China is poised to enshrine individuals’ rights to privacy and personal data for the first time, a symbolic first step as more of the country of 1.4 billion people becomes digitised – and more vulnerable to leaks and hacks.

The legislation is part of China’s first civil code, a sweeping package of laws that is being deliberated during the annual meeting of parliament, which began on Friday after a delay of more than two months due to the coronavirus.According to a recent draft, an individual has a right to privacy and to have their personal information protected.

Data collectors have a duty to protect an individual’s personal information and cannot obtain, disclose or conduct transactions of such data without consent.The push to shore up data privacy in China is widely seen as an effort to protect and legitimize the country’s fast-growing internet sector and place safeguards on the movement of valuable Chinese data overseas.

The legislation will need to be followed by detailed regulation spelling out how those rights will be protected, and this gives no protection from increasingly pervasive surveillance by a government that wields total control over the country’s digital sphere.

Nevertheless, lawyers and legal experts say the recognition of digital privacy rights is an important first step allowing individuals who suffer from leaks to seek readdress.

“When the law hasn’t set a definition for personal information, then a lot of disputes are very hard to resolve because there’s no way to sue,” said Xu Ke, a professor at the University of International Business and Economics in Beijing.

The legislation places China among a minority of countries building legal frameworks governing individual data privacy, although individual protections currently in place are not as strong as Europe’s General Data Protection Regulations, said Chen Lei, a law professor at the City University of Hong Kong.

Legal experts say existing Chinese laws do not provide adequate protection for individuals because they don’t impose significant punishment for companies responsible for breaches.

Chinese courts also have been inconsistent on privacy cases, which some blamed on inadequate regulations and guidance for a rigid court system that limits judges’ scope to make new interpretations in law.

In one high-profile case, a group of 42 people sued Amazon in 2017 for breach of their personal data by scammers.

Yanming, one of those who sued the U.S. e-commerce giant, said he fell victim when a person called him with the exact order number for products he purchased. The person said there was a problem and offered a refund, luring Yanming to a phishing website planted within Amazon’s website that siphoned 247,000 yuan ($34,627) from Yanming’s account.

Chinese courts have ruled twice against Yanming – who requested his last name be withheld for privacy – and the other plaintiffs, however, stating that a criminal case must take place first before a civil case can start.

“The court’s decision is such that companies won’t value personal information protection, or digital safety practices,” said Wang Congwei, the victims’ lawyer.

Parliament plans to roll out separate legislation specifically on protection of personal information later this year, and lawyers say Beijing needs to set stronger penalties for breaches or leaks in order to provide effective protection.

“(The civil code) will help, whether from the perspective of civil suits, or from the perspective of safeguarding rights for the victim, it’s more clear, and for the courts this is a clearer standard,” said Wang.

In Anambra State, several Masquerades (Egungun) were arrested for defying a stay-at-home order issued by the state government over the country’s Coronavirus outbreak.

The government of the Anambra State had directed that the movement and closure of markets in the state be limited for 14 days.

The Masquerades who flouted the order were arrested yesterday at Nkwo Uga, in Uga community of Aguata Local Government Area.

22 new cases of Coronavirus have been confirmed in Nigeria by the Nigeria Center for Disease Control (NCDC) as at 09:00 pm on April 8.

The 22 new cases of the coronavirus in Nigeria were reported as, 15 in Lagos, 4 in the FCT, 2 in Bauchi, 1 in Edo.

The Lagos State Police command has granted bail to singer Naira Marley and former Lagos state governorship candidate, Babatunde Gbadamosi, and his wife.

The trio were detained at the State Criminal Investigation and Intelligence Department, Panti, Yaba on Monday April 6 after they turned themselves in for questionning.

The lockdown due to the Coronavirus pandemic in the state stalled their arraignment at the state magistrate court yesterday April 7.

A police source who confirmed they have been granted bail, said they would be arraigned in court today Wednesday April 8.

The Federal Government said that Nigeria is still on the right track to overcome the country’s Coronavirus pandemic.

This optimism was expressed by the Chairman of the Presidential Task Force on Coronavirus Disease, and Secretary to the Federal Government, Mr. Boss Mustapha.

He made this assurance at a visit of the presidential task force to some of the isolation centres in Lagos on Tuesday.
Mustapha also commended the Government of the State of Lagos ‘efforts to contain the ravaging pandemic.

Despite the optimism, Mustapha urged state residents to continue to provide the requisite help to the government in the battle against COVID-19 to kick it out of the country.

Twenty two people were killed by bandits that attacked Dangara village in the Sabon Birni Local Government Area of Sokoto State on Wednesday.

Confirming the killing, the Sokoto State Police Command said the attack also left about 20 people injured while another source indicated that foodstuffs, cows and other animals were also rustled.

One of the victims, Umar Nuhu, who spoke to our correspondent from Sabon Birni General Hospital, stated that more than 20 people were killed while others were injured.

Nuhu said:

He bandits stormed our town at about few minutes to 4pm and spent close to three hours ransacking, maiming and killing, without any challenge.

“They came in a convoy of over two hundred motorcycles with each of them carrying three persons fully armed with guns.

“After killing our people, they left with foodstuffs, cows, and other animals and later burnt down the shops in the market.”
Sokoto Police Commissioner, Ibrahim Sani Ka’oje, confirmed the incident, through the command’s Public Relations Officer, ASP Muhammad Abubakar Sadiq.

Sadiq said:

“Upon information received from Gangara Police Post that large number of bandits stormed Gangara village at about 1630hrs on motorbikes, the joint Operation Puff Adder and Military patrol teams were drafted to the scene, efforts were made by the bandits to ambush the response team but were unsuccessful, due to strategic response of the team to the laid ambush.

“After a fierce gun duel, the bandits retreated and escaped into the forest with gunshot injuries while one bandit was shot dead.

“Unfortunately, 22 bodies were discovered to have been victims of sporadic shooting by the bandits on arrival.”

Meanwhile, a philanthropist, Alhaji Garba Suleiman, has offered to settle the hospital bills of the victims..

Kenyatta Bellamy, 50, left jail on Tuesday after spending a year behind bars for DUI manslaughter.

When he got to his house in Davenport, Florida, he found his girlfriend, who he let live in his house living with another man.

Bellamy called his mom to see if he could visit her in Miami, but he couldn’t, as bus service was canceled because of the coronavirus outbreak, the Polk County Sheriff’s Office said in a news release.

On Friday, Bellamy took his girlfriend’s son, who the sheriff’s office said calls Bellamy “daddy,” despite not being his father to a family member’s house, and went to grab dinner with his cousin.

Bellamy told his cousin he was upset about his girlfriend’s lover living in his house, and asked him to drop him off at a gas station after dinner because he didn’t want to return home.

His cousin later went to Bellamy’s home, knocked on the door but no one answered. The cousin said he smelled smoke and called 911.

It turns out, according to police, Bellamy killed his girlfriend and her lover, after he became enraged when he saw them having s*x and lit a fire in the bedroom and closed the door.

The 50-year-old said he was power washing the outside of his house, but when he went inside, he saw the woman and her lover having s*x and said he “lost it.”

According to the Polk County Sheriff’s Office, Bellamy used a hammer and knife to kill the man and woman.

Bellamy let his girlfriend live in his house and gave her money to pay the bills, and didn’t know she asked the man to move in with her, police said.

A woman has thrown residents of Ogo-Oluwa in Osun State into shock after jumping into Osun River in Osogbo.

An eyewitness, Abdul-Wasiu Ismail, told Global Times that the woman, when asked, said her reason for jumping into the river is as a result of hunger as the state goes on total lockdown.

She, however, was rescued by some good samaritans in the area.

Ismail also disclosed to Global Times that she also said that she has three children whom she said she could not cater for because she is financially handicapped.

She revealed that her husband stays in Lagos adding that they have separated about thirteen years ago.

Present at the scene of the incident were the chairperson of Osogbo West Osogbo Local Council Development Area, Alhaja Temilade and the state Special Adviser on Public Health, Mr Siji Olamiju.

It was learnt that she has been taken to the hospital for treatment.

Recall that The state governor, Mr. Gboyega Oyetola, had on Sunday announced that the state would go on total lockdown after two cases of coronavirus were reported in the state.

Oyetola reaffirmed the commitment to shut down all the land boundaries effective from midnight, Sunday, March 29, with the total lockdown of the state from midnight, Tuesday, March 31.

Commercial motor parks were equally locked in Osogbo.

Banks and other business outlets were closed for business as residents stayed at home, while only those on essential services and pharmaceutical outlets were seen carrying out their operations.

Angry Warri youths on Wednesday morning, attacked some of the state taskforce team deployed to enforce the state government’s sit at home order.

The governor, Ifeanyi Okowa, on March 26, announced that the state will be on total lockdown beginning from today April 1, to prevent the importation of the Coronavirus to the state.

Men of the state taskforce who were sent out to enforce the order, were attacked by some angry youths along Jakpa road. According to the youths, they cannot sit at home when they have no food to eat.
