If you bring any disputes that has to do with customs and tradition, you will be sent to the customary court first to determine if a law has been defaulted. That's what pilat did, his authority is superior to Herod's because he was the prefect of judea province but he still had to send Jesus to Herod to ascertain whether Jesus has broken any law.
