Following the death of the Abia State PDP Governorship Candidate for the 2023 general elections, Prof. Uchenna Eleazar Ikonne, and pursuant to the provisions of Section 33 of the Electoral Act 2022, the National Working Committee (NWC) of the party has released the Timetable and Schedule of Activities for the conduct of a fresh Governorship Election Primary in the State. All Progressives Congress (APC) chief in Rivers State, Eze Chukwuemeka Eze, has accused Independent National Electoral Commission (INEC) of listing hotels belonging to Peoples Democratic Party (PDP) members as Registration Area Centres (RAC) in Port Harcourt. Eze said the choice of the hotels for the storage of sensitive materials and collation of unit results in the 2023 General Elections was a clear way of rigging the elections. In a statement made available to newsmen in Port Harcourt, the APC chief claimed the list of Registration Area Collation Centers (RACC) and RAC for Port Harcourt City Council released by INEC reveals that “Landmark Hotels, owned by Senator Olaka Nwogu, a former federal lawmaker and ally of Wike and Visa Karena Hotel, owned by Chidi Awuse, another PDP stalwart and Wike’s henchman, would featured as RAC for Orominieke and Oroworukwo communities. “Others are White Palace Hotel, Bebec Hotel, Hotel Dance, Comfort Hotel, White House Hotel, Maas Central Hotel, Danny T. Hotel, Orange Sea Hotel, Stanza Guest House, Thaland Place, Mainland Hotel, Ilo Garden Hotel, Mina Hotel, Otunkwe Guest House and Rachael Hotel. “The ownership or management of the listed hotels are directly or indirectly linked to the PDP and Wike; therefore, shortlisting them as RAC for the purpose of the 2023 elections will undermine the status of INEC as an unbiased umpire and jeopardise the commission’s reputation built over the years,” he said. Eze called on INEC to withdraw its approval of properties owned by members of the PDP for use as RAC and revert to the use of public schools or community halls as it is the case in other local government areas. The Appeal Court sitting in Port Harcourt has reserved its judgement concerning an appeal filed by the All Progressives Congress in Rivers State, and its governorship candidate, Tonye Cole. Naija News reports that the court took a decision to reserve its judgement for a later date over the Rivers APC and Cole’s appeal against the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC). It was gathered that after listening to the arguments of counsels for both parties, the three-man panel of the appeal led by Justice Joseph Ikyegh, reserved judgment on a date to be communicated to the parties. Naija News recalls that the Rivers State chapter of the APC and Cole had appealed the judgement of a High Court that nullified Cole’s candidacy as the governorship candidate of the APC in the state. This was after the PDP in the state dragged the APC and its governorship candidate to court seeking the sack of Cole. A Federal High Court in Port Harcourt presided over by Justice Emmanuel Obile had in his judgment on a suit filed by the PDP ruled that Cole be disqualified as the governorship candidate of APC for allegedly having dual citizenship and that the APC violated the Electoral Act in the conduct of the congresses and the primary election that brought in Cole as a candidate. The coast is now clear for the House of Assembly candidates of the All Progressives Congress, APC, in Rivers State to take part in the 2023 general elections. This comes after an Appeal Court sitting in Port Harcourt set aside the judgment of Federal High Court in Port Harcourt which sacked 16 House of Assembly candidates of the All Progressives Congress in Rivers State. Justice Turaki Muhammed of the Federal High Court had in a suit filed by the Peoples Democratic Party against APC House of Assembly candidates, sacked 16 candidates of the party for alleged Non-compliance with Electoral Act but allowed 16 other state house of Assembly candidates to take part in the election. But a three man panel of the Appeal Court in a unanimous judgment struck out the Appeal by the PDP seeking to disqualify the remaining 16 House of Assembly candidates. The court ruled that the PDP lacks the locus standi to challenge the primary election of the APC. In the judgment read by the lead Justice, Justice Olabode Adegbehingbe, the court held that the Federal High Court lacks jurisdiction to entertain the suit in the first place. The Appeal Court maintained that the choice of candidates of political parties is the total entitlement of the party. The governor recalled how Secondus and his cohorts, now christened Abuja Rivers politicians, had always tried to circumvent his political intentions, but failed. The governor said he has no apology for unsettling the so-called Abuja politicians when the party structure was taken over by him in 2013, while beating them into joining him because there was no other choice left for them. “What most of you didn’t know is that all these people who run away to Abuja, they’ve never worked with us. I led the team; they kicked them out of office in 2007. Yes, I have no apology to that. “In 2014, in spite of the fact I was the one who fought for the structure of the party, most of them sabotaged me at the back to run for governor against me. When they saw there was not hope, there was nothing else for them to do, they had no choice but to come and join us.” Governor Wike observed that in their usual manner, they regrouped against him and clandestinely supported one of them to become the governorship flag bearer of PDP in the state for the 2023 general election but were frustrated. The Rivers State governor listed that he embarked on legal battle to reclaim the state ceded oil wells to Imo and Bayelsa states and today proceeds from them are received by the state. Governor Wike also mentioned the ongoing legal battle over the illegality of VAT collection by the Federal Government when it should be collected by the state. Governor Wike said one of the reasons Rivers people cannot trust Secondus is because of the ugly role he played in 2019. It was about election time, he said, when Alhaji Atiku Abubakar and Bukola Saraki visited him to ask what he was expecting for Rivers State and the demand was clear, the office of the Attorney General of the Federation and Minister of Petroleum. But Governor Wike stated that what Secondus did was to go behind to demand for oil block for himself and not for the state. Governor Wike also recalled how Secondus had always frustrated the completion of projects that are under his purview including the Andoni axis of the Ogoni-Opobo-Andoni Unity Road. “Ask him, what happened when the military took over, when the NRC was in power, Ada George was the governor of the state. Ask him, what happened at Ohamini Road. Why was he told to frog jump? “Who flogged him? Colonel Akubundu (Rtd) who of course was the organising secretary, flogged him, why? He couldn’t do the project of the Ohamini Road.” Governor Wike further alleged, “Ask him, from 1999, when Odili became governor, every project Dr. Odili gave to Andoni through him, ask him, which one was commissioned. “Every company that the state government would pay money to instead of you to allow the company to do the job, you’ll collect the money. An Appeal Court sitting in Port Harcourt, Rivers State, has set aside the judgment of a Federal High Court that sacked all candidates of the All Progressives Congress (APC) for the 2023 general elections including the party’s governorship candidate, Tonye Cole. The Federal High Court presided by Justice Emmanuel Obile on 25th October sacked the candidates of the APC following a suit filed by George Orlu and five others, who alleged that they were excluded from the party’s delegate congresses. The three-man special panel of the Court of Appeal in their judgment delivered by Justice Muhammed Lawal-Shaibu said George Orlu and five others did not exhaust the internal party mechanism before instituting the suit. Shaibu held that the respondents failed to participate in the congress of the APC and so did not have any cause of action and locus standi to go to court. He said it was inconceivable for the Federal High Court Judge not to have joined some candidates of APC, who were interested parties in the suit. The panel said the nomination of delegates and political parties was purely internal party affairs, and that the court lacked jurisdiction to entertain the suit abi initio. Shaibu set aside the judgment against APC and awarded the sum of N500,000 each for the three cases as cost against the appeal respondents in favour of APC. Also, in a 15-ground appeal instituted by the national and state House of Assembly candidates, the court held that the aggrieved defendants could not exhaust the internal mechanisms as provided by the party’s constitution before going to court. He said the trial judge did something strange when it delivered judgement on the preliminary objection of the defense and the substantive matter and granted all the prayers of the plaintiff. Shaibu said the judge committed a serious error for not going into the merit of the matter, queried how the court got reasons to deliver its judgement without properly examining the matter. He said the appeals by APC, Cole and assembly candidates were on merit and were allowed. The Rivers APC 2023 Campaign Council commended the judiciary for standing on the path of justice. The Spokesman of the council, Sogbeye Eli, said the judgment would give Rivers people the opportunity to choose among candidates at the poll, calling on politicians to approach democracy with utmost responsibility. Eli said the APC would commence activities following the decision, adding that the party would not apply to the state to use public schools for campaigns. He said: “We will not apply to anybody to use the school. If we do that it amounts to illegality. We are in court challenging it.”
