Industrial Court orders reinstatement of sacked Ekiti varsity workers From Kehinde Adewole An Industrial Court sitting in AKure, Ondo State capital on Tuesday has ordered the resinstatement of 32 staff of the Ekiti State University (EKSU) who were illegally sacked by the Management on December 5, 2019. Justice K.D Damulak, the presiding Jugde also ordered that the University management pay each of the claimants a sum of N500,000 each as compensation. While delivering his judgement he said: “ I have read the proceedings and the legal submissions of both counsels. I am of the opinion that the issue for determination is whether the claimants have proven their entitlement to the reliefs claimed. " In determining this issue, it shall be necessary to determine 1. Whether the employments of the claimants enjoy statutory protection and 2. Whether the disengagement of the claimants was compatible with their status of employments. 1. Whether the employments of the claimants enjoy statutory protection. The essence of a trial on record pursuant to order 38 Rule 33 of the Rules of this court is that the issue or issues for determination of the court are all legal questions. The question, whether the employments of the claimants enjoy statutory protection, means that it is important to determine the status of the employments of the claimants from the statute establishing the University, the University regulation and the claimants’ letters of employments. An employment is said to enjoy statutory flavor when the tenure, discipline and other conditions are as provided in the statute establishing the employee or institution. An employment with statutory flavor was defined by the court of Appeal in the case of N.E.P.A. v. EDEGBERO (2000) 14 NWLR (Pt.688)615; (2000) LPELR-6884(CA) relying on the decision of the Supreme Court decision in IMOLOAME V. WA.E.C. (1992) 11/12 SCNJ 121 at 135; (1992) 9 NWLR (Pt. 265) 303 thus; " What in effect is an employment with statutory flavour. The Supreme Court had in the case of Imoloame v. WA.E.C. (1992) 11/12 SCNJ 121 at 135; (1992) 9 NWLR (Pt. 265) 303 defined it as: "Where the contract of service is governed by the provisions of a statute or where the Conditions of Service are contained in regulations derived from statutory provisions they invest the employee with a legal status higher than the ordinary one of Master and Servant. They accordingly enjoy statutory flavour".: " The claimants’ counsel rightly gave a take off point as the case of K.S.J.S.C V TOLANI (2020) ALL FWLR (PART 1025)P.480 at 503 where the Supreme Court Held thus; The following two elements must exist before a contract of employment can be said to have statutory flavor; a. The employer must be a body set up by the constitution or sta b. The statute or regulations made pursuant to the constitution Statute or law must make provisions regulating the employm of the category of the employee concerned especially i discipline. " A statute is a law made by the national or state legislature. The defendant is a creation of law, University of Ado-Ekiti law of 2008, amended in 2011 and 2014. To this extent, the first requirement is met. The second requirement is whether the said law or the regulations made pursuant to that law protects the employment of the category of the claimants so that they cannot be terminated by notice or salary in lieu of notice for services not required. 28. I have read the 24 sections of the University of AdoEkiti law of 2014. I find in section 5(a)(iii), the power of the University to institute academic, administrative, technical, professional and other posts and offices and to make appointments thereto. Section 11(a)(c) empowers the University to make statutes which means Rules and Regulations. " It is also worthy to note that the claimants are staff of a state owned University. They are accordingly in the public service of the state according to section 318 of the Constitution of the Federal Republic of Nigeria 1999 as amended being staff of an Educational institution established and financed by the Government of Ekiti State. " In DANIEL M. OGBAJE V. ABUJA INVESTMENT AND PROPERTY DEVELOPMENT COMPANY LIMITED (2007) LPELR-11855(CA) the court held that; The appellant's employment, including the procedure for terminating his appointment is regulated by the terms and conditions of Exhibit "F", the respondent's Staff Conditions of Service. Consequently, the justice of this case demands that the termination of the appellant's' employment must be in accordance with those terms and conditions contained in Exhibit "F" in consonance with the rules of natural justice. What is more, where as in this case, an employee by virtue of Exhibit "A" is qualified by his appointment to a permanent and pensionable position, the employee is not in a servant and master relationship with the employer. The employment cannot be determined at the will of parties but in accordance with the terms and obligations of the conditions of the employment.," He submitted. https://livetimesng.com/industrial-court-orders-reinstatement-of-sacked-ekiti-varsity-workers/

Sex for passport saga in Nigerian embassy in Germany: Mr. Martins' family source and accusers bicker (PHOTOS) After a media report by LiveTimesNG where a group petitions President Buhari and fingered Nigerian Ambassador in Berlin over sex for passport saga, our reporters received a call from an insider, Mr. Obiora Nweke, who gave us a deep understanding on the corruption pervading the Embassy of Nigeria in Berlin and countered the petition sent to President Buhari. In the petition, the group who are Nigerians but domiciled in Germany under the aegis of "For the Sake of Nigeria’s image “, FSNI, said it has written and dispatched a petition to President Muhammad alleging the Nigeria Ambassador in Berlin of gross complicity, aiding and abetting touts and deliberately frustrating diligence at the Embassy. In the letter, which was signed by Victor Christian Chukuwuma, Segun Adebisi Arijaje and Mohammed Sani Bagudu, the group alleged that the Nigeria Ambassador in Berlin, Yusuf Maitama Tuggar is not able to put a stop to the activities of known visa and passport touts, all Nigerians and which is denting the image of Nigeria in Germany. The statement reads: “We as citizens of Nigeria domiciled in Germany wish to intimate the President and good people of Nigeria of the can of worms at the Embassy of Nigeria under H.E. Ambassador Yusuf Tuggar, which led to the sex for passport saga which has cast a blur in the image of Nigeria in the comity of nation. "From our findings, the passport syndicate at the embassy was organized by the Station Head of Immigration, Mr. Imoh Ebong Asuquo upon arriving in Berlin in 2017. Some members of his syndicate include Chuks Biaduo (aka Don), Okechukwu Nwukeforo (aka Bob Okey), Obiwanne, Chidinmma Ohakwe Nwandikom (ex-staff, whose contract was not renewed due to various corruption charges), Obinna Simeon Nzodinma (identified as the commentator in the video), Lucky (aka Blessed Passport). These people seize on the scarcity of appointments for applicants caused by the Covid 19 shutdown, to charge desperate Nigerians exorbitantly to fast-track the applications. "We understood that Mr. Martins is a locally recruited staff, heading the security section. These were charged with ensuring that a new appointment system introduced in March 2020 would give no preferences to influences. A lady applicant, whom Mr. Martins met on her visit to the Embassy for passport renewal and a change to her data, Ms. Faith Uche, had a valid appointment and this qualified her access to the Embassy. We understood from sources close to the Embassy that both agreed to meet after she finished her business, which they did. "The said Ms. Uche came to Berlin, signed for and collected her passport and waited several hours to meet with the Mr. Martins inside the hotel that the video was made. We spoke with Ms. Uche on phone, but she refused to comment on the critical but necessary questions that could cement the claim of “sex for passport” by Mr. Martins. Moreover, we learned from the same sources that both accusers, Mr. Obinna Simeon Uzodinma and Ms. Uche did not honor the invitation by the panel setup by the Ambassador to investigate the accusations levied against Mr. Martins in the video", the statement reads. However, while speaking to our reporter, Obiora said the report with headline: "Group petitions President Buhari, fingers Nigerian Ambassador in Berlin over sex for passport saga", was not true saying it was an attempt to cover the sins of Mr. Martins who was accused of sex for passport allegation in the viral video. Obiora who was described in the report as one of the touts used in the embassy, said he has videos and other details to further nail the accused security man in the embassy while he claimed Mr. Martins has earlier had canal knowledge of the woman they caught with him in the hotel. He added that Mr. Martins wanted to have another intercourse with the woman with his friend named, Muyiwa when they burst him. He added that Mr. Martins wouldn't have opened the door for them but he thought it was Muyiwa was at the door who they both wanted to molest the lady but he was surprised when he saw them. However, when our reporter demanded for the videos and other details that he claimed to further use to indict Mr. Martins, Obiora made a U-turn, saying he is taking the evidence to CNN for proper reportage. Meanwhile, LiveTimesNG has earlier gotten in touch with a source who claimed to be family member of Mr. Martins but didn't disclose his name. The family source said Mr. Martins who was the staff of Nigerian embassy in Germany was set up by those men in the video. The man while talking to our reporter on phone said a lot of corruptible acts have been going on in the embassy and Mr. Martins had been the torn in the flesh of the perpetrators of corruption in the embassy, saying it was the reason he was set up, an organized plan to remove the barricade against corrupt group of touts, who are all Nigerians and feeding fat off fellow Nigerian passport applicants. The source maintained that the woman who was caught with Mr. Martins in the hotel room was not even a married woman as reported saying that she needed no favor from him because she has already qualified and has been cleared to collect her passport. He added that on the day the incident happened, she was already with her passport adding that it was the lady that proposed to Mr. Martins unknowing that the lady was used to set him up. He recounted how Mr. Martins started working in the embassy in 2004 before he was seconded to the renaissance desk in 2006 and visa desk in 2007. He said Mr. Martins was deployed to these departments because corruption was endemic there. He said Mr. Martins was further deployed to the passport desk where he became pioneer staff of ECOWAS passport. In 2011, he said he was deployed to the account department where he became a revenue collector. He said in 2017, the new ambassador, Yusuf Maitama Tuggar was appointed and moved him from office/facility manager to head the security department because of his good records. He claimed that Mr. Martins was charged with full responsibility for the appointment system and had never betrayed this responsibility to date. His current predicament was corruption fighting back because with his actions at the security, he helped stop massive passport racketeering with over €40,000 of illicit earnings each month. The source claimed that the video was corruption striking back as it was organized to intimidate and create an instrument of blackmail. The intention was to use the video as leverage so that this same group could send their clients without valid appointments to the embassy. Our source further said that the video was made in August but as Mr. Martins had refused to subject to various threats and denied clients sent to the Embassy without merit, they made good on their threat, the source said further. https://livetimesng.com/sex-for-passport-saga-in-nigerian-embassy-in-germany-mr-martins-family-source-and-accusers-bicker-photos/

Full story of how S.L Akintola’s feud with Awolowo led to his death in 1966 (PHOTOS) From Taiwo Oluwadare, Ibadan Chief Samuel Ladoke Akintola who was a former Premier in the old Western Nigeria between 1959 and 1962 is no doubt a legend considering his landmark achievements during the era of Western Nigeria before his demise. It will be 56 years in January 2021 that the legend was assassinated precisely January 15, 1966. SLA, as he was fondly called, a Nigerian politician, lawyer, aristocrat and orator, was born in Ogbomosho, in the present Oyo state. He is one of the founding fathers of modern Nigeria who was later elevated to the position of Oloye Aare Ona Kakanfo XIII in the Yorubaland. Akintola began his political career after he was trained as a lawyer in the United Kingdom, and returned to Nigeria in 1949 to team up with other educated Nigerians from the Western Region to form the Action Group (AG) under the leadership of Chief Obafemi Awolowo. As the deputy leader of the AG party, he did not serve in the regional Western Government headed by the premier Awolowo but was the Action Group Parliamentary Leader/Leader of Opposition in the House of Representatives of Nigeria. At the federal level he served as Minister for Health and later Minister for Communications and Aviation. It was gathered that differing interests for strategic alliances in Action Group party led to a political crises between Akintola and his friend, Chief Awolowo. The battle for supremacy in the party led to disagreement between them as Akintola disagreed with Awolowo’s decision not to join the coalition government. Akintola felt the Yoruba people of the West were losing their pre-eminent position in business, university and administration in Nigeria to the Igbo people of the East simply because the Igbo-controlled NCNC had joined the government and the AG had not. He also opposed the party’s decision to adopt democratic socialism as its ideology, preferring a more conservative stance. According to Wikipedia’s accounts, Chief Awolowo accused Akintola of trying to supplant him as leader of the party. In May 1962 with the Western House of Assembly set to remove Akintola after the party had earlier passed a vote of no confidence in the premier in a party meeting, crisis erupted on the floor of the house. The AG party broke into two factions leading to several crises in the Western Region House of Assembly that led the central/federal government, headed by the Prime Minister Sir Abubakar Tafawa Balewa, to declare State of Emergency rule in the Western region. Chief (Dr.) M.A Majekodunmi, the Federal Minister of Health was then appointed as Administrator . Eventually Akintola was restored to power (even though he had lost the legal battle with the Judicial Committee of the Privy Council then Nigeria’s highest tribunal) as Premier in 1963. In the general election of 1965, Akintola won his position as Premier, not as member of the Action Group party, but as the leader of a newly formed Nigerian National Democratic Party (NNDP), which was in an alliance with the Northern People’s Congress (NPC) the party that then controlled the federal government. In a Punch newspaper publication of November 30, 2013, Chief Femi Fani-Kayode, quoted Dr. Omololu Olunloyo, (a great nationalist, a two-time former Commissioner of Education of the old Western Region, a former Governor of Oyo state, one of few remaining elder statesman and a major player in the First and Second Republics) as saying: “Chief S.L. Akintola was the supreme leader. Chief Obafemi Awolowo left (the Premiership of the Western Region) of his own volition without advice to contest the federal election. In the federal election he contested but he had no alliances. “Stubborn, aggressive, very hardworking, visionary leader that Awolowo was, he never understood real politics at any time. In real politics you have to look at the figures, you have to have allies- there are no permanent friends or permanent enemies. You must have some allies. Nigeria is too fragmented for you not to have allies. If you are counting in the presence of someone with nine fingers, you don’t count in the person’s presence and say ‘so you have nine fingers’. We had a brilliant man called S.L. Akintola who understood real politics. “Awolowo believed that book knowledge was so important but he (Akintola) knew better. A situation arose- Awolowo wanted to ally with the east and Akintola wanted to align with the north. So there was a crisis. “These are interesting historical perspectives and insights from a man that was appointed as a Commissioner (or Regional Minister) for a region that comprised of no less than what are 7 states of the Federation today (Oyo, Osun, Ekiti, Ondo, Ogun, Edo and Delta) at the tender age of 27”. Akintola’s first son, Chief (Amb.) Abayomi Akintola while speaking about the feud between both families in the The Sun newspaper edition of December 20, 2015, said his father had nothing against the Awolowo family as it is widely believed. His words: “I will say Akintola had nothing against the Awolowos. And anybody that have that impression should look back into history. Akintola was leader of Youth movement, and the movement was the one gave birth to politics in Nigeria. And when people were calling Akintola to lead the party, he conceded it to Awolowo, to show his loyalty to him”. •Late Segun Awolowo, Awolowo’s son The one-time finance minister and Nigeria’s Ambassador to Hungary also stressed how cordial the relationship between Akintola and Awolowo’s family are. According to him, the families are so close that the son of late Obafemi Awolowo, Segun, who is also late, was his best friend adding that it was unfortunate that Segun died at the age of 22, though survived by a son also named Segun. •Segun Awolowo, Awolowo’s grandson Recounting how he missed his dear friend, Olusegun Awolowo after his death, Chief Abayomi said “I went to England for a course, when I came back, I was informed that Olusegun Awolowo had died. For you to know how close Olusegun and I were, Segun, may his soul rest in peace, and I did spend our holidays together. Also, his immediate younger sister (Mrs. Tola Oyediran), was also very friendly, and did come to Dublin to also study, met her husband, Prof. Oyeniran in my house”. •Late Awolowo and son, Segun “It was after his death that I was hospitalized for about nine months that doctors could not ascertain what was wrong with me but today we thank God. My illness started from the shock I got from Awolowo’s son demise. I was 22, 23 years then. We were like siamese twins that we went around together”, Chief Abayomi recounted. The late sage’s demise Akintola was assassinated in Ibadan, the capital of Western Region, on the day of Nigeria’s first military coup of 15 January 1966 which terminated the First Republic. This was the “Young Majors Coup” or the “coup of the January boys”, which resulted in the assassination of many leading politicians, mostly members of the Northern People’s Congress. The son of the deceased gave a vivid account of how the late Icon was assassinated in Premier Hotel lounge in Ibadan, Oyo state. He said: “I was at the premier lounge with my father but in different sections, one for the children and other for the premier and his wife. Suddenly, I heard a phone call rang and it was Mrs. Fani-Kayode around 2 and 3pm. She started shouting on phone saying “some strange people have kidnapped my husband, where is baba (Chief Akintola)”. “I went straight to my father’s room who came to pick the call and assured her that nothing would happen to her husband and she should keep calm”. “After speaking with her on phone, he called security people. As he dashed out to call security people, shooting ensued. This time, I was at my section and suddenly, a wardrobe blocked me, my younger sibling, wife and my son from going outside the room”. He continued “The shooting ensued for about 2 hours. Later when Baba Akintola went out, the shooting subside but by the time we went out, we had saw him in the pull of his own blood being killed on the floor. We had no option than for my wife to cover him with her clothe”. “I was not a toddler and not that old when all these happened. I was there with my father when he was killed and its so unfortunate that I didn’t know how to live my life afterward but God kept me and my other siblings to survive the negative experience. I am grateful that I am also able to guide my siblings to become what we are today”, he added. Meanwhile, an account on how Captain Emmanuel Nwobosi murdered the Premier in 1966 gave a clearer picture of what transpired on the day Akintola was murdered. •Captain Emmanuel Nwobosi The report reads; “Akintola, come down; you are for lawful arrest by the army on orders from HQ 2 Brigade,” Nwobosi shouted. “Under arrest ke?” Akintola said to himself, “Oya, come and greet your mother’s husband,” as he cocked his gun. When Nwobosi hit the door in an attempt to force it open, the Premier opened fire from inside his bedroom with a submachine gun, shooting contiguously and continuously through the closed door. “Return fire,” Captain Nwobosi ordered his men, which they did, enormously. “Please sir, surrender sir. Stop shooting, please. They only came to take us to Lagos,” Fani-Kayode pleaded and shouted from the landrover urging the Premier to cease firing and surrender. But the Premier kept on firing until he ran out of ammunition. Chief Samuel Ladoke Akintola was the 13th Aare Ona Kakanfo (Field Marshal General) of Yorubaland. A title, whose holder, according to a widely believed myth, was not expected to live long nor experience a calm death. “Krrr, krrr,” the gun sounded. The Premier had run out of ammunition but the captain and his soldiers did not know this, they thought he was reloading and waiting for them. Akintola, now powerless, held out a white handkerchief in a sign of surrender and proceeded to the verandah. Ajao and Uloh who had been hiding in one of the other rooms grabbed him by his arms and dragged him downstairs. “Bring him out, bring him out,” Nwobosi shouted repeatedly after the firing had ceased and he sighted his soldiers with the Premier downstairs. “Now, now, boys. Be gentle. We are friends here,” Akintola said resignedly. “You shot at us. You resisted arrest. It was a direct order from the HQ,” Nwobosi thundered, “we are to eliminate anyone who resisted arrest.” “Boys, it is for the good of the country. Why don’t we negotiate? I will see to it that you treated well. I have the Prime Minister’s ears,” Akintola cajoled. “We are soldiers, sir. We obey direct orders. Egbikor, Chukwu,” Nwobosi called his soldiers and signalled to the two men to open fire on the Premier. Fani-Kayode stared in horror as the Premier endured a deluge of bullets as he fell to his knees still gasping for breath. Nwobosi then joined them in firing at the Premier as he fell backward with a thud as life hurriedly escaped from him. The Captain and his men then released the policemen and proceeded with Fani-Kayode in the landrover to Lagos as the 3-Ton truck headed towards Abeokuta. They all left Akintola’s mutilated body, riddled with bullets, surrounded by empty shell casings soaked in blood, lying there on the bare ground in his courtyard. The Aare Ona Kakanfo had fallen to his death. The curse persists”, HistoryVille recounted. S.L Akintola was described as dignified orator and was responsible for completing the founding of University of Ife (Awolowo’s brainchild and currently Obafemi Awolowo University) in 1962 while still a premier in Western Region. He was also involved in development of Premier Hotel and other monuments. Akintola was married to Chief (Mrs) Faderera Akintola and had five children, two of whom (Chief Yomi Akintola and Chief (Dr.) Bimbo Akintola), later became finance ministers in Nigeria’s Third Republic Chief Yomi Akintola also served as Nigeria’s Ambassador to Hungary and Samuel Akinola’s daughter-in-law, Mrs. Dupe Akintola was Nigeria’s High Commissioner in Jamaica. His fourth child, Chief Victor Ladipo Akintola, dedicated much of his life to ensuring the continued accurate accounting of Samuel Akintola’s contributions to Nigeria’s position on the world stage. He published many works including a biography that highlighted his father’s love for his country and lifelong commitment to its progression. The book is titled: Akintola: The Man and the Legend. His youngest child, Tokunbo Akintola was the first black boy at Eton college and features prominently in the bestselling book by Dilibe Onyeama, Niggar at Eton. A number of institutions, including Ladoke Akintola University of Technology, Ogbomosho, were established in both the Oloye’s home town and other Nigerian cities as a means of honouring him posthumously. https://livetimesng.com/full-story-of-how-s-l-akintolas-feud-with-awolowo-led-to-his-death-in-1966/

Group petitions President Buhari, fingers Nigerian Ambassador in Berlin over sex for passport saga .......alleges Ambassador Tuggar of complicity, aiding and abetting touts All have not being heard over the sex for passport saga in the Nigerian Embassy in Berlin as a group of Nigerians domiciled in Germany under the aegis of „For the Sake of Nigeria’s image “, FSNI, has written and dispatched a petition to President Muhammad alleging the Nigeria Ambassador in Berlin of gross complicity, aiding and abetting touts and deliberately frustrating diligence at the Embassy. This is coming from the background of massive corruption allegations levied against the same embassy some years ago. In the letter, which was signed by Victor Christian Chukuwuma, Segun Adebisi Arijaje and Mohammed Sani Bagudu, the group alleged that the Nigeria Ambassador in Berlin, Yusuf Maitama Tuggar of is not able to put a stop to the activities of known visa and passport touts, all Nigerians and which is denting the image of Nigeria in Germany. “We as citizens of Nigeria domiciled in Germany wish to intimate the President and good people of Nigeria of the can of worms at the Embassy of Nigeria under H.E. The said Ms. Martins in the video. Your Excellency, while we applaud Ambassador Tuggar’s setting up of a panel to investigate the serious allegation of “sex for passport” by the accusers in the video, we call on the panel to find answers to the following questions: 1. Did the security officer offer “passport for sex” or not? 2. If not, did the affair between both parties have anything to do with Mr. Martins work at the Embassy in anyway? 3. Did Mr. Martins rape Ms. Uche? 4. Was the Ambassador aware of several previous complaints against the syndicate led by Mr. Imoh Ebong Asuquo, the Diplomat heading the Immigration Department? 5. Was it a coincidence that the video was made by exactly the same syndicate members working for Mr. Imoh? 6. Why was Mr. Imoh’s name mentioned on many occasions in the video by Mr. Obinna Simeon Uzodinma? 7. Is it true that the said Mr. Martins sent away his later accuser, Mr. Obinna Simeon Uzodinma away from the Embassy earlier on the same day that the video was made? Furthermore, Ambassador Tuggar’s efforts to clarify the following questions, relevant to our national security and collective reputation as a nation, may help to determine the chances of his campaign to becoming the next Governor of Bauchi State in 2023: 1. Did he know that Mr. Obinna Simeon Uzodinma (Agbaego Nkiti Nke Iziz) and Mr. Okechukwu Nwokeforo (aka Bob Okey) are both IPOB activists, who claim Biafra? 2. Did he know that Mr. Obinna Simeon Uzodinma was quizzed for money laundering and fraud by the German Police in 2016 and that he is being tolerated in Germany because of missing identity documents? 3. On credibility as a leader, is the Ambassador preempting the report of the panel that he setup himself by publicly promising Mr. Obinna Simeon Uzodinma that he would sack Mr. Martins? (Mr. Obinna Simeon Uzodinma made this claim on a popular social media that the Ambassador had assured him to sack Mr. Martins). 4. Why Is the Ambassador deliberately protecting corrupt diplomats and practices under his watch? 5. Could the Ambassador have overseen the fact that the accusers were the same members of the passport syndicate operating at his Embassy in the last 3 years? Dear President, we need to take steps to redeem the negative trend this video has brought to our dear country abroad. Only through transparence could we correct this image. We therefor call on the President Muhammad Buhari, through the Agencies at his Executive disposal, to set up a powerful investigation panel to look into the organized corruption by diplomats at our Embassy in Berlin and take necessary steps to ease the process of passport issuance to the millions of Nigerians living in diaspora. https://livetimesng.com/group-petitions-president-buhari-fingers-nigerian-ambassador-in-berlin-over-sex-for-passport-saga/
