For information purpose, let me assist you so that you would save your ignorance before the public Bayelsa and Zamfara in 2019 are all pre election matters and not tribunal. While that of Bayelsa borders on issues of Lyon's deputy in disparities of names which was challanged, Zamfara issues borders on failure of APC to conduct valid primaries with inec as joinder since inec didn't monitor the exercise. And the case was treated as pre election matter accordingly following all Court strata(high court to Supreme Court) But APC in Plateau are instituting a pre election matter in a post election tribunal which the supreme Court lacks the jurisdiction to entertain. Post election matters also known as election tribunal is solely from date election was conducted and matters arising from the exercise only. For instance, over voting and other guidelines which might not be followed on election date to declaration of results that's all Hope your enlightened!! |
Tareq1105:You're wrong, a lot of you don't know the background of those case and how the court operates Rivers case was Instituted by an APC member in a pre election matters which include Congresses down to primary and the issues where followed by all the strata of the courts ; meaning, High court down to supreme ( that's is what we called Pre election matters) Plateau APC brought pre-election matter in a post election court also known as election tribunal. Which by the supreme Court precedence and and electoral act 2022 as amended, you can't bring pre election matter in post election case. This implies that APC can't bring issues of Primaries and Congress of another party to court now, because the election tribunal is restricted to matters arising only from the day election was conducted. Anything out side that, the supreme Court has no jurisdiction. That's why Justice Okoro stroke out PDP case in Benue for bringing pre-election matters. That same George is the one in charge of Plateau case. That same precedent was the reason Atiku's vs Shetima was stroke out for lacking jurisdiction in a suite challenging Shetima's nomination which are pre election matters |
