Family / Re: Is It Proper For My Younger Brother To Be Washing Plates For My Wife? by Konzent(m): 6:06pm On Oct 03, 2016
I think you need wisdom here more than any other thing said . First understand that your brother is feeding his ego and would not want to go down and wash the plates. Allow him there, rather define the tasks in the house and give him a portion of work that would be more dignifying. This would also relief your wife of some work and placate her. If she still complains, know she has something personal against your brother.

Inspiring story there, but you graduated from both masters and Ph.D with first class honours? I don't get you there. Moreover, your Ph.D is called "Doctoral degree" not "doctorate degree" as you wrote. You would be write to say you have a "doctorate"(if you leave 'degree' out).Congrats if this is true.
Career / How Not To End Up Unemployed by Konzent(m): 8:02am On Apr 22, 2016
For the love of our youths lets consider why a lot of people remain unemployed and how to get a job fast.I get sick when i hear the cliche "there are no jobs in Nigeria".Nothing could be more fallacious than to say that there are no jobs in Nigeria, a country with over 20 full scale federal ministries, same repeated and sometimes exceeded across 36 states of the federation. This country has the presence of serious multinational firms like Mobil, elf, shell, chevron, Texaco, Mtn etc. Government agencies and parastatals like NAFDAC,NIMASA,NNPC abound. Meanwhile almost every state has a federal Institution and employ teaching and non teaching staff in addition to state and private Institutions, business, banks, hospitals, international NGO etc.
Do this places employ the services of robots,or ghost? why then is the false believe that there are no jobs. The answer lies in these three questions i often ask when i hear such lie.

QUESTION 1:what did you study
QUESTION 2:what grade did you make
QUESTION 3:where have you applied for job.

Yes i would agree unemployment is high but you can decide not to be in the statistic.
The answer to these three questions or a proactive consideration of same would guaranty your employment.

WHAT DID YOU STUDY ?:its so pathetic that Nigerian youths in a bid to rush into the University choose to study anything at all, irrespective of the prospects, devoid of any passion and sometimes without considering the demand in the labour market. Some courses don't have a place in the employment landscape of this country.I was in my first year in the University when my Lecturer Dr. Esikot said that philosophy does not put food on the table. Who employs a graduate of philosophy in Nigeria, and to do what?
No matter how high sounding a course may be, it may not be your best bait towards securing employment. So instead of fanciful degree in Anthropology, you may rather obtain training on Procurement and store keeping.I bet, you would be called up for employment with the later before the former. How about Radiography instead of Anatomy. Enough said on that, lets consider the next question.

WHAT GRADE DID YOU MAKE ? Its ironic that in Nigeria where there is a lot of competition in the labour market, people still play around in school and graduate with low grades and expect to be preferred over those with good grades.
You hear some say, its not about the grade but what you can offer, why didn't the person offer such in the examination paper way back in school.
Some even say examination is not a true test of knowledge, and i'll quickly ask, what then is?
Truth is your grade tells a lot about your ability to achieve set goals, your passion for excellence, your commitment level and your ability to learn etc.It speaks a lot about your inner drive.
A man with a first class degree might not have been the most intelligent but is certainly one who can set a goal and get committed enough to follow it through, and that is what employers want.
No matter how good you may think you are in practical, your poor grade would deny you the opportunity to be even heard.

So make the best grades in your undergraduate days if you don't want to join the statistics of unemployed graduates. Now to the last question.

WHERE HAVE YOU SEARCHED FOR JOBS ? It could be unbelievable that some graduates are wallowing in the illusion that "there are no jobs, "all jobs are on connection" , "they've already selected whom they want" etc and as such don't bother to search. In this days of internet, you would be surprise that some job seekers don't employ the technology.

The law of probability if applied would follow that the higher the number of jobs applied for ,the higher your chances of landing a job.Why not increase your chances daily.
A lot said, others can add theirs. But if you consider these three, you cant be in the statistics.Good luck.

Politics / FRSC Imposition Of Fines Is Ultra Vires, therefore Unconstitutional And Illegal. by Konzent(m): 9:44am On Apr 17, 2016
A federal high court in Lagos has declared void powers of the Federal Road Safety Corps (FRSC) to impose fines on motorists for traffic offences.
John Tsoho, a judge, held that the commission could not turn itself into a court of law by punishing those who commit traffic offences.
Tope Alabi, a lawyer, had approached the court to declare that only a court of competent jurisdiction could pronounce a person guilty under section 10 (4) and 28 (2) of the FRSC Act 2007.
Other defendant in the suit was the attorney-general of the federation.
The judge also awarded N1million damages in favour of the plaintiff because officials of the FRSC had confiscated his vehicle and driver’s licence.
Tosho said while FRSC was statutorily empowered to arrest and fine traffic offenders, a closer look at the definition of the word “fine” meant a pecuniary criminal punishment or civil penalty payable to the public treasury.
“In the instant case, however, the involvement of the element of arrest takes the imposition of fine by the FRSC to the realm of criminal punishment,” he said.
“From these definitions, it is obvious that the act of sentencing is a judicial action or exercise, and imposition of fine connotes conviction for an alleged offence.
“It is, thus, very clear that the FRSC, not being a court of law, cannot impose fine, especially as it has no powers to conduct trial.
“Hence, the exercise of the statutory powers given to the defendant under the Act as pertain to imposition of fine is clearly a usurpation of judicial powers exclusively vested in the courts.
“In the circumstances, I endorse the plaintiff’s submission that by virtue of section 1(3) of the constitution, the power to impose fine conferred on FRSC by the enabling act is null and void to the extent of its inconsistency with the constitution.”
Tsoho held that the FRSC resorted to “legislative absurdity” when it imposed a fine of 3,000 on the plaintiff, rather than the N2,000 statutorily prescribed.
“FRSC’s function should not go beyond issuance of mere notices of offence,” he ruled.
“It is a cardinal principle of natural justice that no person can be condemned without being heard.
“It is in observance of this that a person alleged to have committed an offence has to respond to such allegation before a court of law during trial.”
According to the judge, the plaintiff was issued a notice of offence Sheet on April 4, 2013, but FRSC did not take him to court for five months before the plaintiff filed his suit on September 9, 2013.
“The vital question to ask is how long would it take the FRSC to reasonably commence prosecution of a traffic offence?” he asked.
“The plaintiff was not under obligation to wait indefinitely for redress due to FRSC’s inaction or laxity.
“I hold the view that the confiscation of the vehicle was unnecessary in the first place, though the FRSC spiritedly sought to justify it.”
The judge then granted 11 of the 14 reliefs sought by the plaintiff, awarding N1million in his favour instead of the N10 million prayed for.

Career / Re: I Work With A Dead Man's Certificate: I Need Help..please HELP A Nlder by Konzent(m): 3:05pm On Nov 19, 2015
With due respect, i think nairalanders are intertwining law with morality. Both are not necessarily coterminous. An act may be unlawful but morality has nothing against it. This is one of such. If we use the clothes, houses and vehicles left behind by a dead man, i don't think anything is wrong with using his certificate. He couldn't have used it in the grave, it does him no harm that OP is using it. In fact the deceased may be happy that even in the grave, his achievement still puts food on someone's table. Go ahead op, the dead is not angry, rather happy that you are promoting his name. But don't be caught up with the law, your act is illegal.
