So whats the constitutional or judicial argument for Faleke not to take the mantle of the APC and continue in the election

According to Atiku/Boni Haruna ruling in 1999. Atiku won the election but he handed the mandate to Boni because it was ruled that the Party PDP was the owner of the mandate.

Also from the Amaechi/Omehia ruling from 2007. Amaechi won the PDP ticket but was illegally substituted . At the general election Amaechis name was never on the ballot and it can be argued that voters voted for Omehia but the court ruled and handed Amaechi the mandate even though he never was on the Ballot for Rivers people

As long as its through a legal means either by elections or through the court. if Faleke wins then fine. Faleke can win and if he doesnt play the right politics be constitutionally impeached

In a country like Nigeria where we are multi ethnic and diverse, rotation of some sort is the only way even a Yoruba man Ibo or non hausa can aspire to be president.

Just like in Lagos an Epe man might never be able to rule without zoning, going by the Popularity contest elections are known to be
We've had some charge & bail lawyers running riot all over the media since yesterday...

A good majority of them insists this costitutional crisis is not synonymous to Boni Haruna & Amaechi scenario because there was no result. so there is nothing to build upon, that the inconclusive nature of the exercise before /after( jury still out on that) Audu's demise invalidates the process so a fresh election should be called...

From what i gleaned, the 49k votes in question is even an anomaly cos the total nos of PVCs collected is 25k which means declaring the result inconclusive in the first place is even a misnomer...

One conspiracy theorists opined that the REC got wind that Audu had bitten the dust & was "influenced" to declare it so in order to invalidate the process...

I believe doctrine of necessity should be invoked here & James Faleke should assume the post & the Igala can then send him packing in '19...

Yeah he is yoruba. Ifa-leke.

The tribe is relevant because Igbiras see Kogi State as their home state and they have the population to perpetrate themselves in power, except by divine intervention. You can't fault them.

The Sarakis hold on Kwara State is a story for another day.
It is not the Ebiras, it is the Igalas, you meant to say...

Okun & Ebira are in the minority in the state...

Ilekehd,

Tribe is the NO1 factor in ANYTHING in this contraption, The Igalas will rather hell rain down than willingly give their votes to one that doesn't belong to them....

Politics is a game of Nos, any political party will think of the individual who has the clout to command the nos & clean up the person's image

PDP folks are just hoping against hope..

If the death announcement had come before the announcement of a partial result, they would have had a reason to be hopeful..

A supplementary election is all that is in the offing, anyone believing what the lawyers sympathetic to PDP are positing is just living in delusion..

APC hs two choices, allow Faleke to go on & become the governor or choose from one of the guber primary contestants...

The Lawyer is a confusionist

modath:
The electoral act did not make allowance for no of PVCs COLLECTED , It's NO of REGISTERED VOTERS , This present electoral act didn't make a case for PVCS, PVC is a new concept in the electoral law.

The reason INEC did that is to ensure no charge & bail constitutional lawyer will be able to take advantage of that proviso to file a case against the victory...

It is a waiting game, as long as the process is allowed to continue, APC is taking it...
Politics › Re: What The Electoral Acts Says About The Death Of A Candidate by modath(f): 5:27am On Nov 23, 2015
kahal29:
That is it:

"The results so far declared shows that APC was leading by 41,000 votes. INEC has said the supplementary election, which is not necessary, should take place in 91 polling units. The number of registered voters in those units is 49,000. Out of this, 25,000 have PVCs. If all of them vote for PDP, which is unlikely, the result won’t be enough to stop APC’s victory. Therefore, INEC should not have declared the election inconclusive in the first place”.

tuniski:
perhaps, the case of GEJ playing out in Kogi. However, the supplementary votes might just be protest votes to return Wada rather than validate Faleke. Whichever way, we have a real scenario on our hand.
But do you see PDP getting a minimum of 42k votes to equal the difference in votes let alone outclassing the APC? The chances of that is between zilch & none...

We have a real dicey situation though, no one ever saw this in a million years...

Its easy to label Yoruba mumu in agitation for a firm response to Ibo. You probably did not know this but in as much that Ibos solicit constitutional right as backing for its excesses in Lagos, OPC equally assert its stand on the various statutes of law which demands that law and order in society must be maintained at all cost, with emphasis on AT ALL COST!
One thing i'd never understand is the fact that their excesses are strictly "domiciled" in the SW, they are as docile & respectful as can be with the northerners..

This is an entirely different case, anyways we'll get to know more 2moro.Gud nyt.
It's a major constitutional crises i tell you...

The electoral law made provisions for both before & after the process but never envisaged while the process is ONGOING..

INEC & APC need to approach the SC with quickness in order to resolve this lacuna...

I don't see the Igalas allowing Faleke to slide in without any hassles, they'd prefer to continue with their Wada than have a non Igala govern that state..

The cancelled votes are mostly from their strongholds so we'll be watching how it will pan out..
Politics › Re: What The Electoral Acts Says About The Death Of A Candidate by modath(f): 9:53pm On Nov 22, 2015
Providence has ensured that a non Igala would govern Kogi cos going by the majority Igala stand that neither of the Ebira/Okun will be at the helms of affairs & would prefer a laggard Igala to a performing non Igala....

This can only come from powers beyond human comprehension.. cool
Politics › Re: Pathetic Last Hours Of APC Guber Aspirant, Abubakar Audu by modath(f): 9:20pm On Nov 22, 2015
FlirtyKaren:
That APC gubernatorial candidate, Abubakar Audu who was earlier on today leading in the yet to be concluded Kogi election, that he is dead is no longer news.
What’s yet to be told is how the controversial former governor died of stroke this afternoon, Sunday, November, 22nd, 2015 after hearing the bad news that the election is inconclusive.
According to the National Enquirer, family sources told them Prince Abubakar Audu's health predicament began yesterday when he was said to have complained of stomach cramps before going to bed.
“He complained of stomach cramps last night, Saturday, November, 21st, 2015 and we all thought it’s something normal owing to the stress of the forthcoming election, but he went to bed and nothing happened”, the source told National Enquirer.
We gathered reliably that trouble started however when Prince Audu woke up this morning looking very pale and jittery, he subsequently suffered stroke this morning around 9am but was slightly okay and was able to manage his health to the polling booth where he got accredited and later voted.
The source told National Enquirer that, the politician who was said to be 72 years old had been so anxious about the outcome of the election so much so that, he kept compelling his aides to get feedbacks from all LGs and by all possible means.
Later in the afternoon, after the Independent National Electoral Commission (INEC) declared the election inconclusive, Audu suffered another stroke and when people around him sensed that, it was getting out of hand, they decided to rush him to Abuja for necessary medical attention in a bid to save his life “by fire by force” and it was on their way to Abuja that he died of cardiac arrest.
It would be recalled that, the politician had faced tough and stringent criticism over his candidacy as the APC guber aspirant for the Kogi 2015 election with so many groups kicking against his candidature and even integrity due to the account of his last stewardship.
The 72 year old is survived by wives and children. May his soul rest in perfect peace.

Audu still better than wada. audu 1999-2003 (ANPP) Wada 2012-2016 (PDP)?

Audu was in a set of uninspiring group of governors and first set of governors after military left in 1999, but still has legacy projects in the kogi state. Wada, ? your guess is good as mine, with massive increase in fg allocation to the state, being in pdp with the centre, he failed woefully.

i believe APC GOOFED with wada and silva as gubernatorial candidates of kogi & bayelsa though , as they are candidates of no integrity in my opinion, but politics is a game of numbers and it is very local, maybe no one has the clout to arrest the attention of the local populace better from the incumbents than those two
