor for not acting like kleptocrats of the old who misappropriated government fund, looted public properties and engaged in violation of due process. The men of yesterday cannot fathom a government as open and transparent as the Adeleke administration, hence their persistent peddling of falsehood and lies.

" We affirm that the current administration has acted rightly by ensuring rice purchase by local and state governments and by putting in place a non-partisan distribution mechanism. The distribution committees across the wards have APC members as key actors.

"Was that ever done under the APC government? Was any distribution committee ever openly put in place as the government of the day has done? Was there any transparency and cost effectiveness in the purchase under APC? Were Osun market associations ever included in the previous transactions? Was there any mention of Sure-p fund in the purported letter APC was circulating?

If the APC government purchased similar rice for yuletide period at an even higher rate of N40,000 per bag and under secrecy, what right has it to question the Adeleke government that got same for below N40k and with transparent distribution process?

Despite clear clarifications that the funding for the purchase did not emanate from Sure-p fund which is still intact, the APC is obsessed with fake news simply because Governor Adeleke stopped the former government from looting the fund. The Sure-P money is very much intact.

As the Governor continues to receive accolades from the public on his handling of the rice distribution project, the PDP once again thanked the Governor Adeleke for breaking new grounds and for setting Osun state on the path of sustainable development and good governance.

BVAS is on ttial now and it is good it happened in Osun.Osun case will assist in other elections. Results of 774 units given to Oyetola by INEC are different from the results given to Adeleke. Why? As allegation and counter-allegation continues over the debt profile of Osun state, the media aide to immediate past Governor Adegboyega Oyetola, Ismail Omipidan, Monday described as reckless and unguarded the statement on Osun loans’ liquidation credited to Mr. Sola Fasure, media adviser to a former governor of Osun and current Minister of Interior, Ogbeni Rauf Aregbesola.

Responding to the claim by Fasure that loans Aregbesola incurred from 2013-2017 had been liquidated, Omipidan challenged Fasure to produce records of the purported liquidation of the loans Aregbesola incurred when he was governor of the state.


He described Fasure’a claim as unfortunate, saying “this is not the first time Fasure will be dishing out lies on behalf of his principal.

“Fasure should know that the EFCC is a responsible agency and a discerning one at that. Therefore, they know facts from fictions. They will know who did what and when. This is where I find his call on the EFCC as not only irresponsible, unguarded but reckless.


“Fasure and his co-travelers are merely trying to exploit the raging political reality to spew lies to the public.

“His statement has further confirmed our position that they are working in cohort with the Adeleke and the PDP. This further explains why the PDP government cleverly avoided publishing the dates the loans were procured.


“I challenge Fasure to publish details of how the loans were purportedly liquidated for the members of the public to analyse.

“Again, I want to reiterate that we never took any loan before or after the July 16 governorship election as being alleged by Fasure and the PDP,” Omipidan stated.

Governor Adeleke Approves Committee on Distribution of Rice, Says Sure-P Fund is Intact

The Executive Governor of Osun State , Senator Ademola Adeleke has approved the composition of a committee for a non-partisan distribution of rice just as the State Government directed that beneficiaries must cover all sectors of the state.

The government also wishes to affirm to Osun People that the Sure-P fund, which Governor Adeleke stopped former government from looting, remains intact and safe in the accounts of the local governments

The distribution committee according to a public announcement by the Secretary to the State Government (SSG), Hon Teslim Igbalaye is composed of the following membership per ward :

1. A member of the league of Imams;

2. A member of Christian Association of Nigeria(CAN);

3. A member of the Traditional Religion ;

4. A member of People's Democratic Party( PDP) ;

5. A member from All Progressives Congress(APC)

6. A Pensioner/Retiree
7. A Woman

The announcement noted that 40 bags of rice are to be distributed per ward, explaining the transparency in the entire process such that the expended fund achieves the goal of Osun money for Osun development.

While the 40 bags per wards were purchased at N32,000 per bag, the rice for state distribution were purchased from 'Egbe Olowo of Osun state at N36,000 per bag, a price still below similar transaction by the previous government.

It would be recalled that the previous administration purchased rice distributed last year at forty thousand naira per bag, a narration the new government has changed by direct purchase and transparent distribution process.

To affirm its committment to transparency, Governor Adeleke ordered that the composition of committee for the distribution of the rice and targeted beneficiaries must be from all sectors in osun state.

His Excellency affirms that this administration is not a thieving government like that of his predecessor and he remains committed to cushioning the effect of the hard time on all sections of Osun society.

It is therefore shameless lie and false reports to claim only PDP members are benefiting or that the Sure-P fund was diverted. It is also pure falsehood to claim Heads of Local Government Administration are denied their entitlements. All issues pertaining to entitlements of public servants are been attended to by the relevant offices.

Osun people can bear witness that the family of His Excellency has consistently distributed food items to Osun people for the past several decades. The philanthropic family with one of its own as the State Governor is determined to elevate the tradition of giving as a state policy.

We therefore assure Osun people that the Adeleke administration is not a thieving government and will not in anyway follow the path of the past. All actions so far taken and that will be taken are in line with due process, state regulations and extant laws.

The Independent National Electoral Commission, INEC, on Tuesday tendered election results it issued for the July 16 Osun state governorship election before the tribunal sitting in Osogbo, the state capital

INEC commenced its defence against the petition filed by former Governor Adegboyega Oyetola and the All Progressives Congress, APC, challenging the declaration of Governor Ademola Adeleke as winner of the July 16 election in the state.

Oyetola and APC closed their case on Saturday, December 3.

At the resumed hearing on Tuesday counsel to the first respondent, INEC, Paul Ananaba, SAN, disclosed that he has before the tribunal, schedule of witnesses the commission intended to call, schedule of documentary evidence, which include forms EC8A series, EC8B series, EC8 C, D and E.

He also informed the court that he has schedule of Bimodal Voter accreditation System (BVAS) and Bimodal Voter accreditation System (BVAS) machine to be tendered as exhibit before the court.

Counsel to Ademola Adeleke, Niyi Owolade and that of the Peoples Democratic Party, PDP, Nathaniel Oke, did not object to the schedules sought to be tendered.

However, counsel to the petitioners, Lateef Fagbemi, SAN, disclosed that though, he has no any objection to the admissibility of schedule of witnesses and forms EC8A, EC8B, EC8C, D and E series, but said the schedule should have been arranged in such a way that it allows for easy marking as exhibits.

He also opposed the tendering of columns 7 and 8 of the schedule of BVAS machine on the ground that the petitioners have not seen nor examined the said machines.

His words; “In principles, we are not opposed to tendering schedules of witnesses, EC8A, EC8B series, EC8C, D, E. My observation, however, is that a column should have been created for marking the document as exhibit, else, it going to be tedious marking the documents.

“But in respect of BVAS machine, we have not examine it and it cannot be subject of tendering. You will also observe that in the schedule dealing with BVAS there are 8 columns there, the last two dealing with accreditation on EC8A, physical inspection on accreditation on BVAS are matters of evidence which they have produced and which we have not had the opportunity of examining it. It cannot form the basis of part of the schedule”.

Responding, Ananaba, said, “what we have done is to present what we intend to do, we do not have to get the permission from the petitioners on how to present our case. It is mere observation and it should be noted”.

The Justice Tertse Kume-led panel then proceeded on recess for 4 hours 45 minutes, during which an INEC trucks with equipments that appear like BVAS machines was drove into the court and parked in front of the tribunal around 4:15pm.

The panel reconvened at about 4:45pm to admit the listed documents on the schedules.

Fagbemi, SAN, however raised issue of fundamental procedural error, saying INEC counsel only sought to tender the schedules not the contents which was admitted even without the petitioners examining same, he urged the court to vacate it order admitting the documents, a position that was not objected by counsels to INEC, Adeleke and PDP.

Justice Kume, thereafter vacated the order admitting the contents of the schedule. Ananaba then applied to tender the contents of the schedules, which include the election results, before the court.

Fagbemi then stated that the petitioners reserved their objection and the grounds till the final address stage as agreed at the pre-hearing conference.

The panel Chairman, adjourned till Wednesday, December 21 for continuation of hearing.

Our Govt will Promote Businesses - Governor Ademola Adeleke

Osun State Governor, Senator Ademola Adeleke has expressed the resolve of his government to support private sector development as a tool for wealth creation, employment opportunities and enhancement of Osun society.

Speaking while commissioning the “Blue Crescent Limited building at Ede on Monday, Governor Adeleke affirmed that businesses are the engine of growth of any society, promising that his administration will institute policies and programmes that will make the private sector to thrive.

" I commend the chairman of Blue Crescent Limited, Mr Oladokun Abideen Kolapo for deeming it fit to invest at home. I call our business people at home and abroad to invest at home. There is a new Sheriff in town who is pro-business and pro-private sector.

" My government will support businesses by addressing issues slowing down business survival. We will work with Chambers of Commerce and Industry to grow local economy and create jobs for our teeming youths", Governor Adeleke stated.

While the father of the day, His Royal Highness, Oba Munirudeen Adesola Lawal (Laminisa 1) advocated patronage of local businesses, Governor promised massive infrastructural development to enhance business growth in Osun towns and villages.

2023: Atiku will defeat Obi in South-East - Aniagwu

Spokesman of the Peoples Democratic Party (PDP) Presidential Campaign Council, Mr Charles Aniagwu says the turn out for the party’s presidential rally in Anambra and Imo states shows that the party had what it takes to win in the South East geopolitical zone.

Speaking on Arise Television on Saturday, Aniagwu said that the PDP was still very popular in the South East and urged Nigerians to support the party’s Presidential candidate Atiku Abubakar and his running mate, Dr Ifeanyi Okowa to rescue the nation from destruction.

Aniagwu said contrary to claims that Labour Party Presidential candidate, Peter Obi may win because he was from the South East, popular politicians had defeated their opponents in the past even in their strong holds.

According to him, the same way you have Peter Obi in the South East, same way you have Atiku Abubakar and Rabiu Kwankwaso in the North and Asiwaju Bola Tinubu in the South-West, so individuals will naturally come from somewhere.

"That a man comes from somewhere does not mean that he may not be defeated and I may need to take you back to 1992 and if you could recall Bashir Tofa and Moshood Abiola. Tofa from Kano and Abiola from Ogun State in the South-West but Abiola defeated him in Kano.

"So that a man is from a place does not mean that the place will automatically be for him. And so I would not want us to be intimidated with the fact that somebody is from somewhere.

"Atiku is not just speaking and making promises, his chances both in the South-East and elsewhere in the country is far brighter than even the northern star and that is on the basis of his pedigree in time past.

"You will recall that between 1999 and 2007, Atiku and Obasanjo held sway in this country and their records are there for everyone to see," he said.

The campaign spokesman further remarked that Atiku had the ability to search for talents to develop the country as he did while he was Vice president.

"Atiku is not just talking because he has the ability to search for talents irrespective of where they are from.

"Dr Okonjo Iweala and Professor Chukwuma Soludo who served as Minister of Finance and Governor of the Central Bank of Nigeria, were discovered by Atiku and they made great impact during their tenure."

On bringing peace back to the South-East, Aniagwu said Atiku had already enshrined peace and unity in his policy document "My Covenant With Nigerians"

"Atiku has made it very clear that he is going to discuss with both state and non-state actors and the crisis in the South-East is basically from non-state actors.

"Some people see them as agitators while others see them as militants but Atiku is not going to be involved in labeling. He will discuss the issues with them and good enough some of the issues are already known to him.

"Issues of under development and marginalization and he says he is going to address them to ensure that every Nigerian irrespective of where you are from is going to be brought on the decision table and once those issues are dealt with, the people agitating would have been assuaged to embrace peace," he said.

Aniagwu who is also Delta State Commissioner for Information, said the party's Vice-Presidential Candidate and Delta State Governor, Senator Dr Ifeanyi Okowa had addressed similar issues in the state to the extent that the creeks where there used to be agitations is now as peaceful as the upland.

"Atiku besides his pan Nigerian disposition also believed that that formula worked and will be adopted to bring lasting peace across the country, so we are quite convinced that Atiku will take decisions that will make everybody comfortable by forming a government of national unity," Aniagwu added.
Atiku Abubakar will win 3 states out of 5 states in south east on February 25th, 2023 presidential election. Atiku/Okowa has come to win.
