Politics › Court Okays Request To Begin Suit Seeking Okorocha’s Trial by LosC(op): 4:49pm On Mar 10, 2020 |
The Federal High Court in Abuja has granted permission to two civil society groups to commence a suit seeking to compel the Economic and Financial Crimes Commission to prosecute a former governor of Imo State, Rochas Okorocha, on corruption charges.
Justice Ahmed Mohammed, on March 3, 2020, granted the leave to the groups, but a copy of the enrolled order of the court was only seen by our correspondent on Monday.
The plaintiffs are Kingdom Human Rights Foundation International and the Rights for All International.
They sued EFCC, Rochas, Zigreat International Company Limited, Eze Enwereku, and Duru Onyeobi, as the first to the fifth respondents, respectively.
The plaintiffs had in their ex parte application filed on February 10, 2020, accused EFCC of refusing to investigate or prosecute Okorocha along with the third to the fifth defendants for various corruption allegations contained in a petition submitted to the agency as far back as August 22, 2019.
Okorocha stepped down as Imo State governor on May 29, 2019 and was later sworn in as the senator representing Imo West Senatorial District.
The groups accused him and the other defendants of “money laundering, inflated contract, unlawful award and execution of contract without due process and breach of the Procurement Act, criminal over-inflation of contract sum and non-execution and completion of contracts fully paid for with public fund.”
Ruling on the ex parte application moved by the plaintiffs’ lawyer, Mr Kingdom Okere, Justice Mohammed granted it and ordered that the respondents should be served with the substantive suit to enable them to respond to it.
The judge in his ruling said, “Leave is hereby granted the applicants to apply for judicial review of the administrative/inaction of the first defendant (EFCC) in terms of the reliefs set out in the statement in support of the application.
“The order of leave shall be served on all the respondents along with the substantive application to be filed after the grant of this leave.
“Hearing notices to be issued on all the defendants. “This suit is adjourned till March 17, 2020.” https://punchng.com/court-okays-request-to-begin-suit-seeking-okorochas-trial/

[s] unbitchable: if i catch this babe eh. 2yrs ago, i was chyking a fulani babe, she is a conservative type but struggling to come out of her shell. At first she was pulling back, didn't want an outsider into her territory. she would later set me up with her close friend who also is fulani. She was upset that i gave her friend attention. i felt she was being childish. she called me a fúckboy and backed out. naturally, i think fulani girls are hardly comfortable with outsiders let alone a relationship. But i enjoyed the fact that she told me a lot about fulani tradition. she told me stuff that is strange. [/s] All these because of girl.. Tueehh |

Politics › Buhari: We’ve Recovered N3.7 Billion, Various Assets From NDDC by LosC(op): 4:14pm On Mar 10, 2020 |
President Muhammadu Buhari says law enforcement agencies have recovered over N3.7billion as well as various assets worth billions of Naira from contractors and former directors of the Niger Delta Development Commission (NDDC).
The President disclosed this at the inauguration of NDDC Advisory Committee, comprising 9 Governors of the Niger Delta Region and the Ministers of Niger Delta Affairs and Environment.
Specifically, President Buhari said: ‘‘To date, the EFCC and other agencies of Government have recovered over N3.7billion in cash as well as various assets worth billions of Naira from some contractors and former Directors of the Commission.
‘‘Furthermore, I am told that Government agencies have placed liens on over N6 billion of assets which are being investigated.’’
The President told the committee that these abuses of the past clearly show the need for strict and diligent oversight, going forward.
He, therefore, charged the newly inaugurated committee to discharge the new assignment diligently and effectively, working closely with the relevant ministries, adding that he looked forward to seeing positive changes in the affairs of the Commission as well as on the ground in the Niger Delta region.
President Buhari recalled that in 2016, his administration launched the “New Vision for the Niger Delta (NEVIND)”, aimed at bringing sustainable peace, security, infrastructure and human capital development to the region.
He said the medium to achieve this noble objective was through the Ministry of Niger Delta Affairs, NDDC and the Presidential Amnesty Programme (PAP).
The President, however, expressed regret that in the past these institutions were unable to deliver their mandates due to mismanagement.
‘‘As a result, the people of the Niger Delta were left with abandoned infrastructural projects and substandard social programmes which were designed to improve their living conditions.
‘‘It is to reverse this trend that I approved, in February 2020, the constitution of a 10-Man Presidential Monitoring Committee (PMC) as provided for in Section 21 of the NDDC Establishment Act.’’
He noted that the PMC, which will be chaired by the Minister of Niger Delta Affairs and its members drawn from various MDAs, will focus on monitoring the operations and activities of the commission, and will be reporting to him.
In the same vein, the President said the inauguration of the NDDC Advisory Committee is in line with the provisions of Section 11 (I) of the NDDC Establishment Act, explaining that the Committee is charged with the responsibility of advising the Board and monitoring its activities.
Justifying the decision to inaugurate the Committee ahead of the reconstitution of the NDDC Board, President Buhari said:
‘‘This is to enable us develop insights into the affairs of the Commission which will properly guide the Board when reconstituted once the Forensic Audit exercise on the Commission is concluded.
‘‘You may recall that the Federal Executive Council, on the 5th of February, 2020 approved the appointment of the Lead Forensic Auditors. I am told they are concluding their pre-engagement activities and should be ready to commence work soon’’.
Speaking on behalf of the members of the Advisory Committee, Governor Ifeanyi Okowa of Delta State thanked the President for inaugurating the Committee and granting the request of the governors, from the region for a forensic audit of the NDDC.
The Governor expressed hope that the result from the forensic audit would help streamline activities of the NDDC with a view to putting it on course to deliver on its mandate to the people.
Underscoring the roles of the Advisory Committee, the Delta State Governor noted that for sustainable development of the region, the NDDC must perform its duties in close collaboration with the States to avoid duplication of projects.
‘‘We do not want to criticise what has happened in the NDDC for quite some time, but the fact is that the cooperation between the states and the NDDC has not been strengthened overtime and we have various cases of duplication of projects that are not properly planned.
‘‘But I believe that with the inauguration of this body we will be able to sit down, meet together, work in collaboration and supportively to bring greater development to our people,’’ he said. https://dailypost.ng/2020/03/10/weve-recovered-n3-7-billion-various-assets-from-nddc-president-buhari/

Politics › Senate Proposes Amendment To Immunity For Vice-Presidents, Governors And Others by LosC(op): 10:05am On Mar 09, 2020 |
The Senate has introduced a bill that will make the vice - president , governors and their deputies lose their immunity if they misappropriate public funds. The President of Nigeria , vice - president, governors and their deputies are currently protected by the nation ’ s laws from criminal prosecution while in office .
However , the proposed legislation from the Senate seeks to change this , but excludes the President from the proposed legislation .
The bill is meant to alter the necessary sections of the constitution to make it possible for law enforcement agencies to arrest and prosecute the vice - president , governors or their deputies found guilty of funds’ misappropriation.
The bill is titled , ‘ An Act to alter the provisions of the Constitution of the Federal Republic of Nigeria , 1999 , to qualify criminal liability for certain public officers under Section 308 . ’
It is sponsored by the Chairman of the Senate Committee on the review of the 1999 Constitution, who is also the Deputy President of the Senate , Ovie Omo - Agege. The proposed amendment seeks to alter Section 308 of the Principal Act by substituting subsection 2 with a new subsection .
It added that any beneficiary of the immunity clause currently in the constitution would lose it if indicted by the court after a thorough investigation by the police and the anti - graft agencies .
It reads in part , “ To persons who hold the office of Vice - President , Governor or Deputy Governor .
“ If it is determined either by the Economic and Financial Crimes Commission, Independent Corrupt Practices Commission, Nigeria Police and Department of State Services through a collaborative investigation that the said person is indicted by a court of competent jurisdiction for:
“( i ) Financial misappropriation of funds belonging to the Federal , State or Local Government ; or “( ii ) Sponsoring of thugs to perpetrate violence that cause injury or death of political opponent, a member of his family , agent or personal representative. ” https://punchng.com/senate-proposes-amendment-to-immunity-for-vice-president-govs/

Politics › Court Restrains Gov. El-rufai From Demolishing 2 Communities In Kaduna by LosC(op): 2:38pm On Mar 08, 2020 |
The plan of Governor Nasir El-Rufai-led administration to demolish over 2,000 houses in Nisi and Tasu communities in Chikun local government area of Kaduna State has been put on hold by a Kaduna State High Court presided over by Justice Binta Zubairu.
Justice Binta Zubairu restrained Governor Nasir El-Rufai or any government agency from demolishing the houses.
The two communities with over 2,000 houses and a population of about 10,000, Churches and schools, had received a demolition notice from the Kaduna State Urban Planning and Development Authority, KASUPDA, on 7th February, 2020.
The Director Central of KASUPDA, Ismail Umaru Dikko, who signed the demolition notice and pasted on all affected properties said, “It has come to the notice of the authority that you have encroached into an industrial layout and illegally developed a piece of land without obtaining necessary approval.
“The action of yours is a contravention of the above mentioned law. In view of the above, you are hereby given 21 days to remove the structure and vacate the site. Failure to comply with the above, the authority will be left with no option than to demolish the structure at your expense in accordance with section 60 (2) of the Kaduna state urban planning law of 2018.”
Following this development, the communities approached the Court through their team of lawyers, led by Sam Atung Esq and sought among other things restraining order stopping the demolition of the two communities by the state government.
Granting their prayers, Justice Binta Zubairu said, “An order of interim injunction is hereby granted restraining the defedant/respondent jointly and severely whether acting by themselves, officials, workmen etc and or whosoever or whosoever from demolishing, pulling down or interfering in whatever manner with the plaintiff/applicants possession and interest in their houses lying and situated at Nisi and Tasu villages in Chikun local government area of Kaduna state pending and determination of motion on notice.”
While briefing newsmen shortly after the case was adjourned till 30th March, Barrister Atung said some houses have their building approvals by relevant government authorities in the state, pointing out that one of the house in Nisi village is also covered with Certificate of Occupancy.
Barrister Atung explained, “The experts order which was granted last week 28th February, 2020 ought to have elapsed today but has been extended to the next adjourned date of 30th March, 2020.” https://dailypost.ng/2020/03/08/court-restrains-gov-el-rufai-from-demolishing-2-communities-in-kaduna/Lalasticlala Mynd44

The Federal government has reacted to the power supply shortage being experienced in Nigeria.
The Transmission Company of Nigeria (TCN) on Saturday, said it was caused by low gas supply.
Mrs Ndidi Mbah, TCN General Manager, Public Affairs, explained that the gas shortage had restrained the ability of many thermal power stations to generate optimally.
The plants affected by gas supply constraint included Sapele National Integrated Power Plant (NIPP), Olorunsogo NIPP, Ihovbor NIPP and Azura Edo.
“Other thermal power plants equally affected but generated at lower capacities include Egbin (Steam) Sapele (Steam) Delta (gas) Geregu (gas) and Omotosho(gas).
“Also affected are Olorusogo (gas) Geregu NIPP, Alaoji NIPP, Omotosho NIPP, Odukpani NIPP, Okpai (Gas/Steam) and Omoku (gas) power generating plants,” she said.
Mbah disclosed that TCN has discussed with the management of some of the affected power plants.
The plants, however, blamed their challenges to gas pipeline and processing maintenance being carried out by their gas suppliers.
”According to the management of some of the affected power plants, the maintenance of gas facilities is expected to last for 10 days,” she said.
TCN added that the gas supply challenges will ease before the end of next week. https://dailypost.ng/2020/03/08/nigeria-govt-explains-electricity-shortage-nationwide/
