THE Supreme Court, yesterday, explained why it has not accorded any probative value on reports from Card Reader Machines that were deployed by the Independent National Electoral Commission, INEC, during the 2015 general elections. The apex court, yesterday, maintained that though the use of the Electronic Card Reader Machine for accreditation of voters was provided for in the Approved Guidelines and Regulations for the conduct of the 2015 general elections, it said the device was never “intended to supplant, displace or supersede” the Voters’ Register.
It observed that the issue had resulted to various Divisions of the Court of Appeal, giving divergent interpretations on election disputes that were brought before them by appellants. “True, indeed, the Card Reader Machine traces its paternity to the above Guidelines and Regulations. Regrettably, its probative pedestal in the vocabulary of electoral jurisprudence has generated conflicting interpretations from Their Lordships of the different Divisions of the Court of Appeal”, the Supreme Court noted.

A seven-man panel of Justices of the apex court, led by the Chief Justice of Nigeria, Justice Mahmud Mohammed, made the position of the court on the matter known, while adducing reasons why the election of Governor David Umahi of Ebonyi State was upheld. According to Justice Chima Centus Nweze who delivered the lead judgment, “With the intervention of this court, in its recent decision in Shinkafi v Yari (supra), it is hoped that practitioners and all other courts will begin to appreciate the position of the said Card Reader Machine, and the Reports generated therefrom, in election litigation.
“Prior to the authorisation of its use by the Guidelines and Manual (supra), the Electoral Act, 2010 (as amended), in sections 49 (1) and (2), had ordained an analogue procedure for the accreditation process. As a corollary to the procedure outline above, section 53(2) of the said Act (that is, the Electoral Act) enshrined the consequences for the breach, negation or violation of the sanctity of the actual poll sequel to the consummation of the accreditation procedure in section 49 (supra).
“With the advantage of hindsight, INEC, pursuant to its powers under the said Electoral Act, authorised the deployment of the said Card Readers. “Even with the introduction of the said device, that is the Card Reader Machine, the National Assembly, in its wisdom, did not deem it necessary to bowdlerise the said analogue procedure in section 49 from the Act so that the Card Reader procedure would be the sole determinant of a valid accreditation process.
“Contrariwise, from the Corrigendum No 2, made on March 28, 2015, amending paragraph 13(b) of the Approved Guidelines, it stands to reason that the Card Reader was meant to supplement the Voter’ Register and was never designed or intended to supplant, displace or supersede it.
“Indeed, since the Guidelines and Manual, which authorised the use and deployment of the electronic Card Reader Machine, were made in exercise of the powers conferred by the Electoral Act, the said Card Reader cannot, logically, depose or dethrone the Voters’ Register whose judicial roots are, firmly, embedded or entrenched in the selfsame Electoral Act from which it )the Voters’ Register). Directly, derives its sustenance and currency.
“Thus, any attempt to invest it (the Card Reader Machine procedure) with such overreaching pre-eminence or superiority over the Voters’ Register is like converting an auxiliary procedure- into the dominant procedure- of proof, that is, proof of accreditation.
“This is a logical impossibility. Indeed, only recently, this court in Shinkafi vs Yari, confirmed the position that the Card Reader Machine has not supplanted the statement of results in appropriate forms; hence, the appellant still had the obligation to prove petition relating to accreditation of voters and over-voting as enunciated in several decisions of this court”, Justice Nweze added.
More so, using the Ebonyi state gubernatorial dispute as an instance, the apex court panel noted that the Head of Unit, ICT Data Management at INEC headquarters, who testified as the PW-8 before the tribunal, explained that the Card Reader performed two roles, namely, the verification of the Permanent Voters Card, PVC, and the authentication of fingerprint. It observed that the witness, who generated a Card Reader Machines Report for Ebonyi State Governorship Election, had admitted that it was not a complete report covering all the details of Polling Units in the state as some Polling Units were not uploaded and thus not included in the report.
The witness said the report she tendered before the tribunal represented data that were successfully uploaded before the chairman of INEC gave an instruction for the server to be shut down. According to the Supreme Court, “Her trenchant responses, clearly, demonstrate that the Card Reader Machine Reports were neither inviolable nor sacrosanct as a host of intervening mischievous human variables could impinge on their reliability.
“Against the background of the testimonies of PW8, it is, actually, surprising, that learned counsel to the appellant chose not to utilise the Voter’ Register, to show the entire gamut of the voters, but rather built his case on what, in the unanswerable words of the lower court was an exhibit that was not accurate, sufficient and comprehensive enough to be relied upon in proof of the allegation of non-compliance with the Electoral Act, 2010, as amended.
“That is to say that the appellant (as Petitioner) failed to weave his case on the Voters ‘Registers and a fortiori did not produce such registers because if he had produced them, their contents would have been unfavourable to the allegations he made in the petition and hence his decision to withhold them.
“Thus, the appellant laboured in vain in the spirited attempt he made before this court to have the findings of the lower court vacated. He was, indeed, attempting the impossible given the anaemic evidence he adduced. In my view, the lower court, rightly, affirmed the findings of the trial tribunal in this regard”. Besides, the apex court held that the appellant, Edward Nkwegu Okereke, who was the candidate of the Labour Party during the April 11, 2015, governorship election in Ebonyi state, could not lay credible evidence to support his case against governor Umahi of the Peoples Democratic Party.
The court said the case of the petitioner failed owing to “irreparable damage of the testimony of witnesses” that testified for him at the lower tribunal, who it said were “thoroughly discredited in cross-examination”. It will be recalled that though the Supreme Court dismissed Okereke’s appeal on January 27, it however reserved its reasons for doing so till yesterday.
Aside the CJN, other members of the apex court panel that also agreed with the lead judgment were Justices Ibrahim Tanko Muhammad, Kumai Bayang Aka’ahs, Kudirat Kekere-Ekun, John Inyang Okoro and Amiru Sanusi.

PRESIDENTMu-hammadu Buhari has revealed that his administration has within three months saved N2.2 trillion for the nation through the enforcement of the Treasury Single Account, TSA. The president made the revelation in London during a meeting with Nigerians resident in the city on Thursday night. President Buhari who was in the United Kingdom for the Supporting Syria and the Region Conference in London, British capital was speaking of the problems bedevilling the oil and gas sector of the economy which he said were part of the challenges he inherited upon an assumption of office.

According to him, the Nigerian National Petroleum Cooperation, NNPC had over 45 accounts scattered in different banks. The same situation, the president said, was also pervasive across the branches of the military. He said: “We are really in trouble. What we discovered was that we tried to enforce what we called treasury single account, TSA. And the reason was simple. This government did not initiate it. It was the previous government. But it was so unpopular to the bureaucracy and the previous government for its own reasons couldn’t enforce it. But when we came and found that we were broke, we said this is the way to do it. And I will just tell you two examples to convince you.
“First, NNPC, the cow that was giving the milk had more than 45 accounts, ministry of defense, that is the military Army, Navy and air force had over 70 accounts. Tell me which account we can trace in these several accounts. So we enforce TSA. We said there must be TSA. “By the end of December, coming to January this year, that is last month, we mopped up more than N2.2trn which we have used through the bureaucracy system to raise vouchers and sign cheques so that they don’t go into the next budget.”
Speaking further on the state of the economy, the president revealed that some Nigerians were behind the crisis. The president stated that most directors of the Central Bank of Nigeria, CBN owned and operated some of the Bureau De Change outfits through which they raked in the foreign exchanges. He said he was determined to stop the ill development and make every Nigerian accountable.
“We found out, when I say we, I mean present federal government, that some of the directors in the central bank own the bureau de change businesses. So when the foreign exchange comes, they take it and give government the change. So we stopped the Federal Government giving bureau de change foreign exchange. “Fellow country men and women, I am giving you a tip of the iceberg of the problem we inherited and we are getting so hard because we have no other way of running the country unless we make everybody accountable”, he said.
While underscoring the importance of education, president Buhari asked the audience to support his administration by educating their children for a better future. On giving diaspora Nigerians a chance to participate in elections, president Buhari said his government was studying the scenario, stressing that what was utmost was to make the process more credible. “We are critically looking at the system itself. We must make sure that the election process itself is credible”, he said.

President Muhammadu Buhari’s quest to provide 500,000 unemployed Nigerian graduates jobs in the teaching profession, has attracted manifold reactions from stakeholders in the education sector. While a school of thought views it as a good policy thrust on tackling unemployment among youths, it is, however, perceived by many as a bid to solve one problem, which may lead to creating more in the process.

It will be recalled that President Muhammadu Buhari had recently stated that 500,000 unemployed graduates will be absorbed into the teaching profession to solve, in the interim, the problem of graduate unemployment in the country.
Apart from the reality that many square pegs will end up in round holes, stakeholders are also asking who will be responsible for the 500,000 teachers’ salaries, as the states and local governments over the years have had the responsibility of paying teachers’ salaries.
In her reaction, the Deputy Vice Chancellor (Academics) University of Calabar and immediate past Dean, Faculty of Education, Professor Florence Banku-Obi applauded the Federal Government’s decision to create jobs, but added: “If the Federal Government is thinking of creating those jobs in the education sector by employing and sending them to the classroom, it is a move in the wrong direction.”
Untrainedteachers
According to her, sending these graduates to the classroom will rather bring in more confusion into the education sector, warning that it is going to be a wrong step to send these untrained teachers into the classrooms.
To her, many of the said graduates are not trained teachers, and many, especially the younger generation don’t want to teach because they have no interest in teaching. She said: ”Employing them will just be a means of earning a living because they have no passion for teaching.”
Alternatively, the DVC disclosed that rather than the government sending them to the classrooms, they can focus on industrialization and other sectors.
“Government can expand agriculture where they need little or no skills to make returns. Yes, I know, there are people who are trained agriculturists, but that is the essence of extension workers. If you are going into agriculture and have no basic knowledge, then you need extension workers to groom you.”
Stressing the need for each state auditing of unemployed teachers for efficiency, Banku-Obi pointed out that there are still thousands of Nigerian youths who read education but are not employed.
She urged the Federal Government to task each state to do auditing for efficiency. She said: ‘’Each state has thousands of unemployed trained teachers seeking teaching jobs, they can be engaged and sent to classrooms, while government creates opportunities for the non-teaching graduates in other areas.’’
She noted that the same Federal Government which owns the Federal Government Teaching Scheme, employs NCE teachers for one or two years and disengages them. Rather than disengage them, she counselled that they should review the policy and make it permanent.
The professor maintained that many NCE graduates who were employed under that scheme, taught for one or two years and were sent back to the labour market.
Banku-Obi who lamented the policy somersaults in the sector said: “The confusion and the problems we have in the sector is as a result of policy inconsistency of the Federal Government. ‘We don’t have educators piloting the affairs of the Ministry of Education, like what we have in health and justice. ”It is high time the Federal Government began to think seriously of employing round pegs in round holes by getting professional educators to man the Ministry of Education.
“Today, we think we are getting to the right direction, tomorrow another minister comes who does not have an idea of what education and teaching is all about comes with another policy. Now, the new man thinks he is doing Nigeria good by sending unemployed graduates to the teaching profession, they are not thinking of the effect on the sector.
Unemployedgraduates
“Already, employers are complaining that we have graduates that are unemployable and the Federal Government is sending these same graduates to the teaching profession.
‘’What are you expecting to get from the system? It will be garbage in, garbage out. They are going to feed the tertiary institutions with poor students. At the end, the tertiary institutions will not be able to perform any magic on the undergraduates. I think we should have a good policy.
‘’If possible, government should have another education summit where people will come and discuss this issue. Unfortunately, when Ministry of Education calls for Education Summits, they bring in directors of different fields, staff from different ministries, professionals from different fields, they will never bring in educationists to talk about education.
‘’They see education summit as an avenue of making their own money. I strongly suggest that there should be a proper education summit and state auditing of teachers. Let them verify if they can get the numbers of teachers they are looking for from the states for the teaching profession. After this, they should engage the services of the Teachers Registration Council to set up aptitude tests and see those who are qualified and have a passion for the teaching profession before engaging them. The body should organize one or two months training for them before engaging them.
Speaking in the same vein, Deputy Director, Distance Learning Institute, University of Ibadan, Professor Oyesoji Aremu also applauded the initiative of the Federal Government to employ the 500,000 unemployed graduates, but however expresses some reservations.
Teachingmanpower
He said: ‘’It is a welcome development given the paucity of teaching manpower generally in the school system (primary and secondary education). According to him, some cautionary notes should however, be sounded in the interest of pupils/students and education for part of the existing malady in the education sector not to repeat itself.
He, however frowned at employing wrong personnel (who masquerade as teachers) into the school system.
His words: “‘Mostly in many public schools (primary and secondary), the teaching force is populated by untrained teachers. This, with proven evidence, has contributed not only to the decline of standards in public schools but also poor academic performance as shown by West African Examination Council (WAEC) and National Examination Council’s (NECO) results, where national performance norm is terribly below average. It has always made public schools unfashionable for many parents who prefer fee-paying private schools for their wards.”
Prof. Aremu added: ‘’With these cautionary notes, it is instructive to advise the Federal Government not to make the employment of 500,000 teachers an all-comers affair. One, it should be phased by first considering graduates of universities and colleges of education who studied education or who have had postgraduate diplomas in education, irrespective of their first degrees or Higher National Diploma certificates.
“The second phase is to consider others who are without certification in education pedagogy. This category of unemployed youths should be exposed to a stop-in-the-gap abridged training in education and should also be made to go through a mock teaching practice. This could be for a month and with a condition that such people be made to go for postgraduate diplomas in education on Open Distance Learning platform.
Aremu further advised; ‘’Logistics of stop-in-the-gap training should also be worked out by the Federal Ministries of Education and Labour in conjunction with state ministries and zonal offices. Lastly, the recruitment should pass integrity test so as not to be hijacked by politicians.’’
Also reacting, the Dean, School of Education, Adeniran Ogunsayan College of Education, Ijanikin, Dr. Deborah Delegiwa urged the Federal Government to reconsider its proposed plan. According to her, the decision to recruit graduates without training as teachers will spell doom for the sector, stating that teaching is an art, not a mere vocation.
Necessary knowledge
She said:”Teaching is an art that requires a person to acquire basic and necessary knowledge before being qualified. If one then desires to go into teaching without being trained, it connotes disrespect of the teaching profession. The action also suggests that the colleges and faculties of education should cease to exist.”
On his part, the Head of Department, Early Childhood Care and Education, AOCOED, Mr Sunday Fowowe, stated that the decision of the President on recruiting graduates with no formal education as teachers amounts to passing no vote of confidence on Teachers ‘Education.
Said he: “No matter how brilliant an individual is, he may not be able to do well in class if he is not made to pass through teacher training programme. ‘’The President’s pronouncement is like passing vote of no confidence on teachers’ education, hence, all colleges and faculties of education should be scrapped.”added Mr Fowowe.

“Those who have been trained for three years in colleges of education or four years in faculties of education are the ones saddled with the sole responsibility of teaching because, they have been equipped with innovative and basic skills.

Uyo—FOLLOWING the drop in the revenue from federation allocation to states in the country, Akwa Ibom State House of Assembly has advised the various ministries, departments and agencies of government to prioritize the items on their budget proposals that will generate revenue for the state.
Chairman, House Committee on Finance and Appropriations, Mr. Usoro Akpanusoh, gave the advice, yesterday, during the 2016 budget defence organised by his committee for the 57 MDAs in the state.
Gov Emmanuel Udom of Akwa-Ibom
This came as most of the MDAs demanded for increase in the vote appropriated for them for year 2016 while making their presentations during the budget defense.
Akpanusoh appealed to them to understand the current economic situation in the country and ensure judicious use of the funds allocated to the items in their proposals for the effective implementation of the 2016 budget.
He said, “My appeal is that you should prioritize items on your budget. There is no need asking for more allocation of funds especially when you are not sure that you will access all during the fiscal year.”
He said that with the drop in the oil revenue, the state was seeking other ways of improving its internally generated revenue to fund the 2016 budget.

In furtherance of its determination to achieve excellence through sports, the Lagos State Government on Tuesday said it has concluded plans to ensure a hitch free staging of the February 6 International Marathon held last in 1983. The Lagos Marathon is expected to be declared open by the State Governor, Mr. Akinwunmi Ambode, while the President of International Association of Athletics Federation (IAAF), Lord Sebastian Coe with his other counterparts from over six countries are expected to grace the event.

In a joint press briefing by the Ministry of Information and Strategy and the State Sports Commission at the Alausa Secretariat, the government assured that everything needed to ensure a successful tournament has been put in place.
Commissioner for Information and Strategy, Mr. Steve Ayorinde said out of the over 100, 000 forms made available, 12, 000 athletes have already confirmed participation, adding that 60 international participants in the male category have been confirmed, while a total of 20, 000 participants are expected to register. He said out of the 20 gold class marathoners in the world, 18 have already confirmed their participation in the male category, while 6 gold marathoners in the female category have also confirmed participation.
He said the international participants are joining from countries such as Kenya, Ethiopia, Bahrain, Eritrea, Morocco, Cameroun, Uganda and India, while about 120 professional athletes in Nigeria will slug it out with their foreign counterparts in the tournament.
The Commissioner disclosed that the starting point of the marathon would be at the National Stadium in Surulere by 7am, and would move through Western Avenue, Ojuelegba bridge, Jibowu bridge, Ikorodu Road, underneath Anthony bridge, underneath Maryland bridge, Ojota, Alapere, 3rd Mainland bridge, Osborn Avenue, Ikoyi bridge, Admiralty way, Lekki Concession Toll Gate, Ozumba Mbadiwe, 1004 Estate, Ahmadu Bello Way, Federal Palace Hotel, Silverbird Galleria, NTA, Bar Beach and then terminate at Eko Atlantic.
According to Ayorinde, the duration of the marathon is 42.195km, while the total prize money for sixty winners in the different categories of the tournament is N92 million. He said the winner of the first prize will smile home with $50, 000, while the second prize winner will get $40, 000, while the third prize winner will get $30, 000. In the Nigerian category, first prize winner will get N1 million; second prize, N750, 000 and N500, 000 for third prize.
Speaking on the specific roles of government agencies, Ayorinde said the Ministry of Health would provide medical services, and that there would be ambulances at strategic locations to take care of any emergencies. He said his Ministry would coordinate the awareness of the State Government concerning the tournament, while the Ministries of The Environment and that of Transportation would monitor and ensure proper cleaning as well as the routes to be used by the participating athletes.
He said the Lagos State Traffic Management Agency (LASTMA), together with other traffic management agencies would be in charge of the alternative routes already created for commuters who may like to go about their normal business activities. He further disclosed that adequate security measures have equally been put in place, adding that there have been provision for permanent and static mobile deployment of 100 security personnel to cover each vulnerable points such as the pre-event venue and hotel accommodating the foreign athletes and guests for 10 days prior to the event.
Also speaking, Special Adviser to the Governor on Sports and Chairman of the Lagos State Sports Commission, Mr. Deji Tinubu said the security personnel were drawn from the Nigerian Army, Navy, Airforce, Police, Nigerian Security and Civil Defence Corp (NSCDC) and the Department of State Security, while five boats will also be deplored. Tinubu added that in line with the commitment of Governor Ambode, there are plans for the event to held yearly, and that the ultimate goal is that it should be the biggest marathon event in Africa, and permanently be logged on the IAAF time table.
He added that there have equally been provisions for transponders to prevent cheating, which would also reduce the number of personnel needed for the tournament.
