ALL Progressives Congress, APC, Edo State chapter, has gone to the Supreme Court to challenge the judgment of the Court of Appeal, which upheld the ruling of the Governorship Election Petition Tribunal allowing the recount of used ballot papers in four of the 18 local government areas of the state.


Respondents in the appeal are the Peoples Democratic Party, PDP, Pastor Osagie Ize- Iyamu, Independent National Electoral Commission, INEC and Mr Godwin Obaseki.


The party, in its appeal, said that the lower court erred in law when it held that, “The 1st and 2nd respondents pleaded, inter alia, that before or at the trial” of their petition, they would apply for the used ballot papers to be, “produced in court,” “recounted in open court. “By the averments in their petition, the 1st and 2nd respondents had duly laid out procedure they intended to employ to produce the used ballot papers and the proposed recount.

In accordance with their pleadings, the 1st and 2nd respondents obtained a subpoena duces tecum and the used ballot papers were produced in court their subpoenaed witness – PW85A. “In this case, having obtained a subpoena duces tecum, an order directing the witness, PW85A to appear in the tribunal and bring or produce the used ballot papers, it would have been in the realm of procedural absurdity for the 1st and 2nd respondents to file a motion on notice for an order for a recount of the same used ballot papers produced on the order of the tribunal.

“In our view, the oral application for a recount of the used ballot papers was properly made by the 1st and 2nd respondents, having regard to the pleadings and circumstances of the case.” The APC further stated that the appellate court erred in law and acted without jurisdiction when it held that because the used ballot papers were produced by an order of the tribunal, they need not to be tendered and marked as Exhibits before their recount and thereby, reached a wrong conclusion in law which had occasioned a grave miscarriage of justice.

The party therefore, wants an order of the Supreme Court to allow the appeal and set aside the judgment of the appellate court and dismiss the oral application of the petitioners in its entirely for being incompetent. No date has been fixed by the apex court for the hearing of the appeal.

Confused Presidency

The embattled governor of Edo State, Mr. Godwin Obaseki, filed an appeal at the Supreme Court against the decision of the Court of Appeal in the case at the Edo State Governorship Election Petition Tribunal.

Obaseki, APC and INEC lost their application at the Court of Appeal where they sought to invalidate the recounting of ballot papers ordered by the Justice Badamosi led Edo State Governorship Election Petition Tribunal at the Court of Appeal.

The Court of Appeal sitting in Benin City ruled that the tribunal was in order to have ordered the recounting and that the recounted ballots will go in issue in determining the case before the tribunal.

However the tribunal, in delivering judgement, curiously ignored the result of the ballot recount and ruled that the election result as declared by INEC is valid notwithstanding, in so far as the total number of voters did not exceed the total number of registered voters, even if it exceeded the total number of accredited voters.
