2. Every case is different, so I can't really give advice. He should bring whatever he has.

3. Categorically no. It will be harder to prove his claims in the U.S. that it would be here.

4. Technically we can't require DNA, but we CAN strongly suggest it. In this case, clearly, it can't be done.

5. The best thing to do is to make an appointment for a U.S. passport at American Citizens Services, so the ACS Officer can interview the person and get a feel for how the case should be investigated.

There are a couple of questions i would like to ask and would want you to be more explicit with from your previous answers by giving examples or clues;
1. (The amount of time depends on when your cousin was born.) How can he show that ? he was born 1979

2. The ACS officer will be interested in seeing good evidence that the two were truly father and son, although he has photos taken of him and his father when he was 3yrs old, he(my cousin) has a birth certificate from the clinic in Nigeria when he was born back then in 1979 stating his fathers last name, he still has fathers company's complimentary card as at that time, all his report cards/certificates/transcripts and even Nigerian passport has fathers last name on them. what other evidences can u suggest that are not on this list that will hold proof?

3. He said he has been to the ACS way back in 2001 before his mother was deceased, submitted all these documents made his claims but sincerely nothing was done, he was told he would be contacted but nothing was done till date not even a file number or anything was stated. Fortunately he was able to find his adopted brother his father terribly sick, now the father is deceased, do you think going to the states with a visiting visa will be more effective for proving his claims than here in Nigeria?

4. if a DNA test was required as the process takes toll now that his father is deceased would it hinder his claims?

Finally please give us the simplest way to go about this issue although from what i can see its a long long road but with patience we ll get there.

The ACS officer will be interested in seeing good evidence that the two were truly father and son, but if the deceased man was an American citizen at the time of your cousin's birth, your cousin may actually be a U.S. citizen himself. Let me use this opportunity to say a big thank u for clearing a lot of issues raised by us Nigerians and clearing the air and also asking a question on behalf of a close relative who needs serious answers to his claims. At first i felt you were a phony but after following this thread and looking at your answer i figured maybe u r truly who u are after all.

I have a cousin whose father is a u.s citizen but found out his father died and was buried recently sometime June 2013 in the u.s. he(my cousin) was born in Nigeria in the late 70's and his father left this shores when the company he worked for as a superintendent in the Niger delta had some issues with the Nigerian Govt during the mid 80's. all effort proved abortive to locate his dad not until some yrs back when he got in contact with his step brother via a social media. he was again in contact with his dad but this time the old man was very ill all efforts to file an application for him proved abortive due to one reason or the other, since his older step brother was even an adopted son to his father but bears same last name with my cousin.

Since he found out about the death of his father some months back, his step brother who was adopted before he(my cousin) was born has been acting dodgy to him for some unknown reasons. he is confused and doesn't know what to do he is a u.s citizen based on the fact that one of his parent is a u.s citizen by birth correct me if am wrong? how does he go about his case of immigrating to the u.s? he is happily married now with kids and has a good job with a multinational company. what do u think would be his fate for obtaining a u.s green card/passport for himself, wife and kids? please advice us on the steps to take and the process to follow. we await your reply anxiously.

AjanleKoko: The US Embassy will only ask for any of your documents if your interview requires it.
For example, I work in ABC company (unknown name) and I earn 3m naira per month. CO might want to see proof that you indeed earn that much, and would even want to know which ABC company in Nigeria, not known to them, can afford to pay someone N3m per month.

Generally, the default position of the US embassy for nonimmigrant visas is to assume you intend to stay in the US and not return to Nigeria. The basis of the CO's assessment is to determine if you are likely to return or not. So they don't start with a verification, but an intent to deny you the visa. Your two or three minutes discussion with the CO is all they need to decide. And yes, there is an element of luck in there.

Same thing with mine.now I am going there with my full family make I see wetin go happen. With God this one must be possible.

Peoples cases are looked @ from different angles. But from what I believe when u r favoured by God and in the right place at the right time saying the right thing with a genuine application u ll be given.

GboyegaD: I am not so convinced about the family tie people stress regarding visa. I have once gotten the US student visa and now a visiting visa after graduation and was never asked anything about family ties.

AjanleKoko: Well . . . I am just wondering how you will expect to be given a nonimmigrant (visit) visa to the US, if you don't earn a reasonable amount of money, and have significant ties to Nigeria.

By ties I mean, ideally you are a settled family person with children, a stable income, high by Nigerian standards, and at least have travelled to some extent to other locations for business or pleasure. The cost of a return air ticket to US for one person can be as high as N400k on some airlines, especially during summer. If you don't even earn that much in a month . . . well, I struggle to understand how you will be able to prove to the CO that you can pay for your trip.

I don't mean it in a disparaging way, mind you. But it's easy to understand how the COs view Nigerian applicants.

pls can u tell us about ur interview, was it thru an invitation or hotel reservation or conference? what documents where u asked to show by the CO or where not asked to show any? what questions where u asked by the CO and most importantly how long did u fast and pray.....kindly itemize ur own scenario so we can learn from u too.

dkgetmuny: bn following this thread for a while...well let me drop my widows mite...the key to obtaining american visa is to be honest, self confident and smart. those consular guyz r highly trained and u may fink dey read minds..i am sorry but i dont buy dat travel history theory..i got my US visa on a virgin passport...i had never travelled out in my life..dat was my first passport and my first visa...u may want to say its an exception but even subsequent visit to the embassy, i saw many odaz wif travel history rejected and many without travel history approved...take d ryt and authentic documents, av a good course to travel and above all be prayerful..answer questions asked directly and dont do over sabi..dont show desperation(even if u not goina come back)....all d best

i was also able to book an appointment for july ending. as the appointment dates were already booked but free from July 27 - Aug 2nd. God has bin truly faithfull, i am keeping my fingers crossed till the interview date. i ll come back and post my interview session with the CO in a months time. whish me good luck guys and stay blessed.

tzetzefly: There is clearly something you're not doing right in your applications. But i tend to wonder how you come about obtaining the UK visas for yourself and family, and fail to get the Canadian TRV.

Actually there's nothing to fear in the US visa application process. The CO only wants to know that you're a genuine traveller willign to depart the US before the expiration of your stay. Once you can prove this, then they have no reason to refuse your application.

Between 2005 and 2008 when you applied, there must have been a process you followed and documents you presented. It is necessary we know what you encountered during that period, for us to advise you accordingly....

tzetzefly: 1. Apply with your family as your circumstance has improved from the last time you visited the embassy. More travel experience a couple of times via family vacation to the UK.

Book a hotel accomodation for the whole family. However if your family friend can accomodate your family comfortably in his residence, ask him for invitation letter and a copy of his utility bills and tenancy agreement.

Take note that if you use the invitation letter from your friend in the US, your purpose for going to the States now changes to ''visiting and not tourism''.

2. You can get an interview appointment date for July if you submit your form within June. It is summer season hence the rush for visa.

seriously i was amazed @ the TRV refusal from canada, their reasons dont even add up to me they quote; i have not satisfied them that i would leave canada based on:
1. my travel history ( bearing in mind we all have 5yrs multiple visas to the u.k and just recently came back from easter trip)
2. Purpose of visit( which was meant to visit a family friend for their first childs birthday).
3.they r not satisfied that i answered truthfully all questions put to me.
well it just showed to me probably my application was not even looked at or verified after wasting close to 28 working days.

As for the usa visa refusal b/w 2005 - 2008 my document where never even asked for or sighted, i got invitations from family friends too. 2005-virgin passport/ not married but from 2007-2008 disvirgined pport/married with one child with uk visas and applied alone.i hope i have put u clearly in the picture. Now my questions are:
1.can i apply for the usa visa with my family going via hotel booking or invitation?
2.since i was refused the TRV from canada can i still apply for the usa bearing in mind my travel dates for august ending, will i be able to get an interview appointment date for july thru august b4 i travel since i will state in the ds-160 form my travel dates and what will be the implication if i dont get an appointment datebw that period.

hello tzetze fly thanks for everything, i have been following this forum for quite some time now and i need advice on getting a u.s visit visa. i intend travelling with my wife and 2 kids say august ending 3 of us have a 5yrs uk visa and my 2nd child has a 2yrs u.k visa we r truly frequent travelers to the u.k and just recently came bck from a trip. i have a phobia for the u.s embassy as i have always bin refused visa for like 4 times from 2005 to 2008. i just got refused a Canadian TRV and i have summoned courage to re apply for a visit visa again to the u.s since 2008. i work in a reputable oil & gas firm and my pay is good, money truly is not a problem. before now i have used invitations from friends now i want to make an hotel booking in 2 tourist areas california and new york. i just need ur candid advice on what my chances would be after 5yrs of application and what to do since i dont want to leave any stone unturned

GOogle mpnp go to their site and follow instructions as regards application if u have a sponsor and ur job happens to me relevant with the province then u stand a chance of being selected. And yes u must write the ielts exam before u submit ur online application

Bussyme: @solomonwis,infact I did IELTS at lagos 3yrs ago (2010). Filled the forms and paid require fees by my cousin in canada with master card,sent everything to them. My forms was rejected base on work experiences and I has to repackages again and collected letter from my working place yet they rejected it. Its not easy to get 67 points unless you have arrange employment in canada and have relative there. Though my money was refunded without deducted a kobo from it.
