Good evening experienced professionals in the house. Please I need your advice, guide and counsel. My late grandfather has a big expanse of lands running into hectares somewhere in Ogun state. He has five children, four females, which one of them happens to be my mum and a male who is also late. None of the children are interested in the land but we the grand children are all interested in the land. The land has no documents. How do we go about it?
Let the surviving children of your grandfather prepare an MOU and a Deed of Gift transferring the land to each of the grandchildren. A survey plan would also be needed.

Preferably, a Provisional Survey plan is done for the entire property and for the sake of dividing it and then each of the grandchildren now does his own Survey Plan.

Is it okay to buy a land with excision?
Not all lands in Ibeju Lekki are fake. However, because Ibeju Lekki is hot cake, many unscrupulous land sellers, real estate companies and agents are taking advantage of that to scam innocent buyers.

If the land already has an excision that is out, your lawyer has verified the land and is sure the sellers are the genuine owners, you can buy.

Before you buy, get your own surveyor to verify the land and be sure it falls within the excision.

Greetings all, please I will really appreciate if someone could explain what it means when a land has as Global C/ O Processing & Registered Survey. I plan to buy a piece of land somewhere in Lagos and the real estate agent told me that this is the title of the property.
It simply means the CofO of the property is currently being processed. Simply put, it has no C of O, but they are processing it.
If they sell out the land and abandon the processing, you're on your own.
If they have any issues after you have bought, you are on your own.

As for the Survey plan, it's not definitive proof of title. 5 people can have 5 different survey plans over the same parcel of land, it doesn't mean anything.

In short, it has no registered Title.

I'll suggest you get a lawyer to conduct verification on that property before you put your money on it.

Hello house,

There is a property in Lagos a friend wants to buy. The owner is dead without a will and left behind 4 children, one of the children is the one selling his piece to my friend.

The piece was given to him by the owner(his parent) word of mouth and confirmed also by the eldest child who the documents of the whole property is with.

Questions: How would they separate the document?
What documents should my friend ask for from the seller?
Do they need to go imo onile that sold it initially?

A Deed of Subdivision would be needed if the title of the property is registered. If it is not registered, the children can get a Contract executed between them which authorises the owner to sell.

Also, the Omonile that sold it initially would need to be reached for the new buyer to obtain the family receipt that covers the part he's buying.

Don't ever buy a property because they used a celebrity as the brand ambassador. Check the land documents and conduct verification before you pay a kobo.

Learn from the mistakes of others, don't make yourself a scapegoat. Verify before you buy.

Land buyers are easily scammed don't know the documents to ask for when buying properties and so, they don't know how to protect themselves. They rely on the title and information presented by the sellers without verification and that is the beginning of heartbreak.

Some fraudulent real estate companies are not left out. They use glossy advertising to lure unsuspecting buyers. Many who have bought from them are unable to take possession of their land simply because they are fraudulent.
