Protesters barricade the road preventing me from accessing the road. The police comes to disparse them and they refuse to bulge. Then, the police use force. Whose right is violated in this case?

That is why l used 'alleged'. It's not a cut and dried issue. In tort it is called public nuisance, a crime for which the remedy is criminal proceedings brought by the attorney general.

The possible defences are that the person/people committing the alleged nuisance have acquired prescriptive rights through purposeful historical infringement of rights.
Also the so-called nuisance could have arisen from the lawful use of the land (bradford corp v. pickles).
The alleged nuisance could have been covered by statutory authority or supervisory body .

The question is, is the blackman impervious to logic? Only a psychological analysis can prove this beyond reasonable doubt if any race could have done better in the same history of conditions.
