GeneralShepherd: Since I officially dumped the idea of a god, I haven't seen my parents. I went home this christmas,it was a wonderful holiday for me,little did I know my mum was hurting deep down inside!

She called me today being the 1st of January 2014 and started telling me how she asked Yahweh to give her a son after she had four girls(who are all married) which He did according to her. She told me how she has barely slept most nights in the pasy year because of my atheism. Also said it might lead her to her early grave if I continue living without god.

My dilemma is I can't pretend about god and the bible,yet I don't want my mum to die or have sleepless nights! When people read the bible the smile on face shows I don't believe any of it, when I try to pray I feel like I'm mad talking to myself or like a kid talking to Barney and friends!

How do I undo what has been done! How do I unknow what I know about god and religion? How do I ignore the inconsistencies?

I love my mum so much and will gladly become a sheeple for her to be happy
Organise religion is confusing and causing so many division, among families and ppl of the world. The truth is nobody knows the truth, we are all following our parents doctrine. There are many religion in the world, all of them claimed they are the right path, hence, we are ALL confused. I think we should follow our conscience as our guide, because no matter your religion, somebody will tell say you are on the wrong path. Atheism is an absolute that there's no god, they don't know either. The best and honest following is Agnostic, who believe that nobody know, they are on the fence per se, and that is the only honest assesment. So, follow your conscience and let your mom know, she cannot save you on the judgment day, if there's one. Everywo/man for him/her self. My 2cents

Simply the bank can't be sue for no reason. The relationship between the bank and any depositor is called bank-coustomer relationship and it only subsits when you open and accout with the bank n deposit money which has not been established here. The money though within the presmises of the bank is not yet in coustody of the bank.Abnitio,(in law it can be seen as negligence on the side of the owner or an act of God. In conclusion the customer can't have any case or damage against the bank.
This is not about just the customer relationship, any one in the bank premises in a foreseable plaintiff, just like when you drive anyone on the road is a foreseable plaintiff. The bank is liable to any one with its premises, provided it can be proving that the bank is failed in its due care to its licensee. Tort law hold the bank to give due care. Rainston v. Kinsner

It's quite simple: If the money is "in your possession," then NO!

1. You are in the bank's premises = your possession
2. You are getting ready to hand the money to the teller = your possession
3. You have handed the money to the teller but it is yet to be recorded in the system = your possession

Until the money is recorded in the bank's system, it's still in your possession!

If the money is in the bank's possession, then YES!

For the argument of tort, the onus of proof of negligence on the part of the bank leading up to the loss would fall squarely on the customer.

Yes, the burden of proof is on the plaintiff. However, the adequate duty of care will be decided by the trier of fact (Jury). My argument is If the bank cannot prove adequate protection for its licensee, it is liable. Another lawyer just concur with me.

Okija_juju: Im sorry but this is a rather crazy question. But I donut the bank is liable.. Reason being:

1. For the bank to be held responsible for your money lost on their premises during a robbery or a fire or any other such situation, the bank must have taken physical possession of the money. Meaning you have handed the cash over to the bank.

2. The banks security is not primarily for the customers per se, but for the bank. Meaning the primary responsibility of the security guards in the banking hall is to first protect the bank and then the customers.

Remember that the monies stolen from the bank would have to be replaced by their insurance company. Problem is because your money was still in your possession as at when the crime occurred, the liability is still on you. It does not even have to be a robbery sef, it could also be pick pockets that stole the money.

It's like asking if you can sue a Man in whose house you got robbed. NO! You can't.

It's like you drove a Brand new Rolls Royce from the dealership to your Insurance company and whilst you were inside still filling out the form, the car got stolen from the premises of the Insurance company when a sign saying 'Vehicle parked at owners risk' is clearly marked on the wall, you can't claim any form of insurance or compensation.

It's like a question someone asked one time that what if you are inside a bank during a robbery and the robbers come out with a stack of cash and sprays it inside the hall before their exit, and then people start picking it, if the bank can hold you. The truth is that it would be a difficult situation.. It would boil down to a matter of jurisprudence. The matter would be resolved by the courts in this case because truthfully, it's a crime. But the technicality of it would be what the courts would have to determine.


But for the sake of argument in terms of the banks duty of care to customers within its halls, a good lawyer maybe able to argue it out..

So in conclusion, it boils down to jurisprudence.
Let answer your question in order stated 1) You do not need to hand over the money to proof tort, and civil wrong on your premises due to your negligence for lack of adequate security makes you liable is called "but for" in law. 2) The bank primary security is equally to his licensee and his business, remember the reason the bank open is to his licensee or customer, the word "licensee" is critical as it differ from invitee, licensee require extra care.

My argument is not about posession, it is about the bank's responsibility once the customer step in their lobby. Possession amount has to be profing later. We are talking whether adequate security is provided, if not bank is liable. Tort Law calls for Duty of Care in resident or business.

Balmoral supermarket ltd vs bank of new Zealand clearly established the precedent that in cases as these, the banks are not liable. As long as the cashier has not stamped and handed over the deposit slip the customer is on his own. Case closed
The burden of proff is rest on the plaintiff, the assumtion has to be proven, you cannot assumed the bank has adequate security, what if the bank lacks, or cut corner, or didn't hire enough security, the bank must prove NOT ASSUMED it provide enough security. The case of Ranson v. Kintner as stated. If your stated case applied common law, the plaintiff will win.

No, bcus your lanlord is not in control of your flat after giving u the key, lanlord is still responsible for the safety of the building. The street belongs to everyone, you're not an invitee, however; even on the street, the city is responsible to keep you safe on the road. At least in the US. That is why you see police patrol.

Banks are not answerable to money not yet collected and verified by their representative,the cashier and duly stamped teller and signed by him acting on behalf of the bank. Until this is done,customer hold the responsibility of keeping his money safe. This is in the case of cash deposit. In case of withdrawal,when the amount is debited from the account,d withdrawal form stamped 'paid' and the amount place on the counter for customer to verify,the bank is no more responsible. Think of it,if the bank is responsible for stolen money in the premises,who is responsible for inside the house and on the streets? The bank premises is vulnerable to robbery attack just like any other place in the society.
You're right in theory, but WRONG in Law. The law applies what is called common law to civil case other than goods. The street is open to everyone, the bank is open only to anyone that have business there. The bank is a commercial establishment therefore give ppl license to come in, thus must protect anyone in their premises, whether the money is deposit or not. The fact as stated is Licensee is owe extra protection, as matter of law. That is why you have security in shops, bank, and office building, to show they have protection. The issue is not about the money collected, the issue is about the licensee customer.

Obviously you're a layman who doesn't understand the law. Law is not about emotion, its strickly fact only. Read a precedent case of Ranson v. kintner. IF I ARGUE THE CASE, I WILL WIN HANDS DOWN, IT WILL NEVER GO TO TRIAL, AS THE BANK ATTORNEY WILL SETTLE, THEY WILL SEE THE WRITING ON THE WALL. Assume the bank fail their duty to their customer.

This is not about banking law specific, your banking law is a branch from common law. Common law is the barometer of services and contract law. In any commercial civil case that are services, you must apply common law, the issue here before us whether the customer is a licensee or invitee, this customer is clearly a licensee since their there to transact business, thus they are owe duty of care, and since robbery is a foreseeable occurence at a bank, the bank should make extra care to protect its customer. My conclusion is based on the info. presented here. Read Ranson v. Kitner, precedent case

Some fellows and i were arguing in my area today whether banks could be sued for money lost that
had not been paid into one's account or not.

Those that supported the notion argued that Banks could be sued "because banks have a duty to guarantee security to customers once they are inside the bank". They argued further that they wouldn't have lost their money if they were not in the bank and since they lost it to bank robberies then they should be compensated. They gave the analogy of how most formal organisations removed themselves from any responsibility that may arise as result of car stolen in their premises and that's why the statement 'ALL CARS ARE PARKED AT OWNERS' RISK' can seen in their parking spaces/garage.

Those who opposed it argued that "since no transaction has taken place then banks cannot be sued for compensation".

Who is right between the two? Please I need your opinion as regard this. I want you to back your comment(s) with facts. And what does Nigerian law say about this?
I studied Law in the US. I am really not verse in Nigerian Law, but since Nigerian Law is based on Common Law, it is similar to the US. There's is a different between a Licensee and invitee. Since you're in the bank premises to conduct business you're a License, therefore the bank owe you a duty and foreseeable care. The statement that we are not responsibile in case of parking lot, is just to limit the liability, will not hold in court, as you've establish a bailment situation, where you entrust your car to other. So yes, the bank will be responsible. However; you must proof your lost and possession at the time of incident. This is not a legal advise, as I don't have the detail info.

Lord Babs: The police in Ogun State have arrested a pastor with a first generation pentecostal church, Daniel Samuel, for allegedly attacking his wife, Patience Samuel, with machete and inflicting deep cuts at the back of her neck.

The pastor allegedly attacked his wife over her alleged persistent failure to attend prayer meetings and other church programmes.

Our correspondent gathered that 45- year-old David, who became the pastor of the Ode Remo branch of the church about a year ago, had travelled to Owode-Egba in Obafemi Owode Local Government Area, where his wife works and allegedly hit her with the machete that left her injured.

Punch Metro learnt that the pastor had accused his 42-year-old wife of shirking in her dedication to church programmes.

The pastor was said to have on several occasions complained to his in-laws about his wife’s obsession with office work at the expense of her family and church services.

Our correspondent however learnt that Patience also sells firewood, charcoal and food at the Redemption Camp to augment her husband’s N15,000 monthly salary and to support their five children.

An elder brother of the victim, Samson Akpikie, was said to have earlier arranged a meeting between the couple and other district pastors of the church for December 15 (yesterday) to resolve their lingering differences.

But the Pastor, who could not wait, was said to have visited his wife at her station where their disagreement degenerated into a heated argument. The pastor allegedly attacked his wife with a machete during the argument.

It was said David initially alerted the neighbours that his wife was attacked by some unknown men.

But doctors at the Federal Medical Center, Idi-Aba, Abeokuta, where the injured wife was taken to, ordered that the case be reported to the police.

The pastor was said to have gone to the Owode-Egba Police Station, where he told the police that the woman was attacked by unknown men.

The police were said to have detained the pastor who later confessed to the crime after interrogation.

The Ogun Command Police Public Relations Officer, Muyiwa Adejobi, confirmed the incident.

He said, “The pastor is with us, he initially lied to the police that his wife was attacked by some men, but later confessed after interrogation. He will soon be charged to court for false information and wounding.”

At the FMC, our correspondent observed that the pastor’s wife could only utter some incoherent words when she was asked questions.

The Consultant of Orthopaedics and Trauma, who was in charge of the patient, Doctor Ojeblenu, said the woman would remain under close observation because of the depth of the injury and the psychological trauma she might be going through.

The other downside is all the chemical produced foods that these shops carry. We are continue to patronise these non wholesome foods with pesticde, while ignoring our fresh organic foods stuff from the local market. In USA people are paying premium price for organic food, while staying away from these package food products. I was shocked to see a long line at shoprite for loaf of bread. They are changing our taste bud, making shoping at shoprite a status symbol.

Dextra: Fellow Nairalanders, I come before you this day with hope that you will provide solution to my problem. I find it very difficult getting a good body lotion that will be perfect for my skin type. I don't know much about my skin type though, but I know my skin easily gets dry, I sweat easily, I hardly get rashes or acne.

I used to be lighter than I am now but due to constant Abuja sunshine and stress my skin looks dark and dull. I don't have any specific body lotion, I've used several of them ranging from Jergens, Nivea, Swiss Collagen, Dove, etc but non of these lotions seem perfect for me.

Few years back, my skin was so fine when I was using Venus Skin toning cream and it was so perfect, all of a sudden I couldn't find it in the market. I really need your help.

I need a lotion that will give and maintain moisture in my skin, that won't make me sweat and won't bleach my skin (Cos I love my skin color), just even skin toning.

please you can recommend any good lotion you know irrespective of the price, I can afford it. I really need your help. I need a good lotion I can stick to.
