The Code of Conduct Tribunal sitting over the false assets declaration case of Nigeria’s Senate President Bukola Saraki has ruled that trial must continue regardless of a pending appeal against the continuation of the case at the Supreme Court. The decision of the CCT forced Saraki’s lead lawyers to stage a walkout in protest against the tribunal’s ruling. Lawyers to Mr. Saraki had applied to the court for another adjournment of the case citing an appeal filed yesterday at the Supreme court of Nigeria. After a short adjournment the lead judge at the tribunal Justice Danladi Yakubu Umar ruled that the case would continue and urge Saraki’s lawyers to prepare for the continuation of the proceedings. However, the ruling angered Saraki’s lawyers, Abubakar Magaji and Raji Ahmed who stormed out of the courtroom accusing the judge of judicial rascality The CCT has adjourned till November 19, 2015, and urged Saraki to engage services of new lawyers or otherwise expect the tribunal to engage state counsels on his behalf. The Code of Conduct Tribunal (CCT) is set to deliver a ruling on whether it will continue with the trial of Senate President Bukola Saraki, following his appeal at the supreme court. Mahmud Magaji, counsel to Saraki, had prayed for a stay of proceedings of the tribunal owing to an appeal at the supreme court on the matter. He said that a motion of stay of proceedings had also been filed against the CCT at the supreme court. Magaji stated that the appeal at the apex court followed a split judgment of the appeal court, which dismissed Saraki’s application to stop his trial at the CCT for lack of merit on October 30. “We urge your lordship to adjourn this matter pending the hearing and determination of our case at the supreme court,” he said. However, Rotimi Jacobs, the prosecuting counsel, argued that the appeal court judgment upholding the jurisdiction of the tribunal to try Saraki was subsisting and binding on all parties in the case. He urged the tribunal to go on with the trial of Saraki, stating that the prayer of Magaji for an adjournment of the case was unconstitutional. Senate President Bukola Saraki has arrived at the Code of Conduct Tribunal (CCT) where is trial for alleged false declaration of assets continues. He arrived in company of numerous senators at 9:45am. TheCable counted at least 35 of them, who were seated in six long seats on the left side of the courtroom.
When Saraki was at the tribunal on October 21, he came with 81 senators.
Some of the senators were Ike Ekweremadu, deputy senate president (PDP); Sam Anyanwu (PDP), Andy Uba (PDP), Adamu Aleiro (APC), Shehu Sani (APC), Dino Melaye (APC), Tayo Alasoadura (APC), Kabiru Gaya (APC) and Uche Ekwunife (PDP).
Saraki was in court for the first time on September 22, after an order for his arrest by the CCT. He pleaded not guilty to 13-count charges of false declaration of assets, and said he was on trial because of his emergence as senate president against the wish of certain people.
Although, he came to the tribunal voluntarily, he had sought to stop his trial at the high court, but failed.
On October 30, the appeal court also dismissed Saraki’s application to stop his trial at the CCT for lack of merit. Consequently, he appealed to the supreme court to set aside the judgment of the appeal court.
The case is yet to come up for hearing at the apex court. This is his third appearance at the CCT. On his second appearance on October 21, the tribunal adjourned his trial on the grounds that there was a pending judgment at the court of appeal.

SaharaReporters has obtained a copy of a text message sent out to Nigerian Senators urging them to accompany embattled Senate President Bukola Saraki to his corruption trial at the Code of Conduct Tribunal in Abuja tomorrow (November 5 2015).
Mr. Saraki and the leadership of the Senate have consistently shut down the Senate to enable senators to storm the venue of the CCT tribunal in a show of solidarity. In previous outings, more than 60 senators had showed up with Mr. Saraki at his hearings. Some civil rights activists have accused Mr. Saraki of using Nigerian taxpayers’ time and funds to attend to his personal corruption trial. Yesterday, Mr. Saraki adjourned the sitting of the Senate until November 10, shortly after releasing the list of newly constituted committees of the Senate. Okorocha, who made this known yesterday while fielding questions from newsmen in Owerri, the Imo state capital, declared that he has been vindicated by the eventual victory of President Muhammadu Buhari in the March 28 election.
According to him, “I appeal to Ndigbo to avoid unnecessary bickering and antagonism with the North, West and other parts of the country, so as to brighten the prospects of a president of Igbo extraction in future.”
While noting that Rivers and Akwa Ibom states are very strategic to the All Progressives Congress, APC, and that the electorate in the two states voted overwhelmingly for the APC in the last election, he alleged that, “their votes were stolen by the Peoples Democratic Party, PDP, through various forms of electoral malpractices.”
Although he refused to disclose the strategies his APC political platform intends to use in sacking PDP in Rivers and Akwa Ibom States, the APC bigwig however noted that plans were on to actualize the target.
On why his administration was yet to appoint commissioners and special advisers, the Governor said it has enabled him to save money for the state, for capital projects, explaining that, “If I appoint them now, they will start demanding for impress, traveling allowance, hazard allowance and this is outside their monthly pay. This has enabled me save some money for the state, for capital projects.”
